Vacancy Rebate Supporting Documentation Checkist The foowing documents are required and must accompany the vacancy rebate appication at the time of submission. If the vacancy is a continuation from the previous term, supporting documentation must be resubmitted. Refer to the checkist beow to ensure a required documents are submitted with your appication. Mandatory for a appications: Sketches Previous Tenant Lease(s), and Lease Amendments/Extensions Monthy Rent Ro(s)/Letter If Appicabe: Rea Estate Listing(s) (Commercia Tax Cass Ony) Agent Letter of Authorization (Not appicabe to Lawyers/Paraegas) Letter for Units/Buidings previousy Owner Occupied OR Never Tenanted New Tenant Lease(s) Termination Notice(s)/Letter(s) Sworn Affidavit Note: A maximum of two appications may be submitted per year per property. Interim appications for vacancies during the first six months of the year must be received by Juy 31 st of the year for which the appication is being made. Fina appications must be received by the ast day of February of the year foowing the taxation year to which the appication is made. Appications reated to omitted assessments must be received within 90 days of the maiing date of the Property Assessment Change Notice. A vacancy appications must be dated and signed by the appicant and a required fieds on the appication must be competed in fu. (See reverse for additiona information)

Sketches: Required for a unit(s) isted on the appication. Sketches must incude the property address, unit number, square footage and/or dimensions which refect the size of the unit area during the vacancy period. Sketches are required to assist the City and MPAC (Municipa Property Assessment Corporation) in determining the appicabe assessment vaue for the vacant space. Pease note: In ieu of a sketch, stacking pans are acceptabe. Previous Tenant Lease(s): The ease(s), amendment(s) and/or extension agreement(s) must contain the foowing information: Landord and tenant name(s), property address (inc. unit number and/or buiding number if appicabe), square footage, ease term (commencement and expiry date), signature page(s) and any page(s) with sections that aow rent free use and/or fixturing periods. Note: Ony the ease pages containing this information are required. Monthy Rent Ro(s): Monthy rent ro(s) commencing two months prior to the vacancy start date and ending the first month after the vacancy period ends are required. The rent ro(s) must ist the foowing detais: property address, tenant name, unit number, buiding number, ease term and square footage. Note: Ony the pages containing the units isted on the vacancy rebate appication are required. In the event monthy rent ro(s) do not exist, the City must be notified in writing. Rea Estate Listing(s): A copy of the rea estate agent s isting agreement or newspaper/internet advertisement is required and must contain the date of the advertisement and must fa within the vacancy caim period. Note: Signage is not acceptabe. Agent Letter of Authorization: If an agent/consutant is submitting an appication on behaf of the property owner, a etter of authorization signed by the owner is required. The etter must specify the agency that is representing them and which tax year(s) the authorization appies to. Letter for Unit(s)/buiding(s) previousy Owner Occupied OR Never Tenanted: A detaied etter from the appicant is required if a vacant unit/buiding was previousy owner occupied OR has been vacant since the date of purchase. New Tenant Lease(s): If the vacant unit/buiding has become occupied subsequent to the vacancy, a copy of the new ease must be submitted. Refer to Previous Tenant Lease(s) for the required ease pages. Termination Notice(s)/Letter(s): A copy of the Termination Notice(s)/Letter(s) is required for any broken ease. Sworn Affidavit: Where documentation supporting the vacancy tax rebate appication does not exist, an appicant must submit an affidavit. Appication for Rebate of Property Taxes for Vacancies in Commercia and Industria Buidings Eigibiity Criteria For compete information about eigibiity and appication requirements, refer to section 364 of the Municipa Act and Ontario Reguation 325/01, as amended. Category 1 - Buidings that are entirey vacant A whoe commercia or industria buiding wi be eigibe for a rebate if: the entire buiding was unused for at east 90 consecutive days Category 2 - Buidings that are partiay vacant A suite or unit within a commercia buiding wi be eigibe for a rebate if, for at east 90 consecutive days, it was.. not used for any purpose; and ceary deineated or physicay separated from the used portions of the buiding; and either - capabe of being eased for immediate occupation, or - undergoing or in need of repairs or renovations that prevented it from being avaiabe for ease for immediate occupation, or - unfit for occupation A portion of an industria buiding wi be eigibe for a rebate if, for at east 90 consecutive days, it was: not used for any purpose; and ceary deineated or physicay separated from the used portions of the buiding. Excusions A buiding or portion of a buiding wi not be eigibe for a rebate if: it is used for commercia or industria activity on a seasona basis; during the period of vacancy it was subject to a ease, the terms of which had commenced; or during the period of vacancy it was incuded in a sub-cass for vacant and. If this appication is for an omitted assessment pease attach a copy of the omitted assessment notice from MPAC REFUNDS As taxes are a ien on property, adjustments resuting from vacancy rebates are appied to the property tax account at the time of determination. If you have an outstanding vacancy appication and are seing your property, pease ensure your awyer makes provision for readjustment of taxes subsequent to your cosing. Affidavit Guideines And Requirements An affidavit (sworn before a Commissioner or Notary Pubic) is required where supporting documentation for the vacancy tax rebate appication does not exist. The affidavit must reference that an appication is being made pursuant to Section 364 of the Municipa Act, 2001 and Ontario Reguation 325/01and must indicate the name and City of residence of the person who is swearing the affidavit. (A person with persona knowedge of the facts must swear the affidavit). The origina Affidavit must be submitted. Copies wi not be accepted. Affidavit must identify the foowing detais: Mandatory Property address; Assessment ro number; Taxation year for which appication is being made; Vacant unit(s) or description of vacant area(s); Previous tenant name and origina terms of the ease; Vacancy period(s); Square footage of vacant area(s); Confirmation that the required document(s) do not exist; Name, address, teephone number, and officia sea (if appicabe) of the individua notarizing the affidavit; Date and City where the affidavit is sworn; Name, phone number, signature, Tite, Company name of Appicant or Authorized Representative swearing the affidavit. If Appicabe Where neither a rent ro or ease exists, a statement detaiing the reason the documentation is not avaiabe and detais of ast tenancy; Where a tenant has broken the terms of their ease, confirmation of the specific date the ease was terminated by the andord; Where neither a copy of a rea estate agent s isting agreement or newspaper/internet advertisement exists, a statement detaiing what form of advertisement was undertaken and the period of time the property was advertised for ease.
