I NTRODUCTION

I NTRODUCTION Purpose Appropriate Educational Programming: A Handbook for Student Services is a reference guide containing information that supports appropriate educational programming in Manitoba. Intended Audience This handbook is intended to provide information that is relevant to student services administrators, school division and school administrators, educators, and school clinicians. Parents and other members of student support teams may also find it useful. Using the Handbook In Manitoba, the Minister of Education, Citizenship and Youth is responsible for administering the Kindergarten to Grade 12 education system. The education system is structured to direct and support students full participation in their educational environment in a way that is responsive to their unique circumstances. The education system is directed and supported by legislation ministerial letters/directives regulations standards policies and protocols guidelines support documents Appropriate Educational Programming: A Handbook for Student Services is divided into sections that are consistent with this structure. Each section contains concise overviews and references addressing a variety of relevant topics. Introduction 3

F OUNDATION P RINCIPLES Philosophy of Inclusion Manitoba Education, Citizenship and Youth is committed to fostering inclusion for all people. Inclusion is a way of thinking and acting that allows every individual to feel accepted, valued, and safe. An inclusive community consciously evolves to meet the changing needs of its members. Through recognition and support, an inclusive community provides meaningful involvement and equal access to the benefits of citizenship. In Manitoba we embrace inclusion as a means of enhancing the well-being of every member of the community. By working together, we strengthen our capacity to provide the foundation for a richer future for all of us. Overview Inclusive schools provide learning environments that are accessible to all students as places to learn, grow, be accepted, and enjoy the benefits of citizenship. Inclusive schools embrace the following core values and beliefs: All students can learn, in different ways and at different rates. All students have individual abilities and individual learning needs. All students want to feel they belong and are valued. All students have the right to benefit from their education. All students come from diverse backgrounds and want their differences to be respected. Students learn in different places and locations. All students have the right to appropriate educational programming. The provincial curriculum should be the starting point for educational programming. Parents and students must be involved in the individual education planning process. The Individual Education Plan (IEP) is the basis for decision making for students with exceptional learning needs. The number of individuals involved in planning to meet a student s needs will increase as the complexity or intensity of the needs increases. Foundation Principles 7

F OUNDATION P RINCIPLES Understanding Legislation, Regulation, Policy, and Procedure Overview In Canada, provincial governments are responsible for education, and the federal government has no constitutional responsibilities for education. In Manitoba, the Minister of Education, Citizenship and Youth is responsible for administering Kindergarten to Grade 12 education and presides over and provides direction to the Department of Education, Citizenship and Youth. At the divisional level, a board of trustees is elected by local ratepayers to direct and oversee the operation of a school division and its employees at the local level. This structure exists to direct and support students full participation in their educational environment in a way that is responsive to their unique circumstances. Legislation In order for the Legislative Assembly to enact a law, a bill must be prepared. Bills are proposed laws. When a bill is tabled in the Legislative Assembly, formal public hearings are held by a Legislative Committee following Second Reading. If passed by the Legislative Assembly and granted Royal Assent by the Lieutenant-Governor, a bill becomes part of the law of the province. When a bill receives Royal Assent, this does not mean that it comes into effect immediately. It may come into effect on the date of Royal Assent, 60 days after the Royal Assent ceremony, on a specific date named in the bill, or on a date to be set by order of the Lieutenant-Governor in Council as set out in the coming-into-force provision of the bill. Once part of provincial law, bills are known as acts or statutes. Acts and statutes can only be amended through another formal legislative process. Ministerial Letters/Directives Directives may be written when the Minister seeks some uniformity of policy across the province. They are often quasi-legislative in nature and are typically developed in response to a specific situation that is not addressed elsewhere in legislation. Directives may involve several Ministers using an intersectoral approach. Regulations Regulations are subordinate legislation, authorized and limited in scope by an act or statute. Regulations cannot override legislation; consequently, they are less difficult to change. Depending on the authority provided in statute, changes to regulations are made by Cabinet or by the Minister responsible. Foundation Principles 9

Standards Standards prescribe province-wide criteria that school boards must try to meet when developing, implementing, and monitoring particular programming or services. Standards often provide direction for compliance and promote a standard of educational practice that is consistent throughout the province. Policies and Protocols A policy defines a course of action that has been developed by a government department. Policies need to be compatible with existing legislation and regulation and require final approval from the Minister(s) responsible for that/those area(s). Policies provide direction to school divisions and it is the responsibility of the school divisions board of trustees to ensure compliance. Guidelines Guidelines are prepared to assist school divisions in carrying out their duties and responsibilities by elaborating on the requirements of the legislation and regulations in a particular area. Support Documents Support documents are written to provide direction to school communities on sound educational practice. F EDERAL L EGISLATION The Constitution Act: Canadian Charter of Rights and Freedoms Overview The Canadian Charter of Rights and Freedoms is Part I of The Constitution Act, 1982, and came into force on April 17, 1982. The Charter sets out those rights and freedoms that Canadians believe are necessary in a free and democratic society. It establishes equality rights before and under the law and states, in part, that Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability. F EDERAL L EGISLATION The Constitution Act: Rights of the Aboriginal Peoples of Canada Overview Rights of the Aboriginal Peoples of Canada is Part II of The Constitution Act, 1982. F EDERAL L EGISLATION Youth Criminal Justice Act (YCJA) Overview On April 1, 2003, the Youth Criminal Justice Act (YCJA) came into force, replacing the Young Offenders Act. The YCJA is based on the premise that young people 1 should be held responsible for their actions but, as children, should be given the opportunity to mature, learn from their mistakes, accept the consequences of their actions, and make amends. Thus, they should be treated differently from adults who are expected to understand and be fully accountable for their actions. The YCJA states that the criminal justice system for young people must be separate from that for adults emphasize rehabilitation and reintegration provide fair and proportionate accountability that reflects the reduced level of maturity of young persons provide intervention in a timely fashion provide enhanced procedural safeguards to ensure that young persons are treated fairly Parents, extended families, the community, and social or other agencies may have a chance to be involved in a young person s case. A young person s gender, ethnic, cultural, and linguistic background, special needs, and Aboriginal heritage may be taken into consideration. Subsection 125(6) of the Youth Criminal Justice Act authorizes the limited disclosure of information respecting young persons dealt with under that Act to school representatives. 125(6) The provincial director, a youth worker, the Attorney General, a peace officer or any other person engaged in the provision of services to young persons may disclose to any professional or other person engaged in the supervision or care of a young person including the representative of any school board or school or any other educational or training institution any information contained in a record kept under subsections 114 to 116 if the disclosure is necessary 1 The YCJA defines a young person, in part, as one who in the absence of evidence to the contrary, appears to be twelve years or older, but less than eighteen years old. P ROVINCIAL L EGISLATION The Child and Family Services Act Overview The Child and Family Services Act (1999) declares eleven fundamental principles guiding the provision of services to children and families. These include, but are not limited to, the following: The best interests of children are a fundamental responsibility of society. The family is the basic source of care, nurture, and acculturation of children, and parents have the primary responsibility to ensure the well-being of their children. Families are entitled to receive preventive and supportive services directed to preserving the family unit. Communities have a responsibility to promote the best interests of their children and families, and have the right to participate in services provided to their families and children. In Manitoba, it is everyone s legal obligation to protect children. This responsibility involves identifying and reporting a child whose life, health, or emotional well-being is being endangered by an act or omission of a person. The Child and Family Services Act (1999), Section 17(2), states that a child is in need of protection where a child (a) is without adequate care, supervision or control; (b) is in the care, custody, control or charge of a person (i) who is unable or unwilling to provide adequate care, supervision or control of the child, or (ii) whose conduct endangers or might endanger the life, health or emotional wellbeing of the child, or (iii)who neglects or refuses to provide or obtain proper medical or other remedial care or treatment necessary for the health or well-being of the child or who refuses to permit such care or treatment to be provided to the child when the care or treatment is recommended by a duly qualified medical practitioner; (c) is abused or is in danger of being abused; (d) is beyond the control of a person who has the care, custody, control or charge of the child; (e) is likely to suffer harm or injury due to the behaviour, condition, domestic environment or associations of the child or of a person having care, custody, control or charge of the child; (f) is subjected to aggression or sexual harassment that endangers the life, health or emotional well-being of the child; 20 Appropriate Educational Programming: A Handbook for Student Services

(g) being under the age of 12 years, is left unattended and without reasonable provision being made for the supervision or safety of the child; or (h) is the subject, or is about to become the subject, of an unlawful sale under section 84. A Special Education Teacher Certificate candidate must complete thirty (30) credit hours of university coursework at the 500 level or above as specified in the guidelines. A selected number of professional development activities will be accepted for credit towards the Special Education Teacher Certificate. Professional development activities will be assessed on the basis of contact hours. Twenty (20) contact hours is equivalent to one (1) credit hour towards the Special Education Teacher Certificate. Only those professional development activities listed in this document under Section 2(b): Professional Development are eligible for credit. A minimum of thirty (30) credit hours of approved post-baccalaureate coursework in special education is required. Coursework completed from various universities must be transferred into a degree program. Coursework will only be accepted if completed within ten (10) years. P ROVINCIAL L EGISLATION The Freedom of Information and Protection of Privacy Act (FIPPA) Overview The Freedom of Information and Protection of Privacy Act (FIPPA) came into force for Manitoba government departments and agencies on May 4, 1998, and for the City of Winnipeg on August 31, 1998. On April 3, 2000, it was extended to all local governments, school divisions, community colleges, universities, regional health authorities, and hospitals. The Minister of Culture, Heritage and Tourism is responsible for central administration and coordination of FIPPA. Access and Privacy legislation provides Manitobans and others with the right to access information held by governments and other public bodies, including information about oneself, subject to certain exceptions the right of privacy for one s own personal information held by public bodies FIPPA defines personal information as recorded information about an identifiable individual. Some examples of personal information are an individual s name, information about an individual s family status, race, hereditary characteristics, educational history, financial circumstances, and criminal history. Personal information also includes any opinions expressed about the individual by someone else. FIPPA contains third-party notice and intervention provisions to protect the personal information of third parties. P ROVINCIAL L EGISLATION The Human Rights Code (Manitoba) Overview The Universal Declaration of Human Rights declares: All human beings are born free and equal in dignity and rights. In Manitoba, this ideal has been translated into law by The Human Rights Code, a provincial statute that prohibits discrimination on the basis of the following protected characteristics: ancestry nationality ethnic background religion age sex gender-determined characteristics sexual orientation marital status parenthood source of income political beliefs physical or mental disability Discrimination is differential treatment of an individual based on generalizations about a group to which they belong or are perceived to belong, rather than on their personal merit. Discrimination also includes the failure to reasonably accommodate the special needs of an individual or group whose special needs are based on any of the above characteristics. The goal of reasonable accommodation is to foster equality of opportunity and treatment. The Human Rights Code recognizes that reasonable accommodation must involve a balancing of the rights of an organization and the rights of the individual. Accommodations that create an undue hardship because of costs or other factors would likely be considered unreasonable. The Manitoba Human Rights Commission is the agency responsible for carrying out the provisions of The Human Rights Code. The Commission is authorized by The Human Rights Code to accept and investigate complaints of discrimination and to attempt to settle substantiated complaints, to carry out educational activities, and to issue binding advisory opinions.
