ThisServiceScheduleisforthesupplyofIPTransitdeliveredacrosstheVocusnetwork.This ServiceSchedulewillapplytothefirstandanysubsequentServiceOrdersexecutedbythe CustomerandVocus. 3. PREREQUISITESTOSUPPLYOFTHESERVICE 3.1. TheServiceissubjecttotheStandardTermsandConditionsbetweenVocusandtheCustomer. DefinedtermsintheStandardTermsandConditionshavethesamemeaninginthisService Scheduleunlessexpressedtothecontrary. 4. PROVISIONOFSERVICE 4.1. 4.2. 4.3. 4.4. 4.5. 4.6. 4.7. 4.8. 4.9. Vocus maintains and operates the Vocus network under the Autonomous System Numbers 4826,9889,9503and18037.VocusmayaddorremoveAutonomousSystemNumbersfrom thevocusnetworkasrequired. TheVocusinternationalnetworkincludespeeringandtransitserviceswithnumerousnetworks toensureredundancy,networkresilienceandnetworkreachability.vocusreservestherightto add,changeorremovepeeringandtransitservices,withoutnotice. Customers may exchange route information with Vocus via the Border Gateway Protocol version4(bgp). VocuswillsupplyafullglobalBGProutingtabletothecustomeroradefaultrouteasspecified intheserviceorder. Theglobalroutingtableislargeandconstantlygrowing.IfthecustomerelectstouseBGPand receiveafullroutingtable,thecustomerisadvisedtoensuretheirequipmentiscapableof supportingthecurrenttableanditsfuturegrowth. VocuswillprovideastandardsbasedinterfacefortheCustomertoconnecttotheVocusaccess deviceateachagreedlocation.thecustomermaychoosefromthefollowinginterfacetypes: ElectricalFastEthernetasperIEEE802.3u OpticalGigabitEthernetasperIEEE802.3z ElectricalGigabitEthernetasperIEE802.3ab Optical10GigabitEthernetasperIEEE802.3ae Additional Interfaces will be considered on a per request basis, and may incur additional charges. TheservicewillbedeliveredatthespeedspecifiedintheServiceOrder,atthelocationspecified intheserviceorderandforthetermspecifiedintheserviceorder. AServicedesignated International or InternationalOnly ontheserviceorderwillbeprovided with Internet routes advertised to the Vocus network by our international upstream transit providersandpeersonly.intracountryroutestotheinternetarenotincluded. AServicedesignatedas Blended ontheserviceorderwillbeprovidedwithbothintrahcountry (i.e.domestic)andinternationalroutesfromourtransitprovidersandpeers. Where a service is not designated Domestic or International then it is assumed to be Blended. WheretheServiceisdeliveredintoadatacentre,VocuswillterminatetheServiceinacommon areaormeethmeroom,irrespectiveofanyvocusequipmenttobesituatedinthecustomer s colocation facility. It is the responsibility of the Customer to arrange any cross connection cablingbetweenthelocationatwhichtheserviceisterminatedandthecustomer sequipment. Without liability to the Customer whether or not under the Service Level Agreement, Vocus reservestherighttoundertakeanyactionnecessarytoprotectitsnetworkincludingundertaking protectionmeasuresagainstaddosattack. TheCustomermustnotuseBGProutingprotocolsorotherwisethat woulddirectcustomer boundtraffictovocusddosmitigationdevicesunlesstheyhaveanactiveddosprotection Serviceinaccordancewithclause15. 5. BILLING 5.1. 5.2. 5.3. 5.4. 5.5. TheServicemaybebilledusingoneofthefollowingmethods: a) FlatRate,wherebytheServiceisbilledafixedmonthlyamountbasedontheServicespeed. b) DataPlan,wherebytheServiceisbilledafixedmonthlyamountbasedonafixedquotaand avariableamountforanyusageabovethefixedquota.seeclause5.3. c) IPBurst,wherebytheServiceisbilledafixedmonthlyamountforusageuptoafixedspeed andavariableamountforanyusageabovethefixed.seeclause5.4. TheServicemaybeorderedwithFlatRatebillingwheretheServiceisbilledafixedmonthly feewithnoadditionalusagecharges. TheServicemaybeorderedwithDataPlanbillingwheretheusageisbilledperGB,inwhich casetheserviceischargedafixedmonthlyfeeforafixedamountoftrafficwithanyexcess usagechargedatthepermborpergbrateaslistedintheserviceorder.usageiscalculated basedontheautonomoussystemnumbersasfollows: a) ServicesconnectedtotheVocusnetworksAS4826andAS18037arebilledbasedonthe largeroftheamountofdownloadedoruploadeddataduringthebillingperiodcor b) Services connected to the Vocus network AS9889 are billed based on the total of the amountofdownloadedanduploadeddataduringthebillingperiod. TheServicemaybeorderedwithIPBurstbilling.IPBurstisabillingoptionwherebytheService will be billed using a 95 th percentile billing method. The Customer agrees to purchase an amountofiptransitinmbps(referredtoasthecommittedspeed)atafixedmonthlyfeeand may transmit up to the speed of the Service (referred to as the Burst Speed). Where the measuredusageoftheservice(inmbps)isabovethecommittedspeed,thecustomeragrees topayforusageabovethecommittedspeed.thefeeforusageabovethecommittedspeed (referredtoastheipburstfee)ischargedpermbpsandwillbelistedontheserviceorder. TheratiooftheBurstSpeedtotheCommittedSpeedshallnotexceed2:1unlessotherwise agreedbyvocus.bandwidthabovethecommittedspeedissubjecttoavailabilityandisnot guaranteed. The Service may be ordered with Aggregated Billing. 5.6. 5.7. 5.8. wherebytwo(2)ormoreportsmaybebilledasifitwasasingleport.forexample,two(2) separate100mbpsportsmaybebilledas200mbps.achargeforeachadditionalportapplies. AggregatedBillingmaybecombinedwithIPBurst,subjecttotheapprovalofVocus.Where thecustomerordersadditionalportswithoutalsoincreasingtheamountofiptransit(inmbps) tomatchthetotalbandwidthsupplied,theservicewillbebilledusingaggregatedbillingwithip BurstandtheIPBurstFeewillbeasstatedintheServiceOrderor,wherenotstatedinthe ServiceOrder,willbe25%morethantheperMbpsfeefortheassociatedIPTransit. AggregatedBillingandIPBurstarenotavailableinalllocationsorwithallServices. TheServicemaybesubjecttoonceHoffinstallationfeesdependingontheServicelocation, speed,equipmentandavailabilityofnetworkinfrastructureandinitialterm.anysuchfeewill beasspecifiedintheserviceorder. 6. THIRDPARTYSERVICES 6.1. 6.2. WheretheServiceprovidedbyVocusincludesequipmentortransmissionservicesfromathird partysupplier( Supplier ),additionalchargesmayapplyfor: a) Cabling, network construction and other work to connect the Supplier s network to the networkboundaryatthecustomer slocationc b) CablingandassociatedworksbetweenanynetworkboundarypointandtheCustomer s locationc c) OtheritemsorservicesaschargedbytheSupplierfromtimetotime. AnyadditionalchargesfromSuppliersrelatedtoclause6.1a)or6.1b)willbeprovidedtothe CustomerforapprovalandanyServicedependantontheSupplier sserviceswillbeplacedon hold.wherethecustomerapprovestheadditionalcharges,withinanyvalidityperiodimposed by the Suppler for the additional charges, provisioning of the Service will recommence and additionalchargeswillbebilledtothecustomer.wherethecustomerdoesnotapprovethe additionalcharges,theserviceinvolvingthesupplier sserviceswillbecancelled,atwhichpoint anycancellationfeesfromthesupplierwillbepayablebythecustomerincluding,butnotlimited to,anycancellationfeesforworkalreadycompleted,equipmentprovidedorforanyfeasibility studiesorsitesurveys. 7. SERVICEINCREMENTS 7.1. 7.2. Aminimumspeedof10MbpsappliesunlessotherwiseagreedorofferedbyVocus. Theserviceisavailableatspeeds: d) startingat10mbpsandincreasingin5mbpsincrementsupto100mbps,then e) from100mbpsandincreasingin50mbpsincrementsupto1gbps,then f) from1gbpsandincreasingin500mbpsincrementsupto10gbps,or g) ataspeedasapprovedbyvocus,fromtimetotime. 8. IPADDRESSESSUPPLIEDBYVOCUS 8.1. 8.2. 8.3. 8.4. 8.5. CustomersmayelecttouseVocussuppliedIPaddresses. AddressessuppliedareoftypeIPv4and/orIPv6. Asinglefour(4)IPv4subnetwillbeprovidedatnocharge.FeesapplyforanyadditionalIPv4 addresses. AnyIPaddressesallocatedtotheCustomerbyVocusremainthepropertyofVocusandmay notbetransferred. VocusreservestherighttochangeanyVocussuppliedIPaddressesallocatedtotheCustomer onatleast7daysnoticeorimmediatelyifanurgentchangeisrequiredinordertomaintain Vocusnetworkavailabilityorstabilityortocorrectafault.VocuswillworkwiththeCustomerin ordertominimizeanydisruptiontotheserviceduringthechange. Once the Customer cancels the Service to which the IP Addresses are attached, the IP AddressesmaybeallocatedtotheServicesofotherVocuscustomers,unlesstheCustomer requeststheirreallocationtoanactiveserviceandwheresuchrequestforreallocationoccurs prior to the aforementioned Service cancellation and is technically feasible. Additional fees applyforallocationsofmorethanfour(4)contiguousipaddresses.dependingonthesizeof theaddressallocation,additionalinformationmayberequiredfromthecustomerinorderfor Vocustofulfilltherequest. Requestsformorethan256IPaddressesarenotgenerallyavailablefromVocusandshould bereferredtoapnic(asiapacificnetworkinformationcentre)ortherelevantregionalinternet registry. 9. VOCUSINTERNETEXPRESS 9.1. 9.2. 9.3. 9.4. 9.5. VocusInternetExpress(VIE)isanIPTransitServicewiththefollowinglimitations: a) VIEisonlyavailableatthesymmetricalspeedsof10Mbps,40Mbps,100Mbpsor250Mbps, unlessotherwiseofferedbyvocus,fromtimetotimec b) Customermustsupplytheirownrouterc c) BGProutingisnotavailablec d) VIEmaynotbeusedinaredundantportarrangementcand e) VIEisonlyavailablewithFlatRatebilling.DataPlanbilling,IPBurstandAggregatedBilling arenotavailable. VIEmaynotbeusedbyInternet,hostingorotherserviceprovidersaspartoftheirownproducts orservicesorusedtoaggregateinternettrafficformorethanone(1)enduser. AVIEservicemaybereHsold ashis toanenduser. VIEmaynotbesoldforprovisionintoadatacentre,exceptwhereagreedtoinwritingbyVocus. WheretheCustomerisinviolationofclauses9.2or9.4,Vocusmaysuspendorcancelaservice onfive(5)dayswrittennotice. 10. TERMINATIONFOREXCESSINSTALLATIONCOSTS 10.1. VocusmayterminateanyServiceOrderifVocusinitsabsolutediscretiondeterminesthatthe costofbuildingtheservicesagreedtobeprovidedareuneconomic,orotherwisematerially differentfromthecostanticipatedpriortotheserviceorderbeingsigned.ifvocusterminates thisserviceorderunderthisclause,vocusmaynotchargeyouforanyunexpiredpartofany InitialTermspecifiedintheServiceOrder.Thisclausesupersedesclause5oftheStandard TermsandConditions. 11. FAULTREPORTING,RESPONSEANDRESTORATIONTIMES 11.1. 11.2. BeforereportingafaulttoVocus,theCustomermusttakeallreasonablestepstoensurethat thefaultisnotafaultinanycustomerequipmentorwithinthecustomer sadministrativedomain. CustomerswhorelyonVocussuppliedCustomerPremiseEquipment(CPE)mustspecifically ensurethatthevocuscpeisreceivingpowerandcoolingasrequiredtobeoperational. TheVocusTargetRestorationTimedoesnotapplywhere: a) ThefaultisnotaP1Faultc b) TheSiteLocationisoutsidethemetropolitanareaofthelistedcityc c) TheServiceisprovidedusingathirdpartytransmissionservice.TheTargetRestoration Timeforaservicedeliveredinwholeorinpartusingathirdpartytransmissionserviceis thevocustargetrestorationtimeplusanytargetorestimatedrestorationtimeofthethird partyservicec d) VocusispreventedaccesstotheService,includinganyVocusEquipmentc e) VocusdiagnosesthefaultasnotwiththeServicecor f) ThefaultisduetoaForceMajeureEvent. 12. SERVICELEVELSAGREEMENTANDREBATES 12.1. ShouldinanygivenmonththeIPTransitServicenotperformtotheaboveServiceLevel,Vocus willprovidethecustomerwithaservicelevelrebate. TheCustomermustreportthefaultinaccordancewithclause6.Thefollowingrebateswillbe providedinrespectofvalidclaims: SumofallOutage 22min.to< 1hourto 2hoursto >4 <22min. timeinamonth 1hour. <2hours <4hours hours %ofmonthly 0% 5% 10% 15% 20% Chargerebated ArebateisnotpayableinanyformotherthanacredittotheCustomer saccountandinany monthiscappedat20%ofthemonthlyservicechargefortheaffectedservice. AServiceLevelrebateclaimmustbesubmittedinwritingwithinfiveBusinessDaysfromthe date on which the fault was restored. Vocus will not be required to consider any claims submittedafterfivebusinessdays. Onceaclaimisreceived,Vocuswillreviewtheeventandcalculatetherebate(ifapplicable) andcreditittothecustomer saccount. ShouldVocusreceiveacomplaintabouttheCustomer suseofaninternetresource(suchas IPblockorASnumber)Vocuswillresolveallsuchcomplaintsinfavouroftheorganisationlisted intheapnic(orrelevantregionalinternetregistry)whoisdatabase.intheeventofadispute, theonusisonthecustomertoproveownershipoftheresource.shouldthecustomerbeunable to do this, any decision taken by Vocus to not permit a prefix announcement will not be consideredabreachofanyslaorcovenantofthisagreement. VocuswillnotsupplypublicASnumberstotheCustomer.ThecustomershouldcontactAPNIC forallocationofsuchresources. 15. DDOSPROTECTION 15.1. IforderedbytheCustomerwiththeirIPTransitServiceasspecifiedintherespectiveService OrderorifofferedbyVocuswhileVocusisprovidingtheCustomerwithIPTransitServicesbut not Internet Express (see clause 15.3 below) (Internet Service), Vocus must provide the CustomerwithadistributeddenialHofHservice(DDoS)protectionservicetoassistinattacksthat attempt to make a Vocus and/or Customer network unavailable to its intended users in accordancewiththisclause15(ddosprotectionservice). H 15.2. ThisDDoSProtectionServiceprovidesprotectionagainstDDoSeventsthat,inthesoleopinion ofvocus,requiremitigationusingtrafficscrubbing,filtering,blackholingorotheractioninorder toprotectthevocusnetworkand/orthecustomer snetwork.theddosprotectionserviceis comprisedofthefollowingproducts: (a) DDoS Detect Vocus provides DDoS and traffic reporting and DDoS event alerts. mayceaseprovidingvocusddosprotectioninrelationtotherequestedddosevent unlessnotifiedbythecustomertocontinueforafurther24hourperiod.thecustomer willbechargedattheapplicablerateforeach24hourperiodoverwhichvocusprovides theddosprotectionandappliesperinternetserviceprotected.thecustomeraccepts thechargesasnotifiedatthetimeoftherequestorassetbyvocusfromtimetotime andthesechargeswillbeinvoicedinarrearscand 15.3. 15.4. (b) DDoS Protect Vocus provides onhnet DDoS protection to automatically mitigate DDoSeventsdetectedbytheVocusDDoSdetectionsystematalltimes.TheCustomer mayusebgproutingprotocolsorotherwisethatwoulddirectcustomerboundtraffic tovocusddosmitigationdevicesforthedurationoftheattackonly.thecustomer mayalsocontactthevocusnoctorequestvocusddosprotectionifnotdetectedby thevocusddosdetectionsystem.chargesarecalculatedasafixedserviceandare based on the total bandwidth of the Internet Service. Where the Internet Service includes IP Burst, the DDoS Protection Service Charge is based on the total Burst Speed. If the Customer has not ordered a DDoS Protection Service, the Customer may request mitigationofaddosattackthatisaffectingthecustomer'sinternetservicebycontactingthe Vocus NOC. Vocus may offer DDoS protection only on the Customer s first request in accordance with the DDoS Detect service, after which the Customer must order a DDoS ProtectionServicetobeabletorequestfutureDDoSprotection. The DDoS Protection Service provides volumetric DDoS protection, not protection against applicationlevelattacks.ddosprotectionisnotavailableifinthesoleopinionofvocus: (a) (b) thetrafficisnotcategorisedasvolumetricddostraffic,or theworkrequiredtoidentify,profileandmitigatethetrafficissubstantial,inwhichcase VocusmaychargeafeeforserviceasagreedbytheCustomer. 15.5. 15.6. 15.7. 15.8. 15.9. ScrubbingofDDoStrafficasanactiontomitigateaDDoSattackislimitedtothecurrentcapacity oftheonhnetscrubbingsystemwithinthevocusnetwork.atanygiventimethecurrentcapacity willdependonthesourceoftheattacktraffic,theingressrouteandtypeoftrafficdestinedfor thehostunderattack,thevolumeofconcurrenttrafficbeingscrubbedandotherfactors.where addosattackislargerthanthescrubbingcapacityofthevocusmitigationsystem,vocusmay blackholetrafficoruseothermethodsatitsdisposaltomitigatetheattack. VocuswillinitssolediscretiondecidethemethodofmitigationtobeusedagainstaDDoS attackincluding,butnotlimitedto,scrubbing,filteringandblackholingoftraffic. ACustomerwhoordersDDoSProtectionServiceisentitledtoaccessonlinesystemsviaa singleuseridasprovidedbyvocuswhichincludesinformationregardingddosevents.the Customermayrequestaccessforadditionalusers(feesapply). Each order for DDoS Protection Services applies only to one Internet Service (a single connectionoranaggregatedbillinggroupofinternetconnections)providedbyvocusundera ServiceOrder.AllIPaddressesassociatedwiththatinternetservicewillbemonitored.The CustomermayrequestmonitoringofadditionalIPaddressesorasubsetofalargerrangeofIP addressesalreadybeingmonitored(feesapply).
