Our Ref: CS/3/wxyz CONDITIONS OF GRANT OF MSC MALAYSIA STATUS Abcd Efg SDN BHD(123456-Z) In consideration of Multimedia Development Corporation Sdn Bhd ( MDeC ) procuring the grant of Multimedia Super Corridor Malaysia Status ( MSC Malaysia Status ) to the company (particulars of which are stated above), the company ( MSC Malaysia Status Company ) hereby agrees to the following terms and conditions:
A. Conditions of MSC Malaysia Status (1) General Conditions The MSC Malaysia Status Company hereby agrees to: (ii) locate the implementation and operation of the MSC Malaysia Qualifying Activities in a designated Zone in a Cybercentre with minimum office space of xxxx sq ft, within six (6) months from the date of this letter. The MSC Malaysia Status Company shall obtain MDeC s prior written approval in the event of any changes in the location or address of the company;
(v) submit to MDeC a copy of the MSC Malaysia Status Company s Annual Report and Audited Statements in parallel with submission to the Companies Commission of Malaysia
B. Review Process To ensure the MSC Malaysia Status Company s commitment to the Government s objectives for the MSC, the MSC Malaysia Status Company agrees that MDeC shall have the right to monitor the activities and operations of the MSC Malaysia Status Company for the following purposes: (i) to ensure compliance with the terms and conditions contained in this letter or other terms and conditions as may be notified by MDeC from time to time;
(ii) providing such information and documentation which may be requested by MDeC from time to time in relation to its activities and operations; (iii) meeting with MDeC s personnel or MDeC s professional advisers or agents to clarify issues, answer queries, evaluate proposals and agree on objectives, activities, timelines and financial figures which may be relevant to the monitoring process; and (iv) granting access to MDeC s personnel or MDeC s professional advisers or agents to enter the premises of the MSC Malaysia Status Company for the purpose of evaluating the activities and operations of the MSC Malaysia Status Company.
WHAT IS MSC BILL OF GUARANTEE? Reflects the Government's intention to provide an environment in MSC Malaysia that is conducive to the development of MSC Malaysia Status entities. The Incentives, rights and privileges granted pursuant to the BoGs are subject to requirements under relevant laws and regulations.
DOs 1. BUILDING within Cybercity / Cybercentre; 2. ROOM - with specific enclosures, eg. 4 walls; 3. TYPE commercial premise; 4. SERVICE OFFICES - MSC companies are permitted to reside at service offices provided all the above mentioned conditions are adhered to; 5. RETAIL UNITS - are permitted so long as the units are not in the form of Cart, Cubicle, Exhibition enclosure, Kiosk; Table; Vehicle DON Ts 1. Residential units, virtual office, pigeon hole ; 2. Sub-units cubicles, desks, workstations.
1. Officer conducts site visits to MSC premise; 2. Source for evidence that the company is undertaking the MSC approved activities with a full deployment of staff. 3. A checklist will be completed for Internal reporting with evidence; 4. Submit recommendation for BoG, e.g. Hiring of foreign knowledge workers; Activation of tax incentives; Tax free importation of multimedia equipment, etc.
