SENATE BILL BY SENATOR(S) Groff, and Spence; also REPRESENTATIVE(S) Marshall, Butcher, Carroll T., Cloer, Frangas, Gallegos, Green, Hodge, Madden, McGihon, Merrifield, Paccione, Plant, Riesberg, and Todd. CONCERNING A REQUIREMENT OF CULTURAL COMPETENCY FOR HEALTH-RELATED PROFESSIONALS, AND, IN CONNECTION THEREWITH, MAKING AN APPROPRIATION. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Part 22 of article 4 of title 25, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: Cultural competency curricula for health-related degrees - task force created. (1) COLORADO INSTITUTIONS OF HIGHER EDUCATION OFFERING HEALTH EDUCATION PROGRAMS, BOTH THOSE CULMINATING IN A SPECIFIC HEALTH-RELATED DEGREE AND THOSE RESULTING IN COMPLETION OF A CURRICULUM IN HEALTH-RELATED TECHNICAL COMPETENCE, ARE ENCOURAGED TO DEVELOP INTEGRATED CURRICULA FOCUSING ON CULTURAL AWARENESS AND COMPETENCE IN THEIR RESPECTIVE HEALTH SERVICE FIELDS. THE CURRICULA SHALL BE DESIGNED FOR AND BY FOUR-YEAR INSTITUTIONS, COMMUNITY AND JUNIOR COLLEGES, Capital letters indicate new material added to existing statutes; dashes through words indicate deletions from existing statutes and such material not part of act.
2 LOCAL DISTRICT COLLEGES, AREA VOCATIONAL SCHOOLS OFFERING HIGHER EDUCATION DEGREES, AND GRADUATE SCHOOLS. (2) THE DEPARTMENT SHALL LEAD A TASK FORCE ON CULTURAL COMPETENCE, WHICH IS HEREBY CREATED. THE TASK FORCE SHALL BE COMPOSED OF NO MORE THAN THIRTY-FIVE INDIVIDUALS SELECTED BY THE EXECUTIVE DIRECTOR OF THE DEPARTMENT TO REPRESENT THE FOLLOWING GROUPS: HEALTH CURRICULUM SPECIALISTS FROM COLORADO INSTITUTIONS OF HIGHER EDUCATION; HEALTH-RELATED LICENSING BOARDS LISTED IN SECTION (3), C.R.S.; STATEWIDE HEALTH-RELATED PROFESSIONAL ASSOCIATIONS; STATEWIDE RELIGIOUS AND ETHNIC GROUPS; AND THE DEPARTMENT. (3) BY JULY 1, 2007, THE TASK FORCE ON CULTURAL COMPETENCE SHALL STUDY AND MAKE RECOMMENDATIONS ON SPECIFIC COURSE CURRICULA FOR EACH HEALTH-RELATED EDUCATION FIELD OFFERED. THE COURSE WORK SHALL BE DESIGNED TO BE OFFERED ELECTRONICALLY AND THROUGH VARIOUS DISTANCE EDUCATION METHODS AND MEDIA SO AS TO MINIMIZE DUPLICATION AND EXPENSE. CULTURAL COMPETENCE HEALTH COURSES SHALL INCLUDE: (a) CROSS-CULTURAL COMMUNICATION; (b) CULTURALLY AND LINGUISTICALLY APPROPRIATE HEALTH POLICY CONSIDERATIONS; (c) EXPLORATION OF HEALTH BELIEFS AND EXPLANATORY MODELS; (d) CULTURALLY COMPETENT HEALTH CARE DELIVERY; (e) HEALTH DISPARITIES, PRIVILEGE, AND EQUITY FACTORS IN THE HEALTH SYSTEM; AND (f) CULTURALLY AND LINGUISTICALLY COMPETENT CARE SUPPORTED BY POLICY, ADMINISTRATION, AND PRACTICE. (4) THE DEPARTMENT SHALL ISSUE AN ANNUAL REPORT CARD TO THE GENERAL ASSEMBLY AND FOUR-YEAR INSTITUTIONS, COMMUNITY AND JUNIOR COLLEGES, LOCAL DISTRICT COLLEGES, AREA VOCATIONAL SCHOOLS OFFERING HIGHER EDUCATION DEGREES, AND GRADUATE SCHOOLS IN PAGE 2-SENATE BILL
3 COLORADO REGARDING EXISTING AND PROPOSED CULTURAL COMPETENCY CURRICULA AT SUCH INSTITUTIONS THAT OFFER HEALTH EDUCATION PROGRAMS. THE REPORT CARD SHALL JUDGE THE COSTS AND BENEFITS OF THE CURRICULA, MAKE RECOMMENDATIONS ON CHANGES TO THE CURRICULA, AND COMPARE COLORADO WITH OTHER STATES' INSTITUTIONS OF HIGHER EDUCATION OFFERING HEALTH EDUCATION PROGRAMS THAT ARE SIMILAR IN SIZE AND MISSION TO COLORADO'S. SECTION , Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: Proposed continuing education requirements for regulated occupations and professions - review by executive director - repeal. (3) (a) THE DIRECTOR OF THE DIVISION OF REGISTRATIONS CREATED BY SECTION ; STATE BOARD OF PHARMACY CREATED BY PART 1 OF ARTICLE 22 OF TITLE 12, C.R.S.; COLORADO PODIATRY BOARD CREATED BY ARTICLE 32 OF TITLE 12, C.R.S.; COLORADO STATE BOARD OF CHIROPRACTIC EXAMINERS CREATED BY ARTICLE 33 OF TITLE 12, C.R.S.; STATE BOARD OF DENTAL EXAMINERS CREATED BY ARTICLE 35 OF TITLE 12, C.R.S.; COLORADO STATE BOARD OF MEDICAL EXAMINERS CREATED BY ARTICLE 36 OF TITLE 12, C.R.S.; STATE BOARD OF NURSING CREATED BY ARTICLE 38 OF TITLE 12, C.R.S.; BOARD OF EXAMINERS OF NURSING HOME ADMINISTRATORS CREATED BY ARTICLE 39 OF TITLE 12, C.R.S.; STATE BOARD OF OPTOMETRIC EXAMINERS CREATED BY ARTICLE 40 OF TITLE 12, C.R.S.; AND STATE BOARD OF PSYCHOLOGIST EXAMINERS, STATE BOARD OF SOCIAL WORK EXAMINERS, STATE BOARD OF LICENSED PROFESSIONAL COUNSELOR EXAMINERS, STATE BOARD OF MARRIAGE AND FAMILY THERAPIST EXAMINERS, AND STATE GRIEVANCE BOARD, CREATED BY ARTICLE 43 OF TITLE 12, C.R.S., SHALL: (I) CONSIDER THE COURSE CURRICULA RECOMMENDED FOR ADOPTION AT COLORADO INSTITUTIONS OF HIGHER EDUCATION BY THE TASK FORCE ON CULTURAL COMPETENCE CREATED IN SECTION , C.R.S.; (II) STUDY THE CONTINUING EDUCATION COURSES TO BE REQUIRED FOR LICENSURE AND LICENSE RENEWAL BY MEMBERS OF THEIR RESPECTIVE PROFESSIONS WITH REGARD TO CULTURAL COMPETENCE; AND (III) BY JULY 1, 2008, SUBMIT INFORMATION CONCERNING THE NEED FOR SUCH A REQUIREMENT TO THE EXECUTIVE DIRECTOR OF THE DEPARTMENT OF REGULATORY AGENCIES PURSUANT TO THIS SECTION. 4 (b) THIS SUBSECTION (3) IS REPEALED, EFFECTIVE JULY 1, SECTION , Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read: Use of settlement moneys - programs. (3) (a) FOR THE FISCAL YEAR, THE DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT SHALL RECEIVE AN APPROPRIATION FROM THE SETTLEMENT MONEYS ANNUALLY RECEIVED BY THE STATE IN THE AMOUNT OF ONE HUNDRED THIRTY THOUSAND EIGHT HUNDRED EIGHTY-TWO DOLLARS TO FUND THE TASK FORCE ON CULTURAL COMPETENCE CREATED IN SECTION , C.R.S. (b) FOR THE FISCAL YEAR, THE DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT SHALL RECEIVE AN APPROPRIATION NOT TO EXCEED FIFTY THOUSAND DOLLARS FROM THE SETTLEMENT MONEYS ANNUALLY RECEIVED BY THE STATE TO FUND THE TASK FORCE ON CULTURAL COMPETENCE CREATED IN SECTION , C.R.S. (c) THE GENERAL ASSEMBLY SHALL APPROPRIATE THE AMOUNT SPECIFIED IN THIS SUBSECTION (3) FROM MONEYS CREDITED TO THE TOBACCO LITIGATION SETTLEMENT CASH FUND CREATED IN SECTION SECTION 4. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the tobacco litigation settlement cash fund created in section (1), Colorado Revised Statutes, not otherwise appropriated, to the department of public health and environment, for allocation to the administration and support division, for the fiscal year beginning July 1, 2006, the sum of one hundred thirty thousand eight hundred eighty-two dollars ($130,882) and 1.7 FTE, or so much thereof as may be necessary, for the implementation of this act. SECTION 5. Effective date. This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution (August 9, 2006, if adjournment sine die is on May 10, 2006); except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or PAGE 4-SENATE BILL
5 part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
