Tyrone Area School District SECTION: PUPILS TITLE: DRUG AND ALCOHOL TESTING FOR STUDENT PARTICIPANTS ADOPTED: AUGUST 9, 2011 1. Purpose 227.1 DRUG AND ALCOHOL TESTING FOR STUDENT PARTICIPANTS The Tyrone Area School District considers participation in athletic and all other extracurricular activities to be a privilege and to be voluntary to every student. Students volunteering to participate are expected to accept the responsibilities granted them by this privilege. As a representative of the school district, students involved in athletics and all other extracurricular activities are examined by the public, become role models for young children, as well as peers, and are special representatives of the community. They have voluntarily chosen to accept this role and, with it, the responsibility of a drug and alcohol free lifestyle. Administrators, teachers and coaches recognize that drugs and alcohol have a deleterious effect on motivation, memory, judgment, reaction time, coordination, and performance. These concerns in conjunction with the health and safety factors of our student participants (students involved in athletics and all other extracurricular activities) have constituted the development of this policy. To this degree, this policy is viewed as a viable drug and alcohol free prevention program. This program is intended to serve as a deterrent to student drug use. No academic, legal or disciplinary action not relevant to the student activities will ensue. Nor will documentation of this policy's infraction appear in any student participant's permanent file. Nor will any information pursuant to drug and alcohol tests be disclosed to criminal or juvenile authorities absent legal compulsion by valid and binding subpoena, or legal process, which the Tyrone Area School Board will not solicit. In the event of service of any subpoena or legal process, the student's custodial parent or legal guardian will be notified. 2. Guidelines During the school term for each middle school, junior high, junior varsity and varsity interscholastic athletic and extracurricular activity, every male and female student participant will be eligible for a lab urinalysis. This policy includes students in Grades 7-12. The random test selection procedure will be done by computer with the process supervised by the administration, athletic director and, if available, a member of the school board. Student participants will be randomly selected throughout the school term. In addition, testing may be mandated by the school administration at any time throughout the school term for any student participant thought to be using illegal substances. All student participants are required to sign a Permission To Test contract authorizing the school district to request that, at any time when the student is on school property, without prior warning and in the manner requested during the school term, the participant submit a urine sample for drug and alcohol testing. This contract must also be signed by the student's parents or guardians. The completed contract must be on file in the Tyrone Area School District High School Principal's Office before the student is permitted to participate in the first
approved date of the activity and will remain in effect until the parents or guardians notify the school district in writing that the student is no longer participating in any athletic, extracurricular, and/or privileged activities. All costs associated with the drug and alcohol testing shall be paid by the Tyrone Area School District unless the test results are challenged by the student. Testing will be administered by laboratory/hospital personnel and school district personnel. The Tyrone Area School District shall utilize only a laboratory/hospital that has been certified by the Substance Abuse and Mental Health Services Administration. A certified medical review officer will review all test results to make a final certification as to whether the test is positive or negative. Any and all prescription medications the student is taking must be identified by the student by providing a copy of the prescription or a doctor's authorization. The Tyrone Area School District will observe the legal rules for chain of custody at both the collection and analysis sites. Chain of custody refers to the security of handling the obtained sample from the point of collection to the final destination of the laboratory, including identification, labeling, sealing, and testing. All test results will be provided in writing to the Office of the Superintendent or his or her designee as soon as possible. All parents will receive written official notification whether their students test positive or negative. If notification is received of a positive test result, a second test is administered to confirm the results. The second test is completed utilizing the original urine sample. The school district physician will investigate any medication taken by the student who has tested positive. The school district physician will decide on any effect the medication taken had on the student's test results. If the second urine test is negative, no further action is taken. If the student's urine test is positive and reveals marijuana, PCP, amphetamines, cocaine, opiates, barbiturates, alcohol, or other substances considered illegal or controlled substances under federal or state law, the athlete shall be disqualified from further participation as outlined in this policy. The school principal convenes a meeting with the student and his or her parents/guardians. Students Who Test Positive For Drugs and/or Alcohol 1. The student must participate in the Student Assistance Program. The student will be required to participate in a drug and alcohol assessment with a certified drug and alcohol evaluator. Failure to comply with the evaluator's recommendations will result in dismissal from the activity. 2. The student participant with a first offense will be suspended from participation and attendance until a negative test is achieved. A fifteen (15) school day waiting period is required between notification of a positive test result and when retesting may occur. A student participant with a positive test result may request to be tested on a random test date or schedule his or her own test with the district approved vendor at his or her own expense. However, that testing will follow school guidelines. Sufficient time should be given between tests for the body to cleanse itself. If a succeeding test following the confirmation test is also deemed positive, this will be considered a second offense. 2
3. The student with a second offense will be suspended from participation/ competition for a period of fifty percent (50%) of all contests or events in which the student participates, based on the regular season of each activity. If there is not fifty percent (50%) of a season remaining, the percentage of the suspension not served shall be recalculated with remainder of suspension carried out for the same activity during the ensuing year. 4. The student will be required to retest before the start of another sport season or activity in which he or she will be a participant. The student must test negative prior to his or her return to competition or participation. 5. The student who tests and is found to have a positive test, qualifying as a third offense, will be suspended from participation, practice and competition for one (1) calendar year from the date of the offense. The student must test negative prior to his or her return to athletic competition or extracurricular participation. 6. The student who has four (4) offenses will be barred from all athletic and extracurricular competitions and activities for the remainder of the current school term and the next two school terms. Throughout the year, student participants will be selected to participate in the drug and alcohol testing program. It is possible that by the random draw of the computer, a student could be selected for testing on more than one occasion. Should any student participant at any time refuse to submit a sample for testing, this shall result in the student's disqualification and be treated as an offense. The student will not be permitted to participate on any team or in any activity, including those considered a privilege, until he or she submits to a drug and alcohol test and tests negative. The student will comply with the athletic and/or extracurricular suspension guidelines as described in this policy. All other Board policies on drugs and alcohol concerning the use, possession, or distribution of illegal substances on school premises shall remain unaffected by this policy. 3
TYRONE AREA SCHOOL DISTRICT Middle School/High School Student Code of Conduct As a participant in any school-related activities in the Tyrone Area School District, I will follow the rules as listed below. I realize that violation of any of these rules will result in consequences as defined: 1. I will not use any tobacco products. 2. I will not drink alcoholic beverages. 3. I will not use any type of drug unless prescribed by a doctor. 4. I will not miss practice or scheduled meetings unless excused by a coach/advisor. 5. I will follow school district discipline policies. 6. I am responsible for all equipment/supplies issued to me. Any loss or damage other than that due to normal wear and tear to issued equipment/supplies is my responsibility. 7. I shall at all times conduct myself in a manner that will not cause embarrassment to the Tyrone Area School District, team, coaching staff, teachers, advisors, school directors, my parents, and the community as a whole. This may be considered a major or a minor infraction. (Example: Major Infraction Stealing; Minor Infraction Misconduct at a public event.) 8. I will use the transportation furnished by the school in going to and from games/activities. A student may be released to a parent or acting guardian after any away event/activity provided the parent gives the coach/advisor a written note prior the team leaving for the event. The student will only be released to the parent or acting guardian. No student will be released to ride with a parent of another minor, or any other relative unless prior approval from the principal is obtained. 9. I will be well groomed at all times. 10. Code of Conduct 1. All minor infractions of this code will be handled by individual coaches/advisors. Examples: Missing the team bus. Failure to turn in equipment/supplies. Missing a practice or scheduled meeting. 2. Repeated minor infractions will result in a two (2) week suspension from public participation. The student can appeal the offense to the principal. 3. All major infractions (tobacco, drug/alcohol, theft, etc.) will result in mandated drug and alcohol and/or another type of counseling in conjunction with a four (4) calendar week suspension from all public participation. The student may practice. 4. Failure to cooperate and participate with mandatory counseling will result in suspension from school activities for the remainder of the school year, or until the student cooperates and participates with the mandatory counseling. The student must serve four (4) weeks of suspension. 5. Secondary offenses of major infractions will result in suspension from activities for the remainder of the school year, or permanent exclusion from participation. 6. Penalties for not following school discipline policies: 1 st Saturday Morning Detention; Suspension from one (1) practice/meeting. 2 nd Saturday Morning Detention; Suspension from two (2) practices/meetings. 3 rd Saturday Morning Detention; Suspension from one (1) game/public participation. 4 th Saturday Morning Detention; Suspension from two (2) games/public participation. 5 th Saturday Morning Detention; Review Committee for a possible four (4) week suspension. 1 st Out-of-School Suspension Suspension from one (1) game/public participation. 2 nd Out-of-School Suspension Suspension from two (2) games/public participation. 3 rd Out-of-School Suspension Review Committee for a possible four (4) week suspension. Procedures 1. All investigations will proceed in the timeliest fashion possible. 2. Parental participation in any investigation will begin at the first available opportunity. Parents will be notified in writing or by telephone. 3. Investigations will be directed by the middle school and/or high school administration in cooperation with the athletic director, coaches and/or advisors. 4. A review committee (consisting of the assistant principal, athletic director, three (3) coaches, three (3) advisors) will determine the merit of each individual case. 5. An appeal (by the student or parent) can be made to the principal who will forward the appeal to the School Board Student Activities and Services Committee. The Committee will review the evidence and render its decision. If appealed, the penalty is delayed and the student may participate in activities pending outcome of appeal. 5

Once a student declares his/her intent to participate in an athletic, extracurricular, and/or privileged activity, he/she is covered by this code until such time the parent/guardian notifies the High School Principal s Office in writing that the student is no longer a participant 2. Coaches/advisors are responsible for holding meetings with students and parents to specifically review the Activities Code. 3. Well-groomed and embarrassment is defined by coaches, advisors and administrators on an individual sport or activity basis. 6

Student participants who are randomly selected will provide a urine sample that will be tested for marijuana, PCP, amphetamines, cocaine, opiates, barbiturates, and alcohol, as well as any other substances that are considered illegal, illicit or controlled substances under any federal or state law. The testing will be cosupervised by laboratory/hospital personnel and Tyrone Area School District personnel. We will observe all the legal rules for chain of custody at both the collection and analysis sites. The superintendent and middle school/high school principal will receive a confidential report of the test results. All parents/guardians will receive written notification whether their students test positive or negative. The test is to be used as a deterrent rather that as a disciplinary tool. However, students who test positive will be notified by the principal and will be: 1. Required to meet with the principal and with his or her parents/guardians. 2. Required to participate in the District's Student Assistance Program and complete a drug and alcohol evaluation. 3. Required to comply with the drug and alcohol evaluator's recommendations as failure to comply will result in dismissal from the activity. 4. Required student disqualification from further participation in the activity or privilege as outlined in this policy (as per Board Policy 227.1 Drug and Alcohol Testing For Student Participants) 5. Required to be retested, with a negative result, before resuming participation in activity or privilege or starting a new activity or privilege. Should any student refuse to submit a sample for testing, he or she will be disqualified from participation in the activity, which will be treated as a first offense. Throughout the school term, we will randomly select, by computer, student participants for testing. Students may be randomly selected for testing more than once during the school term. Testing may be mandated by school administration at any time throughout the school term for any student thought to be using illegal substances. The test will not be announced prior to the actual date of screening. Test results will be held in strict confidence. We will continue to follow our School District Board Policy No. 227 on Drug Awareness concerning the use, possession, or distribution of illegal substances on school premises. 7
