SECTION VI: TERMS AND CONDITIONS / FLIGHT TRAINING Covenant Not to Sue, Liability Release, and Assumption Of Risk Agreement I,, hereby affirm that I am aware that flying and activities associated with flying have inherent and unforeseeable risks which may result in serious injury or death. I understand and agree that neither my instructor nor Aviation Specialists, Inc., nor any of their respective employees, officers, agents, contractors, or assigns, (hereafter referred to as Released Parties ) may be held liable or responsible in any way for any injury, death, or other damages to me, my family, estate, heirs or assigns that may occur as a result of my participation in flying aircraft, flying in aircraft, flight instruction, aircraft rental, aircraft operations, ramp operations, or any associated activities involved with these activities, (hereafter referred to as Flight Activities), or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to participate in Flight Activities, I hereby personally assume all risks of Flight Activities, whether foreseen or unforeseen, that may befall me while I am participating in these activities. I further release, exempt, and hold harmless the Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns, arising out of my participation in Flight Activities including both claims arising during any course of training or after I receive my pilot certification(s). I also understand that Flight Activities are physically demanding and that I must seek the ongoing care of a licensed and authorized aviation medical examiner and that I will not hold Released Parties responsible for events resulting from my physical condition, limitations, or incapacitation. I further state that I am of lawful age and legally competent to sign this liability release or that I have acquired the written consent of my parent or guardian. I understand the terms herein are contractual and not merely recital and that I have signed this document of my own free act and with the knowledge that I hereby waive my legal rights. I further agree if any provision of this Agreement is found to be unenforceable or invalid, that provision may be served form this agreement; however the remainder of this agreement shall then be construed as though the unenforceable provision had never been contained therein. I, BY THIS INSTRUMENT AGREE TO EXEMPT AND RELEASE MY INSTRUCTORS, AVIATION SPECIALISTS, INC., AND ALL RELATED ENTITIES AS DEFINED ABOVE FROM ALL LIABILITY OR RESPONSIBILITY WHATSOEVER FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH HOWEVER CAUSED, INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OF THE RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. SECTION VII: AIRCRAFT RENTAL AGREEMENT (For SOLO students and certified pilots) In consideration of rental to the undersigned Lessee by Aviation Specialists, Inc. (ASI, Lessor) of aircraft for flight time, Lessee agrees that for each flight made on or after the date this Agreement is signed, Lessee shall be bound by the following terms and conditions. Lessee agrees and understands that Lessor provides aircraft rental as a convenience to the Lessee, and Lessor shall in no event be liable to Lessee or Lessee s passengers for any inconvenience, loss or damage arising from any maintenance or repairs that might arise during a flight that might interrupt or delay the Lessee s scheduled arrival to or departure from any airport. Lessee hereby assumes all risk of loss or damage associated with delays that might arise during a flight due to mechanical, electrical, or electronic failure of any aircraft system or component, as well as delays caused by inclement weather. Lessee shall: General Rules and Regulations a. Submit to a logbook review, local checkout flight, and ground evaluation with the ASI designated flight instructor prior to any flights in Lessor s aircraft. Aircraft flight time and flight instructor fees to be paid by Lessee. b. Ensure a copy of identification, proof of U.S. citizenship, current medical certificate, pilot license(s) and ratings are on file with ASI, and ensure prompt notification of any changes. c. Upon request, show pilot logbook for flight experience verification prior to aircraft dispatch. d. Agree to pay a one-time fee of $300 (non-refundable) for the privileges of this continuing rental agreement, and in good faith attempt to fly a minimum of two flight hours per calendar month for proficiency and currency. e. Further agree that if the two hours per month are not flown (can be averaged over a period of three calendar months), Lessee s account will be charged the two-hour minimum per month at the current rate per hour. f. Maintain a positive account balance equivalent to a minimum of two flight hours. Schedule each flight in advance using Schedulemaster and be responsible for updating any schedule changes, as appropriate. Repeated no-shows will lose scheduling privileges. Lessor shall maintain the right to cancel any scheduled flights for maintenance or other reasons, based on aircraft need or inappropriate scheduling practices. g. Prior to each flight, complete a thorough pre-flight inspection of the aircraft, including a review of aircraft documents (AROW), its equipment and accessories; and not accept the aircraft unless satisfied regarding airworthiness and functional operation. h. Prior to each flight, complete a local weather check and not attempt to fly if forecasted or actual weather conditions exceed pilot qualifications and competence. i. Conduct each flight in a safe manner, in accordance with all applicable FAA and civil regulations. j. Ensure that the ASI Cockpit Logbook (in plane) is completed and left with the aircraft; and that any aircraft discrepancies are noted and the Lessor is notified by phone or email of any discrepancy to facilitate repairs, as well as to notify others. k. Ensure that the ASI post-flight checklist (envelope in lock box) is completed and turned in to Lessor, along with payment, fuel receipts, and aircraft keys. Hobbs time shall determine rental fee due, minus fuel purchases (up to a maximum of current fuel price at L38). l. Ensure that aircraft is refueled post flight and cleaned (leading edges and windscreen rid of bugs, trash removed, etc.); see that the aircraft is securely tied down in a proper area, master and ignition switches off, controls secured, covers installed, and doors locked. m. Use the aircraft only for the purpose(s) specified by Lessee s license, and in no event use it for transport of cargo or passengers for hire without express written consent of the Lessor. n. Not to smoke in the aircraft. If found to be in violation of ASI s non-smoking policy, all privileges as an ASI customer will be forfeited. o. Not allow other persons to act as pilot in command nor provide flight instruction unless registered with ASI insurance carrier as an authorized flight instructor. p. Comply with all federal, state, foreign and local air traffic safety regulations, as applicable. q. Agree to not permit a lien be placed upon aircraft without Lessor s written consent, and agree to pay all charges incurred in connection with the use of said airplane during term of rental or in Lessee s possession. r. Agree to pay all costs and reasonable attorney s fees incurred by Lessor in the event a legal suit or claim is instituted by Lessor to recover possession of the aircraft or to enforce any of the terms, covenants and conditions hereof, or to collect any sum or sums of money, damages, or costs from Lessee under this contract or any sum or sums of money for the use of aircraft by Lessee. Cross-Country Flights Lessee shall: a. Remit a $500.00 (refundable) deposit for an overnight cross-country flight, in addition to any credit balance with Lessor, to be applied, at Lessor s option to pay any cost or expense incurred by Lessor that shall be the responsibility of Lessee under this agreement. b. Fly or be charged a minimum of two (2) Hobbs flight hours on cross-country trips per calendar day. c. Obtain current weather reports and an appropriate FSS weather briefing immediately before cross-country flights, and unless instrument rated, shall not fly when weather conditions are below VFR minimums, or when such conditions are forecast for the route of flight. d. File an appropriate FAA flight plan for any cross-country flight of more than 50 nm from L38. e. Use only those paved landing fields designated in the FAA Airport/Facilities Directory, or using turf fields designated by the Lessor as approved landing fields, except in an emergency. f. Return aircraft at the scheduled time, weather permitting. Notify Lessor of delay ASAP by whatever means available, at Lessee s expense. g. Be responsible for proper servicing and security of aircraft at destination(s). h. Shall notify ASI immediately if aircraft is to be kept longer than originally planned for any reason, or if the original destination is not reached. i. Bear all personal expenses associated with any delays, whether due to mechanical failures or weather problems (e.g., meals, lodging, transportation, personal items, etc.) j. Bear and pay all costs associated with return of aircraft to home base in the event that Lessee is not able to return the aircraft to L38. This applies to weather delays, as well as delays caused by maintenance or repair time away from L38. Such cost borne by Lessee shall include, but not necessarily be limited to, commercial air travel for ferry pilot and/or mechanic, reimbursement of aircraft and pilot/mechanic expenses if transported in general aviation aircraft, ground transportation, ferry pilot/mechanic expenses, and Hobbs time for the return flight. k. In the event the Lessee cannot return the aircraft to L38 for any reason within 24 hours of the completion of required maintenance or repairs, then Lessor shall have the option of sending a ferry pilot to return the aircraft to L38 at Lessee s expense. l. Pay any and all landing, tie down, or hangaring fees or any other aircraft related fees, incident to flights away from L38. Maintenance repairs and damages: m. Lessee will not have repairs made to any part of the aircraft, or its equipment and accessories, without specific authorization from Lessor. Notify ASI immediately if there are urgent maintenance needs. n. In the event repairs are required while away from L38, the Lessee has the option of (1) returning by other means at his own expense, in which case expenses incurred in returning the aircraft to L38 will be charged to Lessee as stated in paragraph j above, or (2) remaining with the aircraft at the Lessee s expense until repairs have been completed enabling mission completion and return to L38. o. Lessee shall report any accident or incident to Lessor ASAP and to the FAA as required. Lessee shall furnish names and addresses of witnesses and all involved parties, and will not move or tamper with the aircraft unless directed to do so by the Lessor, appropriate FAA, airport, or civil authorities. p. In the event the aircraft is damaged due to his/her fault or negligence, the Lessee shall pay cost of repairs and any associated costs not covered by Lessor s insurance, such as but not limited to, Lessor s insurance deductible, aircraft and pilot ferry time. Lessee shall further be obligated to pay Lessor for the loss of use for each day the aircraft is out of service being repaired. This loss of use shall be defined as the Lessor s inability to rent the aircraft due to damage when the down time exceeds one week. The average daily rental income shall be computed based on the average rental over the previous six months. The loss of daily rental income shall be charged to the Lessee for each calendar day that the down time exceeds one week. Signed Print Date Witness Print Date Page 5 of 6
