1 Sunnyvale Independent School District DrugTesting and Rehabilitation Program

2 DrugTesting Program Overview The District requires drug testing of any student in grade 912 who chooses to participate in any schoolsponsored extracurricular or cocurricular activity and/or park on campus. Any student, grades 712, who would otherwise not be required to submit to drugtesting may voluntarily agree to participate in this program with the written consent of his or her parent/guardian. A parent/guardian may enroll their minor child in this program, regardless of participation in covered activities, by signing the appropriate consent form. For more information, students and parents may refer to policy FNF(LOCAL). A copy of the policy may be obtained from the principal s office, the central administration office, or through Policy On Line at the following address: Purpose Drugs Targeted The laboratory shall test for the presence of barbiturates, amphetamines, benzodiazepines, cocaine, methoqualone (methadone), opiates (codeine, heroin, morphine, papaverine), tetrahydrocannabinoids (marijuana), propoxyphene, alcohol, inhalant panel, and metabolites of any of these substances. 1

3 DrugTesting Program Collection Procedures Personnel from the drugtesting laboratory shall collect urine samples under conditions that are no more intrusive than the conditions experienced in a public restroom. When selected for testing, a student shall be escorted to the school s testing site by a District employee and shall remain under employee supervision until the student provides a sample. Samples shall be produced by a student from behind a closed restroom stall. Random Testing Refusal to Test or Tampering A student who refuses to be tested when selected or who is determined to have tampered with a sample shall be deemed to have a positive test result and shall be subject to the appropriate consequences depending on previous positive test results, if any. If a student is absent on the day of the random test, a sample shall be collected on the next random testing date. Positive Test Results An initial positive test shall be confirmed by a second test of the same specimen before being reported as positive. The drugtesting laboratory shall notify the district s drugtesting coordinator of the results. Upon receiving results of a positive drug test, the drugtesting coordinator shall schedule a meeting with the student, the student s parent if the student is under the age of 18, and the coach or sponsor of the extracurricular activity to review the test results and discuss consequences. The student or parent shall have three school days following the meeting to provide a medical explanation for a positive result. Consequences Consequences of positive test results shall be cumulative through the student s enrollment while in high school. A student who has a confirmed positive drug test shall be subject to the following consequences: First Offense 2

4 DrugTesting Program 2. The student shall complete an accredited drugeducation program. The drugtesting coordinator shall monitor the student s attendance in the program. 3. Second Offense During the period of suspension, the student may participate in practices but not in any competitive activities or performances The student shall attend a drugcounseling program that includes a social/chemical assessment 4. If the student wishes to return to participation in covered activities or resume parking on campus the student must be retested at the next random testing date. The student shall be retested on all random test dates for the remainder of the school year. 5. Third Offense 3

5 DrugTesting Program After the third offense, the student shall be suspended from any covered activity and his or her parking permit shall be revoked for 45 school days following the date the student and parent/guardian are notified of the test results. For purposes of calculating the period for which a student is suspended from covered activities or for which a student s parking permit is revoked, only those days on which school is in session shall be counted as school days. Weekends and holidays shall not be counted as school days. During the period of suspension, including any offseason time, the student shall not be permitted to participate in practices, be in contact with the activity sponsor, or and use any equipment associated with the activity. Additionally, the following criteria shall be met prior to reinstatement to any covered activities and of parking privileges: If the student wishes to return to participation in covered activities or resume parking on campus, the student must be retested at the end of the period of suspension and have a negative test result; the student shall be retested on all random test dates for the remainder of the school year. Fourth and Any Subsequent Offense After the fourth offense and any subsequent offenses, the student shall be suspended from any covered activity and his or her parking permit shall be revoked 180 school days following the date the student and parent/guardian are notified of the test results. For purposes of calculating the period for which a student is suspended from covered activities or for which a student s parking permit is revoked, only those days on which school is in session shall be counted as school days. Weekends and holidays shall not be counted as school days. During the period of suspension, including any offseason time, the student shall not be permitted to participate in practices, be in contact with the activity sponsor, or use any equipment associated with the activity. 4

6 DrugTesting Program End of Semester Suspensions If a student s suspension from participation in covered activities and parking privileges is not complete by the end of the semester, the student shall complete the assigned period of suspension during the following semester or during the first semester of the following school year. 7 DrugTesting Program Retest Appeals Appeals regarding the provision of this policy shall be in accordance with FNG(LOCAL). The student shall be ineligible for participation in extracurricular activities while the appeal is pending. 6

I understand that failure to comply with the policies and procedures of the Sunnyvale ISD DrugTesting and Rehabilitation Program may lead to dismissal from my extracurricular activity, cocurricular activity, and/or loss of parking privileges on school campus.
