Warranty Program NORDYNE offers an Expressed (Limited) Warranty on all products that it manufacturers and/or sells. This warranty is extended to the end user (Consumer) of the product. The warranty is provided in a written form and tells the end user what the warranty covers. The warranty statement spells out specifically what is or is not included with the product that was purchased. In some states the consumer has additional protection/coverage under the laws of that state which apply only to that specific state. Warranties are either Implied or Expressed. The NORDYNE warranty is an Expressed Warranty, in that it states specifically what is covered under the warranty offer. However, there are Implied Warranties with the product in that they say to the consumer that the product being purchased is merchantable and is fit for the purpose in which it was designed. The NORDYNE Warranty, in addition to being Expressed, is also limited in that it spells out the limitation of the warranty. The distributor and/or Retailer of NORDYNE products is not authorized to offer a warranty on a NORDYNE product other than what is stated on the printed warranty statement provided with the product. It is the retailer s ultimate responsibility to explain to the consumer the warranty s provisions on the product that the consumer purchases from the retailer. It is also the practice of the retailers to provide added value to the product when they install said product to or in the consumer s home. The added value could be one of many items, such as providing a quality installation, providing service after the sale of the product or taking the responsibility of assisting the consumer in resolving any complaints associated with the product and, more specifically, the installation of the product. The distributor enhances the added value of the retailer by providing the retailer with a convenient outlet for obtaining NORDYNE products, replacement parts and warranty administration. The administration of the NORDYNE warranty is a partnership. NORDYNE provides the distributor with the tools to administer the warranty at a local level. These tools are: 1. EPAY and Labor Credit Programs and Procedures. 2. Warranty Claim Procedures. 3. Warranty Support. 4. Warranty Policy on each Product. 0140-0211 Warranty Page 1

LIMITED PARTS WARRANTY Air Conditioning, Heating and Ventilating Equipment Designed For THIS WARRANTY IS EFFECTIVE ON EQUIPMENT MANUFACTURED AFTER JANUARY 1, 2011 STANDARD ONE YEAR LIMITED PARTS WARRANTY: NORDYNE extends a Standard Limited Warranty on the parts of manufactured housing equipment for a period of one year from the original purchase date by the original purchasing homeowner only. One Year Parts Warranty If any part fails due to defects in materials or workmanship under normal use within one year from the date of original purchase, a replacement part will be provided free of charge except for the freight costs which are the owner s responsibility. Labor and service charges will be paid to a servicer, up to the maximums established from time to time in the service rate schedule on the NORDYNE warranty labor claim form, where replacement of an in-warranty part is involved. Labor is covered for a period of one (1) year. Any labor or service charges in excess of these allowances are the responsibility of the homeowner. NORDYNE will not pay for parts purchased in the field from other than a NORDYNE distributor. Replacement parts are warranted only for the balance of the original warranty period. Compressor Warranty (Split Systems) NORDYNE will provide a replacement compressor should the compressor fail due to defects in materials or workmanship during the first five (5) years from the date of original purchase. During the first year of operation, NORDYNE will pay warranty costs as stipulated under our One Year Parts Warranty; during the second through fifth years of installation, NORDYNE will provide a replacement compressor free of charge but the homeowner is responsible for freight and labor charges incurred in the removal of the defective compressor and the installation of the new compressor. Replacement compressors are warranted only for the balance of the original warranty period. Compressor Warranty (P* and Q* Package Systems) NORDYNE will provide a replacement compressor should the compressor fail due to defects in materials or workmanship during the first ten (10) years from the date of original purchase. During the first year of operation, NORDYNE will pay warranty costs as stipulated under our One Year Parts Warranty; during the second through tenth years of installation, NORDYNE will provide a replacement compressor free of charge but the homeowner is responsible for freight and labor charges incurred in the removal of the defective compressor and the installation of the new compressor. Replacement compressors are warranted only for the balance of the original warranty period. Heat Exchanger Parts Coverage for Gas/Oil Furnaces: Gas: High-Efficiency Gas/Electric Package Unit Heat Exchangers - R(-) Series - 10 year limited warranty Gas/Oil: High-Efficiency Upflow or Downflow Furnace Heat Exchangers - 10 year limited warranty HEAT EXCHANGER (GAS AND OIL FURNACES): Heat exchangers which fail due to rust are excluded from this coverage if a self contained air conditioner was connected to the furnace duct without installing a proper close-off damper on the furnace. If the heat exchanger in this appliance fails due to a defect in material or workmanship after the expiration of the first year of coverage on the part, but within the second through tenth year of the part, NORDYNE will provide a NORDYNE distributor a replacement heat exchanger at no charge which will be provided to an authorized service firm for installation into the original appliance. Freight charges for the heat exchanger are the responsibility of the owner/user of the appliance. Labor charges to replace the heat exchanger after the first year are the responsibility of the owner/user of the appliance. APPLIANCE TRADE-IN OPTION: If a replacement heat exchanger is not available for this model furnace, NORDYNE will not issue a refund for the furnace, but will issue a credit to a NORDYNE distributor for the heat exchanger. The credit will be passed to the service firm and then to the user/ owner of the appliance and be applied to the purchase of a new furnace. CONDITIONS AND EXCLUSIONS The Limited Warranty only applies if the following conditions are met: 1. The air conditioner/heat pump/furnace/air handler and/or accessories must be installed by a licensed or otherwise qualified dealer or contractor. 2. The air conditioner/heat pump/furnace/air handler and/or accessories must be installed in accordance with NORDYNE s installation instructions and in compliance with local codes. Improper installation may endanger the occupants of the dwelling. 3. The air conditioner/heat pump/furnace/air handler/accessories and/or replacement parts must be operated in accordance with NORDYNE s operating instructions provided with each unit. The product must not be misused. 4. The air conditioner/heat pump/furnace/air handler and/or accessories rating plate must not be removed, altered or defaced. 5. Proof must be supplied that the equipment has been properly maintained over the life of the warranty, i.e., a minimum of oncea-year maintenance. 6. The units must be installed and located in North America. 7. 8. This warranty does not cover failure due to accident, misuse, abuse, faulty installation, or adjustments to appliance controls required to adapt the appliance operation to the structure size, geographic location, or fuel supply, adjustment of the heat anticipator on the thermostat, any guarantee to the temperature difference between the inside and outside of the structure, normal maintenance, such as oil nozzle replacement, filter replacement, fuses, conversion from one fuel to another, etc. 9. Equipment ordered over the internet, other than from manufacturer, is not covered. 10. Failure and replacement caused by contamination from bacteria are excluded from warranty coverage. Consequential or other damage(s) caused by rust, brownouts, blackouts, oxidation, corrosion, water, water condition, freezing, fire, other abnormal environmental conditions or other natural acts are excluded from warranty coverage. Premature failure due to the use of inferior building materials such as high sulfur content dry wall, corrosive conditions caused by location, moisture, etc. are also excluded from warranty coverage. 11. All equipment requires annual maintenance performed by your servicing dealer or an authorized service technician. Filter changes and/or cleaning filters can be performed by you. You or your servicing dealer may be required to submit proof of annual maintenance, including invoices for materials and or labor charges associated with the annual maintenance. Lack of annual maintenance or failure to provide proof of proper annual maintenance may result in denial of claims under your warranty. You will be responsible for payments of denied claims due to lack of annual maintenance. NORDYNE is not responsible for normal maintenance or service or for problems caused by improper installation, application, or operation of the equipment. We recommend semi-annual preventive maintenance inspections on the entire unit and/or accessories by a licensed or otherwise qualified dealer, service technician, or contractor. 12. Failures to equipment or compressors due to incorrect refrigerants used outside of manufacturer s recommendations or failures due to the improper use of metering devices (i.e. thermal expansion valves) are excluded from warranty coverage. 13. Thermostats are excluded from the 1 year parts warranty and are covered for a period of 30 days. There are no other express warranties, except as set forth above. Any implied warranties of merchantability or fitness for any purpose relating to the parts of the unit shall terminate on the termination dates of the corresponding express warranties covering said parts. Some states do not allow limitations on how long an implied warranty lasts, so the above limitations may not apply. Under no circumstances shall NORDYNE be liable for incidental or consequential damages resulting from breach of any express warranty or implied warranty including the implied warranties of merchantability or fitness for a particular purpose. Some states do not allow the exclusion or limitation of incidental or consequential damages, so this limitation or exclusion may not apply. NORDYNE is not responsible for normal maintenance or service or for problems caused by improper installation, application, or operation of the air conditioner/heat pump/furnace/air handler and/or accessories. It is recommended that an annual preventive maintenance inspection be performed on the entire air conditioner/heat pump/ furnace/air handler and/or accessories by a licensed or otherwise qualified dealer, service technician, or contractor. Improper maintenance may endanger the occupants of the dwelling. This warranty gives specific legal rights, and you may also have other rights which may vary from state to state. Buyer protection plans are available through your dealer. This plan provides you with additional years of service protection. The buyer protection plan must be purchased within one (1) year from the date the equipment was installed. Instructions to the Owner for Service To obtain warranty service, you are required to show the servicer a bill of sale of the appliance or other evidence of purchase to establish the original date of purchase and proof of ownership. If you suspect a defect in your air conditioner/heat pump/furnace/ air handler and/or accessories or are in need of service, please contact the installer of the unit to obtain assistance. Warranty Claim Procedures The procedure for disposing of defective inwarranty parts consists of three elements: 1. The contractor's responsibility. 2. The distributor s responsibility. 3. NORDYNE s responsibility. The Contractor s Responsibility The contractor who has completed the inwarranty service work must complete the Warranty Claim form (#6070 shown on pages 16 & 17 of this section). It is strongly advised that the form be completed while at the home where the work is being performed in order to obtain the homeowner s signature for the work that was performed. The service firm must complete the NORDYNE warranty form by indicating the following: 1. The full address, including postal ZIP Code and complete phone number of the company that is performing the warranty work. 2. The model number and serial number of all components that are required. 3. Proof of installation or purchase information provided by the original homeowner. 4. The name, address, and phone number of the homeowner. 5. The nature of complaint and specific type of service work performed in full detail. 6. A description and the NORDYNE part number of the defective part replaced. 7. Attach the material tag from the claim form to the defective part. 8. Fill in the total miles driven. 9. Fill in the hourly rate, or use the warranty rate chart as applicable. 10. Return the Warranty Claim form and the defective part to the NORDYNE distributor in customer s area. (Keep the original for contractor s files.) 11. The warranty claim must be returned within 30 days after the service work was completed. Any claim sent in later than 30 days following service work may be denied. A NORDYNE Distributor s Responsibility As a distributor of NORDYNE products, the distributor agrees to administer the NORDYNE Warranty program in his geographical territory. For product sold directly to OEM's NORDYNE will provide defective parts for administering the Warranty program. 1. Processing the Warranty Claim Form (#6070 shown on pages 16 & 17 of this section) The NORDYNE distributor must verify that the NORDYNE Warranty Claim form submitted by the contractor is completed correctly and accurately. The items on the Warranty Claim form to verify and fill in by the distributor are: a. Distributor information, such as the number, name and debit memo/reference number (if applicable) is completed. b. The contractor's ID. number, name, address, city, state, ZIP Code and telephone number. c. The model number, serial number (outdoor & indoor units). d. The date of purchase or date of installation of the unit is verified. If the age of the Furnace is two or more years from the date of manufacture, or if the age of the AC or H/P unit is 6 months from the date of manufacture request a proof-of-purchase and send a copy of the proof with the completed claim form to the NORDYNE Warranty Department. e. Service date. f. Be certain to include the owner/user name and phone number. g. The complaint by the owner/user and the type of work performed. h. The NORDYNE part number and description of the defective part returned. i. Pay the Contractor for the in-warranty service performed. EPAY or Credit on the Warranty Claim form. j. Issue a credit to the contractor for the defective parts that are returned. k. Send the completed Warranty Claim forms in to the NORDYNE Warranty Department within 90 days after the date of service. Any documents sent in later than 90 days following service, may be denied and returned. l. Compressors that are less than 20 months old, compare manufacture date of compressor to service date, and have a serial number that ends in 0, 1, 2 must be returned to NORDYNE within the 20 month period. Claims involving coil/compressor/unit changeouts must list the old and new serial numbers. Please use the air handler serial number if an original coil is replaced. 2. NORDYNE Warranty Rate Chart Warranty Claims Payment Schedule The following warranty rates are in effect for service performed: NORDYNE will pay labor and mileage not to exceed: Labor Rate...The mutually agreed upon hourly rate performed during normal working hours and such rate is documented with NORDYNE. Mileage...$.50 per mile (A maximum of 100 miles round trip). Refrigerant...$12.00 per pound (The maximum amount of refrigerant allowed shall be the system charge plus one pound). Field Scrap and Return Material Procedures Processing of Field Scrap or Returned Material Parts If the distributor has more than one location it may be practical to have all defective parts sent to one location. Combining this field scrap process may speed up the defective part credits issued from NORDYNE. Exceptions are noted to the right. Note: NORDYNE reserves the right to have defective parts returned when it is deemed necessary by NORDYNE. The distributor will be notified in writing if a situation develops that requires this action. Exceptions: Compressors that are less than 20 months old, compare manufacture date of compressor to service date, and have a serial number that ends in 0, 1, 2 must be returned to NORDYNE within the 20 month period. (Disregard ending alpha characters.) Provide the replacement compressor model and serial number on the claim form. All other compressor tags must be returned to NORDYNE with the claim form. Those distributors filing on enora may keep those tags on file. Return compressors to Copeland freight collect on delivery. Enhanced Warranty Pay Options EPAY - NORDYNE Generated Checks Labor Credits The EPAY program is a system designed with complete service in mind. Reimbursement waiting is eliminated and your customer has one more reason to continue doing business with you and NORDYNE. EPAY is to be used only for service claim payments on repairs to products manufactured or sold by NORDYNE. Any service performed as a result of defective parts or workmanship, within the time frame as indicated on the warranty and as published and provided with the product is covered under this policy. Payment is for service labor (refrigerant if applicable) only. Parts are not included in the EPAY policy. It is the distributor's responsibility to provide NORDYNE with Federal ID numbers for all contractors receiving labor. Call the NORDYNE Accounting Manager with any questions concerning Federal ID numbers. The labor rate that will be paid to a contractor who performs warranty service work on a NORDYNE product will be that rate which that contractor charges customer per hour, also known as its retail rate or published rate. The contractor must show proof of its normal published service rate by providing the distributor with a copy of its typical invoice for service work performed. This proof should be available to the NORDYNE Regional Sales Manager for inspection as necessary. NORDYNE will be maintaining a service rate file by each contractor and should be advised of any changes. The distributor will utilize the EPAY to pay the Warranty Claim as submitted by the contractor, provided that the claim is filled out accurately and completely. The distributor will pay the contractor for a maximum of one hour per service claim, with seven exceptions (see Warranty Rate Chart for exceptions). A maximum of 100 miles (round trip) mileage at the rate of 50 cents/mile will be paid to the contractor. There is no allowance or payment for travel time, set-up time or diagnostic time. Any claims presented to the distributor in excess of one hour (other than the exceptions listed) are to be approved by NORDYNE prior to processing. 0140-0211 Warranty Page 20
