You may decide how fast you study, and you are free to proceed with the program at your own pace. Each program requires approximately one to four months of full-time study to complete, depending on program selected, and it is expected that students who embark on a program do so with an understanding of the length and rigors of the curriculum. Full Programs: The Medical Transcription Editor, Professional Medical Coding and Billing, Medical Transcription, Medical Administrative Assistant with EHR, Pharmacy Technician, Computer Technician, Medical Administrative Assistant, Healthcare IT, Medical Billing, and Executive Assistant programs may be hereinafter referred to as "Full Programs." Each Full Program requires approximately one to four months of full-time study to complete, depending on program selected. Upon successful completion of a Full Program and its corresponding final exam, provided that your account is current, you will receive a certificate of graduation from Career Step. Upon successful completion of a Full Program and its corresponding final exam, provided that your account is current, you will receive a certificate of graduation from Career Step. Each Full Program below includes a series of textbooks correlated with the online curriculum. These books will be delivered in an ebook for the selected program. If any payment plan is selected, all shipping & handling and sales tax will be paid at time of enrollment. Admission Requirements: In order to be admitted, you must be at least 18 years of age and either a) have a high school diploma or a General Education Development Certificate (GED), or b) pass the Career Step Pre-Enrollment Assessment Test. The Career Step Pre-Enrollment Assessment Test cannot be used in lieu of a High School diploma or GED for the Professional Medical Coding and Billing Program. You must agree to abide by the terms of this Enrollment Agreement. Strong skills in the reading, writing, and speaking of standard American English are recommended. 4. System Requirements: Since the course is completely online, your computer will play an important role in your learning experience. Transfer of Prior Credit: Career Step does not accept course credit from other educational institutions. Career Step does not offer challenge exams in order to waive participation in a program. Students are required to complete all program materials in order to adequately develop and refine their skills in preparation for the final exam and in preparation to get a job, regardless of prior training or experience. 6. Career Step may from time to time offer free course extension vouchers or other promotions. Such promotions are conditional upon your timely fulfillment of all obligations under the Enrollment Agreement including payment of all amounts as they become due. Vouchers and promotions are voidable at the option of Career Step if you breach this Agreement in any way. 7. Final Exam: If your program includes a final exam, Career Step requires you to pass each portion of the final exam to receive a certificate of graduation. You may contact Student Support to find out what score you need to achieve to pass the final exam for your respective program. The final exam may be taken as many as three times, each retake being a new and different exam. 8. Payment, Late Fees and Collection Costs: Subject to the refund exceptions set forth in Section 20, withdrawal from the program or termination of this Agreement does not entitle you to a refund of any kind or release you from any financial obligations you may have to Career Step. Full Programs: Payments are due by the 25th of each month, except those for students who are on an automatic payment plan. Unless otherwise agreed by Career Step, payments are due (and will be charged by Career Step) on the same day of the month as the enrollment date; or, if such day of the month does not occur in a particular month, on the last day of that month. All students who have chosen a four-month payment plan will be placed on an automatic payment plan, unless otherwise agreed by Career Step. Late payments will be assessed a fee of $10.00 or 5% of the payment amount, whichever is less per incident, and returned payments (Non-Sufficient Funds) will be assessed a fee of $20.00 per incident. If full payment is not made as specified, you agree to pay all collection costs, including: interest on the outstanding portion of the bill at a rate of 18% per annum, reasonable attorney fees, and a collection agency commission of up to 40%. At its option, Career Step 9
may also suspend or terminate your access to the program for non-payment or for any other breach of this Agreement. Supplemental Programs: Payment in full is required before you will be given access to your program, except with respect to the Medical Transcription Refresher program. Access will be given to the Medical Transcription Refresher program after the first full installment payment. 9. Information Release: You represent that all of the information you provide to Career Step in the Application for Enrollment (the "Application") is true and correct to the best of your knowledge and may be relied upon by Career Step. You hereby authorize Career Step and its designated agents and representatives to conduct comprehensive reviews of your credit history causing such consumer reports to be generated as Career Step deems necessary in connection with the review of the Application and/or the collection of any credit extended in reliance on the Application. You further authorize any person, consumer reporting agency, firm, corporation or public agency to divulge to Career Step or its designated agents or representatives any and all information pertaining to you that it may have or obtain in response to such inquiries, whether verbal or written. Finally, you hereby release Career Step and its officers, directors, shareholders, agents, and representatives from any and all liability for damages of any kind, which may result to you as a result of the actions authorized by this release. A photocopy or facsimile of this form shall be treated as an original. 10. Ownership; No Shared Access: All contents of Career Step's books, ebooks, CDs, and online programs are copyrighted under the laws of the United States. You may not copy or reproduce these materials in any form and agree that you will not do so. This includes the sharing of passwords or access information to the online version of the program materials. Violators of this policy are subject to immediate dismissal from the program and legal remedies, without refund or recourse. The program materials and associated program enrollment are licensed to you only and are nontransferable. Exceptions to this are by the express written consent of Career Step only. 11. Graduate Services: Graduate services are included with each full program. Graduate Services are specific to each program and are as follows: Medical Transcription or Medical Transcription Editor Program: Personal employment consultation with an employment specialist, resume evaluation and feedback, access to Career Step's employer information database, employment tutorial guides, and access to the graduate help hotline for the first year after graduation. Professional Medical Coding and Billing, Medical Office Manager, Career FastTrack: Medical Coding, or Healthcare IT Program: Personal employment consultation with an employment specialist, resume evaluation and feedback, employment tutorial guides, and access to the graduate help hotline for the first year after graduation. 10
Medical Administrative Assistant with EHR, Pharmacy Technician, Computer Technician, Medical Administrative Assistant, Medical Billing, or Executive Assistant Program: Personal employment consultation with an employment specialist, resume evaluation and feedback, employment tutorial guides, and access to the graduate help hotline for six months after graduation. Supplemental Programs: Graduate services are not provided with enrollment in Supplemental Programs. 12. Appropriate Conduct: All students with access to Career Step's student forum, chat room, and Classroom student message service (collectively, the Forums ) agree to be bound by and comply with the applicable Rules and Terms of Service for those services (the Forum Rules ), which are located on Career Step s web-site, and to conduct themselves appropriately and to use these resources in a positive manner for the legitimate benefit of themselves and other students. Violation of the Forum Rules, including without limitation illegal conduct, profane language, and inappropriate discussion, may result in immediate dismissal from the program and the pursuit of legal remedies, without refund or recourse. You will also be solely responsible and liable for any claims or damages caused by your violation of the Forum Rules, including any damages caused to Career Step. 13. Re-enrollment Policy: If you are dismissed from the program for any reason, or allow your enrollment and/or extensions to lapse for a period longer than six months, you may apply for re-enrollment in the program at the discounted re-enrollment price offered at the time of the re-enrollment.. Upgrades or extra options are chargeable at 100%. Reenrollment will provide you with online program access for an additional term. The length of the re-enrollment term for each program will be identical to the length of the initial term, as set forth in Section 6. Supplemental Program Re-enrollment: If you are dismissed from the program for any reason, or allow your enrollment and/or extensions to lapse for a period longer than one day, you may re-enroll in the program at the then-current full price 14. Registration and Accreditation Disclaimer: Career Step is registered under the Utah Postsecondary Proprietary School Act (Title 13, Chapter 34, Utah Code); however, this registration does not mean that the State of Utah supervises, recommends, or accredits the institution. It is your responsibility to determine whether credits, degrees, or certificates from the institution will transfer to other institutions or meet employer training requirements. This can be done by calling the prospective school or employer. The institution is not accredited by a regional or national accrediting agency recognized by the United States Department of Education. 15. No Warranties: Career Step neither warrants nor represents that Student is qualified for any profession or, upon successful completion of or graduation from the program, will be so qualified. Because students aptitudes vary and job markets change, Career Step cannot and does not now or in the future, either written or verbally, guarantee job placement to graduates upon their successful completion of or graduation from the 11
program. CAREER STEP DISCLAIMS ALL WARRANTIES WITH RESPECT TO ITS PROGRAMS, MATERIALS, WEB-SITE, FORUMS AND SERVICES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT NOT PROHIBITED BY APPLICABLE LAW. 16. LIMITATION OF DAMAGES: UNDER NO CIRCUMSTANCES SHALL CAREER STEP BE LIABLE FOR ANY DAMAGES, INCLUDING DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, THAT RESULT FROM THIS AGREEMENT, THE REFERRAL PROGRAM (SEE SECTION 21 BELOW), OR YOUR ENROLLMENT IN ITS PROGRAMS OR FROM THE FORUMS OR OTHER CAREER STEP SERVICES, EVEN IF CAREER STEP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CAREER STEP'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE) OR OTHERWISE, EXCEED THE AMOUNTS PAID BY YOU TO CAREER STEP. 17. Entire Agreement: This Enrollment Agreement, together with the Career Step Training Program Privacy Policy and License Agreement, when signed or electronically accepted by Student and then approved and accepted by Career Step, represents the full and complete terms of the agreement between Career Step and you regarding the subject matter hereof. 18. Legal Actions: This Agreement shall be governed by the laws of the State of Utah. The parties agree that venue shall be in Utah courts for any disputes arising between the parties and both parties agree to the personal jurisdiction and venue of such courts and waive any right to assert otherwise. In any action between the parties, which arises out of or relates to this Agreement, the prevailing party, in addition to all other rights or remedies, shall be entitled to an award of its costs incurred in connection with the action, including reasonable attorney's fees and costs. 19. Miscellaneous: This Agreement may not be modified or amended except in writing signed by the parties hereto and specifically referring to this Agreement. If any provision of this Agreement is found to be void or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable; or, if it cannot be so modified, it shall be severed and the other provisions of this Agreement shall remain in full force and effect. 20. TERMINATION RIGHTS AND REFUND POLICY: Please review this Section carefully so that you are aware of Career Step s termination and refund policies. You are not entitled to any refund from Career Step except as set forth below. By signing this Agreement you are agreeing to these rights and limitations. (a) 3-Day Right to Rescind: You have a right to rescind this Agreement and receive a full refund of any amounts paid to Career Step, which you must exercise (if you so choose) in writing within three (3) business days from the day you submit the online application or sign the written application. You must deliver a written rescission of this 12
Agreement to Career Step within such 3-day period, or if the rescission is mailed, it must be postmarked on or before the last day of the 3-day period. Prior to receiving the refund, you must first return all program materials and supplies sent to you, as set forth in subsection (d) below. (b) 14-DAY MONEY BACK POLICY: In addition to the rescission rights set forth in subsection (a) above, you may also withdraw from the program for any reason within 14 days after the date you first receive access to online program materials, which is the date of the email sent to you containing your password and login for the online program. In this case, this Agreement shall be rescinded and Career Step will refund your money IN FULL, less a $50 application fee and any initial shipping and handling fees, provided that you first return all program materials and supplies as set forth in subsection (d) below. (c) No Refund After 14 Days: If, for any reason, you withdraw after the initial 14-day review period, you are not released from your obligation to pay the program fees in full and you are not entitled to any refund from Career Step. (d) Materials: Before receiving any refunds under subsections (a) or (b), you must first return any and all program materials and supplies received from Career Step. You must notify Career Step before the last day of the termination period to receive a return code, and returned materials must be sent to Career Step at your expense, insured and tracked through the carrier. Please pack returned materials carefully to prevent damage. After returning program materials to Career Step, you must also destroy all copies of program materials you may have, including all downloaded copies, backup copies, printed or written copies, and derivative works of any kind. (e) Termination: If you withdraw under this Section 20, your enrollment is terminated and you may not transfer your program materials to any other person. 21. Referral Program: The Career Step Referral Program allows you to receive a payment from Career Step when you refer a qualifying new student and are in compliance with the Career Step Referral Program Terms and Conditions found at http://referral.careerstep.com/termsandconditions.php. 22. Truth in Lending Disclosures: The U.S. Government Requires These TRUTH IN LENDING DISCLOSURES. NOTICE TO THE BUYER: (1) Do not submit this agreement before you read it or if it contains any blank spaces. (2) Under the law, you have the right to pay off in advance the full amount due without penalty. NOTICE: ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY DEBTOR. 13
