APPENDIX Public Lands Rents and Other Amounts Payable Order Part 1- Fees 1 The fees with respect to an application for a new disposition are as follows: (1) the fee is $900 for an application for a. Licence of Occupation, b. Recreational Miscellaneous Lease, c. Pipeline Agreement, d. Pipeline Installation Lease, e. Right of Way Easement, f. Vegetation Control Easement, or g. Mineral Surface Lease; (2) the fee is $1,800 for an application for a Commercial/Industrial Miscellaneous Lease; (3) the fee is $1,050 for an application for a a. Land Disposition Request, b. Public Land Sale, or c. Public Land Exchange; (4) The fee is $445 for an application for a Surface Material Licence; (5) The fee is $525 for an application for a Surface Material Exploration; (6) The fee is $1,100 for an application for a Surface Material Lease. 2 The fee with respect to an application for a new Consultative Notation is $785. 3 The fee for an application for an amendment or consolidation for any disposition is $400. 4 The fee for an application for a renewal for any disposition is $400. 5 The fee for an application for an assignment of any disposition, except a grazing lease, is $3,150. 6 The fee for an application for a permit, issued pursuant to section 144(1)(b) of the Public Lands Administration Regulation, is $450. 7 (1) The deposit on appraisals for the sale application of public land is $2000. (2) This deposit is non-refundable but will be applied towards the sale price of the land once the sale transaction is processed. 8 The fee for a reinstatement for any disposition is $400. 9 The fee to register a conditional surrender of a disposition is $400. 10 The fee with respect to an application for a reclamation certificate is $400 per activity.
11 The disposition mapping fee is (a) $125 for each new application plan ; and (b) $50 for each amendment plan. 12 (1) The fees for research, scanning and photocopying are $50 per hour, with a minimum charge of $50. (2) This fee will be estimated in advance by Environmental and Sustainable Resource Development and must be paid by the requestor in advance of any work being commenced. (3) Any unused amounts paid by the requestor in advance will be refunded to the requestor at the conclusion of the work. 13 Except for the fees outlined in section 11, all of the fees set out in Part 1 do not apply to transactions initiated by the Government of Canada, the Government of Alberta, a municipality or an organization as defined by the Rural Utilities Act in Alberta. 14 All of the fees set out in Part 1 are non-refundable, unless specifically stated. Part 2- Royalties, surcharges and security deposits 15 The royalties payable with respect to surface materials are as follows: (1) The royalty is $1.20 per cubic yard for a. gravel; or b. a combination of sand and gravel. {2) The royalty is $1.00 per cubic yard for manufacturing clay. {3) The royalty is $0.70 per cubic yard for a. sand ; or b. silica sand. {4) The royalty is $0.40 per cubic yard for topsoil. {5) The royalty is $0.20 per cubic yard for a. non-manufacturing clay; or b. silt. {6) The royalty is $0.10 per cubic yard for a. marl ; or b. peat moss. 16 The surcharges for licences issued at public pits are as follows: {1) The reclamation surcharge of $0.10 per cubic yard is payable for public pits not operated by Environment and Sustainable Resource Development (ESRD). {2) The surcharge for reclamation, management and administration of public pits operated by ESRD is payable in an amount established with respect to the specific public pit.
17 The following security deposit is required for removal of approved surface materials pursuant to a Surface Material Lease or a Surface Material Licence (1) No security deposit is required in relation to removal of peat moss. (2) Cash deposit of $1000 per acre, but not less than $250 per acre if circumstances warrant, on the approved operating areas or acceptable negotiable security in a similar amount. (3) Paid security deposits are refundable upon the completion of reclamation requirements being met. Part 3 - Rents 18 The rents payable for the agricultural public land activities are as follows: (1) Cultivation permit a. $6.00 per cultivated acre per year, and b. $1.20 per uncultivated acre per year. (2) Farm Development Lease a. Adjusted market rental value for cultivated areas, b. Applicable grazing rates, as established under section 103 of the Public Lands Act, for areas restricted from cultivation, c. Miscellaneous Lease rental rates, as outlined in section 20 below, for the area used for residential purposes, and d. 6% of the appraised value of Crown improvements used by the leaseholder. {3) Forest Reserve Head Tax Permit a. $3.50 per Animal Unit Month for the Zone A, b. $3.00 per Animal Unit Month for the Zone 8, and c. $2.05 per Animal Unit Month for the Zone C. {4) Hay Authorization a. $7.50 per ton for native hay, and b. $15.00 per ton for tame hay. 19 The rents payable for public land activities authorized under a Licence of Occupation are a minimum of $50 per year and can be paid in advance for the term of the disposition as follows: {1) Roadways and ice bridges a. $5.50 per mile for widths up to 50 feet, b. $13.50 per mile for widths 51 feet to 75 feet, c. $16.50 per mile for widths 76 feet to 100 feet, and d. $20.50 per mile for widths greater than 100 feet. (2) $2.00 per acre per year for a. airstrips and heliports, b. reservoirs, c. cooling ponds,
d. settling ponds, and e. ski slopes. (3) No rent is payable in relation to a road for public works purposes where the licence is issued to a municipal government or public body. 20 The rents payable for public land activities authorized under a Mineral Surface Lease are as follows: (1) First year rents for oil and gas wells are calculated as follows: Rent = R x acreage + TO x acreage where R is: $200 for Grey Wooded Soil Zone, $250 for Brown Soil Zone and Dark Grey Soil Zone, $340 for Dark Brown Soil Zone, $440 for Thin Black Soil Zone, and $450 for Black Soil Zone; and where TO is equal to the timber damage rate in the Green Zone set out in the Timber Damage Assessment Billing Rate Table. (2) Rents for oil and gas well for subsequent years are a. $360 per acre per year for areas less than or equal to five acres, and b. $21 per acre in excess of five acres per year. (3) First year rents for surface mines and quarries (including oil sands but not including surface coal mines) are calculated as follows: Rent= R x area disturbed where R is as outlined in section 20(1) above. (4) Rents for surface mines and quarries for subsequent years are a. $360 per acre per year up to five acres, and b. $10.50 per acre in excess of five acres per year. (5) Rents for surface coal mines are a. $25 per acre per year for disturbed areas, and b. $5.00 per acre per year for undisturbed and reclaimed areas. 21 The rents payable for public land activities authorized under a Miscellaneous Lease are as follows: (1) Right of way agreements, including easements a. Issued to a rural electrification association i. $0 b. Issued to a municipal government or other public bodies i. $50.00 one time lump sum payment c. Issued to all other easement holders
i. $100.00 per acre one time lump sum payment, and $25.00 per acre on areas free of standing trees, as a one time lump sum payment. (2) Residential purposes- unserviced year round residence a. $150 per year for areas less than one acre, b. an additional $50 per acre per year for areas from one to five acres, and c. an additional $10 per acre per year for areas over five acres. (3) Residential purposes- serviced year round residence a. $400 per year for areas less than one acre, b. an additional $50 per acre per year for areas from one to five acres, and c. an additional $1 0 per acre per year for areas over five acres. (4) Recreational cottage- unserviced, unsurveyed seasonal residence a. Non-frontage lots i. $150 per year for areas equal to or less than one acre, and b. Frontage lots an additional $150 per acre per year for areas greater than one acre. i. Rates as above for non-frontage lots, and an additional $2.00 per front foot per year. (5) Recreational cottage- serviced, surveyed seasonal residence a. Non-frontage lots i. $400 per year for areas equal to or less than one acre, and b. Frontage lots an additional $150 per acre per year for areas greater than one acre. i. Rates as above for non-frontage lots, and (6) Industrial/Commercial purposes an additional $2.00 per front foot per year. a. $400 per year for areas less than one acre, b. an additional $50 per acre per year for areas one to five acres, and c. an additional $10 per acre per year for areas over five acres. d. within Incorporated Urban Centres, Bow Corridor and the Kananaskis Improvement District is calculated as follows, with a minimum rent of $400 per year: i. 5% per year of appraised land value on intensive uses areas, i 2% per year of appraised land value on non-intensive areas, and 2% per year of appraised land value on commercial recreation or tourism areas.
(7) Horse holding sites a. $200 per acre per year for areas less than or equal to 20 acres, and b. an additional $5.00 per acre per year for areas over 20 acres. (8) $5.00 per acre per year, with a minimum of $50, for a. utilities, or b. public works conducted under an authorization issued to a municipality (including municipal corporations) or an improvement district. (9) 6% of appraised value per year for use of buildings, sites and improvements. (10) $100 or $10 per acre lump sum, whichever is greater, for recreational purposes conducted under an authorization issued to a non-profit organization or society, incorporated under the Societies Act, or a municipality (including municipal corporations) or an improvement district. (11) $1.00 per year, lump sum payable in advance, for managing recreational activities in natural areas or wildlife preserves. 22 The rents payable for public land activities authorized under a Miscellaneous Permit are as follows: (1) Miscellaneous Lease rate x 0.55 for a. trail riding base camp, and b. hunting and/or fishing tent camp. (2) $50 per acre plus timber damage and security deposit (where applicable) for rig storage sites. (3) Miscellaneous Lease rate x 0.75 for all other activities authorized under a Miscellaneous Permit. 23 The rents payable for Pipeline Agreements are as follows: (1) One time, lump sum payment calculated as follows Rent = R x acreage where R is: $100 for Grey Wooded Soil Zone, $125 for Brown Soil Zone and Dark Grey Soil Zone, $170 for Dark Brown Soil Zone, $220 for Thin Black Soil Zone, and $225 for Black Soil Zone. (2) $33 per acre, one time lump sum payment, for using an existing pipeline right of way for installation of an additional pipeline. (3) No rent is payable by a Gas Co-operative for locating pipelines on public lands. 24 The rents payable for a Pipeline Installation Lease are (1) First year rents for a Pipeline Installation Lease are calculated in the same manner as first year rents for oil and gas wells under section 20(1) of this Order.
(2) Rents for subsequent years of a Pipeline Installation Lease are a. $360 per acre per year for areas less than or equal to five acres, and b. $21 per acre in excess of five acres per year. 25 The rents payable for public land activities authorized under a Surface Material Lease are as follows: (1) $7.00 per acre per year for the removal of a. sand, b. gravel, C. clay, d. topsoil, or e. marl. (2) $1.00 per acre per year for the removal of peat moss. 26 The rents payable for public land use under a Temporary Field Authorization are as follows: (1) Temporary Access, a minimum of $50, calculated as follows: a. $5.50 per mile for widths up to 50 feet, b. $13.50 per mile for widths 51 feet to 75 feet, c. $16.50 per mile for widths 76 feet to 100 feet, and d. $20.50 per mile for widths greater than 100 feet. e. $300 one time payment for temporary campsites associated with the construction of an authorized activity. (2) For all other activities, rents are calculated in the same manner as section 20(1) above.
