Mutipe signatures, eectronic check conversion, and simiar transactions - An eectronic check conversion transaction is a transaction where a check or simiar item is converted into an eectronic fund transfer as defined in the Eectronic Fund Transfers reguation. In these types of transactions the check or simiar item is either removed from circuation (truncated) or given back to you. As a resut, we have no opportunity to review the check to examine the signatures on the item. You agree that, as to these or any items as to which we have no opportunity to examine the signatures, you waive any requirement of mutipe signatures. OWNERSHIP OF ACCOUNT AND BENEFICIARY DESIGNATION - These rues appy to this account depending on the form of ownership and beneficiary designation, if any, specified on the account records. We reserve the right to refuse some forms of ownership on any or a of our accounts. Joint Account - With Survivorship (And Not As A Tenancy By The Entirety Or As Tenants In Common) - is an account in the name of two or more persons. Each of you intend that when you die the baance in the account (subject to any previous pedge to which we have agreed) wi beong to the survivor(s). Beneficiaries cannot withdraw uness: (1) a persons creating the account die, and (2) the beneficiary is then iving. You must make any stop-payment order in the manner required by aw and we must receive it in time to give us a reasonabe opportunity to act on it before our stop-payment cutoff time. Because stop-payment orders are handed by computers, to be effective, your stop-payment order must precisey identify the number, date, and amount of the item, and the payee. You shoud be aware that anyone hoding the item may be entited to enforce payment against you despite the stop-payment order. TELEPHONE TRANSFERS - A teephone transfer of funds from this account to another account with us, if otherwise arranged for or permitted, may be made by the same persons and under the same conditions generay appicabe to withdrawas made in writing. Uness a different imitation is discosed in writing, we restrict the number of transfers from a savings account to another account or to third parties, to a maximum of six per month (ess the number of "preauthorized transfers" during the month). Other account transfer restrictions may be described esewhere. TRANSFER LIMITATIONS - For savings and money market accounts you may make up to six transfers or withdrawas by means of a preauthorized, automatic, or teephonic transfer to another account of yours or to a third party or by check, debit card, or simiar order to a third party during any caendar month (or statement cyce of at east four weeks). If the transfer or withdrawa is initiated in person, by mai, or at an ATM then there is no imit on the number of payments that may be made directy to you, directy to us for amounts you owe us, or transfers to other accounts you have with us. Withdrawas by phone are aso unimited if you are requesting that a check be maied to you. AMENDMENTS AND TERMINATION - We may change our byaws and any term of this agreement. Rues governing changes in rates are provided separatey in the Truth-in-Savings discosure or in another document. For other changes we wi give you reasonabe notice in writing or by any other method permitted by aw. We may cose this account if your membership in the credit union terminates, or by giving reasonabe notice to you and tender of the account baance personay or by mai. Items presented for payment after the account is cosed may be dishonored. When you cose your account, you are responsibe for eaving enough money in the account to cover any outstanding items and charges to be paid from the Reasonabe notice depends on the circumstances, and in some cases it might be reasonabe for us to give you notice after the change or account cosure becomes effective. For instance, if we suspect frauduent activity with respect to your account, we might immediatey freeze or cose your account and then give you notice. At our option, we may suspend your rights to member services if you vioate the terms of this agreement. You must keep us informed of your current address at a times. Notice from us to any one of you is notice to a of you. If we have notified you of a change in any term of your account and you continue to have your account after the effective date of the change, you have agreed to the new term(s). STATEMENTS - Statements are a vauabe too to hep prevent frauduent or mistaken transfers. Your statement wi show the transactions that occurred in connection with your account during the statement period. Your duty to report unauthorized signatures, aterations and forgeries - Your statement wi provide sufficient information for you to reasonaby identify the items paid (item number, amount, and date of payment). You shoud keep a record of each transaction as it is made so that when we give you the information in the statement, you wi have a compete understanding of each transaction isted. You have some responsibiities in connection with your statement. You must examine your statement with "reasonabe promptness." Aso, if you discover (or reasonaby shoud have discovered) any unauthorized signatures or aterations, you must prompty notify us of the reevant facts. As between you and us, if you fai to do either of these duties, you must bear the oss entirey yoursef or share the oss with us (we may have to share some of the oss if we faied to use ordinary care and if we substantiay contributed to the oss). The oss you might bear, in whoe or part, coud be not ony with respect to items isted on the statement, but aso other items with unauthorized signatures or aterations by the same wrongdoer. Of course, an attempt can be made to recover the oss from the thief, but this is often unsuccessfu. You agree that the time you have to examine your statement and report to us wi depend on the circumstances, but you wi not, in any circumstance, have a tota of more than 30 days from when we first send or make the statement avaiabe to you. You further agree that if you fai to report any unauthorized signatures, aterations or forgeries in your account within 60 days of when we first send or make the statement avaiabe, you cannot assert a caim against us on any items in that statement, and as between you and us the oss wi be entirey yours. This 60-day imitation is without regard to whether we exercised ordinary care. The imitation in this paragraph is in addition to those contained in the second paragraph of this section. Contact us if you do not receive your reguar statement. If this is a business account, you agree that you wi have at east two peope review your statements, notices, and returned checks, or in the aternative, the person who reviews these wi be someone who does not have authority to transact business on the Your duty to report other errors - In addition to the Commercia Code and other state aw, you agree there is a common aw duty to prompty review your statement for errors in addition to unauthorized signatures, aterations or forgeries. Prompty reviewing your statement is vauabe to both you and us because it can hep identify, correct and prevent future mistakes. In addition to your duty to review your statements for unauthorized signatures, aterations and forgeries, you agree to examine your statement with reasonabe promptness for any other error - such as an encoding error. You agree that the time you have to examine your statement and report to us wi depend on the circumstances. However, such time period sha not exceed 60 days. Faiure to examine your statement and report any such errors to us within 60 days of when we first send or make the statement avaiabe precudes you from asserting a caim against us for any such errors on items identified in that statement and as between you and us the oss wi be entirey yours. If a good reason (such as a ong trip or a hospita stay) kept you from teing us, we wi extend the 60 day time period to report other errors. If the debt arises from a note, "any due and payabe debt" incudes the tota amount of which we are entited to demand payment under the terms of the note at the time we charge the account, incuding any baance the due date for which we propery acceerate under the note. In addition to these contract rights, we may aso have rights under a "statutory ien." A "ien" on property is a creditor's right to obtain ownership of the property in the event a debtor defauts on a debt. A "statutory ien" is one created by federa or state statute. If federa or state aw provides us with a statutory ien, then we are authorized to appy, without prior notice, your shares and dividends to any debt you owe us, in accord with the statutory ien. Neither our contract rights nor rights under a statutory ien appy to this account if prohibited by aw. For exampe, neither our contract rights nor rights under a statutory ien appy to this account if: (a) it is an Individua Retirement Account or simiar tax-deferred account, or (b) the debt is created by a consumer credit transaction under a credit card pan (but this does not affect our rights under any consensua security interest), or (c) the debtor's right of withdrawa arises ony in a representative capacity. We wi not be iabe for the dishonor of any check or draft when the dishonor occurs because we charge and deduct an amount you owe us from your You agree to hod us harmess from any caim arising as a resut of our exercise of our right to repayment. The owner is responsibe for any transactions of the authorized signer. We undertake no obigation to monitor transactions to determine that they are on the owner's behaf. The owner may terminate the authorization at any time, and the authorization is automaticay terminated by the death of the owner. However, we may continue to honor the transactions of the authorized signer unti: (a) we have received written notice or have actua knowedge of the termination of authority, and (b) we have a reasonabe opportunity to act on that notice or knowedge. We may refuse to accept an authorized signer. RESTRICTIVE LEGENDS - The automated processing of the arge voume of checks we receive prevents us from inspecting or ooking for specia instructions or "restrictive egends" on every check. We may determine the amount of avaiabe funds in your account for the purpose of deciding whether to return an item for insufficient funds at any time between the time we receive the item and when we return the item or send a notice in ieu of return.
