NUTS code UKM The notice involves The conclusion of a framework agreement Short description of the contract or purchase(s) The NHS in Scotland has a requirement for various software developments and web based developments; for ongoing maintenance and fixing of software and occasional trouble-shooting of software problems on servers not covered by existing NSS agreements. To support this work within NHS Scotland, NSS is seeking to establish a framework comprising of providers who can provide a comprehensive range of development and support services. Any IPR resulting from work under this framework will require to be owned by the commissioning Health Board, The Scottish Government Health Department or NSS and there must be nothing to restrict or prevent its free use across all of the Public Sector in Scotland. It is envisaged that those providers that are appointed to the framework will compete for packages of work through mini competitions, however providers will also be required 1/7

PROCEDURES FOR APPEAL Body responsible for appeal procedures Lodging of appeals Precise information on deadline(s) for lodging appeals: Precise information on deadline(s) for lodging appeals: NSS will incorporate a standstill period of a minimum of calendar days at and from the time that information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek a further debriefing by NSS before the framework is concluded by the Contracting Authority. Applicants have 2 working days from the date of the notification of the award decision to request additional debriefing, and that information will be provided a minimum of 3 working days prior to expiry of the standstill period. Applicants should request such additional information from the address in point I.1. If an appeal regarding the award of a contract cannot be successfully resolved, the Public Contracts (Scotland) Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the Regulations, to take action in a court of competent jurisdiction. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the relevant court may order the setting aside of the award decision or order the Contracting Authority to amend any document, and may award damages.
