OFFICIAL RULES AND REGULATIONS Last updated: 11 February 2016 ADT CANADA FRIEND REFERRAL TRIP TO THE RIVIERA MAYA, MEXICO CONTEST THIS CONTEST IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor s privacy policy (see below). 1. CONTEST PERIOD: The ADT Canada Friend Referral Riviera Maya, Mexico Trip Contest (the Contest ) begins on January 25, 2016. Customer referrals must be received no later than February 19, 2016 at 23:59 Eastern Time ( ET ) (the Contest Period ). Installation for the referrals must be completed no later than March 31, 2016. 2. ELIGIBILITY: Contest is open to all ADT Canada customers who are in good standing at the beginning of the Contest, and who are legal residents of Canada and who have reached the age of majority in their province/territory of residence at the time of entry. The Contest is not open to employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of ADT Canada Inc. (the Sponsor ), its parent companies, subsidiaries, affiliates, prize suppliers and advertising/promotion agencies (collectively, the Contest Parties ). 3. HOW TO ENTER: A) Step one: The referral A random draw will take place among the eligible entries received. To earn an entry, ADT Canada customers can: (i) ask referrals to call us directly no later than February 19, 2016 during business hours at 1-800-811-1818 (if ADT-Protectron referral) or 1-800-567-5675 (if ADT referral) and mention that they were referred and by whom, or (ii) complete the referral form online at https://e-promotions.me/pro/friend-referral/mexico/1 (if ADT-Protectron customer) or https://epromotions.me/pro/friend-referral/mexico/3 (if an ADT customer) (the Website ) no later than February 19, 2016 at 23:59 ET. To complete the entry form, ADT Canada customers must: (i) enter their first name, last name and phone number, and the name, phone number, and nature of relationship of at least one referral; and (ii) agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the Rules ). Once they have fully completed the entry form with all required information, they must click the SUBMIT button to send their entry form (the Entry Form ). The referrals cannot be existing ADT customers. B) Step two: Signature of a security services monitoring For all referrals that sign a 36-month security services monitoring contract with ADT Canada and complete their installation (in the case of new equipment) or sign a new contract (in the case of a take-over from another provider) no later than March 31, 2016, the Sponsor s customer will obtain one Contest entry in the draw ( Entry ). The entrants recognize that by providing the contact information of their referrals, they have either a family relationship, personal relationship, existing business relationship, or existing non-business relationship with their referrals. The entrants further represent and warrant that they have obtained the express consent of each referral to submit their contact information as part of entry into this contest. Definitions are as follows: family relationship means the relationship between an individual who sends a message and the individual to whom the message is sent if those individuals are related to one another through a marriage, common-law partnership or any legal parent-child relationship and those individuals have had direct, voluntary, two-way communication; personal relationship means the relationship between an individual who sends a message and the individual to whom the message is sent, if those individuals have had direct, voluntary, two-way communications and it would be reasonable to conclude that they have a personal relationship, taking into consideration any relevant factors

2 such as the sharing of interests, experiences, opinions and information evidenced in the communications, the frequency of communication, the length of time since the parties communicated or whether the parties have met in person. existing business relationship means a business relationship between the person to whom the message is sent and any of the other persons referred to in that subsection that is, any person who sent or caused or permitted to be sent the message arising from (a) the purchase or lease of a product, goods, a service, land or an interest or right in land, within the two-year period immediately before the day on which the message was sent, by the person to whom the message is sent from any of those other persons; (b) the acceptance by the person to whom the message is sent, within the period referred to in paragraph (a), of a business, investment or gaming opportunity offered by any of those other persons; (c) the bartering of anything mentioned in paragraph (a) between the person to whom the message is sent and any of those other persons within the period referred to in that paragraph; (d) a written contract entered into between the person to whom the message is sent and any of those other persons in respect of a matter not referred to in any of paragraphs (a) to (c), if the contract is currently in existence or expired within the period referred to in paragraph (a); or (e) an inquiry or application, within the six-month period immediately before the day on which the message was sent, made by the person to whom the message is sent to any of those other persons, in respect of anything mentioned in any of paragraphs (a) to (c). existing non-business relationship means a non-business relationship between the person to whom the message is sent and any of the other persons referred to in that subsection that is, any person who sent or caused or permitted to be sent the message arising from (a) a donation or gift made by the person to whom the message is sent to any of those other persons within the two-year period immediately before the day on which the message was sent, where that other person is a registered charity as defined in subsection 248(1) of the Income Tax Act, a political party or organization, or a person who is a candidate as defined in an Act of Parliament or of the legislature of a province for publicly elected office; (b) volunteer work performed by the person to whom the message is sent for any of those other persons, or attendance at a meeting organized by that other person, within the two-year period immediately before the day on which the message was sent, where that other person is a registered charity as defined in subsection 248(1) of the Income Tax Act, a political party or organization or a person who is a candidate as defined in an Act of Parliament or of the legislature of a province for publicly elected office; or (c) membership, as defined below, by the person to whom the message is sent, in any of those other persons, within the two-year period immediately before the day on which the message was sent, where that other person is a club, association or voluntary organization, as defined in the regulations. membership is the status of having been accepted as a member of a club, association or voluntary organization in accordance with its member-ship requirements. A club, association or voluntary organization is a non-profit organization that is organized and operated exclusively for social welfare, civic improvement, pleasure or recreation or for any purpose other than personal profit, if no part of its income is pay-able to, or otherwise available for the personal benefit of, any proprietor, member or shareholder of that organization unless the proprietor, member or share-holder is an organization whose primary purpose is the promotion of amateur athletics in Canada. There is no limit to the number of referrals provided per Entrant permitted during the Contest Period. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries. All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry Form in this Contest will be the Contest server machine(s). NO PURCHASE NECESSARY. It is possible to enter the contest without providing a referral. Send an original, hand-

3 written letter of at least 50 words explaining why you would like to win the trip, including your first and last names, full address, telephone number and email address, to: Attention Natasha Schneider for the ADT Canada Friend Referral Trip to the Riviera Maya, Mexico Contest 8481 Langelier, Montréal (Québec) H1P 2C3, postmarked no later than February 15, 2016, or it will be null and void. Upon receipt and verification, you will receive one Entry in the Contest. There is a limit of one No Purchase Entry per duly postmarked envelope. There is a limit of 1 No Purchase Entry per person and per residence during the Contest Period. 4. THE PRIZES AND APPROXIMATE RETAIL VALUE: There will be four (4) prizes available to be won. Four (4) random draws will take place among the eligible Entries. The prizes are: 1. First random draw Grand Prize : Trip for two (2) to the Riviera Maya, Mexico for a maximum value of 5,000 CAD 2. Second random draw prize: Apple ipad Air wi-fi 32GB, of an approximate value of 500 CAD 3. Third random draw prize: Apple ipad Air wi-fi 32GB, of an approximate value of 500 CAD 4. Fourth random draw prize: Apple ipad Air wi-fi 32GB, of an approximate value of 500 CAD The customer prizes have a total approximate retail prize value of 6,500 CAD (trip for two to Mexico plus three tablets). Grand Prize details: One trip for 2 people to the Riviera Maya, Mexico, a retail value of 5,000 CAD including taxes. This includes: a) Roundtrip airfare between any major city in Canada and Mexico, in economy class value up to $2,500 (taxes included). b) Transfers from the hotel and airport, up to a value of $200 (taxes included); c) Accommodation for double occupancy in a Standard Room at a hotel of winner s choice, up to a value of $2,300 (taxes included); With the left over money, if any, the winner will receive this as spending money for the trip (to spend on food, beverages, or car rental fees, for example). The following conditions apply to the Grand Prize: a) All charges and all expenses other than those mentioned above are the responsibility of the winner and his/her/guest(s), namely, roundtrip transportation fees from the place of residence to the departure airport, personal insurance, non-included taxes and gratuities, meals and beverages, personal expenses, vaccines, gasoline, car rental insurance, any fees related with additional kilometers, as the case may be, passport and other required travel document fees; b) Subject to what is set forth in the Official Contest Rules and Regulations, the trip must be taken by December 31, 2016, otherwise it will be null and void; c) Reservations related to the trip are subject to availability and must be made through the Sponsor s representative within the prescribed deadline. The winner must give the Sponsor the name appearing on his/her passport or on his/her identification paper used to travel, as well as the name and personal coordinates of the person(s) accompanying him/her. Once the arrangements are completed, no modifications will be accepted; d) The winner and person accompanying him/her must travel together; e) If any part of the trip is not used, for sickness or other cancellation reason, no compensation will be awarded to the winner or to the guest who accompanies him/her; f) The person accompanying the winner will also need to sign a Release Form to take part in the trip. g) Sponsor is not liable for any expenses incurred as a consequence of flight cancellation/delay. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. There is a limit of one prize per person and per residence. Prizes must be accepted as awarded and are not transferable or convertible to cash. No substitutions except at Sponsor s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prizes or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor s sole and absolute discretion, a cash award.

RANDOM PRIZE DRAW AND WINNER SELECTION: On April 4, 2016 (the Draw Date ) in Montreal, Quebec at the ADT Canada Head Office at approximately 10:00 ET, four (4) eligible entrants will be selected by random draw from among all eligible Entries. The odds of winning depend on the number of eligible Entries. The Sponsor or its designated representative will make a minimum three (3) attempts to contact the selected entrants by phone (using the information provided at the time of entry or in the Customer s file) within ten (10) business days of the Draw Date. If the selected entrants cannot be contacted within ten (10) business days of the Draw Date, then the selected entrants will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrants from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, the selected entrants will be required to: (a) correctly answer a mathematical skill testing question without mechanical or other aid as included in the Release Form; and (b) sign and return within ten (10) business days of notification the Sponsor s declaration and release form (the Release Form ), which (among other things): (i) confirm compliance with these Rules; (ii) acknowledge acceptance of the Prize as awarded; (iii) release the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the Releasees ) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agree to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected entrants: (a) fail to correctly answer the skill testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the Prize for any reason; then he/she will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). Within four (4) to six (6) weeks following the reception of the duly completed and signed declaration and release form, the Sponsor will inform the winner of the trip in which way he may take possession of his prize and will send the other prize winners their prize by mail. 6. GENERAL CONDITIONS: All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. The Releasees will not be liable for: (i) any failure of the Website or Application during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry to be received for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant s or any other person s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (v) any combination of the above. Tablet winners acknowledge that the only warranty applicable is the normal manufacturer s warranty. The winner of the trip acknowledges that upon receipt of a letter confirming his prize, the execution of the services related thereto becomes the sole responsibility of the supplier or services. For the purposes of these Contest rules, the entrant is the person whose name appears on the security services monitoring contract concluded with the Sponsor. The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the Régie )

5 in Quebec, if required, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor, with the consent of the Régie, if required, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor s privacy policy (available at http://www.protectron.com/privacy-policy and http://www.adt.ca/en/about-adt/legal/privacy-policy.html) unless the entrant otherwise agrees. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules. In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: Entry Form, Website, Application, French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
