2.3. Regulations on International Money Transfers via PrivatMoney System: Special Terms: PrivatMoney System software for express sending (Transfer Send) and receiving (Transfer Receive) international money transfers between points of cash issuance and sending. Standard Money Transfers international money transfers with an opportunity to receive the transfer at any registered PrivatMoney point. Addressed Money Transfers international money transfers with the specified country, city and the transfer receipt point where the recipient will receive the transfer. Transfer Amount an amount of money that the Customer wants to send or receive via the PrivatMoney System excluding the Fee. Transfer Reference Number a unique code that is assigned to every money transfer for identification thereof in the PrivatMoney System. 2.3.1. The regulations on international money transfers via the PrivatMoney System are applicable when the Customer submits an application on the prescribed form in order to send or receive a money transfer via the PrivatMoney System. 2.3.2. Money transfers via the PrivatMoney System are only available to individuals. 2.3.3. In order to send or receive a money transfer in the PrivatMoney System the Customer does not need to open an Account with the Bank. Transfers via the PrivatMoney System can be made when the Customer pays or receives cash at the Bank. 2.3.4. The Customer shall pay the Fee for the execution of a money transfer in the PrivatMoney System according to the Bank s Pricelist. The Fee is charged in the transfer currency, i. e. US dollars or Euros. When calculating the Fee for a transfer, the Fee amount is rounded to the integer upwards. The Fee for the receipt of the transfer shall not be charged. 2.3.5. Standard Money Transfers: 2.3.5.1. Standard Money Transfers in the PrivatMoney System can be made in US dollars and Euros between Latvia, Russian Federation, Ukraine and other members of the PrivatMoney System and can be received at any service point registered at the PrivatMoney System. The list of the registered service points is constantly changing and expanding. The Customer may check the complete list of these countries and registered service points at any branch of the Bank at its regular working hours or on the Bank s Web-Page. 2.3.5.2. The amount of one transfer may not exceed USD 10,000.00 (ten thousand US dollars) or EUR 10,000.00 (ten thousand Euros). The Transfer Amount should be in round numbers (US dollars or Euros). The number of transfers is unlimited. 2.3.5.3. A Standard Money Transfer via the PrivatMoney System may be executed within 10-15 minutes from the moment of sending the transfer in the PrivatMoney System. The transfer becomes available for payment straight after it has been assigned a Reference Number. 2.3.5.4. A Standard Money Transfer is available for payment during 30 (thirty) days from the day of its sending. After the expiry of this term, the transfer is no longer available for payment. 2.3.6. Addressed Money Transfers 2.3.6.1. Addressed Money Transfers in the PrivatMoney System can only be executed in US dollars between Latvia, Lithuania, Estonia, Belarus, Great Britain, the USA and other countries where service points of the PrivatMoney System are located. The
list of the registered service points is constantly changing and expanding. The Customer may check the complete list of these countries and registered service points at any branch of the Bank at its regular working hours or on the Bank s Web- Page. 2.3.6.2. The amount of an Addressed Money Transfer may not be under USD 10 (ten US dollars) and exceed USD 10,000.00 (ten thousand US dollars). The Transfer Amount should be in round figures (US dollars). The number of transfers is unlimited. 2.3.6.3. An Addressed Money Transfer is executed in the PrivatMoney System within 24 (twenty-four) hours since sending thereof in the PrivatMoney System. 2.3.6.4. An Addressed Money Transfer is available for payment during 30 (thirty) calendar days from the day of sending thereof. After the expiry of this term, the transfer is no longer available for payment. 2.3.7. Receipt of Funds: 2.3.7.1. In order for to receive the money that has been transferred via the PrivatMoney System the Customer should arrive at the Bank (or at a service point of the PrivatMoney System), present an identification document, fill in and submit a certain application to the Bank for the receipt of the transfer. The application should include the following details: 2.3.7.1.1. the Reference Number that was provided to the Customer (the recipient) by the sender; 2.3.7.1.2. the transfer currency; 2.3.7.1.3. the expected Transfer Amount in digits and words; 2.3.7.1.4. the details of the Customer (recipient): the name, surname of the recipient; the father s name of the recipient (if applicable); the address of the recipient; the series, number, issuing authority and the date of issue of the recipient s identification document; the contact telephone of the recipient (home/business/mobile); the identity code of the recipient (for residents of the RL) or the date of birth (for non-residents of the RL); 2.3.7.1.5. the details of the sender: the name, surname of the sender; the father s name of the sender (if applicable); the country of the sender. 2.3.7.1.6. the date and place of submitting the application (for the transfer receipt); 2.3.7.1.7. the signature of the Customer (recipient). 2.3.7.2. The Customer may turn to the Bank for help in filling in the application. The Bank should provide assistance to the Customer within its competence. 2.3.7.3. If the aforementioned details are not provided or do not match those registered in the PrivatMoney System, or if the transfer has already been paid out or returned to the sender, and in other similar cases, the money shall not be paid to the Customer (recipient) and the Bank informs the Customer (recipient) thereof by making an appropriate note on the filled in application. 2.3.7.4. When money is transferred in the PrivatMoney System, the Bank has the right not to pay out the money to the Customer (recipient) in cases and in manner set out in the normative acts of the Republic of Latvia, these Regulations and normative documents of the Bank and inform the Customer (recipient) thereof. The unpaid
money (unless the refusal to pay out the money is related to anti-money laundering, terrorism financing, etc.) is returned to the sender of the transfer according to the transfer return terms (see Paragraph 2.3.11.). 2.3.7.5. The Bank pays the Transfer Amount to the Customer if the details provided in the application and the identification document details of the Customer match those registered in the PrivatMoney System, and if at least one of the following additional identifiers matches the registered: the Transfer Reference Number, expected Transfer Amount, name, surname or father s name (if applicable) of the sender. 2.3.7.6. The Bank shall pass to the Customer the information given by the sender (if the sender indicated such information in the application), issue one copy of the transfer receipt registration confirmation and pay out the Transfer Amount. 2.3.7.7. The transfer receipt registration confirmation with the signatures and the seal of the Customer and a Bank employee shall certify the completion of the transfer (Transaction Completion) in the PrivatMoney System. 2.3.7.8. The Bank has no obligation to contact the recipient of the transfer by the provided telephone number regarding the receipt of the transfer. 2.3.8. Sending Money Transfers 2.3.8.1. If a Customer wants to send money via the PrivatMoney System he/she should arrive at the Bank (or a service point of the PrivatMoney System), present an identification document, fill in and submit an application for sending a money transfer to the Bank. The application should include the following details: 2.3.8.1.1. the transfer currency; 2.3.8.1.2. the Transfer Amount in digits and words, 2.3.8.1.3. the details of the Customer (sender): the name, surname of the sender; the father s name of the sender (if applicable); the identity code of the sender (for residents of the RL) or the date of birth (for non-residents of the RL); the series, number, issuing authority and the date of issue of the sender s identification document; the address of the sender; the contact telephone of the sender (home/business/mobile); 2.3.8.1.4. the details of the recipient: the name, surname of the recipient; the country and city of the recipient (region, if known) Addressed Money Transfers require to enter the specific receipt place, i. e. the country, city and the address of the receipt point (or the Bank s address); 2.3.8.1.5. the date of filling in and signing the application (on transfer sending); 2.3.8.1.6. the signature of the Customer (sender). 2.3.8.2. The sender may include a message (maximum 10 words) in the application for the recipient. 2.3.8.3. The Customer should carefully and fully complete the application for sending the money transfer by providing all required information. Should the Customer fail to provide all the necessary details, the Bank has the right, but shall not be obliged, to ask the Customer to provide additional information. If the Bank fails to specify the details of the application it shall be entitled not to execute the application and not to carry out the transfer. 2.3.8.4. The Customer may turn to the Bank for help in filling in the application. The Bank should provide assistance to the Customer within its competence.
2.3.8.5. The Bank has the right to request and the Customer is obliged to provide the Bank with the requested additional information and documents. The Bank has the right not to execute the transfer in cases and in manner set out in the normative acts of the Republic of Latvia, these Regulations and normative documents of the Bank and inform the Customer (sender) thereof. 2.3.8.6. The Bank executes the money transfer in the PrivatMoney System after the Customer has paid the Transfer Amount in the transfer currency and paid the Fee according to the Bank s Pricelist. The Bank has the right not to accept the application if the amount paid by the Customer is insufficient. 2.3.8.7. When sending a transfer via the PrivatMoney System it is assigned a Reference Number, which the Bank shall pass to the Customer (sender). The Customer should provide this Reference Number to the recipient so that he/she can receive the Transfer Amount. 2.3.8.8. The transfer sending confirmation with the signatures and the seal of the Customer and the Bank s employee shall certify that the transfer has been accepted for execution and sending via the PrivatMoney System. The Bank issues one copy of the transfer sending confirmation to the Customer. 2.3.8.9. By signing the transfer application the Customer (sender) undertakes to inform the recipient that he/she should provide the identification document, specify the Transfer Amount and currency, the Transfer Reference Number, the name, surname and father s name (if applicable) of the sender when receiving the money. The Customer (sender) is fully responsible for timely and complete passing of this information to the recipient. 2.3.8.10. The Bank has no obligation to contact the recipient of the transfer by the provided telephone number regarding the sending of the transfer. 2.3.8.11. The Bank is not responsible for the refusal to pay the Transfer Amount to the recipient if the data provided in the application of the Customer (sender) do not match the data supplied by the recipient or his identification document. 2.3.8.12. The Bank is not responsible for the losses of the Customer and other additional expenses of the Customer that have resulted from the transfer delay or refusal to pay the Transfer Amount if such delay or refusal to pay the Transfer Amount was caused by the fault of third parties who participate in the transfer execution. 2.3.9. Changes to Money Transfer Details 2.3.9.1. The Customer (sender) has the right to introduce changes to the transfer details by arriving at the Bank (or a service point of the PrivatMoney System) from where the transfer was sent. 2.3.9.2. The changes may only by made to the recipient s data and this can be done on the date of the transfer sending or on any other day following the money transfer date but within 30 (thirty) calendar days for both, Standard Money Transfers and Addressed Money Transfers, provided the transfer has not yet been paid out. 2.3.9.3. At the Bank the Customer (sender) should present an identification document, the transfer sending confirmation, the Transfer Amount payment confirmation document, and submit a signed application for transfer data change. 2.3.9.4. The Customer (sender) should indicate the following initial and changed information in the application for transfer data change: the transfer sending date, Transfer Reference Number, Transfer Amount, the currency of the transfer, as well as details of the Customer (recipient).
2.3.10. Cancellation of Money Transfers 2.3.10.1. The Customer (sender) has the right to cancel a Standard Money Transfer only. The Addressed Money Transfers cannot be cancelled. 2.3.10.2. The Customer (sender) may only cancel a Standard Money Transfer by arriving at the Bank in person (or at a service point of the PrivatMoney System) from where the transfer was sent. 2.3.10.3. The Customer (sender) has the right to apply for Standard Money Transfer cancellation only on the sending date if the transfer has not yet been paid to the recipient. 2.3.10.4. The Customer (sender) should present an identification document, the transfer sending confirmation, the Transfer Amount payment confirmation document, as well as submit a signed application for transfer cancellation. 2.3.10.5. The Customer (sender) should specify the following in the application for transfer cancellation: transfer sending date, the Transfer Reference Number and the reason for transfer cancellation. 2.3.10.6. Upon the cancellation of the Standard Money Transfer the Customer (sender) is paid the Transfer Amount and the Fee for sending the transfer in the transfer currency. 2.3.11. Return of Money Transfers 2.3.11.1. The Customer (sender) has the right to apply for the return of a Standard Money Transfer and Addressed Money Transfer. 2.3.11.2. Only the Customer (sender) has the right to apply for return of the transfer and receive the Transfer Amount by arriving in person at the Bank branch where he/she made the transfer (or at a service point of the PrivatMoney System). 2.3.11.3. The Customer (sender) has the right to apply for return and receive the transfer at the Bank during 30 (thirty) calendar days following the transfer date for both, Standard Money Transfers and Addressed Money Transfers. 2.3.11.4. The Customer (sender) has the right to apply for the transfer cancellation at the Bank and receive it within 24 (twenty-four) hours after the cancellation application if the transfer has not yet been paid to the recipient. 2.3.11.5. The Customer (sender) should present the identification document, the transfer sending confirmation, the Transfer Amount payment confirmation document, as well as submit a signed application for transfer return. 2.3.11.6. The Customer (sender) should indicate the following in the application for transfer return: transfer sending date, the Transfer Reference Number, Transfer Amount, currency of the transfer, the details of the Customer (recipient) and the transfer return reason. 2.3.11.7. If the transfer return is made on request of the Customer or due to his/her fault, the Customer (sender) is only paid the Transfer Amount. In this case the Fee paid by the Customer (sender) for sending the transfer shall not be returned to the Customer. 2.3.11.8. If the transfer is returned due to the fault of the Bank, the Bank contacts the Customer (sender) in this regard. The Customer (sender) should arrive at the Bank and receive the Transfer Amount alongside with the Fee paid for the transfer sending in the transfer currency.
