LCA/10/2012: Tender for the Repairs to Roadworks in Malta and Gozo, in relation to the SIBIT Project. 1. Project History The Local Councils Association together with the Malta Tourism Authority, the Provinces of Agrigento, Ragusa, Caltanissetta, Trapani and Siracusa, and the Polo Universitario are collaborating on the Sustainable Interregional Bike Tourism (SIBIT) project to promote bike tourism in Malta and Sicily. The main objective of this project is to introduce and support joint and standardised infrastructural development and new operational activities in both Malta and Sicily within a natural and rural environment aimed at promoting bike tourism as a form of sustained tourist development. The point of inception of the SIBIT project has been based on the presumption that there exists no special offering (in Malta and Sicily) on bike tourism albeit there are the conditions for this segment to flourish. The idea has also focused on the added value of the project since it places particular emphasis on the environment, a healthy lifestyle and seasonal mitigation factors. The aim of this project is to enable the accretion of wealth and financial prosperity through increased commercial activity and more employment opportunities through the packaging of a product (bike tourism) amongst a multitude of direct and indirect stakeholders, e.g tourist guides, hoteliers, restaurateurs, tourist agencies, tour operators, public entities, NGOs, artisans, bike rental agencies which may increase in number as a result of more activity being generated - language schools operators and so forth. Furthermore the project also aims to pave the way for a follow on (after the termination of this project s timeframe) through the introduction of future guidelines as contemplated in the communication plan as well as the involvement of suitable entities in the adherence to new long term agreements brought as a result of activities initiated during the term of this project. This project gives the possibility to both participating parties to, synergistically, promote one another within a tourist oriented context upon which both of them can boast of great potential be this relating to nature, the environment, culture, the art of cooking, architecture and history at large. As a result, the study of a unique and homogenous product which may be exported to a tourist means that both parties may be in a position to increase the overall level of their respective tourist appeal.
Moreover the favourable mild climate which is so prevalent during the entire year allows both interested parties to be in a position to, uninterruptedly, offer many a biking holiday opportunity to enthusiasts during the cold winter months of the northern hemisphere. The exchange of know-how and the possibility for both parties to provide more value for money within so much geographical proximity - where Sicily is closer to Malta than certain high profile tourist cities within mainland Italy is, indeed, an enviable opportunity for growth. 2. The Contract The Contract covers repairs to the existing roads including asphalting and rubble wall repairs to render the roads of the SIBIT Project safe. Annex 1 indicates the Technical Specifications of the works covered by the tender. The detailed schedule of rates is shown in Annex 2. All bidders are also requested to submit all details as per Annex 3. 3. Nature of Works The Contractor shall be guided by the Tender Documentation, Technical Specifications and Special Conditions in the execution of the works. The Contractor shall be working under the control of the Project Manager and the Technical Advisor. The Special Conditions shall be read in conjunction with the Local Councils Regulations and shall be deemed to form an integral part thereof. Particular attention is to be given to Local Councils (Tendering) Regulations (363.03). 4. Lots This Contract is divided into two lots: Lot 1 Lot 2 Works to improve the existing roads along Route 1 (South West Malta) and Route 2 (North West Malta) as per attached drawings. Works to improve the existing roads along Route 3 (Coastal Gozo) as per attached drawings. Tenderers may quote for Lot 1 on its own, Lot 2 on its own, or both lots together.
5. Payment Payment shall not be effected unless certified by the Technical Consultant and endorsed by the Executive Secretary of the Association. The Contractor shall provide an official VAT receipt for all payments made under this agreement. Only the areas specifically indicated on-site by the LCA s Technical Representative shall be carried out by the contractor. Works carried out without prior approval will not be paid for. 6. Duration of Contract The Contractor shall abide by the following time frames: Four (4) weeks from the date of Contract Signature on Lot 1 Four (4) weeks from the date of Contract Signature on Lot 2 Contractor bidding for both lots shall complete all works within six (6) weeks from the signing of the Contract 7. Penalty for Delay In the event that the Contractor fails to meet the set deadlines without justifiable reasons, a daily fine of fifty euro may be applied. In case of excessive delays, the Contract will be terminated. 8. Eligibility To be eligible for participation in this tender the Contractor shall submit the following: a) A list of similar works undertaken by the Contractor during the last five years; b) A Company Profile; c) The Technical Resources available to carry out the works; d) A Programme of Works showing how the Contractor will be meeting the set deadlines. Contractors who fail to submit the above may be disqualified.
9. Compliance with Legislation In providing any services under this Contract, the Contractor shall comply with any regulations contained in any law which may from time to time be in force in Malta and any policies, orders, guidelines or directives issued hereunder. 10. Subcontracting The Contractor may not reassign or subcontract any of the works without the written approval from the Local Councils Association. 11. Performance Bond Within 7 working days of the issue of the Letter of Acceptance to the successful Tenderer, the latter shall furnish a Performance Bond on the supplied form covering the faithful performance of the Contract and the execution of all obligations arising from the contract between the Association and the Tenderer. The Performance Bond shall be valid up to 30 th June 2013, and shall have a value of 2000. 12. Closing Date The closing date for the submission of the tender is Monday 23rd July 2012 at 10.00a.m. All sealed envelopes are to be marked LCA/10/2012. 13. Submission of Tenders Tenders are to be submitted in the tender box at the offices of the Local Councils Association, 153, Main Street, Balzan before the time of tender closure. Tender bids shall be submitted in a sealed envelope marked LCA/10/2012 14. Data Protection Act Any personal data submitted in the framework of the procurement procedure and/or subsequently included in the contract shall be processed pursuant to the Data Protection Act (2001).
It shall be processed solely for the purposes of the performance, management and followup of the procurement procedure and/or subsequent contract by the Central Government Authority/Contracting Authority without prejudice to possible transmission to the bodies charged with a monitoring or inspection task in conformity with National and/or Community law. The provisions of this contract are without prejudice to the obligations of the Central Government Authority in terms of the Freedom of Information Act (Cap. 496 of the Laws of Malta). The Central Government Authority, prior to disclosure of any information to a third party in relations to any provisions of this contract which have not yet been made public, shall consult the contractor in accordance with the provisions of the said Act, pertinent subsidiary legislation and the Code of Practice issued pursuant to the Act. Such consultation shall in no way prejudice the obligations of the Central Government Authority in terms of the Act. 15. Gender Equality In carrying out his/her obligations in pursuance of this contract, the Tenderer shall ensure the application of the principle of gender equality and shall thus inter alia refrain from discriminating on the grounds of gender, marital status or family responsibilities. Tenderers are to ensure that these principles are manifest in the organigram of the company where the principles aforementioned, including the selection criteria for access to all jobs or posts, at all levels of the occupation hierarchy are amply proven. In this document words importing one gender shall also include the other gender.
