Executive Summary Overview In accordance with Texas Occupations Code 1701.304, the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE) administers two basic licensing examinations. The basic peace officer and basic county corrections exams are administered electronically by 67 exam sites throughout the state (including the Austin office). Section 1701.254 of the Texas Occupations Code requires TCLEOSE to evaluate training providers based on the scores from the basic licensing courses. TCLEOSE has implemented Rule 215.13 to be used to determine whether training providers conducting basic licensing course are at-risk. These licensing exams are based on the current basic curricula with a required first attempt pass rate for all students attempting the exam. A law enforcement academy may be found at risk and placed on at-risk probationary status if after September 1, 2009 the passing rate on a licensing exam for first attempts for any three consecutive state fiscal years, beginning with state fiscal year 2007 (September 1, 2006 through August 31, 2007) is less than 80 percent of the students attempting the licensing exam. This three year standard is calculated on a revolving basis. For example, for fiscal year 2010 the three year pass rate will be based on all students attempting the exam from September 1, 2007 through August 31, 2010. Passing percentages for 157 training providers conducting either the basic peace officer and/or basic county corrections officer training course(s) have been calculated and reported utilizing the rosters and exam dates during this evaluation period. Basic Peace Officer Examinations In the three state fiscal years (2007, 2008, and 2009) there were 12,418 first attempts among 76 training providers for the basic peace officer licensing exam. Of those providers 73 met or exceeded the 80 percent average for first attempts during three fiscal years. Academic Alternative Basic Peace Officer Examinations In the three state fiscal years (2007, 2008, and 2009) there were 96 first attempts among nine training providers for the basic peace officer licensing exam. Of those providers six met or exceeded the 80 percent average for first attempts during three fiscal years. Basic County Corrections Examinations In the three state fiscal years (2007, 2008, and 2009) there were 10,315 first attempts among 69 training providers for the basic county corrections officer licensing exam. Of those providers 59 met or exceeded the 80 percent average for first attempts during three fiscal years. Page 3 of 23

Distance Basic County Corrections Examinations In the three state fiscal years (2007, 2008, and 2009) there were 183 first attempts among three training providers for the basic county corrections officer licensing exam. Of those providers two met or exceeded the 80 percent average for first attempts during three fiscal years. Providers Not Meeting Requirements Results Basic Peace Officer Examinations During fiscal years 2007 through 2009, there were two training providers that did not meet the 80 percent requirement for the basic peace officer first attempts. Academic Alternative Basic Peace Officer Examinations During fiscal years 2007 through 2009, there were three training providers that did not meet the 80 percent requirement for the basic peace officer first attempts. These providers have already surrendered their license. Basic County Corrections Examinations During fiscal years 2007 through 2009, there were nine training providers that did not meet the 80 percent requirement for the basic county corrections officer first attempts. As part of their management response, two providers stated they would no longer offer the program and therefore no administrative action will be required. Distance Basic County Corrections Examinations During fiscal years 2007 through 2009, there was one distance training provider that did not meet the 80 percent requirement for the basic county corrections officer first attempts. As part of their management response, the provider stated they would no longer offer the program and therefore no administrative action will be required. TCLEOSE will seek administrative action against training providers based on the following statutory and/or rule requirements: The Texas Occupations Code Section 1701.254(c)(1-2) states: "(c) The risk assessment method must: (1) consider the scores of students enrolled in a school on the basic peace officer examination; (2) consider the past inspection records of a school." The Texas Occupations Code Section 1701.251 (c)(1) states: "(c) The commission may: (1) issue or revoke the license of a school operated by or for this state or a political subdivision of this state specifically for training officers, county jailers, or recruits." Commission Rule 215.13(e) states: "...The commission may take action to revoke their license or contract. The commission may choose not to renew a license or contract with a program that has been found to be at risk or the commission may renew the contract for a shorter period than stated in section 215.1 of this title." Commission Rule 215.3(i)(1) states: "The commission may revoke an academy license if: (1) the academy has been classified as at risk for a 12-month period without substantial improvement." Ten training providers are subject to administrative action: two training providers for failing to meet the 80 percent first attempt pass rate on the basic peace officer examination for the three fiscal year period 2007-2009; eight training providers for failing to meet the 80 percent requirement on the basic county corrections examination for the three fiscal year period 2007-2009.
