Background Downtown Enhancement Plan introduced by APD in April 2014 to address an increase in nuisance and criminal behavior in the Central Business District (CBD) APD Downtown Unit took a more proactive enforcement approach through physical arrests, citations and additional staffing. Overall criminal activity is down in the CBD Nuisance activity and complaints are up Residents Businesses Visitors

Panhandling Panhandling Uptick in complaints regarding aggressive panhandling and soliciting Panhandling/ soliciting on sidewalks and roadways Misconception about violators

Panhandling Current Panhandling Ordinance - 11-5 Defines panhandling as: use of the spoken, written, or printed word, or other acts as are conducted in the furtherance of the purpose of immediately collecting contributions for the use of one s self or others.

Panhandling Current Panhandling Ordinance Applicable Citywide Everywhere in the city it is unlawful to solicit contributions for one s self or for others from any person through speaking, gesturing, or with a sign: 1) after dark; 2) within twenty feet of the entrance to a bank or ATM; 3) by touching someone without their consent; 4) by blocking someone s path; 5) at a transit stop or on a bus; 6) while someone is in line to enter a business; 7) while under the influence of drugs or alcohol; 8) at any outdoor dining or merchandise area while they are open; 9) by or with the use of profane language, or 10) by accosting or forcing oneself on someone else s company.

Panhandling Panhandling Ordinance Also designates the Biltmore Historic Village and a certain zone downtown as high traffic zones where all of the above-mentioned restrictions apply, and where it is also unlawful to solicit using spoken words or gestures. This means that, within those zones, a person may only panhandle by displaying a sign or a hat, or in some other passive manner. Violation of the ordinance is a class 3 misdemeanor punishable by a fine not to exceed $50.

Vending on Sidewalks Current Vending on Sidewalks Ordinance 16-142 It is unlawful for any person to sell, offer for sale, exhibit or demonstrate any goods, wares, merchandise, mechanical devices, animals or any article of any kind whatsoever, by whatever name called, upon any public street, sidewalk, square, avenue or alley within the City. Permits are available for pushcarts and outdoor dining and merchandise areas under very specific conditions, but the ordinance s language clearly prohibits any other vending.

Vending on Sidewalks Concerns: - Sale vs. Donations Vending on Sidewalks - Blocking sidewalks and entrances to businesses City Attorney s Office Guidance: Where goods are exchanged for money the outward expression is a commercial transaction no matter what the parties choose to call it. As such, goods in exchange for a donation is selling under 16-142, and therefore not allowed on City sidewalks. ACTION: APD will use its judgment in enforcing ordinance as written and as interpreted by City Attorney s Office

DOWNTOWN ENHANCMENT PLAN UPDATE Street Performers Current Street Performer Ordinance 16-141 defines Sidewalk Entertainment as performances which may include, but not be limited to, music, dance, mimes, magicians, clowns, jugglers and theatrical presentations, but specifically excluding speeches, lectures, and sermons.

Street Performers Current Street Performer Ordinance 16-145 provides that performers of sidewalk entertainment must: Not violate the City s noise ordinance; Not violate the solicitation/panhandling ordinance; Not obstruct or cause to be obstructed pedestrian or vehicular traffic, including but not limited to not obstructing or causing to be obstructed sidewalks, doorways or other access areas. Entertainers must provide a minimum of 6 feet of pedestrian passageway; Not sell records, tapes or other products; Perform only at time between the hours of 9:00 a.m. and 10:00 p.m.; Not consume or be under the influence of alcohol or other controlled substances; Not perform any closer than 40 feet from another performer; Not perform at locations designated for community events or festivals without a permit; Comply with all local, state, and federal laws.
