THE IMPORTANCE OF FAMILY PLANNING THE BARRISTER I am a Barrister specialising in Criminal Law. You need to ensure that you are insured, your income is insured and that your will and superannuation are up to date and smart. You need to build your wealth into the family entity so that all can continue on easily. OUTCOME: The Barrister suffered his first heart attack in court and was clinically dead for 4 minutes. He recovered to return to practice then retired and passed away. The wife understood where everything was and all the kids got through school and excelled. Gunderson THE LECTURER SCENARIO: GUARANTEEING SOME FUND RAISING I thought it was a good idea at the time. After all the internet was so interactive and could attract so many more people to this good idea. Apparently it just needed me to say I would be the major investor. I didn t think that I would be obligated to put in the shortfall of money. They started talking about a class action and there would be a litigation funder involved. GB APPROACH: You need to measure your wealth and determine the assets that you own that could be at risk. It was good that you had your structure set so well from the beginning, as this meant there were a number of road blocks for the people threatening action. This is a good basis from which to negotiate a better outcome. OUTCOME: The pending action settled at 10% of the muted claim.

OPERATIONS START WITH THE END IN MIND

THE ENGINEER SCENARIO: MECHANICAL ENGINEERING We are good at what we do and have a skill for solving mechanical problems and inventing new ways of doing things. The whole place is very innovative, but we struggle to make sure the mundane day to day thinks like debtors, creditors, inventory and that pesky cash flow get done. GB APPROACH: You need to measure the efficiency of your systems i.e. can your systems actually do what you want, like controlling the cash flow. Once efficient you need to measure the effectiveness of your systems i.e. are your systems actually doing what you want, like controlling the cash flow. Finally, put someone in charge that likes operating the mundane yet very important systems and make them accountable for driving the discipline into the business. Have them report to the business on a monthly basis with what needs to be done. OUTCOME: Turnover has increased fivefold from the amount of new business they have won. Cash flow has also increased fivefold as the systems and management approach is now part of the culture. Gunderson

We have generated lots of fees. We didn t really have enough time to set things up, so all the income for last year comes to me as the sole proprietor. Do I really need to pay that amount of tax? Does my investment income need to be taxed at the highest rate as well? And do I need to pay these big tax instalments in the present year as well? GB APPROACH: You need to measure your tax liability before the end of each financial year. You need to build your structure to protect your operation, minimise risk, be flexible for the family, and manage your average annual tax rate. You need to consider using superannuation, the company tax rate and the lower personal rates that may apply to your spouse and immediate family. OUTCOME: The client paid the tax for the year gone by. The structure was set for the new year incorporating the legal practice and setting up superannuation. The instalments for the present year were varied downward. The average tax rate was halved and has been managed in similar way since.
