Schedule of Port Charges Terms & Definitions Use of Port of Brisbane Pty Ltd (PBPL) facilities attracts charges as defined below with component pricing outlined in the pricing schedule. All prices are inclusive of GST. By using the facilities you agree to be bound by the terms and conditions contained within this schedule and all other relevant PBPL documentation. Port Charges are approved by PBPL s Board of Directors. Wharfage and Harbour Dues Wharfage is a cargo-based charge levied on users of PBPL-owned wharves. Harbour dues are also cargo-based charges levied on users of the Port of Brisbane shipping channel. Charges for bulk and break-bulk trades are generally levied on a volume or tonnage basis (whichever charge is greater). Certain commodities may, however attract specific, negotiated charges. The charges for containers are calculated on a per unit basis according to container size and type. Cruise ships are levied Harbour Dues per Gross Registered Tonne (GRT). Port Access Charge The Port Access Charge (PAC) is a cargo-based charge levied on specific commodities. It is designed to recover the cost of significant capital projects (excluding channels and wharves) which facilitate growth and improve access at the port. Notice of Intention to Load or Unload Transfer Bulk Liquid Application Fee The Notice of Intention to Load or Unload Transfer Bulk Liquid application fee is a fee to cover the costs of bulk liquid transfer inspections performed in accordance with the provisions of the Transport Operations (Marine Pollution) Act 1995 and the condition contained in the Port Notice Bulk Liquid Transfers in Non-Tanks Berths, Use of Sea Values and Tank washing. The fee is applied per vessel entry into the Port of Brisbane and assessed on receipt of each application. Port Security Charge In accordance with the Maritime Transport and Offshore Facilities Security Act 2003, PBPL is responsible for maritime security of all common user and waterside areas at the Port of Brisbane. In order to recover its costs from port users for the implementation and ongoing maintenance of security measures at the Port of Brisbane, PBPL has a cargo-based security charge. Common User Wharf Fees The facility hire fee applies to common-user berths managed by PBPL. This fee covers access to power, the wharf usage of the berth pocket, use of any amenities and any other improvements/infrastructure provided at common-users berths. Charges are based on a 24 hour period defined as when first line ashore from the vessel comes alongside to when the last line is released. If a vessel is required to pass a hull survey prior to loading or unloading cargo at a common user berth, and if it fails that hull survey, the vessel will be charged at a lay-up rate (applicable to that berth) until the vessel commences loading or unloading. Vessel Utility Charge (Water) Water charge based on metered amount (measurement taken by PBPL). Common User Terminal Permit Fees A Terminal Permit Fee applies to terminals provided at common-user berths managed by PBPL. The fee covers the terminal area adjacent to the wharf. Manifest Lodgement Manifests are required to be submitted within five working days of loading/discharge. PBPL will process submitted manifests within three working days of receipt of all necessary information. Both weight and volume must be included on all manifests for non-containerised cargoes. Transhipment Transhipments are charged at the full rate of wharfage and harbour dues for imports. Export transhipments are exempt from harbour dues and wharfage. The Port Access Charge is not payable for transhipments. The Port Security Charge is levied on both import and export transhipments. A transhipment notice must be forwarded to PBPL within five working days of the arrival of the inward vessel. Payment Terms Pursuant to the Transport Infrastructure Act 1994 (the Act) charges payable in relation to a ship or passengers on a ship are payable (jointly and severally) by the owner, master and agent of the owner of the ship and any other person who has accepted liability for the charge. Charges payable in relation to goods are payable (jointly and severally) by the owner, consignor, consignee, agent for the sale or custody or person entitled to possession of the goods, the owner and master on the ship on which the goods were transported and any other person who has accepted liability for the charge. For convenience, PBPL will invoice the owner or agent of the owner for wharfage, harbour dues, security and other port charges payable in respect of the ship, goods or passengers. However, PBPL reserves its right to recover payment from those persons liable for such charges under the Act. PBPL may elect (in its absolute discretion) to extend credit for the payment of such charges for up to 30 days. However, all charges shall be payable upon the relevant ship berthing at the Port of Brisbane. Interest at the rate of 1% per month will be levied on all amounts outstanding after the due date for payment as stated on PBPL s tax invoice. Longer periods can be applied for depending on circumstances. Other Berths Terminal Area Specialised project / heavy lift cargo may seek an alternate arrangement depending on circumstances with price on application. *Usage over 5,000m 2 at GP Berth or 1,000m 2 at Pinkenba will be charged on a pro rata basis.
