The Firm The Hoerster Mediation Firm was formed by its founder, Pam Hoerster in 1996. The firm s goal is to provide efficient dispute resolution and conflict management services in a comfortable, convenient, and confidential setting. The Hoerster Mediation Firm is truly unique in that it provides quality services in several convenient geographically distinct locations. The firm currently has the ability to provide mediation services on a national and statewide basis. The majority of the complex disputes mediated by the firm have been settled in an efficient and effective way. This is due in part to the seasoned trial and mediation experience of the firm s principal, Pam Hoerster. Mediated Negotiation Facilitated by a neutral professional, mediation is a process through which the parties are given an opportunity to evaluate in confidence the realistic options for resolution. The mediation generally begins with a joint session attended by all participants. At this time, a confidentiality agreement is signed and each party summarizes its position on the key factual and legal issues. The joint session is followed by confidential caucuses, between the mediator and each party. The mediator assists each party in evaluating its position and in assessing the alternatives for resolution. Due to the confidentiality of the caucuses and the voluntary nature of the process, the parties retain control over the information, which is shared, the options, which are discussed, and the terms of the ultimate agreement. The end result is a written settlement agreement. Arbitration Services The firm will provide arbitration services. Ms. Hoerster s experience as a civil trial attorney and as an adjunct professor of civil trial, evidence and mediation provides a solid foundation for her arbitration skills. The fee charged for arbitration services will be based on the size of the case, complexity of the legal issues, number of parties and location of the services being provided.
