Short Title. 1 This ordinance 2 shall be known and may be cited as the Borough of Grove City Plumbing Ordinance, adopting by reference, with certain deletions, additions and amendments, the BOCA Basic Plumbing Code, 2nd Edition, 1970, hereinafter referred to in this ordinance as "this code. " 3 (Ordinance 931, April 28, 1972, Section 2) Section 2. Administration and Enforcement. The administration and enforcement of this ordinance 4 shall be the duty of the Building and Housing Official, who is hereby authorized to take such action as may be reasonably necessary to enforce the purposes of this code. 5 In enforcing the provisions of this code, the Building and Housing Inspector shall have the duty of making the inspections and tests required thereunder. 6 (Ordinance 931, April 28, 1972, Section 3, as amended by Ordinance 986, January 21, 1974, Section 2, and by Ordinance 1087, September 17, 1979, Section 4) Section 3. Scope. The provisions of this code 7 may apply to and govern plumbing as defined in this code, including the practice, materials and fixtures used in the installation, maintenance, extension and alteration of all piping, fixtures, appliances and appurtenances in connection with any of the following: sanitary drainage or storm drainage facilities, the venting system, 1. (XIX, sec. 3, cont'd) and public or private water-supply systems within or adjacent to any building or other structure, or conveyance; also the practice and materials used in the installation, maintenance, extensions or alterations of a storm-water or sewage system of any premises to their connection with any point of public disposal or other terminal. (Ordinance 931, April 28, 1972, Section 4) Section 4, Facilitiies. It is recognized that certain facilities in or adjacent to public streets are referred to in the code 8 only a portion of which is under the ownership or the control of the owner or occupant of the building or premises to which this code applies, (Ordinance 931, April 28, 1972, Section 5) Section 5. Right of Entry, The Building and Housing Inspector, in the discharge of his official duties, and upon proper identification, shall have authority to enter any building, structure, or premises at any reasonable hour. (Ordinance 931, April 28, 1972, Section 6, as amended by Ordinance 986, January 21, 1974, Section 1) Section 6 Bonding Requirements. Except as otherwise provided in this ordinance' any person or firm desiring to perform plumbing work within the Borough of Grove City shall execute and deposit with the Borough of Grove City a bond in the sum of two thousand ($2, 000.00) dollars, such bond to be conditioned that all plumbing work performed by the obligor or under his supervision shall be performed in accordance with the provisions of this code 10 and that such person or firm will pay all fines and penalties properly imposed for violation of the provisions of the code11 and will correct any work done which shall be found not to be in accordance with the provisions of the code. Such bond shall be executed by the obligor with reasonable and sufficient surety and shall inure to the benefit of the Borough of Grove City and to any owner or other person with whom such obligor shall have contracted for the performance of plumbing work within the Borough of Grove City. The Borough of Grove City and any owner or other person with whom the obligor has contracted for the performance of plumbing work hereunder shall have a direct right of action against the principal obligor and surety on such bond. No permit shall be granted or work commenced until the requirements of this section have been met. Any person or firm regularly performing plumbing work within the Borough of Grove City shall file such bond with the Borough on or before January 1 of each calendar year and such bond shall remain in full force and effect for the period of such calendar year commencing January 1. (XIX, sec. 7) Section 7. Plumbing Standards. 1. Code Adopted. The BOCA Code 12 is hereby adopted and all installations, repairs, and 13 alterations of plumbing shall, from the effective date of this ordinance, be performed in accordance with its provisions. 2. Official Copy. Three copies of the BOCA Code shall be kept on file by the Board for inspection by and use of the public and shall be marked with the words "Borough of Grove City Official Copy." (Ordinance 931, April 28, 1972, Section 8) Section 8. Permit for Plumbing Work. 1. Issuance of Permit. No plumbing work, unless excepted in this section, shall be undertaken prior to the issuance of a permit by the Building and Housing Inspector; provided, however, that in the case of a bona fide emergency plumbing work may be undertaken to remedy such emergency provided that application is made for a permit therefor at the earliest reasonable time. A permit shal1 14 be issued to a bonded plumber, except as provided in Section 9(2) herein. 2. Exception. Any permit required by this code 15 may be issued without bond to any person to do any work regulated by this code in a singlefamily dwelling used exclusively for living purposes in connection with such building, provided the person is the bona fide owner of such dwelling and that the same will be occupied by said owner and that said owner shall personally purchase all material and perform all labor in connection therewith with the exceptions of alterations to or connections with a sanitary sewer system. 3. Application for Permit. Application for permit shall be made on suitable forms provided by the Borough. The application shall be accompanied by fees in accordance with the schedule of fees. 4. Schedule of Fees. A. For a plumbing permit, the fee shall be at the rate of four dollars ($4.00) per thousand dollars ($1,000.00) of the estimated cost of the plumbing installation up to $10,000.00 with a ten dollar ($10.00) minimum; when the estimated cost is more than $10,000.00 the fee shall be forty dollars ($40.00), plus one dollar ($1.00) per each additional 1,000.00 or part thereof in excess of $10,000.00, provided in no event shall the minimum plumbing fee exceed five hundred dollars ($500.00). 12. The term "estimated cost" as used in this section 16 means the reasonable value of all services, labor, materials, and use of other appurtenances, entering into and necessary to the prosecution and completion of the work ready for occupancy. Deletions, Modifications and Amendments. The BOCA Basic Plumbing Code, Second Edition, 1970, is hereby changed and amended in the following respects: (1) Section P-102.0, Effective Date, is deleted. (2) Section P-109. 0, New Plumbing Systems, is deleted. (3) Section P-111.0, Permits for Plumbing Work, is deleted. (4) Section P-112. 0, Requirements for Permits, is deleted. (5) Section P-113. 0, Fees, is deleted. (6) Section P-114. 0, Inspections and Tests, is deleted. (7) Section P-308. 0 is amended to read as follows: P-308. 1. General. The water distribution system of any building in which plumbing fixtures are installed shall be connected to a public water supply system if available and the sewage facilities of any building shall be connected to the public sewer system. Individual sewage disposal systems are prohibited. A No. 2 copper tracer-ground line shall be buried with all plastic or vinyl type water lines with a wrap every three feet connected to the main line of the Borough and exposed in the area of the water meter. Connections and taps are to be made by the Borough of Grove City. P-308.2. Public Systems Available. A public water supply shall be deemed available to premises used for human occupancy if such premises are within 300 feet measured along a street, alley or easement, of the public water supply, and a connection conforming with the standards set forth in this Code may be made thereto. 16. (8) Section P-311.1 is amended to read as follows: (XIX, sec. 9, cont'd) P-311.1. Light and Ventilation. Washrooms and toilet rooms shall be illuminated and ventilated in accordance with the Building Code requirements, and, for the occupancies to which the Housing Code applies, with the Housing Code requirements. (9) Section P-313.3 is amended to read as follows: P-311.3 Freezing. Water service piping and sewers shall be installed below recorded frost penetration but not less below grade than 2 feet 6 inches for water piping and 2 feet and 6 inches for sewers. Plumbing piping in exterior building walls shall be adequately protected against freezing by insulation or heat or both. (Ordinance 931, April 28, 1972, Section 10; as amended by Ordinance 986, January 21, 1974, Section 3; and by Ordinance 1020, April 23, 1975, Sections 1 and 2) Section 10. Requirements for Plumbing Permits. 1. Plans and Specifications. No permit shall be issued until plans and specifications showing the proposed work in necessary detail have been submitted to the Borough and the administrative authority has determined from examination of such 19 plans and specifications that they conform to the provisions of this code. If a permit is denied, the applicant may submit revised plans and specifications without payment of additional fee. If, in the course of the work, it is found necessary to make any change from the plans and specifications on which a permit has been issued, amended plans and specifications shall be submitted and a supplementary permit, subject to the same conditions applicable to original application for permit, shall be issued to cover the change. Plans and specifications will not be required for residential construction unless specified by the administrative authority. 2. Repairs. Repairs involving only the working parts of a faucet or valve, the clearance of stoppages, repairing of leaks or replacement of defective faucets, fixtures, or valves may be made without a permit provided no changes are made in concealed piping to the fixtures. 3. Protection of Water-Supply System. The Borough shall make such rules and regulations in furtherance of the purposes of this code and not inconsistent with the specific provisions of this code, for the installation, repair or alteration of air conditioning systems, water-treatment equipment, and water-operated devices as may be deemed necessary to properly protect the water-supply system. 4. "Plumbing system" means all piping, fixtures and appurtenances used to transport water to, within and from a building. This includes potable, non-potable and heating system plumbing. [Ord. 1229] 5. All buildings or homes, including manufactured housing and mobile homes, connecting to the Borough's municipal water distribution system after January 6, 1991, shall be required to file, on a form provided by he Borough, a "Lead-Free Plumbing Material Certification" with the Borough of Grove City. The use of solder or fluxes which contain more than two tenths (0.2%) percent lead in the construction, modification or repair of any plumbing system in the Borough of Grove City after January 6, 1991, is prohibited. [Ord. 1229] 7. The use of pipes and pipe fittings (including fixtures) which contain more than eight (8%) percent lead in the construction, modification, or repair of any plumbing system in the Borough of Grove City after January 6, 1991, is prohibited. [Ord. 1229] 8. The Borough may inspect and test the plumbing system prior to or after connection to the municipal distribution system by (1) testing water samples after connection and/or (2) testing solder scrapings prior to connection. [Ord. 1229] (Ordinance 931, April 28, 1972, Section 11; as amended by Ordinance 1229, September 16, 1991, Section 2) Section 11. Saving Clare. Nothing in this ordinance 20 or in the plumbing code hereby adopted shall be construed to affect any rights acquired or liability incurred nor any cause or courses of action accrued or existing under any act or ordinance hereby repealed. Nor shall any right or remedy of any character be lost, impaired or affected by this ordinance. (Ordinance 931, April 28, 1972, Section 12) Section 12 Validity. The invalidity of any section or provision of this ordinance or the plumbing code hereby adopted shall not invalidate other sections or provisions thereof. The appeal 4procedure established under Ordinance 827 (Adoption of Building Code) shall govern and the Building Board of Appeals shall be authorized to hear appeals from decisions rendered by the administrative authority. (Ordinance 931, April 28, 1972, Section 16) Section 14 25 Penalty. Any person who shall violate ny provision of this ordinance or of the plumbing code hereby adopted 26 shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of not less than ten dollars ($10.00) nor more than one hundred dollars ($100.00) and costs of prosecution, and, in default of payment of said fine and costs, to imprisonment for not more than thirty (30) days.
