1 AP 3555 Alcoholic Beverages Reference: Business and Professions Code Sections , , and and 34 Code of Federal Regulations Part (b) Date Issued: January 23, 2008 Last Updated: February 16, 2016 August 13, 2012 The possession, sale, or the furnishing of alcohol on campus is governed by California state law and these procedures. The possession, sale, consumption, or furnishing of alcohol is controlled by the California Department of Alcohol and Beverage Control. However, the enforcement of alcohol laws on-campus is the primary responsibility of the (District) Public Safety Department. The campus has been designated drug free and only under certain circumstances is the consumption of alcohol permitted. The possession, sale, manufacture, or distribution of any controlled substance is illegal under both state and federal laws. Such laws are strictly enforced by the District Public Safety Department. Violators are subject to disciplinary action, criminal prosecution, fine and imprisonment. It is unlawful to sell, furnish, or provide alcohol to a person under the age of twenty-one. The possession of alcohol by anyone under twenty-one years of age in a public place or a place open to the public is illegal. It is also a violation of this policy for anyone to consume or possess alcohol in any public or private area of campus without prior District approval. Organizations, groups, or individuals violating alcohol or substance policies or laws may be subject to sanctions by the District. Alcoholic beverages are not permitted on District owned or operated property, except as follows: The alcoholic beverage is for use in connection with a course of instruction or instructional program such as viticulture, enology, hospitality, or culinary arts at a community college campus, and the instructor has obtained written authorization by the college president using the attached request form; or The alcoholic beverage is for use during a fundraising event sponsored by the Foundation for Grossmont and Cuyamaca Colleges or the District auxiliary; or The alcoholic beverage is for use during an event held at the Water Conservation Garden, conducted pursuant to a written policy adopted by the Water Conservation Garden Authority; or The alcoholic beverage is for use during a third-party sponsored fundraiser held to benefit a nonprofit corporation, such as a college foundation or auxiliary that has obtained a license under the Business and Professions Code. The alcoholic beverage is possessed, consumed, or sold, pursuant to a license or permit obtained under this division for special events held at the facilities of a public community college during the special event. "Special event" means events that are held with the permission of the District Governing Board or designee, that are festivals, shows, private parties, concerts, theatrical productions, and February 16, 2016, Item 655 ATTACHMENT A 1
2 AP 3555 Alcoholic Beverages (Page 2 of 2) other events held on the premises of the public community college and for which the principal attendees are members of the general public or invited guests and not students of the public community college. To obtain approval for alcoholic beverage service under this procedure, the employee or the organization must obtain the specific, prior written permission (Attachment A) of the college president and the Chancellor (Facilities Use Request pursuant to BP 3555 Alcoholic Beverages, if on a college campus). The request for permission will specify: The name and tax exempt status of the organization to receive the benefits; The name and contact information for the one person who will be responsible for the event; That the proper Alcoholic Beverage Control permit will be obtained; That all applicable laws and guidelines will be followed; and That proof of insurance will be provided. Authorization will be at the sole discretion of the Chancellor. Alcoholic beverages cannot be acquired, possessed, or used at any athletic contest or student-sponsored event on District property and/or sponsored by the District. Except as provided in this procedure, alcoholic beverages are prohibited on District owned or operated property. February 16, 2016, Item 655 ATTACHMENT A 2
3 REQUEST FOR APPROVAL FOR ALCOHOLIC BEVERAGE SERVICE (Pursuant to BP/AP 3555 Alcoholic Beverages) To obtain approval for alcoholic beverage service, the organization must obtain the specific, prior written permission of the College President (if on a college campus) and the Chancellor. Please provide the following information: Event Title Event Date/Time Brief description of the primary activity or activities to take place at the event The name and tax exempt status (provide EIN#) of the organization sponsoring the event and receiving the proceeds Name/contact information for the person responsible for the event By making this request, the person responsible for the event (listed above) takes full responsibility for the following (and submitting copies to the Chancellor upon obtaining): Obtaining the proper Alcoholic Beverage Control permit Obtaining Proof of Insurance Compliance with all applicable laws, guidelines, and AP/BP 3555 Alcoholic Beverages Final authorization will be at the sole discretion of the Chancellor. To that end, the Chancellor shall ensure that these procedures, and other board policies and administrative procedures related to safety and the prevention of crime, are established. Definitions Prevention activities increase awareness and minimize the potential for crisis in the workplace. Training is essential for all employees to learn how to recognize early warning signs, so that appropriate intervention can be provided for identified areas of conflict in the workplace. Crisis or conflict constitutes any inappropriate or unreasonable disruption that interferes with the normal functioning of the employees work. Acts of violence include any physical action, whether intentional or reckless, that harms or threatens the safety of self, another individual or property. A threat of violence includes any behavior that by its very nature could be interpreted by a reasonable person as intent to cause physical harm to self, another individual or property. Workplace includes off-campus locations as well as college-sponsored activities where faculty, staff, or student employees are engaged in college business or locations where incidents occur as a result of the person's relationship to the college community. Emergencies Any employee shall immediately report any situation that threatens life or property and demands an immediate response of police, fire, or medical personnel by dialing 911 or the District Public Safety Department. Equipment and Sanitation Should the duties of an employee require the use of equipment to ensure the safety of the employee, the District shall furnish such equipment. Complaints related to health safety, sanitation and working conditions shall be forwarded to the Human Resources Department for review and recommendation. Crisis and Conflict Intervention Any employee experiencing an unsafe work condition should immediately contact his/her supervisor or the Human Resources Department. The supervisor shall immediately notify the Human Resources Department about any acts or threats of violence. The employee will be provided consultation regarding resources available to resolve the unsafe work condition. February 16, 2016, Item 655 ATTACHMENT A 4
5 AP 6800 Safety (Page 2 of 2) It is the responsibility of all employees to immediately report threats, acts of violence or any other behavior which deliberately hurts or harms another person at the college to their immediate supervisor and the District Public Safety Department. Such reports will be promptly and thoroughly investigated. Restraining Orders/Court Orders An employee shall notify law enforcement of any restraining orders/court orders when named as a plaintiff, and provide a copy of the order to the Human Resources Department. In the event the supervisor is informed by an employee of a restraining order, the supervisor will contact the Human Resources Department, to ensure they are aware of it, and that they have a copy of the restraining order on file.
