Public tender for providing Security Services at RRSC (Central) and Antariksh Vihar, Nagpur Description of work: National Remote Sensing Centre, Hyderabad 500 037, requires service providers who are well established and financially sound to provide Security services for round the clock duties in 3 shifts at RRSC (Central) and Antariksh Vihar (ISRO Residential Complex) at Nagpur. Scope of work: 1. Contractor shall deploy 15 security guards (ex-servicemen with good past record) every day as mentioned below: Sl. No. Premises/Area No. of SG Duty Shifts 1. RRSC (Central), Amravathi Road, Nagpur 9 3 in each shift ( 0600 1400, 1400 2200 & 2200 0600 hours ) 2. Antariksh Vihar, ISRO Residential Complex, Civil Lines, Nagpur 6 2 in each shift ( 0600 1400, 1400 2200 & 2200 0600 hours ) 2. The main duties of the security personnel are as folllows: a. To regulate the entry and exit of the persons into the respective premises. b. Detection and prevention of trespasses, intrusion, unauthorised entry into the premises c. Maintain a register for recording the entry and exit of visitors. d. Regular inspection/patrolling of the premises to prevent damages, loss, theft, etc. e. Occurrence of any significant incidents shall always be reported to Administrative Officer, RRSC-C. f. In the event of the theft or loss of property, a report shall be submitted to Administrative Officer, RRSC-C by the quickest possible means, immediately on occurrence of such an event and suitable remedial action shall be taken after consultation with Administrative Officer, RRSC-C. g. A spot enquiry shall be conducted in consultation with the Administrative Officer, RRSC-C. In case he/she is not available, a preliminary enquiry shall be conducted without loss of time so that any prima facie evidence leading to the crime at the spot is not destroyed / disturbed. It shall, however, be ensured that such inquiry will not interfere with any investigations by police. h. The security shall also make out ways and means to recover the stolen property and will suggest measures to block loopholes, if any, in the existing security arrangements. i. In case of fire etc., immediate action to be taken to put out fire and also to bring the same to the notice of the officers concerned. In case of negligence or connivance on the part of Security workforce due to which loss has occurred, the entire loss shall be borne by the Security Agency. j. Proper handing over, taking over of duty charge at the time of starting/closing of the duties to be done in each shift. k. Contractor shall provide first aid box for the Security workforce, which shall be maintained at the work spots. l. The Security workforce is allowed to leave the security point only when the reliever is physically present and charge handed over the duty the reliever. m. Any other security work or related work assigned from time to time by Administrative Officer, RRSC-C. Terms & Conditions: Tender: 1. The Tenderer shall be registered with appropriate authorities and must have permission/licence to provide security service. 2. Tenderer must have an office in Nagpur. 3. Tenderer must have experience of atleast 3 years in providing security services to Govt. departments, Govt. undertakings, Public Sector Units or Public Sector Banks with a contract value of Rs.25 lakhs or above per year. 4. Tenderer shall inspect the two premises of RRSC-C/NRSC indicated above and fully acquaint themselves with the scope and nature of working conditions etc. No claims shall be considered later on the grounds of ignorance or otherwise of the conditions under which the work will have to be executed. Security personnel deployed shall safeguard the premises, movable and immovable property of the assigned area of responsibility. 5. Whenever required, the contractor must be in a position to supply 3 gunmen in place of 3 security guards at RRSC- C/NRSC (Central). In this connection, the contractor shall be responsible for any administrative, statutory, legal approval, licence, permission, etc., to be obtained from concerned authorities. 6. The tenderer shall ensure that attested photocopies of the following documents are uploaded at the time of bidding online. a. Copy of valid registration with labour Department b. Valid DGR Empanelled certificate, in case empanelled with DGR or valid license under Private Security Agencies (Regulation) Act 2005 or State Ex-Servicemen Corporation Certificate. c. Copy of PAN / GIR card d. Copy of the IT return filed for the last three financial years e. Copies of EPF and ESI Registration certificates f. Copy of the Service Tax registration certificate g. Turnover certificate/balance sheet h. Work experience of similar nature during the past three years. i. Copy of the latest DGR Rates j. DD towards tender fee 7. Conditional offers shall not be considered. 8. Once a vendor bids for the tender, it is implied that he has fully understood all the terms and conditions and accepts them. Hence, the vendors are instructed to go through the terms and conditions of the tender and then apply. 9. Bid amount must be mentioned both in figures and words. In cases, where bid amount is mentioned differently in figures and words, such tenders shall be summarily rejected. 10. The contractor shall be bound by the details/documents furnished to RRSC-C/NRSC, while submitting the bid or at subsequent stage. In case, any of such details or documents furnished is found to be false at any stage, it would be deemed to be a breach of terms of contract making him/her liable for legal action besides termination of contract. 11. NRSC, Indian Space Research Organisation, Government of India reserves the right to reject any or all bids without assigning any reason whatsoever. Contract 12. An agreement shall be executed on a stamp paper before the commencement of security service agreeing to terms and conditions set in the contract. 13. The contract is for a period of two years w.e.f. 01.04.2016. If the services provided are found satisfactory, contract may be extended at the discretion of RRSC-C/NRSC, by one more year at the same rate, terms and conditions or with modifications as deemed fit, if the contractor is also willing. 14. Initially, contract shall be given for a period of 3 months and after satisfactory execution during this period, the contract shall be extended for the remaining period of 21 months, unless it is curtailed or terminated by this office owing to deficiency of service, sub-standard quality of workforce deployed, breach of contract, reduction or cessation of the requirements of work or due to any other reason. 15. RRSC-C/NRSC reserves the right to terminate the contract at any time including extension period by giving one month s notice. In case of breach of terms and conditions by the contractor, RRSC-C/NRSC reserves the right to terminate the contract with immediate effect. Page 2 of 8

16. The contractor shall not sub-contract the assigned contract. 17. RRSC-C/NRSC shall not be responsible for payment of compensation, if any payable to the contractor s workforce on the occurrence of an event whatsoever and the security agency shall be solely responsible for any claim in this regard. 18. Continuous non supply of required staff as per the term and conditions of the Contract will entail termination of the contract with immediate effect. Manpower 19. RRSC-C/NRSC has assessed a minimum requirement of 15 security guards for carrying out the quantified work envisaged in this contract. However, if need arises additional workforce shall be deployed. In case, additional persons are required on regular or sporadic nature of work, Service Provider shall provide required manpower at the rates as specified in the contract. The requirement may also decrease during the period of contract and bidder would have to reduce the workforce and proportionate contract amount, accordingly. The Focal Point will intimate the Service Provider the exact number of workforce to be provided from time to time. 20. The deployed manpower (Ex-Servicemen only) should be active and energetic and below the age of 50 years, who are drawing pension for Military service. They should of clean habits. 21. The bidder shall furnish the Details of manpower being deployed at RRSC-C/NRSC, with Bio-data containing all relevant details such as Date of birth, marital status, date of discharge from service, address etc. before the commencement of work. The personnel deployed by the Contractor shall be allowed to work subject to clearance from RRSC-C/NRSC. 22. On appointment, the security personnel must be in possession of the following: a. Appointment order issued to the personnel by the security agency b. Identity card issued by the security agency. c. Latest character and Antecedents certificate issued by Police Authorities 23. Under no circumstances, Security workforce will be permitted to work continuously for more than one shift as it affects the alertness of security staff. However, if continuation of any Security workforce for second shift is found necessary, under extreme conditions, unavoidable circumstances, prior permission is to be obtained from the Administrative Officer, RRSC-C/NRSC. Contract is liable for termination, if work force is deployed on over time duty unless in extreme situations. 24. The manpower deployed shall be required to adhere to the Duty Roster prescribed by RRSC-C/NRSC Contractor is wholly responsible for providing security at both the locations without any break. 25. If any security guard comes late/leaves early frequently or is absent, such security guards must be replaced immediately by the security agency. 26. The selected agency shall immediately provide a substitute in the event of any person leaving the job due to his/her personal reasons. The delay by the Agency in providing a substitute beyond one working days shall attract penalty as per the penalty clause of this contract. 27. The Contractor shall arrange for transportation, food, and any other requirement of contractor s manpower for carrying out the contract works. RRSC-C/NRSC will have no liability in this regard at any stage. 28. The workforce deployed by the Contractor shall always be in uniform and wearing shoes. They shall carry appropriate badges, cap and baton (danda). If the Security workforce is found without uniform including shoes while on duty, he shall not be treated as on duty. 29. Any replacement of security guards, due to any other reason by the Contractor should be in knowledge of Administrative Officer, RRSC-C/NRSC and by giving an application 15 days advance. Also the Contractor shall ensure that unwanted replacement/change of staff is avoided. Further, contractor shall not replace any security guard without prior intimation and consent of RRSC-C/NRSC authorities. However, the Contractor shall change Page 3 of 8

the security personnel within 24 hours if the concerned person shall commit any of the following: a. Any act of disobedience b. Negligent c. Sleeping while on duty d. Any act of dishonesty e. Use of alcohol or any other drugs while on duty f. Any other misconduct 30. The contract is related to security services at RRSC-C/NRSC (Central) and Antariksh Vihar (ISRO Residential Complex). Hence, it is expected that contractor should have adequate qualified Ex-Servicemen work force to man both the places round the clock with 15 security guards from the date of effect of the Contract. 31. The agency should be capable of mustering 15 number of security personnel (Ex-Servicemen) on all days, after granting weekly off/holiday/leave/ absenteeism etc. 32. Contractor shall adhere to the working hours/shift timings (as fixed by RRSC-C/NRSC). The services shall be provided on all the days in a year. 33. The Contractor shall ensure proper conduct of his/her personnel in office premises. Workforce deployed by the Contractor should be well mannered, possess amenable temperament, pleasant and conversant to deal with the visitors, employees, etc., as the case may be. 34. Security Guards should be able to understand, speak Hindi and Marathi. They should be able to understand, read and write English and have ability to maintain the necessary records at the premises they are posted, so that entry of visitors, vehicles in the appropriate registers shall be easily handled by them. Wages & Finance 35. Wages paid by the contractor to the personnel deployed by him shall not be less than minimum wages fixed by DGR, Govt. of India for this type of work. 36. Wages as specified in tender is to be disbursed by cheque / account transfer to the Security Personnel. In exceptional cases and due to compelling reasons only, salary may be disbursed in cash in the presence of representative of RRSC-C/NRSC. Details of bank account in r/o the security guards should be made available to RRSC-C/NRSC. 37. The contractor shall furnish the following ECS/RTGS details after award of contract: - a) Name of party b) Address of party c) Name of party's bank d) Name of Branch of party's Bank e) Party account number f) IFSC code of branch of party's bank g) NEFT code of the branch of party's bank etc. h) All the bank charges shall have to be borne by the contractor. 38. Contractor shall provide pay slips indicating the details of total wages, deductions and net wages paid shall be given to each contract guard, each month along with the wages and also wages shall be disbursed on or before 7th of every month without waiting for clearance of bill by RRSC-C/NRSC. The payments shall be made through ECS/RTGS System. The pay slip must also mention clearly the name and ID of the contract man power, all the components for the payment and deductions separately. Besides, PF Account, ESI Account No, and all other relevant details must also be mentioned on the Pay Slip. 39. The Service Provider shall guarantee faithful execution of the contract in accordance with the terms and conditions specified therein. As a performance guarantee, the Service Provider shall furnish bank guarantee for 10% (Ten percent) of the total contract value, which shall be issued by Nationalized / Scheduled Bank valid till completion of contract. 40. In the event of breach of any of the terms and conditions of the Contract, RRSC-C/NRSC shall have (without prejudice to other right and remedies) right to terminate the contract forthwith and invoke the Bank Guarantee, as the case may be 41. The Tax Deduction at Source (T.D.S.) shall be deducted as per the provisions of Income Tax Department, as amended from time to time and a certificate to this effect shall be provided to the agency by this office. 42. In case, the Contractor fails to comply with any statutory / taxation liability under appropriate law, and as a result thereof this office is put to any loss / obligation, monetory or otherwise, this office shall deduct that amount from the outstanding bills or from the Performance bank guarantee of the Contractor, to the extent of the loss. 43. Payment shall be made to the contractor on monthly basis as per the actual services rendered. The invoice shall be raised in the first week of the following month for the services rendered in the previous month together with aquittance roll/muster rolls evidencing payments made to the manpower deployed, copy of the challan evidencing remittance of ESI, EPF (wherever applicable) and Service tax (from 2 nd month) to enable reimbursement of the amount paid. 44. The claim for Service Tax shall be reimbursable only against documentary proof evidencing remittance of tax to the concerned authority. A requisite portion of the bill/whole of the bill amount shall be held up till such proof is furnished, at the discretion of this office. General 45. In case, the person deployed commits any act of omission/commission that amounts to misconduct/indiscipline/incompetence/security risks, Contractor will be liable to take appropriate action as asked by RRSC-C/NRSC failing which it would be assumed as breach of contract which may lead to cancellation of contract and also invoking performance security deposit depending on the gravity of the case. 46. The Contractor shall provide identity cards to the personnel deployed in this office carrying the photograph and personal information, name, DOB, age and Identification mark etc. 47. The Contractor shall ensure that any details of premises, security arrangements, and administrative/organizational matters are not divulged or disclosed to any person by its personnel deployed in this office. 48. For all intents and purposes, the contractor shall be the Employer within the meaning of different Labour Legislations in respect of workforce so employed and deployed in this office for contractual services. 49. It shall be the sole responsibility of the contractor.to settle disputes if any, arising out of the engagement between himself and the personnel engaged by him and the management of RRSC-C/NRSC shall not in any way be responsible, in the event, the personnel approach to the competent authority, under the Act of the Court. The entire expenses in this behalf shall be borne by the contractor. 50. The contractor shall indemnify RRSC-C/NRSC from any claims that may be made by the manpower deployed by the Contractor against injuries/death during the performance of their functions/duties at any stage at RRSC- C/NRSC and Antariksh Vihar. The Contractor shall be solely responsible for the redressal of grievances/resolution of disputes relating to persons deployed. This office shall, in no way, be responsible for settlement of such issues whatsoever. This office shall not be responsible for any damages, losses, claims, financial or other injury to any person deployed by service providing agency in the course of their performing the functions/duties, or for payment towards any compensation. 51. The man power deployed by the Contractor shall not have any claims of Master and Servant relationship vis a vis RRSC-C/NRSC nor have any principal and agent relationship with or against the RRSC-C/NRSC. 52. The man power deployed by the Contractor for the contract shall not be entitled for claim, pay, perks and other facilities which may be admissible to casual, ad-hoc regular/confirmed employees of this office, during the contract period or after expiry of the contract. In case of termination of the contract also, the persons deployed by the contractor shall not be entitled to or and will have any claim for absorption or relaxation for absorption in the regular/otherwise capacity in the RRSC-C/NRSC. The Contractor shall communicate the above to all the manpower deployed in this office by the Contractor. 53. RRSC-C/NRSC reserves the right to enter into parallel contract(s) for the same service with one or more other contractors during the contract period of the contract. Page 5 of 8

54. If any damage is caused to RRSC-C/NRSC property by any workforce of the Contractor, it has to be made good by the contractor at his own cost. 55. Periodic and surprise checks during night shift, at least weekly are to be conducted by the agency for keeping the workforce alert. All the checking and the findings are to be logged in a register, which is to be submitted to RRSC-C/NRSC once in a month while claiming payment. 56. Contractor shall get the character and antecedents of the Security workforce verified through police at his/her cost and a copy of verification report/police report shall be produced to the Administrative Officer, RRSC-C/NRSC 57. The Contractor shall provide the registers, stationary, torch lights which are required for the day to day work. 58. The contractor shall issue suitable personal protection equipment to the personnel deployed to ward off any threats such as snake bite, head cover during monsoon, to avoid slip / fall while patrolling in field conditions etc. 59. The Security Agency should issue individual orders regarding the terms of appointment, service charges etc., to the Security workforce deployed under this contract. At no time they should report less pay being paid. All liabilities regarding the payments to the Security workforce deployed is to be borne by the Contractor. RRSC- C/NRSC shall not be responsible for payment of dues, wages etc., or for compliance of the Central Govt. or State Govt. acts as the case may be. Salary has to be paid by 7 th of every calendar month. Proof of payment shall be furnished to RRSC-C/NRSC. Statutory / Legal 60. The contractor shall maintain a muster roll register indicating the date and name of persons engaged. Also a register for day to day compliance of work shall be maintained. Both the registers shall got be countersigned by the officer-in-charge and submitted along with the bill, failing which the bill shall not be cleared. (Record) 61. The contractor shall maintain proper records / register as required under the Contract Labour (Regulation and Abolition) Act 1970 and Rules and other relevant enactment's thereon. The records / registers shall be produced for verification / inspection as and when required by Department / Central and State Government agencies. RRSC-C/NRSC shall have powers to conduct checks regarding payments of wages, ESI, EPF etc., as considered necessary. The contractor shall get his ESI records verified once in six months from ESI inspector and submit the report. 62. The contractor shall ensure maintenance of the following registers and shall produce the same, on demand, to the concerned authority of this office or any other authority under the Law. a. Leave register b. Payment of wages register c. Grant/Record of weekly off d. Register of employees e. Attendance register. f. Any other register required to be maintained under the applicable law and as directed by Administrative Officer, RRSC-C/NRSC. 63. The Contractor should have a ESI code for deposition of ESI contributions. The contractor shall cover all his employees under ESI Scheme and shall submit a list of names of employees deployed by him together with ESI number and the name of the ESI Dispensary/Local Office to the Controlling Authority, within 45 days on award of this Contract. 64. The Contractor should have a PF code for deposition of Provident Fund in respect of his employees. The Contractor shall cover all the employees deputed by him under the PF Scheme and the Contractor shall submit the list of names of his employees deputed to RRSC-C/NRSC who are covered under PF Scheme with their PF code/identification number under which PF subscription has been deposited within 45 days on award of the contract. 65. The contractor is responsible for obtaining PF statement from PF Commissioner s Office and distribute the same to the Contractor s employees, periodically and confirm the same to the Controlling Authority. 66. It is the sole responsibility of the contractor to faithfully fulfill all the obligations, Legal, Administration and others on his part especially those concerning payment of wages, contributions towards PF, ESI, EDLI etc. (Both contractors and employees share etc.) as in force at the relevant period. He shall furnish necessary certificate coordinated by ESI / PF to RRSC-C/NRSC by the 10th of the following month towards payment of ESI and PF made as indicated below: "Certified that I / We ----------------------------------------------------- Contractors under contract No. -------------------------- --------------------- have made full (both contractors and employees share) contributions towards ESI / PF, in respect of workforce engaged by me / us under the said contract to ESI / PF commissioner on ----------------------------. 67. The contract rates shall be based on existing Minimum Wages as notified by the Government under DGR wage structure specified in Part 'II' (Price Bid). The amount of Service Charges quoted by the agency shall remain fixed during the period of the contract. However, as and when minimum wages undergo revision, the same will be made applicable to the contract from the date of its implementation and RRSC-C/NRSC will revise the wages of the guards and arrears will be paid accordingly. In this regard Contractor is also liable to keep RRSC-C/NRSC informed on the revision of wage structures and as when as revision takes place, he/she shall submit a copy the Govt. Order for implementation by RRSC-C/NRSC. 68. The Contractor will be responsible for compliance of all statutory provision relating to Minimum Wages, Provident Fund, and Employees State Insurance etc. in respect of the persons deployed by it in this office. 69. Contractor shall also be liable for depositing all taxes, levies, Cess, etc. on account of service rendered by it to RRSC-C/NRSC to concerned tax collection authorities from time to time as per extant rules and regulations on the matter and maintain proper records for verification. 70. The Security Agency shall be responsible for taking necessary action to comply with the provision / requirement of the contract based on the labour (regulation and abolition) Act 1970. 71. Settlement of disputes shall be as per Indian Arbitration and Conciliation Act-1996 and as amended. 72. In case the arbitration award is not accepted by any one of the party, Courts in Hyderabad, Andhra Pradesh State only shall have jurisdiction to deal with and decide on any legal matter or dispute whatsoever arising in this regard. Penalty: 73. In the event of any of the Security workforce not performing the duty properly or absenting himself without proper permission or reason, contractor not arranging replacement for a vacancy within one working day, an amount equal to double the day wages per shift per person will be recovered from the agency s bill. For this purpose, each month will be treated as 30 days. Suitable penalty will be levied for non-performance of any of the above mentioned conditions. In case a Security workforce leaves the duty without prior intimation to the agency, thus leaving his position vacant would not be entitled to claim the wages of the particular person during that period. TECHNICAL REQUIREMENTS OF THE BIDDER 1) The bidder should fulfill the following technical specifications: a) If the Headquarters of the successful bidder is elsewhere other than the place of work, he shall have an office at the place of work from the commencement of the work, until it is fully completed. Such office shall be authorized to act on behalf of the successful bidder to operate and execute terms of contract. b) The bidder shall possess valid licence/certificate from the DGR (if empanelled with DGR) or should have license under Private Security Agencies (Regulation) Act 2005 or State Ex-Servicemen Corporation Certificate) c) The bidder shall be registered with the Labour Commissioner and shall possess valid license. d) The bidder should have at least three years experience in providing security services to Public Sector Enterprises / Nationalised Banks / Government Departments. e) The bidder should have its own Bank Account f) The bidder shall possess PAN Number and registered with Service Tax Department g) The bidder shall possess registration certificate with ESI and EPF. h) The bidder must have successfully executed atleast three contract of value Rs.25 lakhs or more each in the last three years, with Government departments / public sector enterprises / Nationalised banks. 2) The tenderer must be in a position to deploy gunmen when required. Fulfilling all statutory, administrative, legal requirements, etc like obtaining registration, approval, licence, permission, etc., regarding deployment of gunmen shall the responsibility of the tenderer. 3) The manpower deployed should be able to understand and speak Marathi or Hindi. They should be able to understand, read and write English, so that entry of visitors, vehicles in the appropriate registers shall be easily handled by them. 4) The Scope of the work for the manpower deployed shall be as given above, but not limited to the said activities. 5) The antecedents of the manpower deployed by the Contractor shall be got verified by the Contractor from the local Police jurisdiction and submit the police verification certificate before their deployment.
