FOREIGN GARBAGE COMPLIANCE OVERVIEW AND MANAGEMENT TRAINING

WHAT IS REGULATED GARBAGE? Regulated Garbage- 7 CFR 330.400-403 and 9 CFR 94.5, All waste material that is derived in whole or in part from fruits, vegetables, meats, or other plant or animal (including poultry) material, and other refuse of any character whatsoever that has been associated with any such material. *Any garbage that was on, generated on board, or removed from any means of conveyance during international movements¹, and includes food scraps, table refuse, galley refused, food wrappers or packaging materials and other waste material from stores, food prep areas, passenger s or crew s quarters, dining rooms or any other mans of conveyance. Also includes meals of other food that were available for consumption by passengers or crew on an aircraft but were not consumed. Garbage that is commingled with Regulated Garbage becomes Regulated Garbage.* ¹To the continental United states from any territory or possession, or from Hawaii, to any territory or possession from any other territory or possession or from Hawaii, or to Hawaii from any territory or possession. 2 Title/Group/Section,etc.

PURPOSE OF REGULATED GARBAGE REGULATIONS Garbage containing or associated with plant or animal materials from foreign countries is a pathway of serious concern for the dissemination of foreign plant pests and diseases and animal diseases into American agriculture. An incursion of a foreign plant pest or disease or animal disease into American agriculture could have serious consequences for our food supply, global trade, and our economy. 3 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT General Compliance Requirements The Compliance Agreement (CA) and Standard Operating Procedure are issued by United States Department of Agriculture- Animal and Plant Health Inspection Service (APHIS) and the Department of Homeland Security Customs Border Protection (CBP) The CA is renewed annually CA covers Regulated Garbage activities at all Hampton Roads installations All Regulated Garbage must be placed in 3 mil bags, labeled with the words Regulated Garbage and placed in the RED Regulated Garbage container Regulated Garbage is also known as Foreign Food Waste or Foreign Garbage 6 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT General Compliance Requirements Only Regulated Garbage and any item contaminated/comingled with Regulated Garbage are to be placed into the container ALL Food wastes generated within 24 hours of ship s arrival are to be placed in the Regulated Garbage container All offloads of Regulated Garbage must be logged onto the Foreign Garbage Tracking Log This form must be faxed or emailed to NAVFAC Integrated Solid Waste Management (ISWM) daily 7 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT General Compliance Requirements The seal and door on the Regulated Garbage container must not be tampered with or opened All Regulated Garbage must be removed from the installation within 72 hours of placement in the Regulated Garbage container NAVFAC ISWM will coordinate removal of the container by Stericycle, Inc. 8 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT General Compliance Requirements EV Services will provide clean-up response to spills at Navy installations in Hampton Roads Contact the Emergency Communications Command at the respective installation The spill must be entered into the Foreign Garbage spill log All personnel handling Regulated Garbage must be trained annually according to APHIS requirements A back-up plan must be in place for all Regulated Garbage handling functions Records must be kept according to APHIS requirements 9 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT Aircraft Compliance Naval Station Norfolk - LP-210 North Pad - NAS Oceana - Bldg. 3050 Commercial: Jet Services collects Regulated Garbage in 3 mil plastic bags and places in the red Regulated Garbage container at the respective locations, LP-210 (Norfolk Naval Station) or Bldg. 3050 - North Pad (NAS Oceana) Military: Military crew collects Regulated Garbage in 3 mil plastic bags and places in the red Regulated Garbage container at the respective locations 10 Title/Group/Section,etc.

REGULATED GARBAGE MANAGEMENT Vessel Compliance The ship contacts CBP prior to arrival to arrange Customs and Agricultural inspections The ship s designee will accompany the CBP inspector during the on-board inspections Port Operations, on behalf of the ship, contacts NAVFAC ISWM to order a container prior to ship s arrival Port Operations will place the container near the ship at the pier Ship s crew collects all Regulated Garbage in 3 mil plastic bags, labels the bags and places them in the red Regulated Garbage container located near the ship at the pier All food wastes generated within the first 24 hours after arrival must be placed in the red Regulated Garbage container 11 Title/Group/Section,etc.

MANAGEMENT PROCESS All Regulated Garbage offload from aircraft/vessels must be logged and placed into the red Regulated Garbage dumpster Foreign Garbage Tracking logs must be faxed or emailed to NAVFAC ISWM daily NAVFAC ISWM will coordinate offsite disposal within 72 hours of initial waste generation All spills outside of the aircraft or vessel must be reported to ECC immediately and logged into the Foreign Garbage Spill Log 12 Title/Group/Section,etc.

CLEANING AND DISINFECTION Cleaning and disinfection of Regulated Garbage contamination must follow strict APHIS requirements All establishment personnel responsible for cleaning and disinfection of Regulated Garbage contamination must be trained according to APHIS requirements Cleaning and disinfection of Regulated Garbage contamination must occur immediately Only APHIS approved disinfectants may be used to disinfect Regulated Garbage contamination (Virkon-S, bulk powder or tablets to make 1% solution) 13 Title/Group/Section,etc.

CLEANING AND DISINFECTION A complete spill kit must be available at all times that Regulated Garbage is handled Cleaning and disinfection procedures for Regulated Garbage contamination must follow the guidelines in the Compliance Agreement Regulated Garbage contamination outside the vessel or aircraft must be reported to CBP or USDA Records of disinfectant use must be kept according to APHIS requirements Notify ECC NAVFAC Environmental Services will provide response 14 Title/Group/Section,etc.

LEGAL REQUIREMENTS Any person who knowingly violates the PPA (7 U.S.C. 7701 et. Seq.) and/or the AHPA (7 U.S.C. 8301 et. Seq.) May be criminally prosecuted and found guilty of A misdemeanor which can result in monetary penalties, a one-year prison term, or both. Additionally, any person violating the PPA and/or the AHPA may be assessed civil penalties of up to $300,000 per violation or twice the gross gain or gross loss for any violation that results in the person deriving pecuniary gain or causing pecuniary loss to another, whichever is greater Repeatedly non-compliant entities may have their Compliance Agreements cancelled Most egregious violations may result in the entity being prohibited from handling Regulated Garbage PPA Plant Protection Act AHPA Animal Health Protection Act 15 Title/Group/Section,etc.

FOREIGN GARBAGE TRACKING LOG FOREIGN GARBAGE TRACKING LOG This form is used to document Foreign Food Waste (aka Regulated Garbage, Foreign Garbage) removed from vessels and aircraft. The form must be completed prior to Foreign Food Waste offload. The form must be sent to Integrated Solid Waste Management (ISWM) each day after vessel/aircraft off load of Foreign Food Waste into the Red Regulated Garbage Container. The form can be sent via email or fax.
