3 1 PURPOSE This document provides the state motor vehicle department administrators the information necessary to understand the various components of the National Motor Vehicle Title Information System (NMVTIS). The document also describes the data inflows and outflows, the system architecture and supporting documentation for each component. 2 WHAT IS NMVTIS? A system that allows motor vehicle, law enforcement agencies, partner organizations and consumers to instantly and reliably verify the information on the paper title with the electronic data from the state that issued the title. 3 HISTORY When Congress passed the Anti-Car Theft Act in 1992 (PL ), auto theft and fraud were major problems in the U.S. States were not able to share important information which made the titling of stolen vehicles simple. The Anti-Car Theft Act created the National Motor Vehicle Title Information System (NMVTIS). NMVTIS was intended to be a system that would connect all state titling agencies, enabling the sharing of title information prior to re-issuing a new title. Auto theft today remains an extremely lucrative form of criminal enterprise making it an attractive activity for organized gangs. FBI reports indicate that auto theft costs America approximately $8 billion annually. One reason why auto theft and fraud are so lucrative is the lack of electronic connectivity between state titling agencies and their inability to share information on a vehicle regardless of differences in state laws. This gap makes it relatively simple for vehicle title fraud to be perpetrated. The new white collar vehicle crime Vehicle Cloning: Vehicle cloning is described by experts as the new white collar vehicle fraud activity. Each vehicle has a vehicle identification number (VIN) that is unique to that vehicle in the same way that the social security number is unique to an individual. Vehicle or VIN cloning is the equivalent to individual identity theft; in this case, the car s identity is indeed stolen. This phenomenon is considered a white collar crime because it is relatively simple to accomplish requiring little or no mechanical effort. The theft of a car s identity occurs when the VIN from a vehicle that is parked in person s driveway is simply written down then duplicated and placed over the VIN of another similar type vehicle, usually, a stolen vehicle, creating a clone of the first vehicle. Without a national system where VINs can be checked, cloned vehicles are being purchased by unsuspecting individuals. The National Insurance Crime Bureau estimates that there are at least 60,000 cloned vehicles in existence today. However, in fact, no one really knows the true number because a cloned vehicle looks and seems like a legitimate and is very difficult to detect. Page 1

4 Hurricanes Katrina and Rita The Gulf hurricanes in 2005 exacerbated these serious problems by damaging thousands of vehicles and providing a fertile supply to organized crime and terrorist groups. Some 500,000 vehicles, including hundreds of school buses, were flooded or damaged by hurricanes Katrina and Rita. Officials from the insurance industry are still in the process of identifying and inspecting these vehicles. Some of them have made their way to other parts of the country and have been sold to unsuspecting buyers. Aside from the monetary harm being inflicted on consumers, many of these automobiles are ticking time bombs, steadily rotting from within as they are being driven on our roads and highways. Additionally, auto theft is tied not only to organized crime but to terrorist networks that use stealing cars as a funding source. State Department intelligence reports confirm this development. The lucrative nature of auto theft and fraud in the U.S. make it a very attractive target for these groups. Some proceeds from auto theft and fraud activities are being funneled to the Middle East. Interpol sources have also identified auto theft as an area of interest to terrorist organizations. The Solution: These are all national problems. NMVTIS eliminates the inherent gaps in state titling laws by making available current vehicle information as well as the history of any conditions which might affect the safety or the roadworthiness of the vehicle, such as whether it was ever water damaged or sold by an insurance company to a salvage yard. NMVTIS also checks the vehicle stolen status, thereby reducing the potential that a stolen vehicle could be re-titled. In addition, NMVTIS is a tool to deter and detect vehicle cloning. Through a consumer access application individuals can check the status of a vehicle prior to making the purchase decision. Law enforcement will be able to check the nationwide system to determine if a vehicle is titled in multiple states which is an initial indication for a possible clone, making investigations more effective and targeted. Some state law enforcement agencies have already been able to take action on criminal organizations that were involved in VIN cloning as a result of using NMVTIS. It does work! A 2001 Department of Justice (DOJ) cost/benefit study concluded that once fully implemented, NMVTIS could produce benefits of $4-$11.3 billion annually! A 2006 Integrated Justice Information Systems (IJIS) Institute report commissioned by DOJ concluded that the NMVTIS program provides an invaluable benefit to state DMVs and the public community as a whole. 5 4 AAMVA AS THE OPERATOR The Anti-Car Theft Act authorizes the designation of a third-party operator of NMVTIS. Since 1992, the American Association of Motor Vehicle Administrators (AAMVA) has acted in this capacity and operates the system today. AAMVA is a nonprofit, tax exempt, educational association representing U.S. and Canadian officials responsible for the administration and enforcement of motor vehicle laws. 5 GOVERNANCE 5.1 DOJ Advisory Committee NMVTIS is a DOJ program and the DOJ is also responsible for NMVTIS policy and operations. To ensure that informed decisions are made regarding the operation of the program however, DOJ will convene a NMVTIS Advisory Board that will include representation from all of the stakeholder communities affected by the program-states, consumers, insurance carriers, auto recyclers, junk and salvage yards, and law enforcement agencies. The NMVTIS operator AAMVA is also represented on the Advisory Board. The Advisory Board will make recommendations to DOJ regarding NMVTIS and may be asked to make recommendations regarding program operation and administration issues, such as establishing NMVTIS performance measures, accessing additional data within the system that is not required by the Anti-Car Theft Act, assessing program costs and revenues, and quality assurance. 5.2 NMVTIS Working Group The NMVTIS Working Group brings together representatives from participating jurisdictions to raise and address operational and technical issues. In addition, NICB and AAMVA staff participates in the meetings. The Working Group receives information on: Additions and upgrades to jurisdiction participation status System outages and maintenance Planned enhancements Activities of the AAMVA Board, Department of Justice and Congress that may affect NMVTIS operations 5.3 Business Subcommittee The business subcommittee operates under AAMVA's Vehicle Committee. The jurisdictions and AAMVA Program Management is the primary staff for the subcommittee. Members of AAMVA s Information Technology Team also participate. Business subcommittee members address business questions and issues that arise when considering application enhancements. Page 3

6 6 CURRENT NMVTIS PROGRAMS NMVTIS is an amalgamation of programs built specifically to support the regulations defined in the Anti-Car Theft Act. 6.1 State Program The state program provides each jurisdiction the tools required to comply with DOJ regulations regarding title verification and data reporting. There are multiple approaches to facilitate participation in the NMVTIS State Program. The system allows for online participation, batch participation, and a combination of the two. NMVTIS online participants access and update the system interactively in real-time. NMVTIS batch participants supply data and receive summary reports in daily intervals. NMVTIS participants using a combination of the online and batch functionality generally access the system online and provide data in batch. Full integrated, online participation in NMVTIS satisfies the requirements for title verification and data reporting for each state under the Anti-Car Theft Act. Batch participation enables states to provide data and receive some of the benefits of the system before they are able to participate online. State Web Inquiry allows all states to perform instant title verification over the internet with a web browser. State Batch Inquiry allows all states to perform title verification in batch mode for their back office operations. Page 4

7 6.1.1 Integrated State Online Inquiry and Update Description There is no human interface for the NMVTIS online component. Titling data is communicated between the jurisdictions and NMVTIS online using network messaging over AAMVAnet. It is the responsibility of the jurisdiction to integrate the NMVTIS messages into their titling application. The jurisdictions must also build the help desk tools required to support title data updates. It s all about transactions Messages are grouped into business transactions based on certain titling events. A typical NMVTIS transaction will consist of a request message (from the jurisdiction) and multiple response messages from NMVTIS, Transaction Name New Vehicle Inquiry Add Title Used Vehicle Inquiry In-State Title Transfer or Change Change State of Title Description The New Vehicle Inquiry transaction checks for an existing title record, brands already applied and a current theft record. The New Vehicle Inquiry should be used when titling all new vehicles. It can help jurisdictions identify whether: The vehicle has been titled by a jurisdiction participating in NMVTIS The vehicle has been branded The vehicle has been reported stolen After the jurisdiction has verified the title application and decided to issue the title, the jurisdiction updates their title file and then adds the record to the NMVTIS VIN Pointer file. The VIN Pointer file is updated before or as soon as the title or other negotiable proof of ownership is issued. If the jurisdiction issues registration in lieu of title, the jurisdiction updates the registration file and then adds the record to the VIN Pointer file. Finally, if the jurisdiction applies any brands to the vehicle that are not already on the Brand file, the jurisdiction adds the brands to the Brand file. The Used Vehicle Inquiry provides information to assist in retitling vehicles that have been titled at least once. When titling a vehicle from out-of-state, the Anti Car Theft Act requires the titling jurisdiction to perform a NMVTIS inquiry that returns information from the Brand & VIN Pointer files. NMVTIS has established a best practice that the jurisdiction inquires for all title transfers regardless of whether they are out of state and also inquires against the Theft file. When a jurisdiction processes an application for a new title on a vehicle for which the jurisdiction is the current State of Title (SOT) on the VIN Pointer file, the jurisdiction uses the In-State Title Transfer or Change Data transaction to update the NMVTIS VIN Pointer file. When a jurisdiction processes an application to title a vehicle that has a VIN pointer record on which a different jurisdiction is the current SOT, the jurisdiction processing the title application uses the Change State of Page 5

The Add Title Undo transaction removes a VIN Pointer file record added with the Add Title transaction. The Add Title Undo is performed when the jurisdiction determines it should not have titled the vehicle. The Change State of Title Undo transaction removes an update to a record on the VIN Pointer file causing the VIN Pointer file to point to the old State of Title. The In-State Transfer or Change Title Undo transaction removes a VIN Pointer file record added with the In-State Title Transfer or Change Title transaction. As jurisdictions supply a VIN to the system NMVTIS searches the Brand file for a matching VIN. If it finds a match it returns the first 40 occurrences of brand data to the inquirer. The brand update transaction is originated by the SOT to notify the Brand & VIN Pointer controller that it has recorded a brand on particular VIN. The Add Brand Undo transaction removes a Brand file record added with the Add Brand transaction Data reported to NMVTIS Title and brand data are reported to NMVTIS using the add title and add brand transactions. For example, when issuing a title for a vehicle a jurisdiction will initiate an add title transaction. The jurisdiction will send a request message to NMVTIS that contains the following data items. VIN State of Title (SOT) Title Number State Titling Key, if required for that state Title Issued from MCO Indicator Make Model Year Title Issue Date Odometer Reading Odometer Unit of Measure If the jurisdiction also needs to add a brand to the vehicle they will initiate a add brand transaction. 11 6.1.2 State Batch Update Description The NMVTIS batch update program will only allow a state to comply with the data reporting requirement or the Anti-Car Theft Act. The batch upload is executed in two phases: 1. The one time initial load of title and brand data into NMVTIS with title and brand data from the jurisdictions titling system. 2. The ongoing daily update of NMVTIS with new, modified, or deleted entries from the jurisdictions titling system. The daily batch files that contain title and brand data are used to keep the NMVTIS current. The daily files are sent to AAMVA via electronic file transfer over AAMVAnet. 14 6.1.3 State Web Interface Description US DOJ regulations require that states must perform instant title verification on all out-of-state titles before issuing a permanent certificate of title. In order to support the instant title verification check requirement, AAMVA has built and deployed a web-based application to provide jurisdictions access to NMVTIS data online Data displayed by the State Web Interface This application provides for single VIN inquiry capability. 16 6.1.4 State Overnight Batch Inquiry Description US DOJ regulations require that states must perform title verification on all out-of-state titles before issuing a permanent certificate of title. In order to expand a state s ability to comply with the Anti-Car Theft Act (ACTA), AAMVA has developed a mechanism for states to query NMVTIS in a batch mode. AAMVA s approach to providing states the ability to query NMVTIS in batch mode is to allow for submission of an inquiry file containing Vehicle Identification Numbers (VINs) Data updated in NMVTIS This is an inquiry only application. No data are updated in NMVTIS Data returned by NMVTIS Using the states inquiry file as input, AAMVA will query NMVTIS and will make available report files containing title, brand and junk, salvage and insurance information. States can use the data returned by NMVTIS to perform title verification on out-of-state titles before issuing a permanent certificate of title. 18 6.2 Third Party Reporting Program The Anti-Car Theft Act requires that in addition to state motor vehicle agencies, other third parties must report information into NMVTIS. Specifically, junk and salvage yards and insurance carriers are required to report vehicle inventory information to NMVTIS Reporting JSI data using a data consolidator Description AAMVA s approach to the collection of junk, salvage and insurance data are to utilize third parties that serve in the capacity of consolidators. These consolidators serve as portals for the reporting entities to submit the data required by NMVTIS. The consolidators collect and transmit reporting data to AAMVA in flat data files on a daily basis. N M V T I S Data updated in NMVTIS Insurance carriers (or someone acting on their behalf) are required to report all vehicles in their inventory on a monthly basis that has not been reported previously. Detailed reporting requirements for insurers are located at the nmvtis.gov website. One of the audit files will include details regarding successful additions to NMVTIS. The other audit file includes items that could not be added to NMVTIS and are considered in error Architecture The following narrative provides an overview of system architecture: 1. Each consolidator provides their reporting entities an interface to capture their vehicle reporting via the internet or other means of data capture. 2. The consolidator will aggregate all of their entity reporting s into a single load file and transmit the file to AAMVA using SFTP over the internet on a daily basis. Page 17

20 3. Using the load file as input NMVTIS processes the load file and updates the NMVTIS database. 4. AAMVA returns audit files to the consolidators that detail the results of the processing cycle. 21 6.2.2 JSI Destroyed Vehicle File Description As jurisdictions seek to automate and improve the process in which vehicles are identified and marked as destroyed in their jurisdiction, they look to the destroyed vehicle information maintained in NMVTIS to help drive this process. AAMVA s approach to the providing states destroyed vehicle information is to create a batch file that contains vehicle reports from reporting entities that have destroyed vehicles within their jurisdiction. The jurisdiction can use the file of destroyed vehicles to assist them in their business operations that support processing salvage vehicles Data updated in NMVTIS This application is inquiry only JSI data returned by NMVTIS Prior to implementation each jurisdiction will provide AAMVA their destroyed vehicle reporting time frame requirements: The reporting time frame can be Daily, Weekly, or Monthly The destroyed vehicle information extracted from NMVTIS is based on the date the destroyed vehicle information was reported to NMVTIS. An initial load file that contains a history of all destroyed vehicle information for a jurisdiction is available upon request. The following data items are included in the destroyed vehicle file: Element Name/Field Name VIN VEHICLE SALVAGE OBTAIN DATE VEHICLE DISPOSITION TEXT Description A unique combination of alphanumeric characters that identifies a specific vehicle or vessel. The VIN is affixed to the vehicle in specific locations and formulated by the manufacturer. State agencies under some controlled instances may assign a VIN to a vehicle. This field is left justified and is large enough to accommodate VINs created before the 1982 standard of 17 characters. For Salvage Yard/ Recyclers/ Salvage Pool operators: The date on which the vehicle was obtained in inventory. Verbiage used to describe the current disposition of the vehicle. Free form text description of the VEHICLE Model (i.e. REGAL, CORVETTE ) Freeform text description of the vehicle type (i.e. Ambulance, Station Wagon, Hatchback/ Fastback, 2DR, AC ). The date the vehicle report was submitted to NMVTIS. The AAMVA assigned sequence number ties together all of the JSI reporting activity for a VIN. The sequence number starts with the most recent activity and ends with the oldest activity. Amended vehicle reports are imbedded in the sequence and immediately follow the destroyed vehicle reports they are associated with. The sequence number is incremented once for each occurrence of the VIN in the file. (i.e. 0001,0002,0003,0004) Architecture For each state that requests destroyed vehicle information from NMVTIS, AAMVA will create a destroyed vehicle file. The file will be created on a scheduled basis. The requesting jurisdiction can retrieve the file using electronic file transfer. 25 6.3 Consumer Access Program Consumer Access Description Under the Anti-Car Theft Act access to NMVTIS data by prospective purchasers is required. AAMVAs approach to meeting that requirement is to allow service provides to access NMVTIS data. It is the responsibility of the service providers to provide the information to the prospective purchasers and other users. The NMVTIS Consumer Access program provides on-line, real-time access to NMVTIS Title History, Brand, Junk, Salvage and Insurance data. Service providers are responsible for the software and hardware that are required to interface with NMVTIS. Service providers are also responsible for all consumer facing interactions Data updated in NMVTIS This is an inquiry only application Data returned by NMVTIS NMVTIS data are returned to the service provider in the AMIE message format. It is the responsibility of the service provider to assemble the messages and smartly display NMVTIS data to consumers. Title Processing Service providers participating in the NMVTIS Consumer Access program will use the VIN as the inquiry key. The web service also has comprehensive search feature Description The NMVTIS Search Service for Law Enforcement (SSLE) provides law enforcement immediate access to NMVTIS Title, Brand, and Junk, Salvage and Insurance (JSI) data. The service will also provide a data search operation where multiple search criteria can be used to target specific subsets of NMVTIS data. This data mining capability will provide law enforcement partners an important tool to reduce auto theft and vehicle title-related crimes. VEIHICLE NUMBER DOORS 1 A count of the doors in the vehicle or vessel VEHICLE NUMBER AXLES 9 A count of common axles of rotation of one or more wheels of a vehicle, whether power driven or freely rotating. VEHICLE UNLADEN WGT 9 The weight of the vehicle fully equipped for service, not including the weight of the payload (i.e., empty weight). The unladen weight is also known as the scale weight. VEHICLE GVW 9 A value specified by the manufacturer for a single unit truck, truck tractor, or trailer. In the absence of a value specified by the manufacturer, an estimate of the gross vehicle weight of a fully loaded unit may be substituted. VEHICLE GROSS WEIGHT RATING TITLE PREVIOUS JURISDCITION 9 A vehicle has only one vehicle Gross Vehicle Weight Rating (GVWR), which is assigned at the point of manufacture. It represents the greatest allowable load for that vehicle, including trailers. 2 The U.S. Postal code or the code for Canada or Mexico for the jurisdiction that titled the vehicle or vessel immediately prior to the current titling jurisdiction. TITLE PREVIOUS NUMBER 17 The title number assigned to the vehicle or vessel by the previous titling jurisdiction. If the current titling jurisdiction reissues titles using new title numbers, the jurisdiction should retain those title numbers as Duplicate/Replacement Title Numbers.
