The Legal Requirements of Boating Chapter Four / Page 1 Your Vessel s Certificate of Number and Decals Requirements for vessel registration vary from state to state. In Texas, you must have a Texas Certificate of Number (registration card) and validation decals to operate your vessel legally on public waters. The only exceptions are: A sailboat under 14 feet in length Non-motorized vessels such as canoes, kayaks, rowboats, and rubber rafts Vessels registered in other states and using Texas waters for 90 consecutive days or less The Certificate of Number and validation decals are obtained by submitting the proper applications, titles, and fees by mail or in person. After your applications have been processed, you will receive your certificate and decals. The Certificate of Number or a copy of it must be on board and available for inspection by an enforcement officer whenever the vessel is being operated. The registration number and validation decals must be displayed as follows. Number must be painted, applied as a decal, or otherwise affixed to both sides of the bow. Number must read from left to right on both sides of the bow. Number must be in at least three-inch-high BLOCK letters. Number s color must contrast with its background. Letters must be separated from the numbers by a space or hyphen: TX 3717 ZW or TX-3717-ZW. No other numbers may be displayed on either side of the bow. Decals must be affixed on both sides of the bow, three inches behind (towards the stern) and in line with the number. If your vessel requires registration, it is illegal to operate it or allow others to operate your vessel unless it is registered and numbered as described above. Other Facts About Titling and Registering Your Vessel You must obtain a title for all outboard motors, just as you would for a vessel. Battery-operated trolling motors are an exception. A Certificate of Number is valid for two years. You will receive a renewal notice about three months prior to the expiration date. The expiration date is on the certificate and the decals. If you have changed your address within those two years, you must call or write Texas Parks and Wildlife Department within 15 days of your change of address in order to get your renewal notice. If you abandon or destroy your vessel, you must report it to Texas Parks and Wildlife Department within 15 days and surrender your Certificate of Number and your title if applicable. If you lose or destroy your Certificate of Number, you must complete a duplicate form and submit a processing fee to get a replacement. To apply for a Certificate of Number and decals for a homemade vessel, you must submit the following, in addition to completed application forms and title fees: An affidavit regarding the origin of the vessel and receipts for the materials used in its construction Proof of an inspection and certification by a Texas game warden Larger recreational vessels owned by U.S. citizens may (at the option of the owner) be documented by the U.S. Coast Guard (USCG). Call the USCG at 1-800-799-8362 for more information. Documented vessels also must be registered with Texas Parks and Wildlife Department. Hull Identification Numbers: Distinguish one vessel from another the same as serial numbers distinguish one car from another. Are engraved in the fiberglass or on a metal plate permanently attached to the transom. You should write down your HIN and put it in a place separate from your vessel in case warranty problems arise or your vessel is stolen. Buying and Selling a Vessel The procedure for buying or selling, or otherwise acquiring, a vessel or motor is outlined here. The steps are essentially the same whether the seller is a marine dealer or an individual or whether the buyer is purchasing a new or pre-owned vessel. The seller completes the appropriate application form(s). PWD 143, the blue-striped form, is used to buy or sell a new or used vessel. PWD 144, the green-striped form, is used to buy or sell an outboard motor. The buyer reviews and signs the form(s), and the seller assigns the title(s) to the buyer (if titles have been issued). This procedure must be completed no later than 20 days from the date of purchase in order to avoid a penalty. The following items are submitted to Texas Parks and Wildlife Department. Completed and signed blue and green application forms. Assigned titles, bill of sale, or proof of registration (supporting documents, Manufacturer s Statement of Origin (MSO), titles, etc.). All required state fees and sales tax (listed on back of the forms). Note: Fees are based on the size of your vessel, so be sure you know the length before selling or buying a vessel. TPWD will send the buyer a new title and Certificate of Number in the buyer s name. Who May Operate a Vessel Operators must meet the age and boater education requirements shown below in order to operate any of the following vessels legally in Texas: A powerboat powered by a motor of more than 15 horsepower or A personal watercraft or A windblown vessel over 14 feet in length. A person less than 13 years of age may operate only if he or she is supervised by a person who: Is 18 years of age or older and Can lawfully operate the watercraft and Is on board when the vessel is underway. A person at least 13 years of age and born on or after September 1, 1993, may operate without supervision only if he or she has passed a boater education course that is accepted by Texas Parks and Wildlife Department.

Chapter Four / Page 3 All persons required to have passed a state-approved boater education course must carry with them on the vessel: Photographic identification, such as a driver s license or student I.D. and A boater education certification card issued by Texas Parks and Wildlife Department upon successful completion of a boater education course or proof of completion of the requirements to obtain a vessel operator s license issued by the U.S. Coast Guard. Non-residents may fulfill the Texas boater education requirement by supplying proof that they have passed another state s boater education course that is accepted by Texas Parks and Wildlife Department and is NASBLA approved. Party Boat Operator Licensing and Inspection Process As of June 1, 2007, a Party Boat Operator License issued by Texas Parks and Wildlife Department is required for operators of charter vessels that are operating on inland waters, are carrying more than six passengers, and have a length exceeding 30 feet. The only operators exempt from this requirement are those holding a current USCG Operator of Uninspected Passenger Vessel (OUPV) License, often referred to as a 6-pack license, or higher level of Captain s license issued by the USCG. Inland charter or party boats must now also have annual inspections and have the annual inspection certificate posted on their boat. Negligent and Reckless Operation of a Vessel Negligent and reckless operation of a vessel is illegal in Texas. Negligent and reckless operation of a vessel is the failure to exercise the care necessary to prevent the endangerment of life, limb, or property of any other person. The following are examples of negligent and reckless operation. Boating in restricted areas that have been marked clearly by buoys or in some other manner. Allowing passengers to ride on the bow, gunwale, transom, seat backs, seats on raised decks, or any other place where there may be a chance of falling overboard. Operating at speeds that are not reasonable and prudent based on boating traffic, weather conditions, visibility, or other potential hazards. If no speed limits are posted, you should operate a vessel so that it does not endanger others and so that it can be stopped safely. Causing damage to a person or property with a vessel s wake in posted No Wake areas. In these areas, you should operate a vessel slowly so that it does not throw a wake. In addition, you should reduce your speed when passing: Near a swimming area Close to a shoreline Another vessel where people are fishing, water-skiing, diving, or anchored Encircling people engaged in water activities. Unless you are retrieving a downed water-skier or person engaged in a similar activity, do not operate a boat or PWC in a circular course around: Any person swimming Any other boat or PWC when the operator or any passenger is fishing, waterskiing, or participating in a similar activity Remember As an owner of a vessel, you are liable if you allow others to operate your vessel in a reckless manner. Also, you can visit one of the regional or field law enforcement offices listed in the front of this manual. gunwale Upper edge of vessel s side (generally pronounced gunnel ) overboard Over the side or out of the vessel The U.S. Coast Guard Auxiliary and U.S. Power Squadrons will perform a Vessel Safety Check (VSC) of your vessel and equipment free of charge. This inspection covers federal and state requirements. If your vessel meets all VSC requirements, you will receive a VSC decal. If your vessel fails to meet all requirements, no report is made to any law enforcement agency. 4

Chapter Four / Page 4 The best thing you can do for your safety and the safety of your passengers and other boaters is simple... Don t Drink and Boat! Areas of Impairment Due to Blood Alcohol Concentration (BAC) concentrated attention, speed control Alcohol and Drugs Texas law prohibits anyone from operating a vessel while intoxicated (BWI) that is, while under the influence of alcohol or drugs. This includes operating any boat, sailboat, personal watercraft, water skis, sailboard, or similar device while intoxicated. Alcohol and drugs cause impaired balance, blurred vision, poor coordination, impaired judgment, and slower reaction times. Alcohol is a major contributor to boating accidents and fatalities. Read more about the effects and risks of consuming alcohol in Chapter 5. Boaters on Texas waters should be aware of the following Texas laws. Operators who have a blood alcohol concentration of 0.08% or greater are considered intoxicated. Texas law establishes the following penalties for boating while intoxicated. First conviction carries a fine of up to $2,000 and/or jail time of up to 180 days. Second conviction carries a fine of up to $4,000 and/or jail time of up to one year. Third conviction carries a fine of up to $10,000 and/or jail time of 2-10 years. By operating a vessel on Texas waters, you have consented to be tested for alcohol and/or drugs if arrested by a law enforcement official. Refusal to submit to testing may result in the suspension of your vehicle driver s license for at least 180 days. coordination tracking and steering information processing, judgement eye movement control, steadiness, emergency responses divided attention, reaction time, visual function Because you can drink faster than your system can burn off the alcohol, there is an increasing level of alcohol in your blood. This level is referred to as Blood Alcohol Concentration (BAC). moor To keep a vessel in place by setting anchor or tying the vessel to a fixed object or buoy 500 Yards operate at minimum speed Avoid all security zones and restricted areas. Keep a sharp eye out for anything that looks peculiar or out of the ordinary. Obstructing Navigation Vessel operators should always be considerate of other vessel operators even when stopping to anchor or moor. Keep in mind that it is illegal to: Operate any vessel in such a way that it will interfere unnecessarily with the safe navigation of other vessels on the waterway. Anchor a vessel in the traveled portion of a river or channel in a way that will prevent or interfere with any other vessel passing through the same area. Moor or attach a vessel to a buoy (other than a mooring buoy), beacon, light, or any other navigational aid placed on public waters by proper authorities. Move, displace, tamper with, damage, or destroy any navigational aid. Obstruct a pier, wharf, boat ramp, or access to any facility. Homeland Security Restrictions 100 Yards Keep Out! Recreational boaters have a role in keeping our waterways safe and secure. Violators of the restrictions below can expect a quick and severe response. Do not approach within 100 yards and slow to minimum speed within 500 yards of any U.S. Naval vessel. If you need to pass within 100 yards of a U.S. Naval vessel for safe passage, you must contact the U.S. Naval vessel or the U.S. Coast Guard escort vessel on VHF-FM channel 16. Observe and avoid all security zones. Avoid commercial port operation areas, especially those that involve military, cruise-line, or petroleum facilities. Observe and avoid other restricted areas near dams, power plants, etc. Do not stop or anchor beneath bridges or in the channel. Keep a sharp eye out for anything that looks peculiar or out of the ordinary. Report all activities that seem suspicious to the local authorities, the U.S. Coast Guard, or the port or marina security.

Chapter Four / Page 5 Personal Flotation Devices (Life Jackets) All vessels must be equipped with U.S. Coast Guard approved life jackets, called personal flotation devices (PFDs). The quantity and type depend on the length of your vessel and the number of people on board and/or being towed. Each PFD must be in good condition, be the proper size for the intended wearer, and very importantly, be readily accessible! Readily accessible means you must be able to put the PFD on in a reasonable amount of time in an emergency (vessel sinking, on fire, etc.). PFDs should not be stowed in plastic bags or in locked or closed compartments, and they should not have other gear stowed on top of them. Vessel operators should ask everyone on their vessel to wear a PFD whenever on the water. PFDs can save lives, but only if they are worn! PFD Requirements All vessels (including canoes, kayaks, and other paddlecraft ) must have at least one USCG-approved Type I, II, III, or V (wearable) PFD (life jacket) for each person on board. In addition to the requirements for life jackets, vessels 16 feet or longer (except canoes and kayaks) must have one USCG-approved Type IV (throwable) PFD on board. All PFDs must be in good and serviceable condition and must be readily accessible. The PFDs must be of the proper size for the intended wearer. Sizing for PFDs is based on body weight and chest size. Texas law requires all children under 13 years of age to wear a USCG-approved Type I, II, III, or V (wearable) PFD while underway (not at anchor, moored, or aground) on any vessel less than 26 feet long, including canoes, kayaks, and other paddlecraft. Each person riding on or being towed behind a PWC must wear a USCG approved Type I, II, III, or V PFD. One Type V may be substituted for any other type if it is specifically approved by the U.S. Coast Guard for the activity at hand. Type V PFDs may not be substituted on children weighing less than 90 lbs. PFD Descriptions TYPE I: Offshore Life Jackets These vests are geared for rough or remote waters where rescue may take awhile. They provide the most buoyancy, are excellent for flotation, and will turn most unconscious persons face up in the water. TYPE II: Near-Shore Vests These vests are good for calm waters when quick assistance or rescue is likely. Type II vests will turn some unconscious wearers face up in the water, but the turning is not as pronounced as with a Type I. TYPE III: Flotation Aids These vests or full-sleeved jackets are good for calm waters when quick assistance or rescue is likely. They are not recommended for rough waters since they will not turn most unconscious persons face up. Type III PFDs are used for water sports such as water-skiing. Some Type III PFDs are designed to inflate when you enter the water. TYPE IV: Throwable Devices/Not Wearable These cushions and ring buoys are designed to be thrown to someone in trouble. Since a Type IV PFD is not designed to be worn, it is neither for rough waters nor for persons who are unable to hold onto it. TYPE V: Special-Use Devices These vests, deck suits, hybrid PFDs, and others are designed for specific activities such as windsurfing, kayaking, or waterskiing. Some Type V PFDs are designed to inflate when you enter the water. To be acceptable, Type V PFDs must be used in accordance with their label. Boater s Tip An emergency situation (rough water, rapid onset of bad weather, or dangerous boating traffic) can occur suddenly leaving little or no time to put on life jackets. Life jackets are very difficult to put on once you are in the water. Be a smart boater, and have everyone on board your vessel wear their life jackets at all times. Types of Personal Flotation Devices Read and follow the label restrictions on all PFDs. TYPE V TYPE III TYPE I TYPE III Inflatable TYPE IV Cushion TYPE IV Ring Buoy TYPE II

Chapter Four / Page 6 Boater s Tip PWC operators need to take special steps in case of fire. Because their fire extinguishers may not be easily accessible, they should simply swim away quickly and use another operator s extinguisher. They should not open the engine compartment to put out the fire. Fire Extinguisher Charge Indicators Check the charge level of your fire extinguishers regularly. Replace them immediately if they are not fully charged. green button To check this style of extinguisher, depress the green button. If it is fully charged, the green button should pop back out immediately. Fire Extinguishers Extinguishers are classified by a letter and number symbol. The number indicates the relative size of the extinguisher, and the letter indicates the type of fire it will extinguish. Type A fires are of combustible solids like wood. Type B fires are of flammable liquids like gasoline or oil. Type C fires are electrical fires. All vessels are required to have a Type B, U.S. Coast Guard approved fire extinguisher(s) on board if one or more of the following conditions exist: Closed compartments under seats where portable fuel tanks may be stored Closed storage compartments in which flammable or combustible materials may be stored Closed living spaces Permanently installed fuel tanks Approved types of fire extinguishers are identified by the following marking on the label Marine Type USCG Approved followed by the type and size symbols and the approval number. Use this chart to determine the type and quantity of fire extinguishers required for your vessel. Length of Vessel Without Fixed System With Fixed System* Less than 26 feet one B-I None 26 feet to less than 40 feet two B-I or one B-II one B-I 40 feet to less than 65 feet three B-I or one B-II and one B-I two B-I or one B-II * refers to a permanently installed fire extinguisher system Extinguishers should be placed in an accessible area not near the engine or in a compartment, but where they can be reached immediately. Be sure you know how to operate them. Fire extinguishers must be maintained in usable condition. Inspect extinguishers regularly to ensure the following. Seals and tamper indicators are not broken or missing. Pressure gauges or indicators read in the operable range. There is no physical damage, corrosion, leakage, or clogged nozzles. On this style of fire extinguisher, the needle indicator should be in the full range. Remember Keep bilges clean and free of trash in order to reduce the risk of fire.

Chapter Four / Page 7 Backfire Flame Arrestors Because boat engines may backfire, all powerboats (except outboards) that are fueled with gasoline must have an approved backfire flame arrestor on each carburetor. Backfire flame arrestors are designed to prevent the ignition of gasoline vapors in case the engine backfires. Backfire flame arrestors must be: In good and serviceable condition U.S. Coast Guard approved (must comply with SAE J-1928 or UL 1111 standards) Periodically clean the flame arrestor(s) and check for any damage. Ventilation Systems Ventilation systems are crucial. Their purpose is to avoid explosions by removing flammable gases. Properly installed ventilation systems greatly reduce the chance of a life-threatening explosion. All gasoline-powered vessels, constructed in a way that would entrap fumes, must have at least two ventilation ducts fitted with cowls to remove the fumes. At least one exhaust duct must extend from the open atmosphere to the lower bilge. At least one intake duct must extend from a point at least midway to the bilge or below the level of the carburetor air intake. If your vessel is equipped with a power ventilation system, turn it on for at least four minutes in either of these situations: After fueling Before starting the engine If your vessel is not equipped with a power ventilation system (for example, a personal watercraft), open the engine compartment and sniff for gasoline fumes before starting the engine. Mufflers Motor-driven vessels must have a factory-type muffler or exhaust water manifold installed on the engine or another effective muffling system for noise reduction purposes. Vessel operators may not hear sound signals or voices if the engine is not adequately muffled. WARNING: Gasoline vapors can explode. Before starting engine, operate blower for four minutes and check (using your nose) engine compartment for gasoline vapors. Vessels built after July 31, 1980, which contain power exhaust blowers in gasoline engine compartments, must have the above warning sticker placed near the instrument panel. backfire Explosion of prematurely ignited fuel or of unburned exhaust gases in an internal combustion engine cowl Hooded opening designed to scoop in air Powerboats are built to ventilate the engine when underway. As the boat moves along, an air intake scoops up fresh air and forces it down the air duct into the engine compartment. The exhaust sucks out the explosive fumes from the lowest part of the engine and fuel compartments.

Unpowered Vessels Less Than 65.6 Feet Navigation Lights Vessel operators must make sure that their vessels are equipped with the proper navigation lights and use the lights during these conditions: When away from the dock between sunset and sunrise During periods of restricted visibility such as fog or heavy rain The different types of navigation lights are described in Navigation Lights in Chapter 3. No other lights that may be mistaken for required navigation lights may be exhibited. Note: Blue or red flashing lights are restricted to use by law enforcement vessels only. The required navigation lights differ depending on the type and size of your vessel. The common lighting configurations for recreational vessels are discussed below. For other configurations and requirements for larger vessels, see the U.S. Coast Guard s Navigation Rules. Power-Driven Vessels Less Than 65.6 Feet Long When Underway If less than 65.6 feet (20 meters) long, these vessels must exhibit the lights as shown in illustration 1. Remember, power-driven vessels include sailboats operating under engine power. The required lights are: Red and green sidelights visible from a distance of at least two miles away or if less than 39.4 feet (12 meters) long, at least one mile away on a dark, clear night. An all-round white light (if less than 39.4 feet long) or both a masthead light and a sternlight. These lights must be visible from a distance of at least two miles away on a dark, clear night. The all-round white light (or the masthead light) must be at least 3.3 feet (one meter) higher than the sidelights. Unpowered Vessels When Underway Unpowered vessels are sailing vessels or vessels that are paddled, poled, or rowed. If less than 65.6 feet long, these vessels must exhibit the lights as shown in illustration 2. The required lights are: Red and green sidelights visible from a distance of at least two miles away or if less than 39.4 feet long, at least one mile away on a dark, clear night. A sternlight visible from a distance of at least two miles away. If less than 23.0 feet (7 meters) long, these vessels should: If practical, exhibit the same lights as required for unpowered vessels less than 65.6 feet in length. If not practical, have on hand at least one lantern or flashlight shining a white light as shown in illustration 3. All Vessels When Not Underway All vessels are required to display a white light visible in all directions whenever they are moored or anchored outside a designated mooring area between sunset and sunrise. 3. Unpowered Vessels Less Than 23 Feet An alternative to the sidelights and sternlight is a combination red, green, and white light, which must be exhibited near the top of the mast. To prevent a collision, vessel operators should never leave shore without a flashlight. Even if you plan to return before dark, unforeseen developments might delay your return past nightfall.

Chapter Four / Page 9 Visual Distress Signals Visual Distress Signals (VDSs) allow vessel operators to signal for help in the event of an emergency. VDSs are classified as day signals (visible in bright sunlight), night signals (visible at night), or both day and night signals. VDSs are either pyrotechnic (smoke and flames) or non-pyrotechnic (non-combustible). Vessels on federally controlled waters must be equipped with U.S. Coast Guard approved visual distress signals. All vessels, regardless of length or type, are required to carry night signals when operating between sunset and sunrise. Most vessels must carry day signals also; exceptions to the requirement for day signals are: Recreational vessels that are less than 16 feet in length Non-motorized open sailboats that are less than 26 feet in length Manually propelled vessels VDSs must be U.S. Coast Guard approved, in serviceable condition, and readily accessible. U.S. Coast Guard Approved Visual Distress Signals Pyrotechnic Visual Distress Signals Orange Smoke Handheld Orange Smoke Floating Day Signal Red Meteor Day and Night Signal Red Flare Day and Night Signal Pyrotechnic Devices Pyrotechnics are excellent distress signals. However, there is potential for injury and property damage if not handled properly. These devices produce a very hot flame, and the residue can cause burns and ignite flammable materials. Pistol-launched and handheld parachute flares and meteors have many characteristics of a firearm and must be handled with caution. In some states, they are considered a firearm and are prohibited from use. Pyrotechnic devices should be stored in a cool, dry, and prominently marked location. Non-Pyrotechnic Devices The distress flag is a day signal only. It must be at least 3 x 3 feet with a black square and ball on an orange background. The electric distress light is accepted for night use only and must flash the international SOS distress signal automatically. Non-Pyrotechnic Visual Distress Signals Electric Light Night Signal Orange Flag Day Signal If pyrotechnic VDSs are used, they must be dated. Expired VDSs may be carried on board, but a minimum of three unexpired VDSs must be carried in the vessel. The following combinations of signals are examples of VDSs that could be carried on board to satisfy U.S. Coast Guard requirements: Three handheld red flares (day and night) One handheld red flare and two red meteors (day and night) One handheld orange smoke signal (day), two floating orange smoke signals (day), and one electric light (night only) It is prohibited to display visual distress signals while on the water unless assistance is required to prevent immediate or potential danger to persons on board a vessel. Arm Signal Although this signal does not meet VDS equipment requirements, wave your arms to summon help if you do not have other distress signals on board. federally controlled waters Waters on which vessels must observe federal requirements, including VDS requirements; these waters include: Coastal waters The Great Lakes Territorial seas Bodies of water connected directly to one of the above, up to a point where the body of water is less than two miles wide

Chapter Four / Page 10 Common Sound Signals Some common sound signals that you should be familiar with as a recreational boater are as follows. Changing Direction One short blast tells other boaters I intend to pass you on my port (left) side. Two short blasts tell other boaters I intend to pass you on my starboard (right) side. Three short blasts tell other boaters I am backing up. Restricted Visibility One prolonged blast at intervals of not more than two minutes is the signal used by powerdriven vessels when underway. One prolonged blast plus two short blasts at intervals of not more than two minutes is the signal used by sailing vessels. Warning One prolonged blast is a warning signal (for example, used when coming around a blind bend or exiting a slip). Five (or more) short, rapid blasts signal danger or signal that you do not understand or that you disagree with the other boater s intentions. Divers Flag For FCC information Alfa Flag Scuba divers and snorkelers should not place a flag in an area already occupied by other boaters or where their diving operation will impede the normal flow of waterway traffic. Divers also should follow all of the water safety rules themselves. headway speed The slowest speed at which it is still possible to maintain steering. Note: This is the proper speed for No Wake areas. Call the FCC for a recorded message: 1-800-322-1117 On the Internet, go to the FCC website: http://wireless.fcc.gov/marine/ Sound-Producing Devices In periods of reduced visibility or whenever a vessel operator needs to signal his or her intentions or position, a sound-producing device is essential. The navigation rules for meeting head-on, crossing, and overtaking situations described in Chapter 3 are examples of when sound signals are required. Vessels less than 65.6 feet (20 meters) in length, which includes PWCs, are required to carry on board a whistle or horn or some other means to make an efficient sound signal audible for at least one-half mile. Vessels that are 65.6 feet (20 meters) or more in length are required to carry on board a whistle or horn, and a bell that are audible for at least one mile. Other Equipment Diver-Down Flags: Scuba divers or snorkelers must display a diver-down flag that marks the diving area as required by the Texas Water Safety Act. Vessels must remain at least 50 feet away from the flag. If they have to approach the diving area, vessel operators must have permission from the person who placed the flag or the vessel displaying the flag. Outside of 50 feet, vessel operators must operate at headway speed out to a distance of 150 feet away from the flag. Patrol or rescue craft are exempt from such requirements. Two types of flags are used to indicate diving activity. A rectangular red flag, at least 15 x 15 inches, with a white diagonal stripe is required on state waters. A blue and white International Code Flag A (or Alfa flag), at least 3.3 feet (one meter) high and visible from all directions, must be displayed on vessels on federally controlled waters. This flag indicates that the vessel is involved in a diving activity. Trailers: Texas has the following requirements for trailers. Trailers must be registered with your county tax assessor just like your automobile. If the gross weight of the vessel and trailer exceeds 4,500 pounds, the trailer must be equipped with brakes. Trailers must have proper lighting, including turn signals, taillights, and brake lights. All trailer lights must be maintained in an operable condition. Trailers must be connected to the towing vehicle by a set of safety chains or a cable of sufficient strength to maintain connection under all conditions. VHF Radio: Some vessels that are equipped with VHF radios are required to have a Ship Station License issued by the Federal Communications Commission (FCC). As of 1996, most recreational vessels no longer need an FCC license if operating domestically. Domestically means not traveling to foreign ports or transmitting to foreign stations, including Canada. Recreational vessels that still are required to carry an FCC Ship Station License are powerboats over 65.6 feet (20 meters) in length and any vessel on an international voyage. Permits and Regulations Marine Events: Although no state permit is needed to hold a race or regatta on Texas waters, always notify the controlling lake authority. Events held on federally controlled waters are granted a permit through the U.S. Coast Guard by applying at least 30 days in advance. Local Regulations: Local waterways may have specific equipment and operational restrictions in addition to those covered in this chapter. Be sure to check for local regulations before you go boating.

Chapter Four / Page 11 Requirements Specific to Personal Watercraft (PWCs) In addition to adhering to all boating laws, personal watercraft (PWC) operators have requirements specific to their vessel. Each person riding on or being towed behind a PWC must wear a U.S. Coast Guard approved Type I, II, III, or V personal flotation device. An operator of a PWC equipped with a lanyard-type ignition safety switch must attach the lanyard to his or her person, clothing, or PFD. It is illegal to operate a PWC between sunset and sunrise. A PWC must maintain a distance of at least 50 feet from another boat or PWC, a person, a stationary platform, or a shoreline. The only exception is when the PWC is maintaining headway speed. PWCs should not be operated in a manner that requires the operator to swerve at the last possible moment to avoid a collision. Furthermore, a PWC operator should not jump the wake of another vessel recklessly or unnecessarily close to that vessel. PWCs must be rated to carry the number of persons on board at any time. It is illegal to chase, harass, or disturb wildlife with your PWC. Towing a Person With a Vessel Legally Vessel operators towing a person(s) on water skis, aquaplanes, surfboards, inner tubes, or any similar devices must obey these laws also. It is illegal for operators of boats to tow a person(s) on water skis, skiboards, or any device of this type between one-half hour after sunset and one-half hour before sunrise. It is illegal for operators of PWCs to tow any person or device (or operate) between sunset and sunrise. All vessels towing person(s) on water skis or similar devices must be operated in a careful and prudent manner. A reasonable distance from other vessels, people, and property must be maintained so as not to endanger life or property. Buzzing or spraying another vessel or swimmer is illegal. Only a vessel operator who is retrieving a downed water-skier or person engaged in a similar activity may operate in a circular course around that person. Every vessel towing a person(s) on water skis or a similar device must have: An observer, other than the vessel operator, 13 years of age or older on board or A rearview mirror. The size of the mirror must be no less than four inches in size from bottom to top and across from side to side. It should be mounted firmly to give the vessel operator a full, complete view beyond the rear of the vessel at all times. Note: Most PWC mirrors do not meet these size standards. PWCs have rating requirements that must be met when towing people. A PWC must be rated for at least two people when towing a person on water skis or a similar device. If an observer is used, the PWC must be rated for three people the operator, the observer, and the retrieved skier. Remember As an owner of a PWC, it is illegal for you to allow anyone else to operate your PWC in such a way that it violates the laws of Texas. PWC operators who are towing skiers should be aware that their factory-installed rearview mirror may not comply with Texas regulations. A wideangle mirror is needed for adequate viewing of a skier. TX 3717 ZW If an observer is used, a PWC towing a skier must be rated for three people the operator, the observer, and the retrieved skier. Stay up-to-date on new boating laws! Pump-Out Station Y valve must be secured Garbage Disposal Placard Drainage to pump-out station Typical Marine Sanitation Device Waste, Oil, and Trash Disposal in Texas and Federal Waters It is illegal to discharge waste, oil, or trash into any state or federally controlled waters. This is for very good reasons. Sewage carries disease and other pollutants that are harmful to people, aquatic plants, and animals. Trash thrown into the water can injure swimmers and wildlife alike. It also can plug engine cooling water intakes. Pollution is unsightly and takes away from your enjoyment of the water. Vessel operators need to be aware of the following regulations for waste, oil, and trash disposal that apply to both federally controlled and state waters. The Refuse Act prohibits throwing, discharging, or depositing any refuse matter of any kind (including trash, garbage, oil, and other liquid pollutants) into the waters of the United States. Discharge of Sewage and Waste It is illegal in Texas to discharge sewage and recreational waste into or adjacent to any Texas waters. All boats, including houseboats and floating cabins, equipped with a galley or toilet must have a waste-water holding system to prevent the discharge of waste products into surrounding waters. If you have a recreational vessel with installed toilet facilities, it must have an operable marine sanitation device (MSD) on board. There are three types of MSDs. Types I and II MSDs are usually found on large vessels. Waste is treated with special chemicals to kill bacteria before the waste is discharged. Types I and II MSDs with Y valves that would direct the waste overboard must be secured so that the valve cannot be opened. This can be done by placing a lock or non-reusable seal on the Y valve or by taking the handle off the Y valve. Type III MSDs provide no treatment and are either holding tanks or portable toilets. Collected waste should be taken ashore and disposed of in a pump-out station or onshore toilet. Vessels 65 feet or less in length may use a Type I, II, or III MSD. Vessels more than 65 feet in length must install a Type II or III MSD. All installed devices must be U.S. Coast Guard certified. According to Texas law, the Clean Water Certification Program requires owners of boats with MSDs and owners of pump-out stations to obtain a decal by completing a certification application. The application and decal self-certify that the MSD or pump-out station is operating properly to prevent the discharge of sewage into Texas waterways. To get an MSD or boat pump-out station certification application online, go to www.tceq.texas.gov/field/cleanwatercert. Initial application fees for certification and the decal are $15 (MSD) and $35 (boat pump-out station). Certifications expire on December 31 of every odd-calendar year. Discharge of Trash The Act to Prevent Pollution from Ships places limitations on the discharge of garbage from vessels. It is illegal to dump refuse, garbage, or plastics into any state or federally controlled waters. Many forms of litter can kill birds, fish, and marine mammals. You must store trash in a container while on board and place it in a proper receptacle after returning to shore. If boating on federally controlled waters and your vessel is 26 feet or longer, you must display a Garbage Disposal Placard in a prominent location. The Garbage Disposal Placard is a durable sign that is at least 4 x 9 inches and notifies passengers and crew about discharge restrictions.

Chapter Four / Page 13 Discharge of Oil and Other Hazardous Substances Regulations issued under the Federal Water Pollution Control Act require all vessels with propulsion machinery to be able to retain oil mixtures on board. You are not allowed to discharge oil or hazardous substances. The penalty for illegal discharge may be a fine of up to $10,000. You are not allowed to dump oil into the bilge of the vessel without means for proper disposal. Fuel spills can be removed using absorbent bilge pads. You must dispose of oil waste at an approved reception facility. On recreational vessels, a bucket or bailer is adequate for temporary storage prior to disposing of the oil waste at an approved facility. You must notify the National Response Center and the Texas Commission on Environmental Quality immediately if your vessel discharges oil or hazardous substances in the water. Report the discharge s location, color, source, substances, size, and time observed. If boating on federally controlled waters and your vessel is 26 feet or longer, you must display a 5 x 8-inch placard made of durable material, fixed in a conspicuous place in the machinery spaces or at the bilge pump control station, stating the Federal Water Pollution Control Act s law. Waste Management Plan Ocean-going vessels that are 40 feet or more in length with cooking and sleeping facilities must have a written Waste Management Plan. The captain of the vessel is responsible for implementing the Waste Management Plan. The Waste Management Plan, identifying the vessel s name and home port, should be posted and should include directives to all persons on board about: Discharging sewage and hazardous substances Discharging garbage and other food waste Disposing of plastics, bottles, and cans Reading applicable placards for additional information Advising the captain in case of oily discharges or diesel spills It s the Law: On the Water With Your Vessel Protect Texas Seagrasses Seagrasses are plants totally adapted to living underwater. Their canopy of leaves and net of roots create a stable and protected habitat for marine life. It is this habitat that helps make the fishing great. Seagrass benefits the environment by providing habitat for young stages of fish, crustaceans, and shellfish, which are important to commercial and recreational industries. Seagrass stabilizes bottom sediments and removes nutrients from the water, aiding the growth of the other marine life. Seagrass loss in watersheds of estuarine and marine systems is caused by human activities such as dredge and fill activities, coastal development, nutrient pollution, degraded water, and uprooting by propellers. If boating in shallow areas or seagrass beds, you will see a mud trail in your wake where your propeller has churned up the bottom, clouded the water, and cut seagrass roots. If you see this trail you should: 1. Lift. Stop your vessel. Tilt your motor out of the water. 2. Drift. Use the wind to drift to and through dense submerged vegetation. 3. Pole. Pole or walk your vessel out of the shallow area or seagrass bed. 4. Troll. Use a trolling motor to navigate the shallow waters. In Redfish Bay State Scientific Area, consisting of 30,000 acres of dense submerged vegetation located on the mid-central coast, it is against the law to uproot seagrasses with a propeller. BAR: Date Entered: By: Protect Texas Lakes and Waterways from Invasive Plants and Animals Introducing non-native species into Texas waters can upset the balance of the ecosystem, thereby harming the environment. Non-native aquatic plants, such as common salvinia, giant salvinia, and alligator weed, can overshadow native submersed plants and lower oxygen levels; hamper sport fish feeding; create ideal mosquito breeding habitats; restrict water flow, resulting in flooding; and increase the sediment in waterways. Non-native aquatic animals, such as zebra mussels, can reduce fish and bird populations, disrupt city water supplies, and damage boat hulls and motors. To curb the spread of these invasive species, you are required by law to remove harmful plants and animals from your boat and trailer. Before launching and before leaving a boat ramp, you must: Remove aquatic plants from your boat, motor, and trailer. Check all underwater fittings and equipment. Dispose of vegetation properly. Empty your bait bucket on land. Drain your equipment, including the motor, bilges, live wells, bait buckets, and cooler. Rinse your vessel, propeller, trailer, and equipment, using a high-pressure washer if available. Dry everything for at least five days, if possible. Vessel Accidents and Casualties What the Law Requires You To Do An operator involved in a boating accident must: Stop his or her vessel immediately at the scene of the accident and... Assist anyone injured or in danger from the accident, unless doing so would seriously endanger his or her own vessel or passengers and... Give, in writing, his or her name, address, and certificate of number to anyone injured and to the owner of any property damaged by the accident. Vessel operators involved in an accident must report the accident to the TPWD by the quickest means possible if it has resulted in: Death or... The disappearance of a person from a vessel under circumstances that indicate death or injury or... Injury requiring medical treatment beyond first aid or... Property damage exceeding $2,000 to all vessels, docks, etc. involved in the accident. Accident reports submitted by the operator(s) are confidential and are not admissible in court as evidence. Report forms are available from TPWD offices and game wardens, or call the TPWD 24 hours a day at 512-389-4848. Penalties and Enforcement The boating laws of Texas are enforced by the Law Enforcement Division of Texas Parks and Wildlife Department and other marine safety enforcement officers. All marine safety enforcement officers and game wardens are given the authority under the Texas Water Safety Act to enforce the boating laws of Texas. This includes the right to stop and board vessels in order to check for compliance with federal and state laws. The U.S. Coast Guard has enforcement authority on federally controlled waters. Every person who violates or fails to comply with laws contained within the Texas Water Safety Act is guilty of a TPWD Code misdemeanor. Those convicted of a misdemeanor must pay a fine of not less than $25 nor more than $500. In addition, they may be required to complete and pass an approved boater education course.
