1. INTRODUCTION 1.1 The abuse or illegal use or illegal possession of alcohol, illegal drugs or other substances by learners or staff at St Andrew s is prohibited. 1.2 The abuse or overuse of scheduled medication by learners or staff at St Andrew s is prohibited. 1.3 While St Andrew s is not obliged to assist learners or staff in the use or overuse of scheduled medications or in overcoming addictions to alcohol, drugs or any other substance, it may, with appropriate cooperation and authority of a member of staff, a learner and the parents of the learner, as the case may be, assist an addicted person in overcoming the addiction and their rehabilitation. 2. PURPOSE The purpose of this Policy is to establish the principles: 2.1 Governing the protection of learners at St Andrew s from exposure to the abuse, illegal possession and/or illegal use of alcohol and illegal drugs, scheduled medication and/or other substances; and 2.2 St Andrew s approach to assisting learners and staff who have become addicted to the use of alcohol and illegal drugs, scheduled medication and/or other substances to overcome their addiction. 3. SCOPE This policy applies to all learners, parents and staff at St Andrew s or third parties while on the St Andrew s campus or attend any activity that may fall under the control of St Andrew s. 4. GLOSSARY OF TERMS Unless inconsistent with the context, the expressions set out in this policy will have the meanings assigned to them in the glossary of terms applicable to all policies, procedures, standards and guidelines adopted and published by the St Andrew s Information Security Committee ( ISC ). The Glossary of terms shall be available on the St Andrew s website (http://www.standrews.co.za/ckfinder/userfiles/files/glossary.pdf). 5. STATEMENTS General 5.1 The Combined Management Committee of St Andrew s shall be responsible for promoting compliance with this Policy and establishing appropriate procedures for the management of any interventions, including, without limitation, testing for the use of alcohol, illegal drugs and substances, the counselling and rehabilitation of learners and staff who may have become addicted to the use of alcohol, illegal drugs and substances and any disciplinary actions that may become necessary in terms of this Policy. 5.2 In fulfilling its oversight obligation the Combined Management Committee shall: 5.2.1 appoint persons who will be directly responsible for ensuring that the procedures developed are implemented, monitored and regularly reported on to the Combined Management Committee; 5.2.2 appoint professionals properly qualified to deal with alcohol, drug or substance abuse, which professionals may be members of St Andrew s staff or third parties engaged by St Andrew s for this purpose. 5.3 The Combined Management Committee shall develop procedures and standards to support this Policy, with particular reference to and without limitation: 5.3.1 education; 5.3.2 reporting of contraventions of this Policy; 5.3.3 the lawful search for, and if appropriate, seizure of alcohol and/or illegal drugs or substances; 5.3.4 testing for illegal substances; 5.3.5 where appropriate interaction with parents of learners; 5.3.6 counselling and rehabilitation; and 5.3.7 appropriate disciplinary action. Prohibition of use of Illegal Drugs or Substances 5.4 The consumption or use by learners enrolled at St Andrew s of alcohol or any illegal drug or substance is prohibited. 5.5 The abuse or inappropriate use of alcohol by educators or parents, alternatively the consumption or use of any illegal drug or substance by educators or parents while on the St Andrew s campus is prohibited. 5.6 The abuse or inappropriate use of alcohol, alternatively the consumption or use of any illegal drug or substance, by educators, parents or third parties while on the St Andrew s campus, alternatively while they are in the presence of St Andrew s learners at any official educational, sporting, cultural, recreational or social activity under the control of St Andrew s, whether within or outside of the St Andrew s campus is prohibited. Abuse or Overuse of Scheduled Medication 5.7 The abuse or overuse of scheduled medication by learners, parents or St Andrew s staff while on the St Andrew s campus, or in any activity that may fall under the control of St Andrew s is prohibited. 5.8 If the abuse or overuse of scheduled medication by any person that adversely affects learners, parents, St Andrew s staff or third parties while on the St Andrew s campus or during the course of any activity under the control of St Andrew s, an educator appointed by St Andrew s may take appropriate action to remove the user from the person s being adversely affected. 5.9 If the person abusing or overusing scheduled medication is a learner at St Andrew s the provisions relating to Investigation, Search and Seizure, Testing, Rehabilitation, Counselling and Disciplinary Measures, as defined in this policy, will all apply to dealing with the abuse or overuse of the scheduled medication, as may be appropriate. Sale or Purchasing of Alcohol or any Illegal Drug or Substance 5.10 The illegal sale or purchasing of alcohol, drugs, scheduled medication or substances on the St Andrew s campus, alternatively any official educational, sporting, cultural, recreational or social activity under the control of St Andrew s, whether within or outside of the St Andrew s campus, is prohibited. 5.11 The legal sale of alcohol on the St Andrew s campus shall only be permitted on the prior written authority of persons appointed by the Combined Management Committee to authorise the sale. Educational Programmes 5.12 The Combined Management Committee shall, on an ongoing basis, ensure that St Andrew s learners, staff and parents are provided with information addressing the abuse of alcohol and illegal drugs and substances as well as the abuse or overuse of scheduled medication and are engaged in educational programmes aimed at the protection of learners against the abuse of alcohol and the use of illegal drugs and substances or the abuse or overuse of scheduled medications. Reporting 5.13 Educators, parents and learners must be encouraged to report contraventions of this Policy and may do so to any educator at St Andrew s. 5.14 The name and the details of a person reporting a contravention of this Policy shall remain confidential unless the law requires that the name of the person reporting the contravention is disclosed. Investigation 5.15 The Combined Management Committee shall develop procedures allowing for the reporting of any contravention of this Policy, ensuring that the rights of confidentiality and, in the case of learners, to be represented by their parents are observed. 5.16 These procedures shall take account of: 5.16.1 The lawful search for any alcohol, illegal drugs and substances; 5.16.2 the lawful seizure and secure retention of any alcohol, illegal drugs and substances; 5.16.3 if applicable, the lawful testing for the use of alcohol, illegal drugs or substances; 5.16.4 proper consideration of the circumstances of the person; 5.16.5 notice to parents. 5.16.6 the person who may be found to have abused alcohol, scheduled medication, illegal drugs or substances and the obligations of St Andrew s in terms of any legislation governing the control of alcohol or illegal drugs or substances. Search and Seizure 5.17 The Combined Management Committee, acting under the authority of the Head, is authorised in terms of appropriate provisions of the South African Schools Act to, without the consent of parents of a learner, where a learner may be subject to a search, to conduct a search for alcohol or illegal drugs or substances. 5.18 In terms of the South African Schools Act the prior consent of the parent of the learner in the case where a learner may be searched, shall not be required. 5.19 If alcohol or illegal drugs or substances are found in the possession of a learner these must be seized. Testing 5.20 The Combined Management Committee, acting under the authority of the Head, if it deems appropriate and as may be required by law, shall order the appropriate testing for the use of alcohol or illegal drugs or substances. 5.21 In terms of the South African Schools Act the prior consent of the parent of a learner in the case where a learner may be tested, shall not be required. 5.22 In accordance with section 8A of the South African Schools Act, the Head or his/her delegate may administer a urine or other non-invasive test to any learner or group of learners that is on fair and reasonable grounds suspected of using illegal drugs. Rehabilitation, Counselling and Disciplinary Measures 5.23 The Combined Management Committee, on determining that a contravention of this Policy has occurred, must seek to ensure that disciplinary measures are aimed primarily: 5.23.1 the deterrence of a further contravention of this Policy; and 5.23.2 if there is evidence of an addiction to alcohol and/or illegal drugs or substances, to the assistance, counselling and rehabilitation of the person suffering the addiction is made available. 5.24 Particularly in the event that there is evidence of an addiction, disciplinary procedures should not be retributive or if they are retributive, should be suspended conditionally upon the person suffering the addiction cooperating in the efforts to assist, counsel and rehabilitate such person. 6. PARENTS OBLIGATIONS 6.1 Parents of learners at St Andrew s shall not use alcohol inappropriately while in the presence of learners or at any official educational, sporting, cultural, recreational or social activity under the control of St Andrew s. 6.2 Parents shall use their best endeavours to ensure compliance with this Policy by their children while they are learners at St Andrew s. 7. ENFORCEMENT OF THIS 7.1 The terms of this policy or other policies which may support this policy shall have the force of a contractual agreement between St Andrew s, its staff, its learners (duly assisted by their parents) and parents of learners. 7.2 Enforcement and compliance with this policy shall be monitored by persons appointed by the Combined Management Committee and failures to comply with this Policy will be investigated by the persons so appointed. 7.3 Subject to the provisions of sections 5.20 and 1 (dealing with rehabilitation and counselling), if disciplinary proceedings are appropriate, they will conducted in terms of the formal disciplinary procedures, as detailed in the Acceptable Conduct Policy in force at St Andrew s from time to time. 7.4 The contravention of this Policy constitutes an offence which requires it being reported to any law enforcement agency, the Administrator will prepare the necessary information and provide it to the Combined Management Committee and the Head (and in the absence of the Head for whatever reason, the Deputy Head of the Senior School) before the offence is reported. 8. 8.1.1 monitor and review this Policy and procedures relating to this Policy and where necessary amend this Policy or the procedures on a regular basis but at least once every year. 8.1.2 maintain a revision history of this Policy in the schedule appended to this Policy entitled Revision History - Drug, Alcohol and Substance Abuse Policy.
