2016 Tri-Ute Games The purpose of the games is to come together so our athletes/children can get to know each other better, to foster friendship between the Northern Ute, Southern Ute and the Ute Mountain Ute tribes. It is the games for the pleasure of sport and the training ground for the North American or the All Indian Games. Coach s Code of Conduct Tri-Ute Mission is to come together, as one so our children can get to know each other better, fostering friendship between the Ute Tribe, Southern Ute, and the Ute Mountain Ute tribes. Please Respect as a coach that you exert a profound impact on our youths; therefore, have high expectations for you. As such, you are responsible for executing coaching as a professional. The coach-athlete relationship provides an opportunity to maximize the athlete s development physically, mentally, socially and emotionally. Such influence can be positive or negative, depending on how well you follow acceptable guidelines and expectations. As a Coach: 1. I will teach the athletes fundamentals, basic skills and good sportsmanship. 2. I will take responsibility for athletes well-being and development. 3. I accept the reality that I serve as role model; as such, my actions must live up to my words. 2016 Tri-Ute Games 4. I will provide a physically and emotionally safe environment for athletes during practice, as well as During the Tri-Ute Games. 5. I will exemplify ethical behaviors, including honesty, integrity, fair play and sportsmanship. These are life-long lessons that take precedence over any emphasis on winning. 6. I will maintain a professional demeanor in my relationships with the athletes, officials, colleagues, Administrators and the community. 7. 2016 Tri-Ute Games PLEASE READ CAREFULLY BEFORE SIGNING Agreement for Assumption of Risk, Waiver and Release of Liability, and Indemnification In consideration of my participation in the 2016 Tri-Ute Games, I acknowledge and agree as follows: 1. Assumption of risk. There are inherent dangers associated with the activities of the Program and these dangers may be increased when the participants are minors. I understand and acknowledge that such risks cannot be eliminated nor does the Southern Ute Indian Tribe, Ute Mountain Ute, Ute Tribe ( Tribe ) have the duty, responsibility or ability to eliminate such risks due to the nature of such activities. The risk of serious personal injury or death from participation in the Program s activities, including transportation associated with those activities, may be very high and includes the potential for injuries or death. I knowingly assume all such risks of injury or death, whether specifically identified or not, that may result from my participation in the Program and I assume full responsibility. 2. Program Independent Contractor/Volunteers. I understand and acknowledge that the Tribe may hire an Independent Contractor(s) and/or utilize volunteers to assist with, operate and direct the Program. The Tribe therefore may not exercise day-to-day control or supervision over the Program and therefore have no duty of care as a participant in this event or to protect from injuries or harms arising from the actions or negligence of the Independent Contractor or any volunteer. I understand and acknowledge that the Tribe does not have any control over the provision of services from any Independent Contractor. 3. Waiver and release of liability. For myself and my heirs, I hereby waive and release the Tribe, its Tribal Council members, appointed officials, employees, and agents (collectively released parties ) from all claims, liabilities, causes of action, and damages that in any way arise out of, are connected with, or result from my participation in the Program.
4. Agreement to pay costs and attorney fees. For myself and my heirs, I agree that if I make any claim or bring any suit against the released parties, the prevailing party shall be entitled to recover reasonable attorney s fees and costs. 5. Indemnification. I agree to defend and indemnify the released parties for any loss or damage that results from claims or lawsuits for personal injury, death and/or property loss or damage related in any way to my participation in the Program in any capacity whatsoever. 6. Governing law, forum, and non-waiver of immunity. The forum for the resolution of any dispute arising from this agreement shall be the Southern Ute Indian Tribal Court and the governing law shall be tribal law. Nothing in this agreement, however, shall constitute a waiver of any immunity of the Tribe. I verify that I am the participant identified below. I have read and understand this agreement. Prior to signing this agreement, I have had the opportunity to ask any questions about this agreement and the Program.
