Useful information Rental Payments & Arrears The rent is due to be paid by the Tenant/s into the Village Real Estate Pty Ltd Rental Trust Account on the date the rent falls due and payable. To allow for processing of cheques, electronic transfers etc., the transfer from the Trust Account to you make take up to three (3) days. Whilst the vast majority of tenants pay their rent on or close to the due date, there are occasions when this does not occur. Our procedure regarding rent arrears is as follows: 2 Days Overdue: A reminder notice is sent to the tenant (either by phone, email or text) 3 Days Overdue: A reminder notice is sent to the tenant (either by phone, email or text) 5 Days Overdue: A reminder notice is sent to the tenant (either by phone, email or text) 7 Days Overdue: The tenant is advised in writing that if payment is not made within 7 days, a 14 day notice to vacate will be served, and an application to VCAT made. 10 Days Overdue: Phone call to the tenant to explain again the 14 day Notice procedure if rent is not received. 15 Days Overdue: Notice to Vacate is served. 18 Days Overdue: Application is made to VCAT for a Warrant of Possession upon Landlords Instructions. These actions are carried out automatically and are done in accordance with the Residential Tenancies Act to minimize the possibility of financial loss. No formal action for recovery of rent can be undertaken until the tenant is 14 Full days in arrears. Agents Authority The Authority to lease and manage your property included with this document authorises us to sign all tenancy agreements on your behalf. Furthermore, we will sign the Bond Lodgement Form on your behalf prior to lodging it with the Residential Tenancies Bond Authority. By signing this instruction form, you are authorising us to select tenants, to collect rents due, issue receipts for all money collected, exercise your right to terminate tenancy agreements and tenancies in accordance with the provisions of the Residential Tenancies Act, serve relevant notices upon tenants subject to the Act and attend Tribunal hearings on your behalf wherever necessary. Residential Tenancies Act 1997 The Act, which came into operation on 1 July 1998 has changed in many aspects in relation to the legislation governing residential tenancies. The following is only a summary of those changes and we strongly recommend that if you require any further information on any of the areas listed, please contact our office. Jurisdictional limit of the Residential Tenancies Tribunal The maximum jurisdiction limit for the Residential Tenancies Tribunal is $10,000. The tribunal may only hear and determine an application or make a determination in respect of a higher amount if both parties to the application agree so. Rental Arrears The legislation has developed an alternative method for gaining possession of a property if the tenant is in arrears with rent. When the tenant is over 14 days in arrears, an application is made to the Tribunal and a 14 day Notice to Vacate is served by registered post upon the tenant. This notice must contain objection forms which if not received by the Tribunal form the Tenant prior to the Notice expiring, the matter will be determined by the Member and an Order made for Warrant of Possession. Rent Increase 60 days Notice is required to be given to the tenant of a rent increase. A rent increase cannot be implemented during a fixed term tenancy period unless otherwise stated in the Lease Agreement. Whilst it is not required by legislation, it is our recommendation that this notice is served by registered post as proof of service. However, with every notice, of an increase in the rent, the tenant must be advised of their rights regarding excessive rent increases. Access to Property Access to the property is limited so as to allow the tenant s peaceful and private enjoyment of the property. However access can be gained during periods of maintenance, routine inspections or following the issue of a Notice of Entry for specific reasons as set out in the Act. Please note that upon the Tenant providing the required 28 days notice to vacate the property, access can only be gained during the last 14 days of the tenancy. Bonds The Residential Tenancy Bon Authority (RTBA) administers all tenants bonds paid on residential properties. The only way a bond can be recovered from the Authority is by: An application signed jointly by the tenant and the lanlord (or agent) A Order of the Tribunal A court Order In the vast majority of cases, recovery will be automatic as most tenants fully meet their obligations.
