Amy Shaw requested that Cupful, Inc. dba Marley Coffee Kiosk (item VI. a. ii.) be corrected to Cupful, Inc. without the dba. Amy Shaw also requested that The Hispanic Agency, LLC dba The Diversity Agency (item VI. a. iv.) be corrected to The Hispanic Agency, LLC without the dba. Yvonne Schuman requested that the second sentence (item VII. a.) be corrected to state that Ms. Schuman indicated NDOT received one SBE applicant and it will be presented to the Committee next month. Jr2, Ltd is being presented as an SBE certification, not DBE. Ms. Munoz would like to add a discussion on housekeeping issues and the meeting conference notice e mailed by B2G Now. Other Discussions will be added to each agenda where committee members can discuss issues not previously listed on the agenda. VI. New Business a. Nevada Department of Transportation Certification Review i. JR2, Ltd. (SBE) Henderson (For Possible Action). Ms. Munoz introduced this item and Pat Torvinen reviewed the certification material. JR2, Ltd is the first SBE application processed by NDOT. The applicant provides traffic control, project management, submittal management and public information management services. JR2, Ltd. meets the eligibility standards of 49 CFR Part 26.39, Section 3 of the Small Business Act and CFR 13 Part 121. The firm s average gross receipts for the past three years does not exceed the SBA small business size cap of $22.41M and the owner s personal net worth does not exceed the $1.32M cap. Yvonne Schuman recommends removing ethnicity and gender from the SBE Verification Form. Personal Net Worth (PNW) assessment is not required, but if a certifying agency chooses to evaluate PNW, a personal financial statement form must be provided. NDOT uses the same personal financial statement form used to evaluate DBE firms. NDOT had extensive committee meetings comprised equally of small and large businesses. The small businesses supported having a cap to avoid large businesses from creating subsidiaries. The SBE program is part of the DBE program and the PNW is set to help small businesses. New firms seeking SBE certification must submit the complete SBE Verification Form. Firms that are certified by the SBA can submit the one page application but they must complete the Personal Financial Statement form. Amy Shaw stated that McCarran has not yet received an SBE application. The original SBE Verification Form did not include a review of PNW, but since we are accepting SBA certifications which have a personal net worth cap, the SBE program should also have a cap. Yvonne Schuman stated that there is some guidance on the PNW for the SBE program in the FHWA Q&A Guidance on Part 26.39. Joan Woods commented that the SBE program is being implemented differently in different states and that DOT should have provided more guidance. ii. iii. James & Associates (DBE) Las Vegas (For Possible Action). Ms. Munoz introduced this item and Pat Torvinen reviewed the certification material. James and Associates provides real estate appraisal services. The applicant meets the requirements 49 CFR, Part 26. The firm s gross receipts do not exceed the $22.41M size cap and the owner s personal net worth does not exceed the $1.32M cap. Graham Dollarhide requested clarification on the firm s PNW which indicates that the owner s net worth exceeds the cap. Pat Torvinen explained that the Personal Financial Statement includes the spouse s net worth. The spouse has no ownership in the company and the amount also includes the equity of the primary residence. The actual personal net worth should be based on one half of the assets and liabilities since Nevada is a community property state, and pursuant to the regulations, the equity in the primary residence is also deducted. Joan Woods commented that while the primary residence is excluded from the personal net worth calculation, it is important to insure that the personal property value is equitable to the value of the property. Ms. Munoz introduced this item and Pat Torvinen reviewed the certification material. Smalls Senibaldi Services, LLC is a janitorial and construction clean up firm. The applicant meets the requirements 49 CFR, Part 26. The firm s gross receipts do not exceed the $22.41M size cap and the owner s personal net worth does not exceed the $1.32M cap. iv. Innovative Real Estate Strategies (DBE) Las Vegas (For Possible Action). Ms. Munoz introduced this item and Pat Torvinen reviewed the certification material. Innovative Real Estate Strategies buys, sells, and manages real estate; they specialize in short sales and property management. The applicant meets the requirements 49 CFR, Part 26. The firm s gross receipts do not exceed the $22.41M size cap and the owner s personal net worth does not exceed the $1.32M cap. MOTION: Yvonne Schuman SECOND: Elisa Rizzo Abstain: None ACTION: Approve DBE Certification for Innovative Real Estate Strategies. VII. Discussion a. Small Business Enterprise Program (Update) Yvonne Schuman stated that NDOT conducts on sites for SBE firms for the same reason that on sites are conducted for DBE applicants to verify that the company exists and the firms is what it says it is. There is no need to conduct an on site for applicants who are SBA certified. General discussion regarding SBE applicants who are SBA certified who are not presented to the UCP for approval. Since it would be helpful to share the names of SBA firms that have been certified as SBEs, the committee agreed that each certifying agency will share a list of those firms at the monthly meetings. Yvonne Schuman stated that NDOT slightly modified the on site review form as there are some questions that do not pertain to SBE firms. She recommended that the committee develop a standard on site form for SBEs. Amy Shaw will e mail the current on site form used by McCarran with the gender and ethnicity questions removed. Committee members were asked to strike through questions that do not apply for further discussions at the next meeting. Elisa Rizzo asked if anyone has projects with SBE goals. Reno Tahoe Airport Authority has a project that will be issued in March and they are looking into setting an SBE goal. There were no other agencies that have established SBE goals for upcoming projects. b. ACDBE/DBE Website Posting Amy Shaw inquired whether it is possible for certifying agencies to get back door access to the B2G System to add new firms and modify information for only those firms that the specific agency certifies. Pat Torvinen believes that there is an option for the airports to access their particular data, but deferred this question to Dana Olivera who is the project manager. The Committee requested that Dana be added to the February agenda. January 28, 2014 Meeting Minutes Page 5 of 6
There were discussions regarding the changes to the website listing of certified firms and the difficulty in accessing information. Kathy Keever inquired whether an SBE/DBE header can be added. Pat Torvinen deferred this question to Dana but stated that they are still in the implementation phase, so it may be possible to add headers. The data base is coded so if someone is looking for an SBE, every firm will come up. But if a contractor is looking for a DBE or a firm with a specific NAICS code, they can tailor their search to exclude SBEs. Ms. Munoz asked the committee to provide a list of their representatives who want to get all UCP related emails vs. just being notified of the monthly meetings.
