2 1.0 Healthcare insurance Working hours with a healthcare treatment guarantee 1.1 The Insurance conditions apply from 1 January Healthcare insurance is a group insurance created in Mølholm Forsikring A/S. The Danish Insurance Contracts Act shall be legally applicable. The insurance shall be subject to any future amendments to the Danish Insurance Contracts Act. 1.2 The company entering into the contract with Mølholm Forsikring A/S is considered to be the policyholder. 1.3 The person whose health is insured is considered to be the insured party. 2.0 Who is covered by the Healthcare Insurance? Employees of a company registered (CBR no.) in Denmark, registered in the Faeroe Islands, registered in Greenland, which has entered into a contract with Mølholm Forsikring A/S, or taken out a healthcare insurance policy through a collective agreement. The insured party is obliged to notify Mølholm Forsikring A/S of any change of address. 3.0 Where does the Healthcare Insurance apply? The Healthcare Insurance covers healthcare centres selected by Mølholm Forsikring A/S (the Mølholm Forsiking A/S network) in Denmark, Norway and the EU. The healthcare centre shall meet Danish healthcare treatment standards and must therefore be approved by Mølholm Forsikring A/S. Approval shall be given before initiating healthcare treatment. 3.1 Some private hospitals may be exempt due to e.g. increased operating frequency. Re-operation at these hospitals is not covered. 4.0 The healthcare treatment guarantee Mølholm Forsikring A/S cooperates with selected private hospitals, which consistently provide highquality treatment and very high-quality service. The healthcare centres are monitored on a monthly basis by means of anonymous questionnaire surveys. These surveys are conducted by Enalyzer. The company prepares an annual report on each healthcare centre for scrutiny at the annual meeting 4.1 The insured party is guaranteed examination, treatment (including pre-operative investigation) or surgical procedure within 10 working days of Mølholm Forsikring A/S approval of coverage of the insured party's disorder/disease/diagnosis. The healthcare treatment guarantee applies to Mølholm Forsikring A/S own network of healthcare centres. 4.2 Pre-operative investigation that does not lead to further healthcare treatment is covered under the healthcare insurance If the insured party's own doctor does not suspect a disease in his/her referral, it cannot be approved for investigation/treatment. 4.3 MRI scanning is covered by the healthcare insurance, regardless of whether such scanning leads to further treatment beyond simply diagnosing the insured party s symptoms. 4.4 Ultrasonic scanning is covered by the healthcare insurance, regardless of whether such scanning leads to further treatment beyond simply diagnosing the insured party s symptoms. 3 4.5 Pre-operative investigation, treatment and surgical procedures shall only be performed by specialist doctors The healthcare insurance does not cover examination and treatment by a general practitioner or specialist in general medicine (another title for general practitioner). 5.0 When does the healthcare insurance coverage apply? 5.1 Symptoms/disorders/diseases or consequences following an accident which is work-related are covered by the healthcare insurance. These must be diagnosed by a general practitioner or specialist doctor, and approved by Mølholm Forsikring A/S Claims must always be accompanied by a doctor s referral, which describes the work-related problem. 5.2 The healthcare insurance commences on the date stated in the group insurance agreement. 5.3 In case of termination of contract of employment (termination means dismissal eligible for disability pension and pension), the healthcare insurance coverage for the work-related disorder/disease/accident shall continue for a period of up to 6 months after the healthcare insurance is terminated, if the disease, disorder or diagnosis is reported during the insurance policy period Where a claim has been lodged and the healthcare insurance is transferred to a healthcare scheme with another company, coverage will continue for a period of three months The healthcare insurance covers in the event of termination (single resignation from the company agreement) of the healthcare insurance for up to 3 months after the healthcare insurance has been terminated, if the disease, disorder or diagnosis is reported during the insurance policy period and it is work-related Where insurance has been transferred from another insurance company to Mølholm Forsikring A/S, and the claim has been lodged in the previous insurance company, the present healthcare insurance cover will not cover work-related claims until after a period of three months. 5.4 There is no qualifying period for employees (see ) However, current treatment and planned treatment are not covered Future voluntary company/association schemes with less than 200 employees have a 6-month qualifying period. Effective date is 1 January 2015 and thereafter. 5.5 If, at the time of employment, the insured party has comparable coverage with another insurance company, the seniority on that insurance will be transferred to Mølholm Forsikring A/S. This transfer of seniority must be notified to Mølholm Forsikring A/S as soon as possible, but no later than the lodging of a claim for treatment of work-related disorders/diseases and must be approved by Mølholm Forsikring A/S. The transfer of seniority also includes coverage for previously identified disorders (work-related) (see Clause 5.4.1). Seniority can be notified as an employment date or as inclusion in a previous healthcare insurance and can be notified by either the broker or the company. A copy of the previous healthcare insurance contract will facilitate the administration of the transfer of seniority At the conclusion of the new healthcare insurance contract (company contract) with Mølholm Forsikring A/S, all employees are transferred. 5.6 Payment on work-related disease/accidental injury claims are contingent upon Mølholm Forsikring A/S having approved healthcare treatment before it is initiated. 5.7 Where the insured party chooses to receive treatment for a work-related injury/disorder/disease at a private hospital other than one in the Mølholm Forsikring A/S network, the healthcare centre concerned may be refused if it is not certified by Mølholm Forsikring A/S or if it fails to live up to Mølholm Forsikring A/S healthcare standards. The healthcare centre concerned shall meet Danish healthcare standards and shall therefore be approved by Mølholm Forsikring A/S If, notwithstanding the above, the insured party wishes to choose another healthcare centre and thus not to act on the referral provided by Mølholm Forsikring A/S (because the healthcare centre does not belong to the Mølholm Forsikring A/S network), Mølholm Forsikring A/S shall be entitled to refuse to cover costs or alternatively to cover a sum corresponding maximally to the sum the treatment would have cost at a healthcare centre in the Mølholm Forsikring A/S network If the insured party wishes to choose another healthcare centre for a work-related injury/disorder/disease outside Denmark (i.e. in Norway or the EU) and thus not to act on the referral provided by Mølholm Forsikring A/S (because the healthcare centre does not belong to the Mølholm Forsikring A/S network), Mølholm Forsikring A/S shall be entitled to refuse to cover costs or alternatively, to cover a sum corresponding maximally to the sum (plus 25%) that the treatment would have cost at a healthcare centre in the Mølholm Forsikring A/S network. Travel costs outside Denmark are not covered. Mølholm Forsikring 1 January
4 5.8 The treatment of work-related injury illness/disorder/ disease must always be performed by specialist doctors. 5.9 Height and weight shall be stated on the claims form In case of overweight (BMI over 30), weight loss will be required before a work-related operation can be approved. A dietician will be made available in these cases. Remember any referral from a general practitioner. Mølholm Forsikring shall for its part be entitled to demand that the insured party returns to his/her normal weight before surgery can be approved (BMI: 25) The total coverage of work-related injuries/disorders/ diseases per insured party in any one insurance year (calendar year) shall not exceed the maximum sum stated in the group agreement, 2015: DKK 1,800,000 per insured party per year. 6.0 What does the Healthcare Insurance Working Hours cover? 6.1 The healthcare insurance covers the insured party s costs in connection with the treatment prescribed by a specialist doctor for work-related injury/disorder/disease. Costs shall be approved in advance by Mølholm Forsikring A/S before treatment commences. 6.2 The terms work-related diseases/disorders or the consequences of a work accident are used to describe a significantly impaired condition of health, which, according to generally accepted medical practice, can be cured by some form of treatment (medical, surgical, etc.). The treatment shall, according to generally accepted medical practice, be appropriate to undergo in order to cure the illness or injury concerned. The illness or injury being cured significantly as a result of treatment means that the insured party s condition of health, according to generally accepted medical practice, will be significantly improved by his/her having undergone the treatment relative to not having under gone it 6.3 Consultation The healthcare insurance covers the insured party s costs incurred in connection with consultation, regardless of whether consultation leads to a diagnosis and subsequent treatment. 6.4 Pre-operative investigation The healthcare insurance covers the insured party s costs incurred in connection with the investigations necessary for making a diagnosis, e.g. MRI scanning, ultrasonic scanning, radiological examination and laboratory tests, regardless of whether these lead to treatment or not. 6.5 Hospital admission and meals The healthcare insurance covers the insured party s costs in connection with meals and care during his/her admission at a private hospital 6.6 Surgical and medical treatment The healthcare insurance covers the insured party s costs in connection with surgical or medical treatment, either as an out-patient or during admission at a private hospital for work-related disorders. Following surgical treatment given at a private hospital, the insured party s costs for hip and knee prostheses and aids (e.g. crutches) necessary to the treatment, if these disorders/diseases are work-related. 6.7 Allergies Allergy tests (prick test) are covered if the allergy is attributable to a work-related injury/disorder/disease. It must be prescribed by a specialist. 6.8 Other treatments Any other necessary treatment/therapy in addition to medical or surgical therapies administered during hospital admission, are also covered by the healthcare insurance. 6.9 Medicine prescribed by a specialist The healthcare insurance covers the insured party s share of the cost of medicines prescribed by a specialist doctor for up to 2 years in connection with workrelated injury/disease/disorder. The medicine must be available by prescription only. The medications must be prescribed by the specialist doctor treating the insured party and must be relevant for the work-related disorder/disease on the claim and be an integral part of the specialist treatment paid for by the healthcare insurance. Non-prescription medications and medications that are available both on prescription and over the counter, are not covered. Mølholm Forsikring 1 January
5 6.9.1 However, medications costs are covered only until such time as Mølholm Forsikring A/S considers that the treatment is complete Medicine that the insured party is prescribed before the claim, and which is not connected to the reported disorder, is not covered Medicine prescribed by the insured party's general practitioner or specialist in general medicine (another title for a general practitioner) is not covered Re-examination The healthcare insurance covers reasonable outpatient re-examinations after the end of treatment, including MRI scanning, ultrasonic scanning, radiological examination and laboratory tests. The healthcare insurance covers any further out-patient re-examinations necessitated by the treatment carried out. Annual check-ups which are of a research nature or are requested by the trade association are not covered Re-examination after surgery Necessary re-examination after surgery can be covered for up to 24 months (but see Clause 6.10) Second opinion The term second opinion describes the following: The insured party has a difficult decision to make in relation to a work-related injury/disorder/disease, which means that further examination by a specialist doctor is relevant The diagnosis or future treatment may be subject to a degree of uncertainty In such cases the insured party is entitled to seek a second opinion. If Mølholm Forsikring A/S agrees with the insured party, a second specialist examination will be covered Third opinion If two specialist doctors differ widely in their opinion as to what treatment the insured party should be offered in connection with a work-related injury/disorder/ disease, the insured party can ask for a third opinion. If Mølholm Forsikring A/S agrees with the insured party, a second specialist examination will be covered The insured party cannot claim second or third opinion of his general practitioner. 7.0 Physical therapy and chiropractics 7.1 Rehabilitation: If the insured party has received treatment (operation) for a work-related injury/disorder/disease as an out-patient or as an in-patient at a private hospital, the healthcare insurance covers the insured party s costs in connection with the required rehabilitation. 6 habilitation must be approved by Mølholm Forsikring A/S. Rehabilitation shall be approved initially for a 3-month period, after which time the insured party is required to claim by telephone for a further 3 months of coverage. If after 6 months the insured party needs further rehabilitation, a new claim must be sent including an assessment from either a specialist doctor or a general practitioner. This is to establish if rehabilitation is progressing as planned or if the insured party needs to consult a specialist doctor again The insured party s costs in connection with necessary rehabilitation by a physiotherapist or chiropractor are covered until the treatment is complete by agreement with Mølholm Forsikring A/S. Rehabilitation must be prescribed by a specialist doctor Rehabilitation for work-related injuries/disorders/diseases can be awarded for a maximum period of 24 months from the date of surgery Mølholm Forsikring is entitled to receive the insured party s subsidy from the healthcare insurance association Sygeforsikring Danmark 7.2 Ergotherapy: Up to 10 sessions of treatment are covered, although maximally for a period of 7 months, after surgery for work-related disorders/diseases/injuries The price for ergotherapy treatment: Maximum cost per treatment DKK 395. Any excess amount must be paid by the insured party If a physiotherapist uses ultrasound in the treatment, this is not covered Ultrasound treatment/examination must always be performed by specialist doctors. 7.3 Home nursing and home care: Home nursing and home care are covered by the healthcare insurance if prescribed by the operating specialist doctor and it is part of the treatment of a work-related injury/disorder. Home care can be prescribed for cleaning, laundry, food shopping and cooking. The specialist doctor determines the number of hours per week in each area. 8.0 Transport (stretcher) If the insured party s condition necessitates transportation by ambulance, this is covered by the healthcare insurance. Transportation costs must be approved by Mølholm Forsikring A/S. Stretcher transportation in connection with a work-related injury/disorder/disease must be prescribed by a specialist doctor. The injury must be work-related or an occupational accident. 9.0 What is not covered by the Healthcare Insurance Working hours? (The following are not considered to be work-related) 9.1 The insured party s private expenses including accommodation (self and companion). The insured party s expenses in connection with treatment of illness when travelling and staying abroad is not covered by the healthcare insurance. 9.2 General and preventive health checks. 9.3 Treatment of HIV (human immunodeficiency virus) infection and illnesses induced from this, i.e. treatment of any condition that is due to or can be attributed to the HIV-positive or a similar condition. 9.4 Chronic dialysis treatment. 9.5 Organ transplantation 9.6 Fertility treatment. 9.7 Induced abortion. 9.8 Surgery to correct short-sightedness/long-sightedness and astigmatism Cataract surgery is not covered Binocular vision problems are not covered by the healthcare insurance Investigation and treatment of squinting is not covered by the healthcare insurance. 9.9 Ordinary sight tests as part of the correction of shortsightedness/long-sightedness and astigmatism. Sight tests in connection with diagnosis of another chronic illness are also not covered Cosmetic treatments and operations Dental treatment, except as a direct consequence of an occupational accident. Dental prostheses (false teeth) are not covered If the insured party has crowns or teeth that were treated in connection with a previous accident, treatment of these teeth will not be covered. Damage to teeth due to chewing on something hard is not covered. Dental bridges are not covered Prostheses of any kind are not covered The treatment must be completed within 6 months from the date of the work-related accident Claims made more than 6 months after the date of the accident will not be covered. 7 Only teeth directly affected by the work-related accident will be covered Other dental treatment such as bone reconstruction is not covered Later problems associated with the dental surgery are not covered If the insured party s dental status is generally poor, coverage will be reduced. E.g. if periodontal disease is present, coverage will be reduced Dentist or an oral surgeon who is a dentist: There is no cover for operations/procedures performed by dental/oral surgeon who is a qualified dentist If the price of treatment exceeds what Mølholm Forsikring A/S provides in its treatment network, the excess may have to be paid by the insured party. The insured party can also choose to switch to the network and receive a refund of the entire cost There can be no treatment on +/-5-/+ and +/-6-/+ and +/-7-/+ and +/-8-/+. Wisdom teeth are not treated Alternative forms of treatment These are forms of treatment that are not approved by the Danish National Board of Health and where treatment is performed by practitioners who do not have the Danish National Board of Health authorisation 10. Furthermore, the healthcare insurance Working Hours does not cover: 10.1 Diseases/disorders/injuries that have occurred in connection with an accident that was deliberately provoked by the insured party or due to gross negligence on his/her part. This applies regardless of the mental state of the insured party at the time of the accident Diseases/disorders/injuries that have occurred as a result of indulging in professional sport, when the sport is the insured party s primary source of income Radio frequency catheter ablation (RFA) is not covered. Cardiac conversion is not covered The healthcare insurance does not subsidise hearing aids or other aids to impaired hearing. The healthcare insurance does not cover hearing aid adjustment or difficulties associated with this The healthcare insurance does not cover shoulder and hip resurfacing In case of overweight (BMI over 30), weight loss will be required before an operation can be approved. The services of a dietician will be made available in these cases. Remember any referral from a general practitioner Anisomelia (unequal leg length) is not treated Growth factor and orthokine treatment is not covered Botox treatment is not covered Metvix treatment is not covered Orthopaedic shoes or inserts and soles are not covered. 8 10.12 Cartilage transplants are not covered Bone scintigraphy is not covered Chronic skin diseases: Skin diseases considered chronic by a specialist dermatologist, are not treated Other chronic diseases: If the insured party has been diagnosed with a chronic disease, further treatment is not covered Acute work-related diseases (definition): Diseases that require immediate treatment are not covered Mølholm Forsikring A/S does not cover acute disorders The Danish private hospitals treat diseases/disorders where the treatment can be planned The treatment of life-threatening/severe cancers (including e.g. gastrointestinal cancer, and cancers of the liver, pancreas and lungs, and cancer of the central nervous system etc.) and life-threatening/severe heart disease are considered acute illnesses, which by definition are included in the so-called treatment packages in the public health sector Where it is considered a serious illness or the risk of surgery is elevated, Mølholm Forsikring A/S can choose that the public hospital sector shall be used In any given situation, Mølholm Forsikring A/S will provide counselling and advice in the ongoing process, including providing coverage in situations where there is unnecessary waiting time or where Mølholm Forsikring A/S assesses that the intended effect of the treatment package scheme cannot be achieved Shockwave and similar treatment is not covered by the healthcare insurance Certificates are not included VAT is not refundable. VAT on treatment is not covered The healthcare insurance agreement 11.1 The healthcare insurance agreement is entered into on the basis of the written information provided by the company in a signed agreement 12.0 When does the healthcare insurance Working Hours come into force? 12.1 Immediately after the company has signed the agreement, unless otherwise agreed in the group insurance agreement. It is assumed that the group insurance agreement is signed when it is returned to Mølholm Forsikring A/S If an application to join the healthcare insurance is made via the application form, the healthcare insurance commencement date will be the first day of the next month after Mølholm Forsikring A/S receives the application Payment of the premium etc The first premium payment is due on the commencement date of the healthcare insurance and is for one year, unless a different payment period has been agreed. Monthly, quarterly or half-yearly payment of the premium can be agreed for a fee (applies only to corporate agreements) Payment of premiums can be made using a giro payment slip or otherwise by agreement.. If it is chosen to pay by giro payment slip, a giro payment slip will be sent when the premium is due for payment. The giro payment slip (demand) is sent to the policy holder s address. 9 13.3 The demand for payment of the initial premium will be sent no earlier than 8 days before the due date. Subsequent premium payment demands will be sent no earlier than 2 weeks before the due date. The policy holder is liable to pay costs incurred in connection with payment of the premium and any administration charges Premiums are reduced proportionally in case of termination of contract of employment. The reductions are offset in future premium demands Companies with 100 or more employees have their own risk accounts If there is a general premium increase (including one due to the Statistics Denmark labour costs index for the private sector) of more than 10%, the insured party is entitled to disregard the notice of termination of the agreement. The insured party is entitled to choose an alternative supplier within a period of 14 days. Any desire to choose an alternative supplier must be notified in writing. If such a desire is not notified within 14 days, the terms of the insurance are considered as continuing If the increase in the insurance premium is by less than 10% (including price-index adjustment) the healthcare insurance may be terminated, subject to three months' advance notice to a renewal date Non-payment, reminder procedure 14.1 Reminder letter 1: Due date + 14 days The reminder letter will state that coverage will be cancelled if premium is not paid on receipt of the reminder letter If coverage is cancelled, claims received and claims approved will be processed in accordance with applicable regulations Mølholm Forsikring A/S is entitled to levy an administration charge when sending a reminder letter Regulations for premium regulation and insurance services 15.1 The healthcare insurance premium rates can be regulated in accordance with Statistics Denmark s average earnings index for the private sector The healthcare insurance premium may be regulated every year on 1 January (or on the renewal date of the healthcare insurance) to the premium level applicable to the insured party s average age or own risk accounts The premium on the group insurance contract is regulated every year on 1 January (or on the renewal date of the healthcare insurance). The premium payable per insured party is also regulated every year on 1 January or on the renewal date of the healthcare insurance The composition of the group in terms of age and profession forms the basis for calculation of the premium in Clause There will be no return of premium related to bankruptcies, termination of the insurance contract with Mølholm Forsikring or termination of the business Changes to the premium and insurance conditions 16.1 Mølholm Forsikring A/S is entitled to increase the premium (i.e. not indexation in accordance with the Statistics Denmark average earnings index for the private sector) and to amend the insurance conditions Mølholm Forsikring A/S may amend the insurance conditions and prices (not indexation) with one month s advanced notice in writing to the renewal date If insurance conditions become more stringent or if prices are increased, the policy holder is entitled to terminate the healthcare insurance with 14 days notice in writing after receiving notification from Mølholm Forsikring A/S Assignment 17.1 As the healthcare insurance is a group insurance, it cannot be assigned, pledged as collateral or otherwise employed as an object of revenue, nor will the healthcare insurance have achieved any value on termination Discontinuation of the healthcare insurance The healthcare insurance discontinues at the end of the month, in which: 18.1 The insured party s contract of employment is termi nated The insured party ceases to reside in Denmark, the Faeroe Islands, Iceland or Greenland. Expatriate employees are exempt from his rule The insured party moves into an old people s home or is permanently admitted for treatment at a care institution, psychiatric hospital or other institution. 10 18.4 The insured party no longer meets the conditions for membership The insured party reaches 70, unless other agreement is reached. Exempt from this provision are employees in a company which has entered into an insurance agreement with Mølholm Forsikring A/S. Where an employee remains in employment after his/her 70th birthday, healthcare insurance coverage will continue until the employee leaves the company 18.6 The group agreement is discontinued due to one of the parties having given notice of termination Special conditions: 19.1 The insurance scheme may continue as a private insurance policy under the Mølholm Healthcare Treatment Insurance, Mølholm Junior or Senior Mølholm scheme Where the company omits to notify of new employees, these will be covered under the healthcare insurance from the date they are included in the group insurance agreement When a collective or corporate scheme presents unsatisfactory risk accounts, the member or the employee may not transfer to another group scheme with a lower premium. This provision has been introduced to protect other collective and corporate schemes against speculation and thus subsequently premium increases When he/she changes job, the employee/member may at any time join the healthcare insurance scheme for that particular company When belonging to a healthcare insurance scheme, the employee/member is not permitted to transfer to a partner/cohabitant scheme if this represents an extra burden on the affected corporate risk accounts A transfer (if any) must always be approved in advance by Mølholm Forsikring A/S An approved transfer can only be made from the renewal date Termination provisions 20.1 The corporate agreement can be terminated with 3 months notice to the renewal date Taxation the Act on Taxation of Income and Property and is therefore not taxable for the employee. The healthcare insurance only covers work-related injuries/disorders/ diseases In accordance with current tax regulations, any payment or payment made is tax-free Applicable law 22.1 The general provisions in Danish law applicable to insurance agreements and Danish law generally apply to the extent that the law itself is not waived by the provisions of the insurance agreement. Future amendments to the applicable legislation shall be applied Claims 23.1 Claims must be made within the period of insurance. In connection with discontinuation of the insurance, claims for work-related injuries/disorders/diseases that have occurred and are lodged in the period of insurance will be covered for a period of up to 6 months after discontinuation of the healthcare insurance, is the insured party is dismissed, awarded a disability pension, a reduced-hours job or light duties Claims must be made to or notified by telephone to tel To qualify for coverage, treatment of the work-related injury must be approved in writing by Mølholm Forsikring A/S before it is initiated Notification of a work-related injury to a specialist doctor is valid for 4 months After four months, a new claims form must be completed and a new case number created When deciding on surgery on the work-related injury/ disorder/disease within the 4 months, and it is most appropriate for the employee for reasons of work, holidays or similar, to postpone the date for the surgery, a new new claims form will not be required Administration 24.1 For questions, claims forms and other enquiries, please refer to Mølholm Forsikring A/S Finlandgade 1, 5100 Odense C, Denmark Tel Fax The healthcare insurance is covered by Article 4 of Mølholm Forsikring 1 January
11 24.2 The healthcare insurance is taken out by Mølholm Forsikring A/S, private limited insurance company (Danish Central Business Register (CVR) no ), Finlandgade 1, 5100 Odense C, Denmark 25.0 Complaint procedure 25.1 Any complaint may be brought before the Danish Insurance Appeals Board (Danish: Ankenævnet for Forsikring).
