Last year more than 23,000 people were severely injured or killed in New Zealand work places. On 4 April, the Health and Safety at Work Act (HSWA) comes into force bringing new responsibilities for everyone in the workplace. The new law is part of a reform package aimed at reducing the number of serious work-related injuries and deaths in New Zealand by at least 25 percent by 2020. Current regulations are being easily misinterpreted or incorrectly applied and duty holders having difficulty knowing their responsibilities and whether they have done enough to comply. CREATING A ZERO HARM ENVIRONMENT WORKING AT HEIGHTS

Everyone has a role to play in keeping people safe. Everyone has a role to play in keeping people safe and healthy at work, but with responsibilities that match what people can reasonably influence and manage. A PCBU (Person Conducting a Business or Undertaking) with the primary duty to ensure Health and Safety. A PCBU will usually be a business entity, such as a company, rather than an individual person unless they are a sole trader or a self-employed person. More than 1 PCBU may have a duty imposed under the Act. An Officer is any person occupying the position of a director of the company (by whatever name called). A Worker is defined as anyone who carries out work in any capacity for a PCBU (an employee). Health and safety representatives provide workers with a formal, visible way for them to have a say in work health and safety. HSRs also provide a voice for workers who might not otherwise speak up about work health and safety matters. Businesses have a duty to provide effective, on-going ways for you to make suggestions, raise ideas, or take other steps to improve health and safety at work.

We are now required to cooperate and coordinate around how we manage risks collectively. Duty to manage risk A duty imposed under this Act requires the person to eliminate risks to health and safety, so far as is reasonably practicable. A duty under this Act may not be transferred to another person. A Person may have more than 1 duty. More than 1 person may have same duty. Duty to consult other duty holders if more than 1 person has a duty in relation to the same matter Duty of self-employed persons must, so far as is reasonably practicable, ensure his or her own health and safety while at work. A PCBU must ensure, so far as is reasonably practicable, the health and safety of workers and that other people are not put at risk by its work. Who is best placed to have influence and control? This will be dependent on what is reasonably practicable in the circumstances. For example, at a large building site cooperation and coordination will be needed between the construction firm, the principal contractor, electricians, carpenters, and bricklayers. Each has responsibility for the health and safety of workers on site as well as others eg visitors. Together they will make sensible arrangements that reflect who has the most influence over which area of work. http://www.business.govt.nz/worksafe/hswa/working-smarter/health-and-safety-whos-responsible What is Reasonably practicable? A PCBU must ensure that a duty reasonably able to be done in relation to ensuring health and safety, taking into account and weighing up all relevant matters. A PCBU must ensure the health and safety of workers and that other people are not put at risk by its work. (eg employees or contractors, including their subcontractors or workers) A PCBU who is a self-employed person must also ensure, so far as is reasonably practicable, his or her own health and safety while at work. The Act significantly increases the category of offences The Act significantly increases the category of offenses, with a threetiered hierarchy being introduced, along with a range of other offending provisions. The Act then imposes across all three tiers a six-fold increase in fines from the Act. Recklessness PCBU - $3 million fine; Officer - $600,000.00 fine and/or five years imprisonment; Worker - $300,000.00 fine and/or five years imprisonment. Risk of death/serious injury/illness PCBU - $1.5 million fine; Officer - $300,000.00 fine; Worker - $150,000.00 fine. Failure to comply with a duty PCBU - $500,000.00 fine; Officer - $100,000.00 fine; Worker - $50,000.00 fine. Failure to notify a notifiable event PCBU - $50,000.00 fine; Worker - $10,000.00 fine.

How do I minimise risk? A PCBU must, as soon as possible after becoming aware that a notifiable event arising out of the conduct of the business or undertaking has occurred, ensure that the regulator is notified of the event. A notification may be given by telephone or in writing (including by email, or other electronic means); and must be given by the fastest possible means in the circumstances. A PCBU must keep a record of each notifiable event for at least 5 years from the date on which notice of the event is given to the regulator. Working to Best Practice The requirement for fall protection is defined by law, and to guidelines set out by safety standards authorities. The Ministry of Business, Innovation & Employment publishes the Best practice guidelines for working at height in New Zealand. The guidelines provide practical guidance to employers, contractors, employees and all other engaged in work associated with working at height and how they can meet their obligations under the Health & Safety at Work Act 2015 and its associated reforms and regulations. Selecting the right method of fall protection is no longer a case of just choosing a fall arrest harness and hoping there will be an anchor point nearby.

Eliminating, isolating and minimalising hazards from working at height Where possible, if the job can be done by working on the ground, this is the best option. However, elimination is not always possible. Isolating is a method of control for working at height. This includes using safe working platforms, guardrail systems, edge protection, scaffolding, elevated work platforms, mobile scaffolds and barriers to restrict access. If isolation is not practicable then steps should be taken to minimise the likelihood of any harm resulting from falling. All harness work requires training and competence and only trained and competent personnel can install and use harness systems on site.

Training Persons not trained should be inducted by the system installer or other qualified persons before they are permitted to use the system. They should also be supervised at all times by another person who is also trained and competent. For workers who are to complete basic work while using restraint methods, a recommended means of achieving competence is NZQA Unit Standard 23229 Use a safety harness for personal fall prevention when working at height, oran equivalent or higher qualification. A recommended means of obtaining competence for workers who are involved in planning, installing, operating fall arrest systems and supervising staff is NZQA Unit Standard 15757 Use, install and disestablish proprietary fall arrest systems when working at height or an equivalent or higher level of qualification. NZQA Unit Standard 23229 is a prerequisite for achieving NZQA Unit Standard 15757. Compliance New Zealand s Standards AS/NZS 1891.4:2009 give specific descriptions of competency required for the various roles of work at height. 1.4.8 Height Safety Equipment Inspector A person who is competent in the skills needed to detect faults in height safety equipment and to determine remedial action. 1.4.9 Height safety manager A person who is competent in the selection, design, manufacture or installation of height safety systems or equipment, or the development of control measures or work practices 1.4.10 Height Safety Operator A person who is able to perform harness based work at heights under the direct practices. 1.4.11Height Safety Supervisor A person who is competent in the skills needed to perform harness based work at heights, to supervise other operators including those at entry level and to participate in the first response rescue. The skill sets and unit standard training required for each competency type is further described in AS/NZS 1891.4;2009, 2.2.1 Training and Competency. Anyone who has been trapped or suspended in their harness is at risk of serious life threatning effects or death.

Never work alone when using a fall arrest systems. Anywhere a system allows for a fall, there is a requirement for on-site rescue capability. The greater the risk of unconscious suspension or injury in a harness, the greater the need for an appropriate rescue response. Planning a rescue A rescue plan should be developed before installing the harness system. It is critical that a suspended worker can be promptly rescued. A pre-rigged retrieval system is a good way of ensuring prompt rescue. A rescue plan should consider: The rescue method, i.e. use of a crane or elevating work platform available equipment responsibilities and training communication medical requirements involving the emergency service. Escape MK ll device is used for lowering only, and can be used during rescue operations at height for workers who are suspended in PPE equipment. Choosing the right helmet for working at height Many industrial helmets are only designed to protect the head from falling objects. For work at height, it is essential that in the event of an uncontrolled fall the helmet is retained on the head and can withstand multiple point impacts. AS/NZS 1801.1997 does not meet these requirements. The EN12492 standard is designed around the user being the falling object.
