Bremen Port Authority Harbourmaster Freie Hansestadt Bremen Rev. 4 (January 2011) Information for Ship Masters, Agents and Owners on Ship Waste Disposal Implementation of directive 2000/59/EC of the European Parliament and of the Council of 27 November 2000 on port reception facilities for ship-generated waste and cargo residues The Bremen ordinance on port reception facilities for ship-generated waste and cargo residues and also the respective amendment of the Bremen ordinance on port dues entered into force on 1 April 2003. The waste management plan was first published in 2005. The actual plan was published in January 2011. The plan describes the procedure for ship waste disposal and contains also a list of port reception facilities. The relevant information for ship masters and agents are mentioned below. Procedure for ship s waste disposal 1. All ships must notify the waste carried on board. In order to facilitate data exchange between the authorities being responsible for the control of waste discharge in the various ports of Europe, the waste notification has to be submitted by means of electronic data interchange. The relevant web application (SIS) is operated by dbh logistics IT AG. Ships shall use the waste notification form (see below) and send the completed form to the local agent who has to enter the data into the SIS system. 2. For the disposal of domestic waste (garbage) and plastic material the ship is supplied with garbage receptacles depending on the size of the ship; the disposal charge is calculated per number of receptacles and invoiced by the BremenPorts port due department. Exemptions from this disposal charge cannot be granted. - 2-3. In addition all ships are charged with a fee for the disposal of oily waste. By payment of this fee ships are entitled to receive a reimbursement of the substantial expenses incurred for the disposal of oily waste. The fee is charged irrespective of the actual use of the reception facilities. Same as the disposal charge for domestic waste, the fee for oily waste is invoiced by the BremenPorts port due department. The fee amounts to 1.40 per 100 GRT. The minimum fee to be paid is 14, the maximum fee is limited to 448. For car-carriers and ro-ro-ships the fee is reduced by 50%. Exemptions from this fee may be granted if the conditions stipulated in No. 10 are complied with. 4. In principle all ships shall deliver all ship-generated waste before leaving the port. Notwithstanding this principle a ship may proceed to the next port of call without delivering the waste if there is sufficient dedicated storage capacity for all ship-generated waste that has been accumulated and will be accumulated during the indented voyage until the next port of call. 5. The disposal of oily waste has to be contracted by the respective ship or the agent. Suitable disposal facilities are listed in the waste management plan (see below). 6. The contracted disposal facility sends the invoice to the ship respectively to the ship s agent and shall be paid by the agent. 7. To receive a reimbursement of the substantial part of the disposal expenses a reimbursement application, accompanied by a copy of the disposal invoice and by the amber coloured original of the waste movement document, is to be submitted to the Bremen- Ports port due department. The expenses are reimbursed up to the following maximum amounts: GRT Max. quantity Max. reimbursement Up to 1500 4 m³ 546 1501 to 3500 6 m³ 594 3501 to 6000 10 m³ 690 6 001 to 10000 15 m³ 810 10001 to 30000 22 m³ 978 Over 30001 30 m³ 1170 Ships equipped with decanter for sludge processing and disposing of concentrated super sludge in drums receive upon application a reimbursement of a base expense of 200 per disposal and of 1.20 per liter of super sludge up to the above mentioned maximum reimbursement. 8. The waste movement document is returned to the ship s agent together with the reimbursement note. 9. In order to facilitate the accounting procedure between ship owner / ship agent and the disposal facility, the ship agent may agree with the disposal facility to cede the entitlement for the reimbursement of the substantial disposal expenses to the disposal facility. The ship agent shall submit a reimbursement application for each ship which actually did dispose its waste, and, if appropriate, shall note on this application that the entitlement for the reimbursement was ceded to the disposal company (name to be notified). In case the invoiced amount does not exceed the maximum possible reimbursement, the ship

- 3 - agent will not receive an invoice; in all other cases he will be invoiced with the amount which exceeds the maximum possible reimbursement. BremenPorts port dues department pays out the reimbursement to the disposal facility. 10. Ships calling at the ports of Bremen and/or Bremerhaven at least twice a month, or ships having a permanently allocated berth for more than 60 consecutive days may be exempted upon application from the oily waste disposal fee. The application shall be submitted to the Port Authority (Harbourmaster). 11. The exemption will be granted if the correct disposal of the waste is proved by submission of a copy of a disposal contract, showing name and address of the disposal facility, name of the ship and waste type for which the contract was agreed. 12. Exemptions are granted for one year at the most and are charged with an administrative fee of 125. 13. Exemptions granted by Bremerhaven or Bremen Port Authority are valid both for Bremerhaven and Bremen. Exemptions granted for other ports are not valid for Bremerhaven and Bremen. 14. Hazardous waste originating from the operation of the ship (such as contaminated rags and filter material, contaminated packing material, residues of paints and solvents, batteries, fluorescent tubes) and also cargo associated waste (such as dunnage and sweepings from the cargo hold) shall be disposed to the appropriate disposal facility (see waste management plan). The disposal shall be contracted by the ship or by the agent. The disposal facility will send the invoice to the ship respectively to the ship s agent and shall be paid by the agent. Additional Information on the disposal of sewage 1. Annex IV to MARPOL convention entered into force on 27 September 2003 and was revised on 1 August 2005. Due to this fact, directive 2000/59/EC was amended to include sewage in the waste notification form. 2. According to regulation 11 of MARPOL Annex IV the controlled discharge of sewage into the sea is permitted at a moderate discharge rate at a distance of more than 12 nautical miles from the nearest land. 3. In case a ship has not sufficient dedicated storage capacity in her sewage tanks to comply with this requirement, the sewage must be delivered to a port reception facility. Only in this case, the line sewage in the notification form must be completed. If a legal discharge into the sea is intended, the line sewage needs not to be filled in. 4. The disposal shall be contracted by the respective ship or by the agent. The disposal facility (see waste management plan) will send the invoice to the ship respectively to the ship s agent and shall be paid by the agent.

Die Gebühr für die Behältergestellung und Abfallentsorgung wird mit den Raumgebühren eingezogen. Observations 1. The information has to be submitted by means of electronic data interchange. 2. The contents of this notification can be passed on to the police and to the competent authorities of other ports for control purposes. 3. In the ports of Bremen and Bremerhaven all ships are supplied with waste receptacles for the collection of food waste and plastic. The number of receptacles depends on the size of the ship. The fee for the supply of the receptacles and waste disposal is collected together with tonnage dues.

- 6 - List of port reception facilities The revised waste management plan was prepared according to 5 of the Bremen Law on Port Reception Facilities for Ship Generated Waste and Cargo Residues (BremGBl. [= law gazette] Nr. 61 (2002) page 565) and was published in the official journal Amtsblatt der Freien Hansestadt Bremen No. 9 /2011 on 26 January 2011. According to 5 of the Ordinance on Port Reception Facilities and Charges for Ship Generated Waste and Cargo Residues all ship generated waste shall be delivered only to those reception facilities which are listed in the waste management plan. - 9 - If certain specific wastes for which no port reception facility is listed are to be disposed of, the feasibility of disposal is to be checked in each individual case. The conditions of disposal will be laid down by the competent authority if applicable. If an appropriate reception facility is found, the disposal will be carried out based on a disposal contract between the ship and the reception facility, the ship acting as waste generator and taking over all obligations assigned to the waste generator by the applicable national waste regulations.
