Pre-qualifying the Contractor The Experience Modification Rate (EMR) is the ratio of actual losses over expected losses in a moving 3 year period. The moving three year period ends one year before the EMR becomes effective, and each year the loss experience for the earliest year is eliminated and a new year added. For example, a 2000 EMR reflects loss experience for 1998, 1997 and 1996. EMR s are used by insurance companies to set the manual rate premium to reflect an employer s variation from the average of others with the same classification code or codes. The manual rate is an insurance premium rate based on the type of work performed in a job classification such as pile driving, steel erection, boilermakers, etc. The rate is dollars per $100 in direct payroll. For example, the average manual rate for boilermakers is $10.27 per $100 in direct payroll. EMR s alone however do not completely reflect a contractor s safety performance since there is a bias in the calcuations where a large contractor can have a potentially very low EMR because of a large payroll. Thus, OSHA recordable incident rates should also be utilized to define a contractor s safety performance. It is not uncommon for contractor s with high EMR s and recordable incident rates to pay twice the premium costs for worker s compensation insurance of those with best safety performance.
Safety Rates & Ratios RIR - Recordable Incident Rate is number of OSHA defined recordable injuries x 200,000 divided by number of man hours TCIR - Total Recordable Case Incident Rate is RIR over a three year period LTWR - Lost Time Work Rate is number of lost time injuries x200,000 divided by number of man hours DART - 3 year days away, restricted, or transfer case incident rate Example provided of an extremely successful safety program wrap-up from 165 jobsites averaging 60 workers a day per site

(General Conditions Section 5.17) the Contractor will have primary responsibility for safety at the project site (OCIP Safety Standards) SITE SAFETY IS THE CONTRACTOR S RESPONSIBILITY! The Contractor is solely responsible for safety as per the construction contract; however, all parties on a project site are obligated to ensure safety and safe work conditions. (Construction Management Manual Section 14.9.4) Accountability to ensure the contractor is adhering to the specifications including safety is the OAR s responsibility Initiating safety partnering with the Contractor with the goal of zero injuries and incidents is the OAR s responsibility

OAR Responsibilities Review & Accept 1 Contractor s Project Safety Plan (PSP)/ Injury & Illness Prevention Program (IIPP) Review & Accept 1 Contractor s Emergency Action Plan Review & Accept 1 Contractor Safety Report Submittals Monitor Contractor safety meetings/orientations Immediately report on- and off-site incidents to Safety Office Ensure all site-visitors have required personal protective equipment Ensure adherence to all requirements of OCIP Manual and Safety Standards Ensure utilization of LAUSD Safety Office for training, audit assistance, incident investigation 1 Utilize Safety Office for review of proposed contractor safety submittals
OAR Responsibilities Frequently walk site & observe safety practices If an unsafe condition is observed: IMMEDIATELY notify Contractor and if correction is made on the spot ask how they will prevent incident from occurring again (root cause corrective action) ~ follow through with ensuring promises are executed If unsafe act or condition continues, inform LAUSD Construction Safety Manager (CSM), Senior PM & Regional PM and request written immediate corrective action of the Contractor Document contractor notification and cc: Safety Office; copy Safety Office on response by Contractor If a Serious condition is observed, STOP WORK in the affected area typically not the entire site
OAR Responsibilities Ensure Contractor has on-site copies of: Project Safety Plan with LAUSD comments incorporated That all workers are familiar with PSP/IIPP including all subcontractor workers Ensure Contractor has posted on-site copies of: Emergency telephone numbers & procedures CAL-OSHA Posters OCIP Wall Card Ensure OAR has at his/her desk: Emergency external telephone numbers Copies of OCIP Manual & Safety Standards Copy of Contractor Project Safety Plan Ensure OAR has posted: Internal LAUSD Emergency telephone numbers

Machine guarding What about the not so obvious grounding of the equipment? Is hearing protection required? Where is the fuel being stored? Fire extinguisher?
What does the Contractors PSP say about fall protection? Can the worker fall more than 6 feet? Did the worker access the roof in an acceptably safe manner? If a tool falls can it strike someone below? Do they have a regular harness and equipment inspection program?
Did the OAR have a 10 Day Look Ahead with the Contractor? Was an Excavation/Shoring Plan submitted by the contractor? Any issues with confined space? Who is the competent persons? Ladder to access excavation required?
