HSBC Premier Golf Contest Rules and Regulations 1. Contest Period. HSBC Bank Canada s ( HSBC ) HSBC Premier Golf Contest (the Contest ) begins (the Contest Period ) at 12:00 a.m. (Eastern Daylight Time) on Thursday, August 1, 2013 and closes at 11:59 p.m. (Eastern Daylight Time) on Monday, September 30, 2013 (the Contest Closing Date ). 2. Prizes. VIP Prize Package winners are responsible for booking their own flights and hotel accommodation. Dates, prizes and locations are subject to change without notice. 3. VIP Prize Package Conditions. Each VIP Prize Package selected entrant and his or her guest must be capable of arriving in Shanghai, China, on or before October 29, 2014. winner and (iii) depart from and, upon return from Shanghai, China, arrive at, the major commercial airport served by Air Canada that is nearest the prizewinner s residence. Should the selected entrant and guest be unable to travel to or attend the above events, the selected entrant will forfeit any right to the VIP Prize Package and HSBC may select an alternate entrant or withdraw the VIP Prize Package. The VIP Prize Package includes only what is specifically described in these Contest Rules and no other allowance will be granted. The selected entrant, should they be declared a prizewinner, and any guest, will be responsible for covering all additional expenses incurred, including, without limitation, transportation other than the above noted flight (transportation to and from airports is not included), travel and medical insurance, meals and beverages, telephone calls, in-room charges and all other hotel incidentals and gratuities, miscellaneous travel related expenses, taxes, levies, surcharges and any other costs and expenses not specifically described as included in the VIP Prize Package. The selected entrant is responsible for ensuring that all required travel documents are in order prior to departure. If the selected entrant or guest is unable to travel due to lack of proper documentation, the selected entrant will forfeit any right to the VIP Prize Package and HSBC may select an alternate entrant or withdraw the VIP Prize Package. 4. Eligibility. The Contest is open to residents of Canada who have reached the age of majority in their province or territory of residence at the time of entry into the Contest, except employees, agents, representatives, members of the immediate families of employees (and those with whom such persons are domiciled) of HSBC and HSBC s affiliates, subsidiaries, advertising agencies, the Contest judging panel and the suppliers of prizes. 5. To Enter. No purchase necessary to enter. To enter, entrants will receive Contest entries in accordance with the following (Contest entry options may be combined): a) One (1) Contest entry for every C$10,000 of new deposits and investments made in any qualifying account (see section 5(g)), calculated as a net total at the end of the Contest Period. New deposits and investments refers to funds that have never been previously invested or otherwise on deposit with HSBC or any of its subsidiaries prior to the Contest Period. b) Five (5) Contest entries will be provided for each customer who (i) becomes an HSBC Premier account holder during the Contest Period, (ii) who opens an HSBC Premier chequing account during the Contest Period and (iii) has a C$100,000 balance in combined personal deposits and investments with HSBC or any of its subsidiaries as at the Contest Closing Date. See section 5(h) for a description of qualifying accounts; c) One (1) Contest entry for every C$50,000 of mortgage proceeds funded or of existing mortgage renewed during the Contest Period; d) One (1) Contest entry for every completed outbound Global Transfer or wire transfer (minimum transfer amount C$1,000); e) One (1) Contest entry for the first Personal Internet Banking transaction completed during the Contest Period; f) One (1) Contest entry for every successful referral of an HSBC Premier customer through the HSBC Share the Experience Program (for details on the referral program, please speak with an HSBC Premier Relationship Manager at your local HSBC branch); g) One (1) Contest entry upon HSBC s receipt of an original handwritten essay of at least 200 words answering the question What are the key benefits of HSBC Premier? on a single 8.5 x11 sheet of paper mailed to and received by HSBC during the Contest Period. must include their mailing address, email address and phone number. Entrants taking advantage of the no-purchase option are limited to one (1) Contest entry. Qualifying accounts for deposits and investments referred to in see sections 5(a) and 5(b) include: HSBC Bank Canada chequing accounts, savings accounts, RRSP accounts, TFSAs, term deposits, GIC and structured deposits; HSBC Investment Funds mutual funds (MF) and World Selection Portfolio (WSP) accounts; HSBC InvestDirect accounts; and HSBC Global Asset Management Private Investment Management accounts. The following accounts and products are not included: HSBC Bank Canada RRIF accounts and holding company accounts related to any HSBC Premier customer; HSBC Trust accounts or products; and HSBC InvestDirect holding company accounts related to any HSBC Premier customer. For the purpose of calculation, any eligible deposits or investments held in foreign currencies will be converted to their Canadian Dollar equivalent using HSBC s daily standard exchange rate for that currency in effect from time-to-time. Where there is more than one (1) account holder, each account holder will be allocated one (1) Contest entry for each of the activities listed in sections 5(a) to 5(e), with the exception that if there is more than one (1) mortgage account holder, only the primary mortgage account holder will be given one (1) Contest entry. 6. Secondary Prize Draws. Random draws for ten (10) Secondary Prizes will be conducted at 5:00pm PT in Vancouver, British Columbia on each of August 23, 2013, and September 13, 2013, to select Contest entries from all of the eligible Contest entries received up to the last business day of the previous month before the respective draw date, for a total of twenty (20) Secondary Prizes. Prizewinners of Secondary Prizes drawn on August 23, 2013, will not be eligible for any of the Secondary Prizes drawn on September 13, 2013. All prizewinners of Secondary Prizes will be eligible for the VIP Prize Package draw on October 11, 2013. 7. VIP Prize Package. On October 11, 2013 at 5:00pm PT in Vancouver, British Columbia, two (2) Contest entries will be selected by random draw from all eligible Contest entries received by the Contest Closing Date for each of the two (2) VIP Prize Packages. 8. Chances of Winning. The chances of winning are dependent upon the total number of eligible Contest entries received by the Contest Closing Date (in the case of the VIP Prize Packages), or the applicable draw date (in the case of the secondary prize draws), whichever occurs first. 9. Compliance with Contest Rules. If any selected entrant is unwilling or unable to comply with these Contest Rules, that entrant will be disqualified and another Contest entry form will be drawn from the remaining eligible Contest entries received. 10. Skill-Testing Question and Release. Before being declared a prizewinner, each selected entrant must correctly answer a time-limited, skill testing, mathematical question posed during a prearranged telephone interview or by mail. The selected entrant must (and their guest, if applicable) must also sign a declaration and release form in a form satisfactory to HSBC: RESTRICTED - Page 3 of 5
(a) (b) (c) confirming compliance with the Contest Rules and acceptance of the prize as offered; acknowledging the non-responsibility of HSBC and all of its affiliates and subsidiaries, and the prize suppliers and their agents from any and all injuries, accident, loss or misfortune relating to a prize or any portion thereof, the Contest and a selected entrant s participation therein; and acknowledging the right of HSBC and all its subsidiaries and agents to publish or broadcast the prizewinner s picture, name, voice and statements without further compensation other than the prize offered. 11. Conditions to Being Declared a Prizewinner. The selected entrant will be contacted by telephone or email at the telephone numbers or e-mail addresses noted on their client file maintained by HSBC or provided with their essay entry. If a selected entrant (or their guest, as applicable) cannot be reached by HSBC within five (5) days following the corresponding prize draw date, incorrectly answers the skill-testing question, declines the prize or fails to return a signed declaration and release form in a form satisfactory to HSBC, the selected entrant will be disqualified and another entrant will be randomly selected by HSBC from all remaining elegible entries. 12. Amendment, Extension and Cancellation. The Contest may be amended, extended or cancelled at the sole discretion of HSBC at any time without notice, subject only to the approval of the Régie des alcools, des courses et des jeux in Québec. 13. No Substitution/Transfer. The prizes must be accepted as offered and no substitution is allowed. The prizes are not transferable or convertible to cash. HSBC reserves the right to make substitutions in the event of non-availability of a prize. 14. Privacy. HSBC is collecting personal information about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants, unless entrants provide HSBC with explicit permission to do so. Entrants who request more information on products and services of HSBC or its affiliates will be contacted by HSBC, its subsidiaries and/or affiliates accordingly. 15. Use of Name and Images. By accepting a prize, the prizewinner consents to the use by HSBC of his or her name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice. 16. Entries Property of HSBC. All Contest entries become the property of HSBC and will not be returned. 17. No Liability. HSBC assumes no responsibility for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or any technical problems or traffic congestion on the Internet at any website, or any combination thereof. HSBC assumes no responsibility for any delayed, misdirected or late Contest entries or for any typographical or other production errors. 18. Interference with Contest. Any attempt to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should any such attempt be made, HSBC reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. HSBC reserves the right to refuse or terminate an individual s participation and entry (entries) if HSBC or its subsidiaries suspects or discovers that the individual is interfering with the proper and intended operation of the Contest, is violating the Contest rules or is committing an RESTRICTED - Page 4 of 5
unlawful act (including, but not limited to fraud or a determination, in HSBC s sole and entire discretion, that an investment, transfer or deposit is made illegally or for illegal purposes. 19. Release. By entering this Contest, entrants release and hold harmless HSBC, its subsidiaries and affiliates and their respective directors, officers, employees and agents from any liability in connection with this Contest or, if declared a prizewinner, the prize. 20. Final and Binding. All decisions of HSBC with respect to all aspects of the Contest are final and binding. 21. Quebec Residents Only. For residents of Quebec, any litigation involving a Quebec resident respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation involving a Quebec resident respecting the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement. 22.
