TEXAS DEPARTMENT OF PUBLIC SAFETY 2003 ANNUAL TRAFFIC STOP DATA REPORT

TEXAS DEPARTMENT OF PUBLIC SAFETY COLLEEN McHUGH,COMMISSION CHAIRMAN ROBERT B. HOLT, COMMISSIONER JAMES B. FRANCIS, JR., COMMISSIONER THOMAS A. DAVIS, JR., DIRECTOR DAVID McEATHRON, ASST. DIRECTOR In October, 2000, the Texas Department of Public Safety (DPS) released the first Traffic Stop Data Report relating to Traffic Law Enforcement traffic stops. The report was designed to provide a historical background pertaining to the issues of racial profiling and examined the activities of the Texas Department of Public Safety as related to traffic stops. In an on-going effort to keep the state s leadership, DPS commissioned officers, and other interested citizens of the state of Texas informed on department activities, a Traffic Stop Data Report is issued annually for activities January through December. During the 77th Regular session of the Texas Legislature, Senate Bill 1074 regarding Racial Profiling was enacted. Senate Bill 1074 requires Texas Law Enforcement Agencies to collect certain traffic stop data and to annually report the data to the governing body of the agency. This report reflects traffic stop activities of the Texas Department of Public Safety for the calendar year 2003. The ethnic breakdown of the Texas population in this report is based on the 2000 United States Census Data, rather than the population estimates from the Texas State Data Center reflected in the initial report of October 2000. The Texas Department of Public Safety remains committed to the prevention of racial profiling. Racial profiling is illegal, inconsistent with the principles of American policing, and an indefensible public protection strategy.

Based upon available data Troopers with the DPS made traffic stops, issued citations, warnings, and/or conducted searches of vehicles as follows: Traffic Stop Data Report Annual 2003 Revised 03/24/2004 TRAFFIC STOPS Stops Traffic Stops Population of Texas Asian* 21,173 1.17% 2.80% 293,051 9.13% 11.34% 1,060,697 33.04% 31.99% Indian** 2,730 0.15% 0.60% 18,233 0.57% 0.84% 1,814,623 56.52% 52.43% TOTAL 3,210,507 CITATIONS Stops Traffic Stops Population of Texas Asian* 12,063 1.58% 2.80% 119,965 9.62% 11.34% 340,439 27.30% 31.99% Indian** 1,388 0.18% 0.60% 8,194 0.66% 0.84% 764,903 61.34% 52.43% TOTAL 1,246,952 WRITTEN WARNINGS Stops Traffic Stops Population of Texas Asian* 9,110 0.87% 2.80% 173,086 8.81% 11.34% 720,258 36.68% 31.99% Indian** 1,342 0.13% 0.60% 10,039 0.51% 0.84% 1,049,720 53.46% 52.43% TOTAL 1,963,555 VEHICLE SEARCHES Searches Searches Population of Texas Asian* 411 0.72% 2.80% 13,456 10.67% 11.34% 54,393 43.13% 31.99% Indian** 134 0.23% 0.60% 493 0.39% 0.84% 57,231 45.38% 52.43% TOTAL 126,118 TYPE OF SEARCH CONDUCTED Race # of # of Consent # of Searches Searches Searches *** Asian* 411 239 172 13,456 7,240 6,216 54,393 18,829 35,564 Indian** 134 76 58 493 269 224 57,231 25,060 32,171 TOTAL 126,118 51,713 74,405 DRUG INTERDICTION Stops Traffic Stops Population of Texas Asian* 41 0.42% 2.80% 2,756 17.96% 11.34% 2,789 18.18% 31.99% Indian** 24 0.25% 0.60% 44 0.29% 0.84% 9,689 63.15% 52.43% TOTAL 15,343 *Asian/Pacific Islander ** Indian(American Indian or Alaskan Native) *** searches include: Probable Cause, Incident to Arrest, and Inventory
