2 Beyond the Border Action Plan Single Window Initiative Canada/United States Alignment Deliverable BACKGROUND: The Beyond the Border Action Plan on Perimeter Security and Economic Competiveness sets out a range of initiatives to promote security and support trade and economic growth in North America. The Single Window Initiative (SWI) is one of the 32 initiatives announced under the plan, which will facilitate trade by aligning regulatory approaches to protect health, safety and the environment while supporting economic growth. Action Plan Commitments: The Canada Border Services Agency (CBSA) and the United States Customs Border Protection (US CBP) agreed to implement their respective single window programs to allow traders to electronically submit all information required to comply with customs and other government regulations. This information would then be assessed electronically by the relevant government departments and agencies, resulting in border-related decision which would be transmitted electronically. In doing this: Fully implement and, to the greatest extent possible, align their single-window programs for imports entering our respective territories. Convert the data requirements of all participating government departments and agencies (PGAs) to electronic form by December In carrying out this conversion, departments and agencies will review their existing regulatory requirements and identify for conversion, only that information essential for regulatory purposes. As an interim milestone for Canada, convert border-related decision processes, for at least the top four priority PGA(s) to electronic form by December The Top 4 PGA(s) are Canadian Food Inspection Agency (CFIA), Department of Foreign Affairs and International Trade (DFAIT), Health Canada (HC) and Transport Canada (TC). As both countries integrate other government partners into their Single Window systems, they intend to utilize a common design based on World Customs Organization (WCO) principles. Page 2 of 43

3 PURPOSE: While the focus of the Single Window Initiative is to create the electronic environments for the trade to report required data electronically, both Canada and the US are building separate Single Windows. It is understood that it is desirable to have a common language for trade, both nationally and when possible, internationally. Traders who import into both Canada and the US would benefit if the required data were harmonized between the two countries. harmonization is the first step in the evaluation of a national Single Window for each country. Since data is the heart of each country s Single Window, data alignment was considered a crucial first step and a major deliverable. harmonization under this initiative was undertaken to accomplish the following: Provide an understanding of the data required by the regulating agencies in the US and Canada. Establish common definitions of the data in each country through the use of the WCO data model. Provide data choices for those PGAs who have not completed their data requirements for imports. Provide the basis for subsequent harmonization of required data reporting by PGAs, on both sides of the Canada/US border, who have the same responsibilities. Provide insight into data requirement differences resulting from differing statutory and legislative mandates on imports. Provide mapping to the WCO data model as both CBSA and CBP have long supported the WCO data model as the international standard. METHODOLOGY A team was established comprised of members from CBSA, Single Window Initiative, Projects Division, and CBP, Import Safety and Interagency Requirements, International Trade System Branch. This team met in Washington, D.C in December, 2011 and February, 2012 and held numerous conference calls to finalize the Customs Border Protection and Canada Border Services Agency Comparison (see Appendix A). The data mapping was accomplished through the following processes: The CBP and CBSA PGA datasets were mapped to the WCO data model (version 3.2). Align to WCO data model elements. Identify the differences. Determine reasons for unmapped data. Review definitions to verify mapping. Note exceptions. Page 3 of 43

4 OUTCOME/RESULTS: The results suggest that there are a few data elements collected by one country but not the other. Of the 155 data elements supplied by the CBSA and CBP to represent the release/entry and PGA requirements, the team was able to harmonize 143 (92%). The differences are generally related to information required by each country for specific system related purposes (e.g., Canada requiring a Priority Indicator for perishable goods for system generated workload management) and information differences that arise in countryspecific regulations governing the regulated commodities; e.g., Surety Bond information for US Department of Transport not required by Transport Canada 8% of data did not match 92% of data similar for US/CAN The following table (Table 1) lists the unmatched data elements and the reason for the disparity. 6 Other more subtle differences that have been noted are collection of similar information from different trade chain partners (US collects Ultimate Consignee from carrier while Canada collects End-User from ) and differences in Privacy legislation (Admissibility document information for driver/crew shared with US PGAs while Canada collecting these documents in the future under authority of Immigration Refugee Protection Act and cannot share with PGAs). However, as the information itself is being collected by both countries, these subtle differences have been noted but the data alignment is considered a match by both countries. (See Annex A for Details) CONCLUSION: The data mapping shows a high level of data similarity between the US and Canada. While we did expect some differences, they were fewer than anticipated. The data mapping team believes the product of this effort will be useful in stimulating future discussion between PGAs on both sides of the US/Canadian border. The concurrence of data required for imports by both Canada and the US should lend assurance to the trade community. Upon acceptance of this deliverable by the CBP/CBSA Senior Management Working Group, each country intends to use the attached information in discussions with PGAs on the development of Single Window. Results of the data alignment will also become part of the Canada/US Joint Trade Consultation strategy that each country is committed to undertaking. The results of this effort will also influence the direction of the WCO data model through the requested inclusion of additional data elements. We hope these additions will broaden the application of the WCO data model to other PGAs internationally. Finally, the mapping of the data elements required for imports will remain dynamic as it may be influenced by process changes on both side of the border. For example, the Simplified Entry is changing the set of data elements supplied by the importer for entry of goods into the US while relying on the carrier manifest report to supply other key pieces of information that is currently reported by both parties. The data mapping team is aware that there is another Beyond the Borders initiative (8b) that has undertaken a harmonization of cross border data for security purposes. An additional effort should be undertaken to ensure that harmonization decisions made by that team do not adversely impact the down stream data filings for entry.
