SPECIFICATIONS PART A - GENERAL 1. Scope of Work These specifications detail the requirements for the repair, refurbishment, and upgrading of a passenger lift installed at Binja San David, Triq San David, Mtarfa. The works involved include the following: i. Repairs works to existing lift; ii. Refurbishment and upgrading works as per T.E. Report (attached); iii. Testing and commissioning and placing the lift into operation. iv. Maintenance of the lift installation for two years. 2. Submittals The Tenderer shall be required to produce at tendering stage: i. Certificates of conformity for any safety components to be installed; ii. Method of placing the lift into service. 3. Quality Assurance Service Provider Qualifications: The Contractor shall have not less than five (5) years of satisfactory experience in the upgrading, refurbishment, repair and maintenance of lifts equal in character and performance to this project. In addition the Contractor must be competent to carry out the works as listed in the Bill of Quantities and as defined under the L.N. 231 of 2007 (Inspection of Lift Regulations). 4. Applicable Legislation & Standards The provision of the services shall comply with the latest versions of: L.N. 231 0f 2007 - Inspection of Lift Regulations; MSA EN81-1:1998 Electric Lifts; MSA EN13015 Maintenance of Lifts; I.E.E. Wiring Regulations; Electricity Supply Regulations as issued by the Enemalta Corporation; Design Guidelines Access for All; 89/336 EC Regulation (EMC) & 77/23 EC Regulation (Low Tension). Any deviations from the above standards must be clearly indicated by the Contractor at tendering stage. 2
5. Contractor s Responsibility The Contractor shall provide all the required material, tools, instruments and equipment as well as provide transport for his employees to and from the site of work. The Contractor shall be fully responsible for his employees and his equipment. He will also be held responsible for any damage, structural or otherwise, caused as a consequence of the works in progress to Government and/or third party property. This includes protection of all existing finishes while carrying out works. Any damage caused shall be made good by the Contractor at his own expense. The Contractor shall properly dispose of any debris and surplus material at the end of each working day. 6. Occupational Health & Safety The Contractor shall assume full responsibility and accountability regarding the health and safety of his/her employees and/or sub-contractors including any third parties involved in the execution of this contract. He shall also provide onsite all safety measures to ensure safety of third parties at all times during the works and until the installation has been fully completed. The Contractor shall be bound to conform to the Occupational Health & Safety Act as well as any other national legislation, regulations, standards, and/or codes of practice in effect during the execution of the contract, regarding health and safety issues, as they apply for the Contractor's particular operating situation and nature of work activities. 7. Storage The Contractor will not be offered storage facilities for material and equipment during the period of works. 8. Project Conditions 8.1 When the offers are evaluated, it shall be assumed that the respective Tenderers are well aware of the site conditions and have assured themselves of the necessary works required, verified all critical dimensions and examined all other conditions under which the works are to be executed. 8.2 On tender submittal the Tenderer, unless notifying in writing any unsatisfactory site conditions to be corrected including builders work, is accepting the existing site conditions. 8.3 Any deviations from the specifications, as well as valid reasons, must be clearly indicated by the Contractor at tendering stage. 3
9. Warranty The successful Tenderer shall submit the manufacturer's standard written warranty agreeing to repair, restore or replace defects in components supplied and workmanship not due to ordinary wear and tear or improper use or care for 24 months from the date of handover. This warranty needs also to cover for an additional 24 months any parts or equipment replaced in the initial 24 months warranty. 10. Maintenance 10.1 Furnish maintenance and call back service for a period of 24 months from date of the initial effective handover and acceptance of works. Service shall consist of periodic examination of the equipment, adjustment, lubrication, cleaning and supply of parts to keep the lift in proper operation. i. Maintenance work, including emergency call back repair service, shall be performed by trained employees of the Contractor during regular working hours. This service shall not be subcontracted. This service shall not cover adjustments, repairs or replacement of parts due to negligence, misuse, abuse or accidents caused by persons other than the Contractor. The maintenance work including servicing work shall be logged in a maintenance book purposely kept. For this purpose, the Contractor shall submit a maintenance agreement to be signed by the parties concerned for the provision of such service. 10.2 Tenderers shall include in their annual lump sum price for: - Eight (8) periodic preventive maintenance visits; - Assisting ACAB where required; - Emergency and normal repair call out within office hours; Prices for emergency call outs after office hours shall be submitted at hourly rates. 11. Tendered Rates The tendered rates shall be inclusive of all work as specified as well as any other works which are of a contingent or indispensable nature for completing the work in its entirety and to the satisfaction of the Engineer in charge. The rates shall be inclusive of all materials necessary, profits, landing charges and levies on all imported goods, all hire of plant and machinery required as well as all transport of materials to the site of works, but exclusive of VAT. Tenderers quoting on a delivered to store/site basis are to submit prices/rates inclusive of Customs Import Duty, Levy and any other charges, as applicable, but exclusive of VAT. Moreover, the successful bidder shall be bound to conform in all respects with VAT legislation and regulations. 4
12. Completion Period Tenderers are to state the shortest possible period for the completion of the works. However, all works shall be carried out within a maximum period of 15 weeks from the date of order to start works. If the Tenderer fails to declare his completion period it shall be assumed that the period of completion stipulated above is accepted. The time period may be a determining factor in the award of the contract. 13. Penalty for Delay Failure to complete works within the stipulated period shall entail a penalty of 50 per day of delay inclusive of Sundays and public holidays. 14. Insurance Cover The successful Tenderer shall take up and maintain at his own expense a policy for All Risks Insurance covering the full value of the contract works until the full completion of the works. The policy should also cover third party liability for an amount of not less than 100,000 for any one accident. 15. Arbitration Clause Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the rules of the Malta Arbitration Centre as at present in force. Any reference in the attached General Conditions to other arbitration procedures shall not apply. 16. Terms of Payment The terms of payment shall be as follows: 90% settled once the upgrading has been completed in its entirety; 10% settled after 1 year from completion of works. 17. Bad Workmanship The Engineer in charge shall, during the progress of the works, have power to order the removal within such reasonable time or times as may be specified in the order, of any materials which in his opinion are not in accordance with the specifications or his instructions, the substitution by proper materials and the removal and proper reexecution of any work executed with materials or workmanship not in accordance with drawings, specifications or instructions and the Contractor shall forthwith carry out such order at his own cost. In case of default on the part of the Contractor to carry out such order, the Engineer in charge shall have power to employ and pay other persons to carry out such work and all expenses consequent thereon or incidental thereto shall be borne by the 5
Contractor and shall be recoverable from him or may be deducted from any moneys due or that may become due to him. 18. Defects after completion The Contractor shall replace at his expense any work, which is proved to be defective even after completion. 6
PART B PRODUCTS 1. Product Technical Specifications The products to be supplied, installed and commissioned shall form part of the repair, refurbishment and upgrading works. The products shall conform to the regulations and standards listed in Part A, Para 4 - Applicable Legislation & Standards. The products must be compatible with the existing installation in order to ensure the safe and hassle-free operation of the referred lift and the placing into service of the lift as per Lifts Regulations 2002. The existing lift has the following characteristics: a. Lift Capacity: 630 kg / 8 persons b. Lift No.: 15322 c. Make: Sideron, Italy d. Year of Manufacture: 1992 e. Type: Traction Electric Any deviations from the specifications, as well as valid reasons, must be clearly indicated by the Contractor at tendering stage. 2. Schedule of Products (to be supplied and installed) The schedule of products which are to be supplied and installed is as follows which form part of the repairs and upgrading works: a. Double acting safety gear assembly with cut-out switch with compatible safety governor assembly (to include new tensioning pulley in pit with tensioning switch); b. Sheave guard and wire rope protection rods; c. Safety protection guards against falling objects inside the well from the machine room. d. Complete control panel with motor overload protection, communications unit, phase-reversal / phase failure protection, and run-time limiter; e. Control operating panel in cabin and landing call buttons; f. Car overload device with indication in COP; g. Communications system (autodialing device) including on top of cabin and pit as per MSA EN81-1 Para 14.2.3.2 & 14.2.3.3; h. Shaft lighting as per MSA EN81-1:1998 Electric Lifts; i. Reduction of distance between shaft front wall to sill. j. Safety balustrade on top of car roof; k. Replacement of batteries for alarm bell; l. Emergency light in cabin; m. Pit ladder as per mandatory requirements; n. Counterweight screen as per mandatory requirements; o. Electrical accessories including single phase protection, lockable main switch, etc.; 7
p. Emergency instruction sign inside machine room; q. Shaft lighting 2 way switches; r. Socket outlet and light switch in machine room; s. New landing door brackets for level 0; t. Split pins on motor brake solenoid lever; u. Shaft information switches; v. New wire ropes with "socket and wedge" terminations on both ends; w. New maintenance controller on top of cabin. Additional works to include: a. Servicing of all landing doors b. Servicing of car door gear mechanism c. Lubrication of guide rails d. Serving of traction motor. 8
PART C - EXECUTION 1. Examination a. Before starting works, verify the lift installation and all other conditions under which the work is to be executed. b. Commencement of works constitutes acceptance of existing conditions and responsibility for satisfactory performance. 2. Execution of Works a. Carry out the necessary repair works, upgrading works and co-ordinate installation of components. b. Work shall be performed by competent personnel in accordance with component manufacturer s installation instructions and as per Part A, Para. 3 Quality Assurance. The Contractor is considered fully responsible for the repair work, supply and installation of the works. c. Comply with the latest edition of the I.E.E. wiring regulations for electrical work required during installation. d. Perform works as per submitted works program. 3. Field Quality Control a. Acceptance testing: Upon completion of the works and before permitting use of the lift, perform acceptance tests as per L.N. 231 0f 2007 - Inspection of Lift Regulations. b. Advise Engineer in advance of dates and times tests are to be performed. c. Test certificates are to be handed over to the Engineer in charge. 4. Adjusting Make necessary adjustments of operating devices and equipment to ensure lift operates smoothly and accurately. 5. Demonstration a. Instruct Housing Authority personnel and/or the representatives of the building in the proper use, operation and daily maintenance of the lift. Review 9
emergency provisions, including emergency access and procedures to be followed at time of failure and other building emergencies. b. Make a final check of the operation of the lift with Engineer present, immediately before date of Test Certificate. Determine that control systems and operating devices are functioning properly. 10
APPENDIX Maintenance Agreement The Tenderer is requested to attach a completed Maintenance Agreement form in this Appendix for the consideration of the Housing Authority. Guidelines to tenderers in their submission of the requested Maintenance Agreement are listed in Clause 10 Maintenance. 11
