17 THE MECHANISM FOR INTERNATIONAL CIUMINAL TRlBUNALS ("Mechanism"): SITTING as Single Judge Vagn Jocnsen pursuant to Rule 57 of the Ru les of Procedure and Evidence (the " Ru les"); BEING SEIZED of the Prosecutor's Request for a Warrant of Arrest and an Order fo r Transfer of LA DIS LAS NTAGANZWA (the "Accused") filed on 27 March 20 14; CONSIDER1NG the Second Amended Indictment against the Accused confirmed on 30 March 20 12 by Judge Vagn Jocnsen of the International Criminal Tribunal fo r Rwanda ("ICTR"); CONSIDERJNG the Warrant of Arrest and Order for Transfer and Detention of the Accused dated 9 May 20 12, which is currently in force; CONSIDERING United Nations Securi ty Co uncil Resolution 1966 (2010) regarding the cooperat ion of States with the Mechanism; CONSIDERING Article 28 of the Mechanism Statute and Rule 57 of the Rul es; NOTING the need to vacate the Warrant of Arrest and Order for Transfer and Detention dated 9 May 20 12 requesting transfer of the Accused to the custody of the Rwandan authorities, issued by the letr with a req uest for th e arrest and transfer of the Accused to the custody of the Rwandan authorities, issued by the Mechanism; 1. HEREBY RESPECTFULLY REQUESTS ALL Member States of the United Nations to: I. SEARCH FOR, ARREST AND TRANSFER to the custody of the National Publ ic Prosecuti on Authori ty of the Republic of Rwanda LADISLAS NTAGANZWA, a Rwandan citizen born about 1962 in Gasharu cellule, Muhambara SeCIf! Ur, Butare prefecture, Rwanda, who is accused of having committed during 1994 in Rwanda the fo llowing crim es: genocide, direct and pub li c incitement to commit genocide, and crimes against humanity (exterminat ion, murder and rape); n. SERVE on th e Accused at the time of his arrest or as soon as practicable im mediately following arrest, in a language he und erstands, a certifi ed copy of this warrant of arrest, accompanied by a copy of the indictment certified in accordance with Rule 48 (G) of the Rules and a statement of the rights of the accused set forth in Article 19 of the Statute and in Rul es 40 and 41 of the Rules; Case No. MICT- 12-21 -PT 7 May 20 14 ~.

INFORM th e Accused at the time of hi s arrest or as soon as practicable immediately fo llowing arrest, in a lan guage he understands, that he is being transferred to the custody of the Rwandan authorities; SEEK AN ACKNOWLEDGMENT of receipt from the Accused of a co py of th e warrant of arrest, the indictment and the statement of rights in a language be understands, and return one set of documents together with proof of service to the National Public Prosecution Authority of the Republic of Rwanda; V. SEARCH AND SEIZE all phys ical evidence re lated to tbe crimes alleged aga inst the Accused; VI. VII. VIII. IX. CREATE an itemi zed inventory of all seized materi als, including documents, books, papers or any other objects, that is properly witnessed and is acknowled ged by the Accused; TRANSFER all seized evidence and the inventory to the National Public Prosecution Authority of the Republic of Rwanda; NOTIFY the Registrar of the Mechanism and the Prosecutor-General of the Nati onal Public Prosecution Authority of the Republic of Rwanda of the arrest of the Accused for the purposes of arranging hi s transfer to the custody of the Nati onal Public Prosecution Authority without delay; REPORT forthwith to the Registrar of the Mechanism and the National Public Prosecution Authority of the Republic of Rwanda if unable to execute thi s Warrant or Ord er for Transfer, indicating the reasons for the inability to do so; and X. MAKE INQUIRIES to discover whether the Accused has assets located within the territory of the Member State and if so, to adopt provisional measures to free ze such assets, without prejudice to the ri ghts ofthird parties. 2.
