Settled on confidential terms favorable to the client. 2008 Tax Shelter Litigation $20+ million in settlements in litigation against law firms and accounting firms for negligent tax advice to numerous clients. 2007 Riggs v. Jenkens & Gilchrist, P.C. $81.5 million class settlement in legal malpractice claim arising out of tax shelter advice. Represented a class representative and acted as class co-counsel. Lead class counsel was David Deary of Dallas, Texas. 2006 Lane s Gifts & Collectibles v. Google $90 million + technology audit of Google click-fraud technologies. Class counsel in action against Google, Yahoo! Inc. and other search engines for claims arising out of clickfraud. Settlement included Google s agreement to submit its pay-per-click monitoring efforts to evaluation by an independent expert. 2005 Texas Treasure Fields v. Corona, et al. Confidential settlement. Represented client in claims arising out of the largest residential fire in U.S. history. Home on the market for $44.5 million was completely destroyed by fire. Settled on confidential terms favorable to the client. 2003 Davis v. Shlishi Confidential settlement. Represented the family of Dallas firefighter Vincent Davis, killed in the line of duty as the result of negligent construction practices. 2002 Frentzen v. Continental Airlines Confidential settlement. Retained with Dallas lawyer John Howie by the surviving relatives of 17 passengers killed in the crash of the Air France Concorde at Charles DeGaulle Airport, Paris, France, in July 2000, to represent them in litigation in the United States. Global settlement reached by German co-counsel on terms favorable to the clients. 7
2001 Doe v. Doe $100+ million. Concluded 10 year representation of a Dallasbased oil & gas exploration company in an oil field operation dispute. Client s total recovery, including debt forgiveness, exceeded $100 million, before attorney s fees. AFRICA EXPERIENCE Since 1991, I have been involved in numerous matters involving African mining interests, including diamond and titanium mines in Sierra Leone; copper, cobalt, zinc, and diamond mines in The Democratic Republic of the Congo; mineral sands deposits in Madagascar; zinc deposits in Zambia; marine diamond mining in Namibia; and diamond deposits in Angola. Since 2002 I have represented the government of the Democratic Republic of the Congo in various actions involving debt collection litigation brought by U.S.-based vulture funds and expropriation claims brought against the Congo for the alleged unlawful expropriation of a gold mining operation in the Congo. In 2006 I was the founding chairman of Empower African Children and served in that role until 2007. I was asked in 2008, to resume that position. 2005-2011 - FG Hemisphere Associates, LLC v. The Congo and S.N.E.L. Engaged by the Democratic Republic of the Congo to defend against efforts by U.S.-based vulture funds to execute on Swiss Arbitration Awards arising out of a sovereign debt default action. Successfully defended against efforts to execute on judgment by seizure and forced sale of diplomatic properties. 2004-2007 - Adastra Minerals Inc. v. Empresa Nacional de Diamantes de Angola, E.P. Engaged by Adastra Minerals Inc. and IDAS, its wholly owned subsidiary, to pursue a claim against Empresa Nacional de Diamantes de Angola, E.P. the Angolan State diamond company, for unlawful expropriation of a mining concession in Angola. 2002-2003 - Red Mountain Finance, Inc. v. The Congo and Central Bank of the Congo Engaged by the Democratic Republic of the Congo to negotiate resolution of sovereign debt arrears judgments of the High Court of Justice, Queens Bench Division, Commercial Court London. Settlement of the claims 8
facilitated an International Monetary Fund Poverty Reduction and Growth Facility of approximately US $750mm and a Belgian, French, South African and Swedish contribution of a bridge loan to clear the debt arrears of approximately $450mm with the International Monetary Fund. 2002 - Banro Resources Corporation v. The Democratic Republic of the Congo Engaged by the Democratic Republic of the Congo to defend it against claim of expropriation of gold mining assets. Settled by the government on favorable terms. 1998 - America Mineral Fields v. Anglo American Corporation of South Africa Retained to pursue tortious interference claims against Anglo American Corporation of South Africa:, DeBeers Consolidated Mines, and affiliated entities arising out of a mining project agreement between America Mineral Fields and the Democratic Republic of the Congo for a copper/cobalt mine.
