Municipal Building, Harmony, NJ Regular Committee Meeting October 7, 2014 6:00 p.m. Meeting Roll Call Consent Agenda The Regular Meeting of the Harmony Township Committee was called to order by Deputy Mayor Yamrock. Mrs. Yamrock made the following announcement: Adequate notice of this meeting was given in accordance with the Open Public Meetings Act by providing a notice of the meeting to the Star Gazette and The Express-Times, posting a copy thereof on the Township bulletin board and filing a copy thereof in the office of the Municipal Clerk. The Pledge of Allegiance to the American Flag was led by the Deputy Mayor. Present Deputy Mayor Yamrock and Committeeman Cornely. Mayor Tipton absent. unanimously by roll call vote to approve the following items on the consent agenda: Municipal Attorney Report Road Department Supervisor Report Warren County Health Department Municipal Engineer s Reports Zoning Officer Report Minutes of September 2, 2014 New Business unanimously to accept Desiree Denker s resignation to the Historical Commission Preservation and the appointment of Lynn VanAssen to the Historical Commission Preservation. Representative of the Historical Commission and Society were present. They presented a slide show of the farmstead from start to where they are now. They discussed the need for a match to a grant they were awarded for repointing the farmhouse. They had originally requested these funds during budget time but were turned down. They have done the RFP and are ready to award the project but cannot due to lack of matching funds. This is a critical step in the restoration of the farmstead and the Commission does not want to lose the grant due to lack of a match. They are requesting $32,000 to start phase 5 of the restoration. Motion by Yamrock seconded by Cornely and carried unanimously to approve the request of $32,000 to be transferred to the Historical Commission account specifically for the match of a grant to repoint the farmhouse. Motion by Cornely, seconded by Yamrock and favored by both to set Trick or Treat on Friday October 31, 2014 between 6pm-8pm. unanimously to introduce the following ordinance by title only: 1

ORDINANCE NO. 14-8 HARMONY TOWNSHIP WARREN COUNTY, NEW JERSEY ORDINANCE OF THE TOWNSHIP OF HARMONY, COUNTY OF WARREN, STATE OF NEW JERSEY TO AMEND, REVISE AND SUPPLEMENT CHAPTER 18 FIRE DEPARTMENT, TO ADD SECTION 9, EMERGENCY CALLS FOR RESIDENTIAL NURSING HOMES, OF THE CODE OF THE TOWNSHIP OF HARMONY. WHEREAS, the misuse of emergency services by residential nursing homes for non-emergencies and transportation is a drain on the community s resources and creates the potential for a lack of services available for true emergencies; and WHEREAS, the Township Committee has received complaints for the Township Fire Department regarding the abuse and misuse of emergency services by certain residential nursing homes within the Township; and WHEREAS, the Committee of the Township of Harmony, County of Warren, State of New Jersey, has determined that Chapter 18 Fire Department, of the Code of the Township of Harmony shall be amended, revised and supplemented to add Section 9, Emergency Calls for Residential Nursing Homes. NOW, THEREFORE, BE IT ORDAINED by the Committee of the Township of Harmony, County of Warren, State of New Jersey that Chapter 18 Fire Department, of the Code of the Township of Harmony shall be amended, revised and supplemented as follows: Section 1: 18-9 Emergency Calls for Residential Nursing Homes A. Definitions. As used in this article, the following terms shall have the meanings indicated: Emergency Call: Shall be considered a situation requiring immediate medical attention or immediate transportation to a medical facility for medical treatment. Entity: Any business, heath care facility, nursing home or other organization within the Township of Harmony that calls for the Harmony Township Fire Department, the Harmony Township Emergency Squad or any other emergency squad through mutual aid. False Emergency Call: Shall be considered a situation where an individual is not in need of immediate transportation to a medical facility, nor is the individual in need of emergency medical care. Individual: Any inhabitant of the Township of Harmony who calls for the Harmony Township Fire Department, the Harmony Township Emergency Squad or any other emergency squad through mutual aid. B. Nursing homes to provide transportation; penalties. 2

i. Residential nursing homes shall provide emergency and nonemergency transportation service for residents of nursing homes. ii. iii. iv. In the event that the Harmony Township Fire Department, the Lopatcong Township Emergency Squad or any other emergency squad through mutual aid is called by a residential nursing home for nonemergency transportation for a nursing home resident, the nursing home shall be issued a warning. In the event of a second call in the same calendar year for nonemergency transportation, a penalty in the amount of $200 shall be paid. In the event of a third or subsequent call in the same calendar year, a penalty of $500 shall be paid. Section 2: Severability. The various parts, sections and clauses of this Ordinance are hereby declared to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder off this Ordinance shall not be affected thereby. Section 3: Repealer. Any ordinances or parts thereof in conflict with the provisions of this Ordinance are hereby repealed as to their inconsistencies only. Section 4: Effective Date. This Ordinance shall take effect upon final passage and publication as provided by law. NOTICE NOTICE is hereby given that the foregoing Ordinance was introduced to pass on first reading at a regular meeting of the Committee of the Township of Harmony held on October 7, 2014, and ordered published in accordance with the law. Said Ordinance will be considered for final reading and adoption at a regular meeting of the Township Committee to be held on November 4, 2014 at 6 p.m. or as soon thereafter as the Township Council may hear this Ordinance at the Municipal Building, 3003 Belvidere Road, Phillipsburg, New Jersey, at which time all persons interested may appear for or against the passage of said Ordinance. Rotundi Consideration of Off Tract Improvement Agreement with Off Site Tract Harmony Compost aka Rotundi Site has been carried to the Improvements November meeting. New Backhoe Motion by Yamrock, seconded by Cornely to purchase a new Purchase backhoe for the DPW from the capital improvement fund. 3

Roll Call: Ayes: Cornely, Yamrock. Nays: None Old Business O:14-6 Attorney Campbell updated the committee on the items Harmony Sand and Gravel were required to provide. She noted as of today Mr. Weber received via email the revised maps and calculations for the haul road restoration bond that were due on September 30 th along with the revised bond. The Bond had been received as of September 30 th. Mr. Weber advised the committee of the outstanding items and his time that will be required to review the new submissions. It was the recommendation of Attorney Campbell to have Gene review the work and provide a bond estimate for the restoration of the haul road side of the pit. Ms. Campbell will develop a resolution granting their permit based on the conditions the committee as set forth at the September meeting. unanimously to open to the public for public hearing and consideration of Ordinance 14-6; Title an Ordinance to Amend, Revise and Supplement Chapter 156 Vehicles and Traffic, Section 14, Parking Prohibited at all times on certain streets, Section 33 Speed Limits and Section 39 Handicapped Parking, of the Code of the Township of Harmony to address parking issues in Brainards and lower the speed limit near Merrill Creek. Gail Raub asked about parking spaces. unanimously to close public comment. unanimously to adopt Ordinance 14-6. O:14-7 unanimously to open to public comment on Ordinance 14-7; Titled and Ordinance of The Township of Harmony, County of Warren, State of New Jersey authorizing the Lease for Agricultural Purposes of certain Properties Owned by The Township and not required for Public Purposes and more commonly known as Block 45, Lots, 2,3 and 24. There were no public comments. unanimously to close public comments. unanimously to adopt Ordinance 14-7. Sustainable Sustainable Economic Plan has been moved to November s Economic meeting. Emergency Services Vouchers Emergency Services Donation Distributions has been moved to November s meeting. Public Comment Jane Nemeth states that the signs for Harmony Township are wrong on Harmony Brass Castle Rd and Brainards Rd. Fred Cavalier of 474 Montana Road asked the committee about removing a tree in the Township ROW because it is a safety hazard. After a brief discussion it was decided it should be addressed by the power company forester. Mr. Cornely will contact the forester and as him to take a look at it.
