East Central University Athletic Department Drug Policy (Updated July 2008)
1.0 ECU Athletic Department Drug Testing Policy 1.1 General Information The East Central University Athletic Department is strongly opposed to the use and abuse of illegal drugs (street & performance), NCAA banned performance enhancers, alcohol, underage drinking, and tobacco products. The use of illegal substances is not only detrimental to the physical and mental wellbeing of the student-athlete but is against the law and violates the East Central University Drug Policy. 1.2 Drug Education Program A trained counselor or staff personnel will present the drug education program annually to all student-athletes, the term student-athletes will refer to all student-athletes, cheerleaders, and pom squad members. The program will be mandatory for all student-athletes and head sport coaches (responsible for supervising attendance). The program will focus on: 1. Examination of personal and social attitudes toward illegal drugs (street & performance), NCAA banned performance enhancers, alcohol, underage drinking, and tobacco products. 2. Information on the effects of different types of drugs. 3. East Central University s prohibition of drug use and possession, and disciplinary action for violating rules. 4. Information and video on the NCAA regulations and drug testing policies. 5. Information on the ECU Athletic Department Drug Testing Policy and Procedure. 6. Question and answer period. 1.3 Drug Testing All ECU student-athletes fall under the guidelines of and therefore must follow the East Central University Drug Policy. ECU s Drug Policy consists of random drug testing done throughout the year and selective drug testing done based on reasonable suspicion that a student-athlete is involved in the use of drugs or alcohol which will contradict fitness for the rigors of the sport and poses a risk to health of the student-athlete. East Central University will test for illegal drugs (street drugs) and/or performance enhancers banned by the NCAA. Some of these NCAA banned substances are found in supplements sold legally at a most nutrition stores. A list of these substances if available from the Staff Athletic Trainers but still may not appear on the supplements label. 1.4 Drug Testing Procedural Guidelines 1. All student-athletes will be required to sign a consent form as a condition of athletic eligibility, prior to being able to participate with the team, giving the ECU Athletic Department permission to test the student-athlete at any time. 2. When a student-athlete is selected for testing he/she will be instructed of when to show up for the testing by either the Drug Testing Program Director or the student-athlete s head coach. There is no minimum or 24 hour notification time. East Central University student-athletes can be tested immediately after test selection notification, meaning that no notice testing is permissible. 3. Failure to appear for a scheduled drug test will be treated as a positive drug test. 4. The student-athlete will report at the time of the test and be expected to give a urine sample in the presence of an official collector. 5. The sample will then be tested. There are two methods of testing: On Site Testing and Laboratory Testing. During On Site Testing the A sample will be screened on sight, if found to be positive, the B sample will be sent to an accredited independent laboratory where it will be further tested. If the A sample is found to be negative, the B sample will be disposed of on site. During Laboratory Testing the samples will be sent to an accredited independent laboratory for testing. If the A sample, is found to be positive, the B sample will be unsealed and tested. 6. The Drug Testing Program Director will be notified of the results and will then notify the Director of Athletics and the student-athlete s head coach of the results. The Drug Testing Program Director and the studentathlete s head coach will then hold a meeting with the student-athlete to inform them of the test results and to talk about the necessary disciplinary steps that must be taken. Parents/guardians will be notified by telephone of the positive drug test by an appropriate ECU representative. A follow-up letter will be sent from ECU to the parent/guardian detailing the positive drug test and the disciplinary actions and steps to follow. 7. With a student-athlete having a positive drug test, repeat drug testing will be performed as often as deemed necessary by the Drug Testing Program Director, Director of Athletics, and head sport coach. 8. Failure to comply with repeated drug testing constitutes a positive test.
9. If a student-athlete does not comply with the guidelines set forth by the Drug Testing Program Director, Director of Athletics, and head sport coach for a positive test they will be immediately suspended from the team and their athletic scholarship shall be revoked. They will be unable to participate with the team until all guidelines have been met and the student-athlete has been granted admission back onto the team by the studentathlete s head coach. 1.5 Penalties for Positive Tests Student-athletes, Cheerleaders and Pom Squad Members A. The Drug Testing Program Director will notify the Director of Athletics, and the student-athlete s head coach. B. The student-athlete s parents or guardian will be notified. C. The student-athlete will be continually re-tested as often as deemed necessary. D. The student-athlete will be required to participate in counseling at the ECU counseling center or with a private counselor (done at the student-athlete s expense). E. The student-athlete will perform no less than twenty hours of community service, arranged by the studentathlete s head coach. F. The student-athlete will be suspended for a minimum of one sanctioned intercollegiate athletic contest (e.g. scrimmages shall not be counted as game suspensions). G. All athletic scholarships for the student-athlete may be terminated. A. The Drug Testing Program Director will notify the Director of Athletics, and the student-athlete s head coach. B. The student-athlete s parents or guardian will be notified. C. The student-athlete will be continually re-drug tested as often as deemed necessary. D. The student-athlete will be required to participate in counseling at the ECU counseling center or with a private counselor (done at the student-athlete s expense). E. The student-athlete will perform no less than forty hours of community service, arranged by the studentathlete s head coach. F. The student-athlete will be dismissed from the team for one calendar year from the date of the second positive test. G. All athletic scholarships for the student-athlete will be terminated. 3. Remedial Guidelines: Third Offense A. The student-athlete will be permanently banned from intercollegiate athletics at East Central University. 1.6 Penalties for Positive Tests Student/Graduate Assistant Coaches, Athletic Trainers, & Managers A. The Drug Testing Program Director will notify the Director of Athletics, and the head coach. B. The student/ga coach, athletic trainer, or manager s parents or guardian will be notified. C. The student/ga coach, athletic trainer, or manager will be continually re-tested as often as deemed necessary. D. The student/ga coach, athletic trainer, or manager will be required to participate in counseling at the ECU counseling center or with a private counselor (done at the student-athlete s expense). E. The student/ga coach, athletic trainer, or manager will perform no less than twenty hours of community service, arranged by the head coach/athletic trainer. F. The student/ga coach, athletic trainer, or manager may be immediately terminated from employment in the East Central University Athletic Department. A. The student/ga coach, athletic trainer, or manager will be permanently banned from working for the East Central University Athletic Department. 1.7 Penalties for Positive Tests Athletic Training Education Program A. The Drug Testing Program Director will notify the Director of Athletics, and the Program Director. B. The student-athletic trainer s parents or guardian will be notified. C. The student-athletic trainer will be continually re-tested as often as deemed necessary.
D. The student-athletic trainer will be required to participate in counseling at the ECU counseling center or with a private counselor (done at the student-athlete s expense). E. The student-athletic trainer will perform no less than twenty hours of community service, arranged by the Program Director. F. The student-athletic trainer will be suspended from the athletic training room for a minimum of one month. A. The student-athletic trainer will be permanently banned from the East Central University Athletic Training Education Program. 1.8 Two-Sport Student-Athletes Two-sport student-athletes still must follow the same 3 offense outline as everyone else. If a student-athlete tests positive in their first sport the penalty will only count against that particular sport. However, the student-athlete s head coach of the second sport has the right to test the student-athlete as soon as they begin to practice with that particular sport. If the student-athlete tests positive for the second sport, even though only first offense for that particular sport, it brings the student-athletes total to two offenses meaning that they are subject to the disciplinary action of a second offense. 1.9 Appeal Procedure An appeal procedure is available to any student-athlete who produced a positive test. The appeal will be heard by the Drug Testing Program Director, Director of Athletics, and the student-athlete s head coach. A second test may be conducted at the student-athlete s personal expense within 24 hours of the first positive test result. 1.10 Safe Harbor Program 1. Self-Referral A student-athlete who has engaged in prohibited drug or alcohol use is encouraged to seek assistance from the East Central University Athletic Department by voluntarily disclosing his or her use. A student-athlete eligible for the Safe Harbor Program may refer himself or herself to the Safe Harbor Program for voluntary evaluation and counseling. If the student-athlete seeks assistance prior to being identified as having violated this policy or prior to being notified that he or she must undergo screening, the impermissible use will not be deemed an offense for purposes of determining sanctions under this policy. A student-athlete will not be permitted to enter the Safe Harbor Program thirty (30) days prior to NCAA or Conference postseason competition. 2. Treatment Plan East Central University Athletic Department will work with the student-athlete to prepare a Safe Harbor treatment plan, which may include confidential drug testing. If the student-athlete tests positive for a banned substance upon entering the Safe Harbor Program, that positive test will not result in any administrative sanction unless the student-athlete tests positive in a subsequent test or the student-athlete fails to comply with the treatment plan. (The team physician may suspend the student-athlete from play or practice, if medically indicated.) A student-athlete will be permitted to remain in the Safe Harbor Program for a reasonable period of time, not to exceed 30 days, as determined by the treatment plan. 3. Removal from the Safe Harbor Program Failing to complete the treatment recommended by the counselor, having a positive test for any banned substance after entering the Safe Harbor Program, or having a positive result on a reentry test will be deemed a Second Positive Result under this policy. 4. Safe Harbor Protection While in compliance with the Safe Harbor Program treatment plan, the student-athlete will not be included in the list of student-athletes eligible for random drug testing by East Central University Athletic Department. Student-athletes in the Safe Harbor Program, however, may be selected for drug testing by the NCAA or other organizations. 5. Confidentiality of the Safe Harbor Program The Drug Testing Program Director, Director of Athletics, Head Sport Coach and if the student-athlete consents, the student-athlete s parents or guardians will be informed of the student-athlete s participation in the Safe Harbor Program. The team physician assigned to that sport may also be notified, if medically appropriate. The assistant coach (es) may also be informed at the discretion of the head coach. Other university employees may be informed only to the extent necessary for the implementation of this policy.
1.11 Student-Athlete Advisory Committee (SAAC) Purpose or Function: The Student-Athlete Advisory Committee shall serve in an advisory role to the Athletic Department. The committee will advise and initiate recommendations to increase preventative, educational, research and collaborative efforts on campus to improve the overall physical and behavioral health of the student athlete. 1.12 Coaches' Role It is the responsibility of the head coach to ensure that their student-athletes follow through with all responsibilities regarding their assessment, treatment, or aftercare programs. 1.13 Violation of State or Federal Law Any criminal violation of state or federal laws involving the possession or sale of any drugs or illegal substances by student-athletes will be dealt with using the procedures outlined in the Student-Athlete Code of Conduct. 1.14 Drug Testing Consent Form A copy of the Department of Athletics Drug Testing Consent form is included in the back of this handbook with all other forms to be signed by all student-athletes. 1.15 Tobacco Ban NCAA Bylaw 30.15.20 No student-athlete, coach, or game official may use any form of tobacco during practices or games. 1.16 Department of Athletics Policy on Tobacco The East Central University Department of Athletics strongly discourages the use of all tobacco products. Use of tobacco products while representing the University in any capacity is prohibited. 1.17 Department of Athletics Drug and Alcohol Policy Purchase or use of alcohol or any other drugs by student-athletes during any East Central University sponsored athletic trip or event is prohibited. This policy also pertains to students who are of legal drinking age, and includes all trips, even those trips for which student-athletes may have paid part of the expense. 1. No alcohol is to be served at team meals, team functions or team banquets. 2. No alcohol or any other drug should be used on any buses or vans transporting ECU student-athletes to and from athletic contests and ECU sponsored events. 3. No alcohol or any other drug may be purchased with money allocated for team travel; this pertains to coaches and staff as well. 4. The use of alcohol while representing East Central University in any capacity is prohibited. 5. The use of illegal or non-therapeutic drugs at any time is prohibited. 6. The use of alcohol at any time during an unofficial or official recruiting visit is prohibited. The Tobacco, Drug and Alcohol Policy apply to all coaches, Department of Athletics staff members and studentathletes. Team rules may supplement the above policy. 1.18 Policy Changes The above policies (1.1 1.17) are subject to change at any time with out prior notification. Notifications will be made public through the ECU Athletic Website.

The student/ga coach, athletic trainer, or manager will be permanently banned from working for the East Central University Athletic Department. Appeal Procedure An appeal procedure is available to any student/ga coach, athletic trainer, or manager who produced a positive test. The appeal will be heard by the Drug Testing Program Director, Director of Athletics, Dean of Students, and the head sport coach. A second test may be conducted at the student/ga coach, athletic trainer, or manager s personal expense within 24 hours of the first positive test result.
