Bill Summary (Note: This summary applies to this bill as introduced and does not reflect any amendments that may be subsequently adopted. The bill creates the alcohol and substance abuse medical detox centers pilot program (pilot program) in the unit that administers behavioral health programs and services, including those related to mental health and substance abuse (unit), within the department of human services (department). are addicted to alcohol or substances and who are going through the detoxification process. The pilot program will initially consist of one rural treatment center and one urban treatment center. Alcohol and substance abuse treatment centers in Colorado may apply to the unit to participate in the pilot program. The state board of human services shall develop rules for applications, review the applications, and select treatment centers for funding. The pilot program will last years. After years, each treatment center will submit a report on activities and outcomes to the unit, which shall in turn submit a report to the public health care and human services committee of the house of representatives and the health and human services committee of the senate. The alcohol and substance abuse medical detox centers pilot program fund is created. 1 1 1 1 1 1 1 1 Be it enacted by the General Assembly of the State of Colorado: SECTION 1. In Colorado Revised Statutes, add -0- as follows: -0-. Alcohol and substance abuse medical detox centers pilot program - definitions - administration - reporting - fund - repeal. (1) AS USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE REQUIRES: (a) "FUND" MEANS THE ALCOHOL AND SUBSTANCE ABUSE MEDICAL DETOX CENTERS PILOT PROGRAM FUND CREATED IN SUBSECTION () OF THIS SECTION. (b) "PILOT PROGRAM" MEANS THE ALCOHOL AND SUBSTANCE ABUSE MEDICAL DETOX CENTERS PILOT PROGRAM CREATED IN SUBSECTION () OF THIS SECTION. (c) "RURAL TREATMENT CENTER" MEANS AN ALCOHOL OR SUBSTANCE ABUSE TREATMENT CENTER THAT SERVES A COUNTY OR GROUP OF COUNTIES THAT HAS A TOTAL POPULATION OF LESS THAN THIRTY THOUSAND PEOPLE, ACCORDING TO THE MOST RECENTLY AVAILABLE POPULATION STATISTICS OF THE UNITED STATES BUREAU OF THE CENSUS. -- HB1-

1 1 1 1 1 1 1 0 1 (d) "URBAN TREATMENT CENTER" MEANS AN ALCOHOL OR SUBSTANCE ABUSE TREATMENT CENTER THAT SERVES AN AREA WITH A TOTAL POPULATION OF THIRTY THOUSAND OR MORE PEOPLE, ACCORDING TO THE MOST RECENTLY AVAILABLE POPULATION STATISTICS OF THE UNITED STATES BUREAU OF THE CENSUS. () (a) THERE IS CREATED WITHIN THE UNIT THE ALCOHOL AND SUBSTANCE ABUSE MEDICAL DETOX CENTERS PILOT PROGRAM. THE PURPOSE OF THE PILOT PROGRAM IS TO PROVIDE LIMITED MEDICAL SERVICES THAT ARE CURRENTLY UNAVAILABLE THROUGH STANDARD SOCIAL DETOX PROGRAMS TO INDIVIDUALS WHO ARE ADDICTED TO ALCOHOL OR SUBSTANCES AND ARE GOING THROUGH THE DETOXIFICATION PROCESS. (b) (I) SUBJECT TO AVAILABLE APPROPRIATIONS, THE PILOT PROGRAM WILL BE AVAILABLE TO ONE RURAL TREATMENT CENTER AND ONE URBAN TREATMENT CENTER AND MUST BEGIN ON OR BEFORE JULY 1, 01. ALCOHOL AND SUBSTANCE ABUSE TREATMENT CENTERS IN COLORADO MAY SUBMIT AN APPLICATION TO THE UNIT FOR CONSIDERATION AS A PARTICIPANT IN THE PILOT PROGRAM. BASED ON RECOMMENDATIONS FROM THE UNIT, THE STATE BOARD OF HUMAN SERVICES SHALL ADOPT RULES FOR THE APPLICATION PROCESS, INCLUDING REQUIREMENTS FOR PARTICIPATING IN THE PILOT PROGRAM, DEADLINES, AND THE CRITERIA AGAINST WHICH APPLICATIONS WILL BE WEIGHED. (II) ON OR BEFORE JANUARY 1, 01, THE UNIT SHALL MAKE A RECOMMENDATION TO THE STATE BOARD OF HUMAN SERVICES CONCERNING WHICH RURAL TREATMENT CENTER AND WHICH URBAN TREATMENT CENTER SHOULD BE FUNDED. ON OR BEFORE FEBRUARY 1, 01, THE STATE BOARD OF HUMAN SERVICES SHALL DECIDE WHICH ARE -- HB1-

1 1 1 1 1 1 1 0 1 FUNDED. (c) THE TWO TREATMENT CENTERS PARTICIPATING IN THE PILOT PROGRAM SHALL OPERATE THEIR PILOT PROGRAM FOR TWO YEARS. AT THE END OF THE TWO-YEAR CYCLE, EACH TREATMENT CENTER SHALL SUBMIT A REPORT ON ITS ACTIVITIES AND OUTCOMES TO THE UNIT. THE UNIT SHALL SUBMIT A REPORT ON THE PILOT PROGRAM TO THE PUBLIC HEALTH CARE AND HUMAN SERVICES COMMITTEE OF THE HOUSE OF REPRESENTATIVES AND THE HEALTH AND HUMAN SERVICES COMMITTEE OF THE SENATE, OR ANY SUCCESSOR COMMITTEES, ON OR BEFORE JANUARY 0, 0. () THERE IS CREATED IN THE STATE TREASURY THE ALCOHOL AND SUBSTANCE ABUSE MEDICAL DETOX CENTERS PILOT PROGRAM FUND, CONSISTING OF ANY MONEYS THAT MAY BE APPROPRIATED TO THE FUND BY THE GENERAL ASSEMBLY. THE MONEYS IN THE FUND ARE SUBJECT TO ANNUAL APPROPRIATION BY THE GENERAL ASSEMBLY TO THE DEPARTMENT FOR THE DIRECT AND INDIRECT COSTS ASSOCIATED WITH IMPLEMENTING THIS SECTION. THE STATE TREASURER MAY INVEST ANY MONEYS IN THE FUND NOT EXPENDED FOR THE PURPOSE OF THIS SECTION AS PROVIDED BY LAW. THE STATE TREASURER SHALL CREDIT ALL INTEREST AND INCOME DERIVED FROM THE INVESTMENT AND DEPOSIT OF MONEYS IN THE FUND TO THE FUND. ANY UNEXPENDED AND UNENCUMBERED MONEYS REMAINING IN THE FUND AT THE END OF A FISCAL YEAR REMAIN IN THE FUND AND SHALL NOT BE CREDITED OR TRANSFERRED TO THE GENERAL FUND OR ANOTHER FUND. () THIS SECTION IS REPEALED, EFFECTIVE JULY 1, 0. SECTION. Act subject to petition - effective date. This act takes effect at 1:01 a.m. on the day following the expiration of the -- HB1-

ninety-day period after final adjournment of the general assembly (August, 01, if adjournment sine die is on May, 01); except that, if a referendum petition is filed pursuant to section 1 () of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 01 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor. -- HB1-
