Policy Terms & Conditions This Policy document sets out the details of your insurance cover. This has been arranged by Bank of Ireland Insurance Services Ltd. Please read this policy carefully and keep it in a safe place. All the words that appear in bold shall have the meaning given to them in the Definitions Section on page 8. If You are not entirely satisfied with the protection provided, You may within 30 days of receipt, return your policy for cancellation and any premium You have paid will be credited to your account. This policy protects You in the event of your Disability, Redundancy, Critical Illness/Major Injury, Death and an element of cover in the event of loss or damage to property as specified under the Purchase Protection section. These Policy Terms and Conditions apply if You : have chosen cover under this plan underwritten by Financial Insurance Company Limited, trading as Genworth Financial for Disability, Redundancy and Critical Illness/Major Injury cover and New Ireland Assurance Company plc trading as Bank of Ireland Life for life cover ( we, us, our ) have paid the insurance premium These Policy Terms and Conditions provide cover for cardholders that have availed of the Credit Card Payment Protection Plan. Unless You have signed the section on your application form in the section headed Payment Protection to indicate that You wish to avail of Payment Protection cover, the cover is not provided and this policy does not apply. 1. Your signed Credit Card Application Form is incorporated in, and forms part of, these Policy Terms & Conditions, which are issued by Bank of Ireland. 2. Provided that You opt to pay the premium You will be entitled to the benefits, subject to the Terms set out in these Policy Terms & Conditions. Bank as Beneficiary Bank of Ireland and its associated companies are the legal owner of the policy, however when a valid claim (as defined by the Insurance Policy) is to be discharged the payment will be made to the Bank or associated company via the Insured s credit Card Account and this will result in the reduction of the customers credit card Outstanding Balance. Premium The premium is payable at calendar monthly intervals on the statement date of your account by direct debit thereto. The amount of each monthly premium will relate directly to the balance on your account on the statement date. The Insurers may alter the premium rate at any time by giving at least 30 days notice to Bank of Ireland, which undertakes to advise You of any such change. (The monthly premium is 0.80 cent per 100 monthly balance, or part thereof. In the event of the outstanding indebtedness being nil, then no premium is due). 1

Payment Protection Eligibility You are eligible for Payment Protection Insurance if at the Start Date You agree to pay the Monthly Premium on the Premium Due Date; and either:- 1. for Life, Disability, Redundancy or Critical Illness/Major Injury are aged 18 or over and will be less than 65 years old at the End Date; 2. for Disability, Redundancy or Critical Illness/Major Injury are engaged in Full Time Employment; and 3. are not aware of any impending life threatening event, Disability, Redundancy or Critical Illness/Major Injury. 4. Policies are not transferable. We will only cover Bank of Ireland credit cards under this policy. Purchase Protection Eligibility You are eligible for Purchase Protection Insurance if at Start Date You are 18 or over and will be less than 75 years old at the End Date. Payment Protection - Description of Benefits 1. Life Cover In the event of Your death during the Term, the Outstanding Balance (less any arrears) will be credited to your Card Account and all liability under this policy will cease. The Maximum benefit You can obtain is the Outstanding Balance up to a maximum of 15,500. 2. Disability Cover In the event of You suffering Disability for a period of 30 consecutive days commencing during the Term, the Monthly Benefit will be credited to your Card Account in arrears. The same amount of Monthly Benefit will be credited at calendar monthly intervals thereafter for each complete calendar month that Disability continues, up to a maximum of 12 Monthly Benefit payments in all for any one period of Disability. After the maximum benefit of 12 Monthly Benefit have been made in respect of any Disability claim, further Disability claims must be preceded by at least 180 days continuous Full Time Employment. Maximum Monthly Benefit 2,000. 3. Redundancy Cover (not applicable to State Employed or Self Employed persons) In the event of your becoming Redundant, and such Redundancy continuing for more than 30 consecutive days and commencing during the period of cover, the Monthly Benefit will be credited to your Card Account in arrears. The same amount of Monthly Benefit will be credited to your Card Account at calendar monthly intervals, thereafter for each complete calendar month that Redundancy continues, up to a maximum of 12 Monthly Benefit payments in all for any one claim. Further Redundancy claims not preceded by at least 180 days continuous Full Time Employment shall be construed as one continuous period for the purposes of assessing the maximum benefit entitlement. Maximum Monthly Benefit 2,000. 4. Critical Illness/Major Injury 2

(for State Employed and Self Employed only) In the event of You suffering a Critical Illness or a Major Injury incurred after the Start Date (but not within 30 days of the Start Date) the Outstanding Balance up to a maximum of 15,500. Purchase Protection - Description of Benefits In the event of items purchased (Insured Property) by You or an additional cardholder being lost or damaged within 90 days of the Date of Purchase your Card account will be credited with the cost of purchase or alternatively the item(s) will be repaired or replaced (at the Underwriters discretion). Maximum Benefit for a single item - 635. Maximum Benefit for any 12 month period - 10,000 You are responsible for the first 32 of each claim. We will pay all benefits under this plan for the credit of your credit Card Account to Bank of Ireland. In addition, up to two Luxury Items purchased by You or an additional cardholder will be covered for loss or damage within 365 days of the Date of Purchase, up to a maximum value of 2,000 per item. Data Protection Statement You understand and give explicit consent that the sensitive health and other information you provide about yourself will be used by Financial Insurance Company Limited (the Data Controller), it s agents and associated companies, other insurers, regulators, industry and public bodies (including the police) and agencies to process this insurance and any other insurance, handle claims and prevent fraud. This may involve the transfer of such information to other countries (including those which have limited or no data protection laws). Financial Insurance Company Limited have taken steps to ensure that your information is held securely. You have the right to access your personal data held by Financial Insurance Company Limited. If you believe that your personal data held by Financial Insurance Company Limited is inaccurate you have the right to ask for this to be rectified. Payment Protection Exclusions A We pay Disability benefits for all valid claims except those resulting directly or indirectly from: self-inflicted injuries (whether sane or insane); Normal Pregnancy unless: the symptoms of a normal pregnancy develop into a pathological condition, sickness or disease which are diagnosed by a suitably qualified consultant who is a member of the Royal College of Obstetricians and Gynaecologists (Ireland), is recognised by that Royal College as being a consultant or doctor who specialises in obstetrics, and the pathological condition lasts for 30 days or more and is not excluded under any other exclusion set out in this section; alcohol or drugs not taken under the advice and supervision of 3

a Doctor; civil unrest, war, or riot; any sickness, disease, condition or Major Injury which You knew about or ought reasonably to have known about or for which You asked about or received advice, treatment or counselling from a Doctor, during the 12 months immediately before the Start Date; radiation, contamination or the radioactive effect of any nuclear fuel; psychiatric Critical Illness including stress and related conditions, unless diagnosed by a consultant; backache unless there is radiological evidence of the abnormality causing your backache; medical operations or treatments which are not medically necessary including cosmetic or beauty treatment; HIV and/or AIDS or related conditions; Chronic conditions. if You are receiving payment for Redundancy; B We will only pay Disability benefits if You have been in Work for 30 consecutive days between your last claim and the next one if your Disability is from a different condition or cause or You must have been in work for 180 consecutive days if your next Disability is from the same condition or cause. C We will not pay Redundancy Claims in the following circumstances: If You are not in Full Time Employment continuously for a period of 6 months immediately before your employment ended; If at the Commencement Date You knew You were going to be made Redundant or You had reason to believe that it was likely to happen; If Unemployment is a regular feature of your employment, and your employment is seasonal; If Redundancy arises when You are outside Ireland or the UK unless You are on a specific project of 30 days or less, and at the date your employment ceases You had not been outside Ireland or the UK for more than 30 continuous days since the Start Date; If You are aged 65 or You have taken early retirement; If You terminate your contract of employment voluntarily; If You do not make a genuine attempt to obtain employment in Ireland and/or the UK after You were made Redundant; If You are receiving a payment for Disability; If You were made Redundant after working on a fixed term contract which has expired; If You receive notification from your employer that your employment is to cease within 90 days of the Start Date; If You are receiving payment in lieu of notice; If You were made Redundant voluntarily; If You are Laid Off (because of, for example, a temporary work shortage); If You are not being credited with Social Insurance Contributions in Ireland, or National Insurance Contributions in the UK; If You are State Employed or Self Employed when You are made Redundant; If the Redundancy occurs as a result of: 4

D E any of the circumstances when You cannot make a claim for Disability referred to in A above; a Strike or Lock-out; misconduct; We will not pay Redundancy benefits where a benefit has been paid in respect of an earlier Redundancy unless You have been in Full Time Employment between the earlier and subsequent Redundancy for at least 180 consecutive days. We will not pay Critical Illness/Major Injury benefit for any claim which is the result of; transient ischaemic attacks and attacks of vertebrobasilar ischaemia; all skin cancers (except invasive malignant melanomas), non invasive cancer in situ, or stage 1 Hodgkin s Disease, ovarian tumours of borderline malignancy or papillary cancer of the bladder; All tumours of the prostate unless histologically classified as having a Gleason score greater than 6 or having progressed to at least TNM classification T2N0M0; All forms of lymphoma in the presence of any Human Immunodeficiency Virus; Kaposi s sarcoma in the presence of any Human Immunodeficiency Virus; a condition which You knew about or received treatment for from any Doctor before the Start Date; any of the causes referred to in A above. Purchase Protection Exclusions A No benefit is payable for Loss and/or Damage which results from:- radiation, contamination or the radioactive effect of any nuclear fuel or its components; atmospheric or weather conditions, including the action of light; normal wear and tear; an inherent product defect in the Insured Property; an illegal act by You or a person living in your household; loss of the Insured Property which is not reasonably explained by You; the action of insects, vermin, fungus or rust; the action of pets belonging to either You or a person living in your household; electrical or mechanical breakdown of the Insured Property; taking apart, maintaining, cleaning, restoring, dyeing or repairing the Insured Property; Loss and/or Damage which happens more than 90 days after the Date of Purchase (excluding any Luxury Item); Loss and/or Damage to any Luxury Item which happens more than 365 days after the Date of Purchase; theft, malicious damage or anything similar causing the Loss and/or Damage unless it is reported to the police within 24 hours of You discovering the Loss and/or Damage or if after 24 hours, as soon as reasonably possible; the Insured Property being used for business purposes; 5

B physical abuse of the Insured Property by You or a person living in your household; You or a person living in your household not taking Reasonable Care of the Insured Property. Where goods are purchased and Lost and /or Damaged outside Ireland or the UK, the Underwriters reserve the right to pay the claim under this policy if it has received satisfactory evidence of the Loss and/or Damage and any payment of benefit is at our discretion. How to Claim You can obtain a claim form from Genworth Financial whose telephone number is (061) 73 73 73 or alternatively write to: Genworth Financial, PO Box 602, Shannon. Co. Clare. No benefits will be payable if:- the Underwriters do not receive proof to their reasonable satisfaction of all matters relevant to the claim. The Underwriters may, during the claim, ask for any further proof that they may consider relevant, that the claim is still valid. There will be no payment under this policy where a false or fraudulent claim is made. Payment of Benefits Benefits due shall be paid into the Card Account on your behalf. Benefits are paid monthly for Disability and Redundancy and as a single payment for Life and Critical Illness/Major Injury and Purchases. Premiums Monthly Premiums must be paid from your Card Account on the Premium Due Date and must continue to be paid during any period of claim. Each Monthly Premium is for one month s cover. The Monthly Premium is a percentage of the balance outstanding under the Agreement on the Calculation Day in the previous month. The percentage rate may be changed by the Underwriters by giving You at least 30 day s notice in writing. When Does the Cover End? Insurance cover is for one month at a time and is renewed automatically for another month at the end of every month until:- the End Date happens; or You cancel your cover under the cancellation section on page 9. Total Combined Insurance Cover Limit The maximum benefit payable for one disability or redundancy claim under this policy will not be more than 24,000. The maximum benefit payable for your death or major injury/critical illness under this policy will not be more than 15,500. The maximum combined benefit payable for any single one incident of disability or redundancy under this policy or any other of our credit card, 6

mortgage, motorloan or personal loan payment protection policies sold by Bank of Ireland will not be more 75,000 in total. The maximum aggregate benefit payable for life, major injury/critical illness, disability or redundancy under this policy or any other of our mortgage, credit card, motorloan or personal loan payment protection policies sold by Bank of Ireland will not be more 100,000 in total. General You cannot transfer your rights or your interest under this policy to any other person or entity. This policy will not have any value at the End Date or if the policy is cancelled. Financial Insurance Company Limited propose to choose Irish law as the law applicable to this policy (unless the parties agree to exercise their right to choose any other law before the date that this policy is entered into by You). The appropriate stamp duty has been or will be paid by the Insurers to the Revenue Commissioners in accordance with the provisions of section 19 Finance Act 1950 and section 113 Finance Act 1990. Complaints Procedure We set ourselves high standards but if You are not satisfied with our service please tell us. If You follow the procedure set out below we will deal with your complaint in the most efficient way possible. Step 1 Please contact Bank of Ireland Insurance Services, 3rd Floor, New Century House, Lr Mayor Street, Dublin 1 or The Insurance Manager, Genworth Financial, PO Box 602, Shannon, Co. Clare Step 2 If you are still not happy or the issue has not been resolved to your satisfaction you may refer it to the Financial Services Ombudsman s Bureau 3rd Floor, Lincoln House, Lincoln Place, Dublin 2. Cancellation You may cancel your insurance cover under this policy by writing to Bank of Ireland Credit Cards, New Century House, Mayor Street Lower, IFSC, 7

Dublin 1 within 30 days of receiving your policy documents and receive a refund of any premium paid. After 30 days of receipt of this policy booklet this insurance cover may be cancelled by either You or Bank of Ireland Insurance Services Limited giving 30 days notice in writing. No refund of monthly premium will be paid. Definitions 1.1 In this summary of cover the words below have the following meanings:- Accident ( Accidental ) means an unforeseen, unintentional, violent external event; Agreement means the credit agreement between Bank of Ireland and You setting out the Terms of the credit for which the insurance is taken out; Calculation Day means the day in each month that the Bank of Ireland works out the amount of interest, any credit charges and the Monthly Premium which You must pay by the date shown on your next Card Statement; Card means the credit/charge card issued to You and any additional cardholder by the Bank of Ireland under the Agreement and used by You and any additional cardholder in accordance with its terms and conditions for use; Card Account means the account that You have with the Bank of Ireland relating to the Agreement; Chronic Conditions means any condition, Major Injury, Critical Illness, disease, sickness or related condition and/or associated symptoms resulting from a chronic condition that was in existence at the Start Date whether it was requiring medical attention at that time or not. A chronic condition is a condition which has at least one of the following characteristics: It continues indefinitely; It is constant and is controlled rather than cured; It has symptoms which recur and have required consultation, treatment or care in the past; or It requires long-term monitoring or treatment, consultations, check-ups, examinations or tests; Control means (in relation to a company) the power of a person to exercise direct or indirect control over that company s affairs including, but not limited to, owning the greater part of the share capital or voting rights of that company or by powers given to that person in any recognised document; Critical Illness (Critically Ill) means any illness or disease set out below: Heart Attack: The death of a portion of heart muscle, due to inadequate blood supply, that has resulted in all of the following evidence of acute myocardial infarction: Typical chest pain; and new characteristic electrocardiographic changes; and the characteristic rise in cardiac enzymes, troponins or other biochemical markers; where all of the above shows a definite acute myocardial infarction; Other acute coronary syndromes, including but not limited to angina, are not covered under this definition; Cancer: Any malignant tumour characterised by the uncontrolled growth and spread of malignant cells and invasion of tissue. The term cancer includes leukaemia and Hodgkin s disease but the following are excluded; All tumours which are histologically described as pre-malignant, as non-invasive or as cancer in situ; 8

9 All tumours of the prostate unless histologically classified as having a Gleason score greater than 6 or having progressed to at least TNM classification T2N0M0; All forms of lymphoma in the presence of any Human Immunodeficiency Virus; Kaposi s sarcoma in the presence of any Human Immunodeficiency Virus; Any Skin cancer other than invasive malignant melanoma; Stroke: Any cerebrovascular accident or incident lasting more than 24 hours and resulting in permanent neurological damage. Transient Ischaemic Attacks are specifically excluded; Kidney failure: The end stage renal failure presenting as chronic irreversible failure of both kidneys to function, as a result of which either regular renal dialysis or renal transplant is initiated; Coronary artery disease requiring surgery: The undergoing of open heart surgery on the advice of a consultant cardiologist to correct narrowing or blockage of one or more coronary arteries with by-pass grafts, but excluding balloon angioplasty, laser relief or any other procedures; Major organ transplant: The actual undergoing as a recipient of a transplant of a heart, liver, lung, pancreas or bone marrow; Quadriplegia and Paraplegia: Complete and permanent loss of use of two or more limbs through paralysis; Date of Purchase means the date shown on either the Card Statement or store receipt (whichever is the earliest) when You or an additional cardholder bought the Insured Property; Disability ( Disabled ) means:- a Disability resulting from sickness, disease or bodily injury; and; this Disability completely stops You from doing your Normal Job or Self- Employment and You are not doing any other paid or profitable job; and You are under Regular Care and Attendance; End Date means the date the insurance cover under this policy ends which will be the earliest of the following dates:- the date on which the card is cancelled, withdrawn or expires and is not renewed by Bank of Ireland; for life, Disability, Redundancy or Critical Illness/Major Injury, your 65th birthday, or your earlier and final retirement, whether or not voluntary (You must notify the Underwriters of any early retirement); for Purchase Protection your 75th birthday; the date upon which a Critical Illness/Major Injury benefit is paid; the date of your death; Full Time Employment means that You are:- attending your place of work, if appropriate; and doing your Normal Job for at least 18 hours per week in Ireland (even if You are State-Employed) or at least 16 hours in the UK; Incurred Date means:- for Disability and Unemployment claims, the day after your last day in Full Time Employment or Self-Employment; and the date of diagnosis or operation in respect of a Critical Illness/Major Injury as referred to in the Critical Illness and Major Injury definitions; or the date upon which the 12 month period referred to in Section A of the Major Injury definition has been completed, or the date of diagnosis of the Loss of Limb or the Loss of Sight of one or both eyes by the Consultant; for life claims, the date of your death; Insured Property means any personal property bought by You or an

additional cardholder using the Card either for your own use or to purchase an item for another person on or after the Start Date excluding:- furs, all precious metals and precious stones; cash or its equivalent (including travellers cheques, tickets, cheques, postal orders and any other negotiable instruments); perishable goods; used or second hand goods, mail order items or items delivered by courier, animals or plants, motor vehicles, motor cycles, boats, private leisure craft, tents, caravans, (including any accessories fitted to these or any articles left unattended in these); contact lenses; Laid Off ( Lay Off ) has the meaning given by the Redundancy Payments Act 1967 in Ireland or the Employment Protection act (Consolidation Act) 1978 in th UK, as appropriate; Loss and/or Damage means the direct physical Loss and/or Damage to Insured Property; Loss of Limb means total, permanent and irrecoverable loss of use or loss by physical separation at or above the wrist or ankle; Loss of Sight means total, permanent and irrecoverable Loss of Sight; Luxury Item means any item of Insured Property with a purchase value of more than 1,000 on the Date of Purchase bought by You or an additional cardholder using the Card either for your own use or to purchase an item for another person on or after the Start Date excluding:- furs, all precious metals and precious stones; cash or its equivalent (including travellers cheques, tickets, cheques, postal orders and any other negotiable instruments); perishable goods; used or second hand goods, mail order items or items delivered by courier, animals or plants, motor vehicles, motor cycles, boats, private leisure craft, tents, caravans, (including any accessories fitted to these or any articles left unattended in these); contact lenses; Major Injury means:- A an injury caused to You directly and solely from an Accident which in the reasonable opinion of a Consultant appointed by the Company:- - is of such a serious nature as to continue for the remainder of your life; - shall, in all probability, prevent You for the remainder of You life from performing your Normal Job or your household duties or from driving motor vehicles or motorcycles of any type or make whatsoever (excluding those motor vehicles which are electronically propelled and designed for Disabled persons): - has continued for at least 12 consecutive months from the date of the Accident: and - occurred at an identifiable time and location, after the Start Date and before the End Date and within 12 months from the date of the Accident; B an injury caused to You directly and solely from an Accident which results in the loss of use of a limb, or the loss of use of an eye or both eyes, which in the reasonable opinion of a Consultant appointed by the Company is total, permanent and irrecoverable; 10

11 Monthly Benefit means:- 10% of the Outstanding Balance or 12.70, whichever is the greater amount; or if the Outstanding Balance is greater than 12.70, the Outstanding Balance subject to an overall aggregate limit of 2000 in respect of all agreements; Normal Job means:- the job for payment or profit carried on by You immediately before the Disability, Unemployment or Critical Illness/Major Injury; or any similar job for payment or profit which You are (in the reasonable opinion of the General Company) qualified or may reasonably become qualified to do when considering your training, education and ability; Normal Pregnancy means:- symptoms which normally accompany pregnancy (including multiple pregnancy) and which are generally of a minor and/or temporary nature (e.g. morning sickness, fatigue etc) which do not represent a medical hazard to mother or baby or a combination of minor symptoms, and, childbirth, including delivery by caesarean section or any other medically or surgically assisted delivery which does not cause medical complications; Outstanding Balance means the balance outstanding on the Calculation Day immediately before the Incurred Date, less any arrears and any accrued interest on such arrears; subject to a maximum benefit or 15,500 whether for one or more Agreements; Premium Due Date means the date each month that You must pay your Monthly Premium; Reasonable Care means:- taking all reasonable precautions to protect the Insured Property from any foreseeable risks which may cause Loss and/or Damage; and attending the Insured Property at all times (unless it is properly secured against theft and any other Loss or Damage); Redundancy ( Redundant ) means dismissal attributable wholly or mainly to:- the fact that the employer has ceased, or intends to cease, to carry on the business for the purposes of which the employee was employed by him or has ceased, or intends to cease, to carry on that business in the place where the employee was so employed; or the fact that the requirements of that business for employees to carry out work of a particular kind, in the place where they were so employed, have ceased or diminished or are expected to cease or diminish; Regular Care and Attendance means the regular and continuing treatment and attendance of the Insured Person by a Doctor for the condition making the Insured Person Disabled; Self Employed ( Self Employment ) means an Insured Person is:- actively working in Ireland for profit in a profession or business alone or in association with others, and being liable to pay and paying Class S Pay Related Social Insurance Contributions in Ireland, or liable to pay tax under schedule D case I II IV or V (as defined by the Income and Corporation Taxes Act 1988 ( ICTA ) in the UK; or being a company director who is a proprietary director in Ireland (as defined by section 64(2) of Irish Finance Act 1974) or a controlling director in the UK (as defined by schedule 31 ICTS), including the spouse, parent, child, brother or sister who is in any way connected (as defined by section 839 ICTA) with the proprietary or controlling director; State Employed means actively working in Ireland for at least 19 hours per week for profit and employed in the public service, and in the context of this

policy employment in the public service shall mean being employed as a civil servant; and employee of a health board, local authority, or county committee or agriculture; a member of the Permanent Defence forces and the Garda Siochana; or an employee of the state within the educational sector; Start Date means the date of the Agreement; Strike and Lock-out each have the meaning given by section 6 of the Redundancy Payments Act 1967 or by paragraph 24 of schedule 13 Employment Protection (Consolidation) Act 1978 in the UK, if appropriate; Term means the period from the Start Date to the End Date; Unemployed (Unemployment) means the Insured Person is not doing his Normal Job or Self Employment or any other paid or profitable job and is:- signing on at an office of the Department of Community and Family Affairs and being credited with Social Insurance contributions or with National Insurance contributions in the UK of the appropriate class by reason of Unemployment (or not being in receipt of Unemployment benefit; and/or not being credited with Social Insurance contributions because of having been entitled to make reduced Social Insurance contributions in the past) or because of being a female in the UK aged 60 or over and therefore not entitled to National Insurance contributions; If the Insured Person has received a payment in lieu of notice, he will not be considered as Unemployed within this definition for the period which relates to the payment in lieu of notice. Reference to any statute or statutory provision includes any amendment, extension or re-enacted version. You means the person(s) who have entered into the credit card agreement with Bank of Ireland and who satisfies the eligibility requirements set out in the Payment and Purchase Protection Eligibility sections on pages 2 and 3 and are named as the policyholder.
