NETWORK CODES - Considerations (I) Process is delayed We are far from being ready in 2014! EC is struggling with adoption process: Regulation (RfG, DCC) versus Guidelines (Operational Codes and EB) Both are binding law, different amenment process NC-Regulation: EC opens the process and stakeholders can also ask ACER for it Guideline: process is not as detailed EC legal services criticized to delegate too much to NRAs on methodologies to implement NCs

NETWORK CODES - Considerations (II) ACER is asking for oversight competence of ENTSO-E and to set binding decisions NRAs oversees national TSOs while there is no body to oversee ENTSOE EC will establish Stakeholder Committees for guidance & monitoring of NCs implementation

Network Codes State of Play WHO IS GEODE AND WHAT DOES IT DO FOR ITS MEMBERS?

NETWORK CODES State of Play Capacity Allocation & Congestion Management, CACM State of Play September 2014 Comitology phase The Capacity Allocation Congestion Management Binding Guideline (CACM) was the first Code to enter Comitology in December 2013 Currently being discussed within the Electricity cross-border Committee Last meeting 10/9 Next meeting 9/10 vote not expected yet, probably in November

NETWORK CODES State of Play Requirements for Grid Connection, RfG State of Play September 2014 Pre-Comitology phase After NC CACM, it became the second Code to enter Comitology Discussions on NC RfG between EC and Members States took place in January 2014 at the Electricity cross-border Committee. Expected to be discussed not before 2015 ENTSO-E has published implementation guidelines for the NC RfG, to support the code by highlighting the impact on specific technologies, the link with local network characteristics, as well as the need for coordination between network operators and grid users

NETWORK CODES State of Play Electricity Balancing, EB On 23 December 2013, ENTSO-E delivered the NC EB to ACER ACER provided its reasoned opinion on the Network Code on 23 March 2014 On 16 September 2014, ENTSO-E submitted a new version of NC EB to ACER Pending ACER's recommendation to the EC for adoption of the code

NETWORK CODES State of Play Demand Connection Code, DCC State of Play September 2014 Pre- Comitology phase Discussions on NC DCC between EC and Members States took place in March 2014 at the Electricity cross-border Committee. NETWORK CODES State of Play Load Frequency Control and Reserves, LFCR State of Play September 2014 Pre-Comitology phase On 27 September 2013, ACER issued a positive reasoned opinion and recommendation to adopt the NC LFCR The EC is now reviewing the NC before they begin the process of implementing the network code into a European legislation

NETWORK CODES State of Play Emergency and Restoration, ER State of Play September 2014 Pre-Comitology phase On 1 April 2014, ENTSO-E was mandated by the European Commission to draft these operational rules In July 2014, a preliminary working draft was finalized by ENTSO-E on 9 July ENTSO-E held a first Public Stakeholder Workshop and a 2nd Public Stakeholder Workshop on 12 November The public consultation period will start in October 2014
