I. Call to Order The meeting was called to order at 8:01 a.m., Thursday, September 18, 2014. The following Board members were present:,,,, and. presided. welcomed members of the audience, explained the procedure for addressing the Board, and stated the mission of the Board. VI.C.6. Jenny Martha Pina RN166241 (Richter) moved, seconded, and it was unanimously carried to table Agenda Item VI.C.6. VI.E.1. Mark Newton RN162648 (Pilder) Newton was present and available for questions. Attorney Rob Chelle was present and addressed the Board. moved, seconded, and it was unanimously carried, based upon the information in the investigative report, to offer a Consent Agreement for a Decree of Censure. Toni Papin RN063339 (Chambers) Papin and attorney Rob Chelle were present and addressed the Board. moved, seconded, and it was unanimously carried to issue a Letter of Concern for medication errors made on or about November 28, 2009, and July 31, 2013, while working as a RN at Hospice of Arizona in Phoenix, Arizona. arrived at the meeting at 8:13 a.m. presided. VI.D.7. Christina E. Palaez RN Exam (Morton) Attorney Rob Chelle was present and addressed the Board. moved, seconded to grant licensure upon meeting all requirements, and issue a Letter of Concern for her May 29, 2002 misdemeanor conviction of Minor in Possession of Liquor, in the Chandler Municipal Court, in Chandler, Arizona, her December 27, 2003 DUI arrest in Scottsdale, Arizona, her April 13, 2005 conviction of a misdemeanor DUI, and a class six undesignated offense of endangerment, that was reduced to a misdemeanor on March 2, 2007, in the Maricopa County Superior Court, in Maricopa County, Arizona. The motion carried with six in favor and one abstained. VI.N.5. Julie Lindeman Locke RN158299 (Wilson) (aka: Lindeman; Fahnel) Wilson addressed the Board and confirmed receipt of additional information. Attorney Rob Chelle was present and addressed the Board. Julie Locke was present and available for questions. moved, seconded, and after discussion it was unanimously carried, based upon the information in the investigative report, offer a Consent Agreement for a Decree of Censure. VI.C.6. Jenny Martha Pina RN166241 (Richter) moved, seconded, and it was unanimously carried to reopen Agenda Item VI.C.6. Attorney Craig Orent was present and addressed the Board. moved, seconded, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a substance abuse evaluation by a Board approved PhD level licensed psychologist, at no cost to the Board, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue a Notice of Charges and include the factual allegations and alleged violations of statute and rule for failure to comply with the Interim Order. VI.P.10. Amie Lyn Schnorr RN123257 (Galan) Attorney Teressa Sanzio was present and addressed the Board. An attempt was made to contact Schnorr telephonically. moved, seconded, and it was unanimously carried, based upon the findings of fact and statute/rule violations identified in the investigative report, upon meeting all licensure requirements and signing a Consent Agreement for a 12 month stayed revocation during which time the license is placed on probation with terms and conditions, followed by a 12 month probation with terms and conditions, all to include attached stipulations, grant a limited license for the purposes of completing an RN Refresher course, for licensure. Upon successful completion of RN Refresher Course, issue RN license under applicable terms contained on the attached stipulation worksheet. If not signed within 30 days, deny licensure. V.C.3. Gail Ziv RN045016 (Austin) Attorney Teressa Sanzio was present and available for questions. moved, seconded, and it was unanimously carried to terminate Consent Agreement and Order NO. 0802104-NUR. VI.C.10. Tammy June Turney RN076812 (Richter) (aka: Jenkerson) Turney was present telephonically and available for questions. Attorney Allen Bickart was present telephonically and addressed the Board. moved, seconded, and it was unanimously carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a psychological evaluation with an emphasis on anger management by a Board approved PhD level licensed psychologist, and to include any additional testing deemed necessary by the evaluator, at no expense to the Board, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue a Notice of Charges AzBN September 2014, Regular Board Meeting Minutes 3

and include the factual allegations and alleged violations of statute and rule for failure to comply with the Interim Order. VI.E.15. Neale Michael Spender CO Compact; RN 189433 (Pilder) Pilder addressed the Board with additional information. Spender was present and attorney Kathryn McCormick were present and addressed the Board. moved, seconded, based on a determination of reasonable cause, based on the information in the investigative report (and material presented at this Board meeting), at no cost to the Board, issue an Interim Order for a psychosexual misconduct evaluation to be completed by a Board approved licensed psychologist who has expertise in professional sexual misconduct, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the information identified in the investigative report, issue Notice of Charges against the privilege to practice and deny the application for licensure and include the factual allegations and alleged violations for failure to comply with the Interim Order. Karen Merle King RN106795; AP2526 (Hunter) (aka: Lewis) moved, seconded, and it was unanimously carried, based upon the information in the investigative report, offer a Consent Agreement for a 12-month stayed suspension during which time the license is placed on probation, and to include the attached stipulations. VI.M.1. Suzanne Michelle Daniels RN165488 (Hunter) (aka: Listemann; Carter) moved, seconded, and it was unanimously carried to reopen Agenda Item VI.M.1. Daniels was present and attorney Darius Nickerson was present and addressed the Board. moved, seconded to issue a Letter of Concern for tampering with a prescription label and submitting the label as false evidence in response to a positive urine drug test for oxycodone, a drug for which she did not have a prescription. After discussion the motion failed with five opposed and two in favor. moved, seconded, based upon the findings of fact and statute/rule violations identified in the investigative report, offer a Consent Agreement for a Decree of Censure. If not signed within 30 days, issue Notice of Charges. The motion carried with five in favor and two opposed. YES 5 X X X X X NO 2 X X V.B.5. Michelle Shepis RN129469 Greabell Shepis was present and attorney Ken Baker was present and addressed the Board. moved, seconded, and it was unanimously carried to terminate Consent Agreement and Order No. 1202088 and issue a Letter of Concern that on or around September 13, 2013, while Shepis was employed as an RN at BrightStar Home Care in Tucson, Arizona, she completed a form required for patient C.C. to receive home health aide services and failed to include on the form that respondent obtained the required information from C.C. s niece, R.C. instead of directly from C.C. V.B.3. Leasa Michael RN156154 Greabell Greabell addressed the Board and confirmed receipt of additional information. Michael and attorney Ken Baker was present and addressed the Board. moved, seconded, on a determination of reasonable cause based on the information contained in the investigative report (and material presented at this Board meeting), at no cost to the Board, issue an Interim Order for a substance abuse and relapse evaluation to be completed by a Board approved evaluator who is at minimum PhD prepared, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the information contained in the investigative report and material presented at this Board meeting, issue Notice of Charges and include the factual allegations and alleged violations for failure to comply with the Interim Order. VI.B.8. Michelle Jeannine Debellis RN0161797; CRNA Endorsement (Monas) (aka: Lewis) Monas addressed the Board with additional information. Attorney David Klink was present and addressed the Board. Debellis was present and available for questions. moved, seconded, and it was unanimously carried to grant Registered Nurse Anesthetist Certification upon meeting all requirements, and issue a Letter of Concern for Applicant s April 4, 2013, conviction of Driving under AzBN September 2014, Regular Board Meeting Minutes 5

the Influence of Alcohol, with a blood alcohol content of.144 at 2250 hours, and.141 at 2256 hours. VI.B.9. Taylor Bryce Mitchell RN Exam (Monas) Monas addressed the Board with additional information. Attorney David Klink was present and addressed the Board. Mitchell was present and available for questions. moved, seconded, and it was unanimously carried to grant licensure upon meeting all requirements, and issue a Letter of Concern for Applicant s January 3, 2005, charges of Manuf/Dist or Intent to Manuf/Dist Controlled Dangerous Substances, Possession of Marijuana/Hash over 50 grams, Possession of Drug Paraphernalia, Possession of Controlled Dangerous Substances (Other), Inhalation of Toxic Chemicals, Distributing Drugs on School Property, dismissed on or about January 17, 2007, after completion of 1 year Conditional Discharge, received on November 3, 2005. The meeting recessed at 9:52 a.m. and reconvened at 10:09 a.m. VI.K.1. Kelly Lee Covert LP044817 (Kish) Attorney Anthony Fernandez was present telephonically and addressed the Board. Covert was present telephonically and available for questions. moved, seconded, and it was unanimously carried to dismiss the complaint. VI.K.2. Kristen Ann Mellinger RN135910 (Kish) Complainant S.H. was present telephonically and addressed the Board. Attorney Fulton Cavett was present telephonically and addressed the Board. Mellinger was present telephonically and available for questions. moved, seconded to dismiss the complaint. After discussion the motion carried with four in favor and three opposed. III.E. Board Information Regarding Imposters, Cease and Desist Orders and Court Ordered Revocations III.E.1. Amanda L Trujillo RN137552 V. Smith Lucia Trujillo, mother of Amanda Trujillo, was present and spoke to the Board, including reading a statement she said was written by Amanda Trujillo. Ms. Trujillo asserted the complaint information submitted to the Board related to Cease and Desist Order was fabricated, and a document showing Amanda Trujillo s LinkedIn profile had been altered. She stated the LinkedIn profile that was online was created years ago and did not contain current information. Ms. Trujillo stated she does not agree that Amanda Trujillo should not be able to use title "nurse". Board members directed her to the statutes, and mentioned title protection. Staff clarified that after receipt of the complaint, Ms. Trujillo s LinkedIn profile was obtained independently by staff, who found that the online profile was active and incorrectly identified Trujillo as presently employed as an RN. IV.B. Felony Bar Cases IV.B.1. Board Staff Recommendation: Adopt Order of Denial for Applicants Agenda # Name License/Certificate # Staff IV.B.1.d. Christina Elaine Parker CNA Endorsement Arias Parker was present and addressed the Board. moved, seconded, and it was unanimously carried to adopt the attached Order of Denial. V.B.6. Norman Nicholas Mack LP018901; RN146159 Greabell Greabell addressed the Board with additional information. moved, seconded, and it was unanimously carried to allow Respondent to continue on Consent Agreement and Order No. 1303033. Respondent shall obtain a substance abuse and anger management evaluation with a Ph.D. level Board approved evaluator and begin nursing ethics counseling or coursework in nursing ethics within 60 days of the Board meeting. If the evaluation is not completed and coursework or counseling in nursing ethics has not commenced with 60 days, lift the stay of revocation. Consent Agreement and Order No. 1303033 remains in effect until the matter is resolved. Issue a Letter of Concern, while under Consent Agreement and Order No. 1303033 for failing to complete a psychiatric substance abuse and anger management evaluation with a Ph.D. level Board approved evaluator within 30 days of the effective date for the Order and for failing to make an appointment to undergo and complete nursing ethics counseling or submit a syllabus of proposed ethics coursework to Board staff within 30 days of the effective date of the Order. V.B.2. Meredith Joann Abdi RN147896; CNA880519641 (exp 3/31/2004) Greabell moved, seconded, and it was unanimously carried, based on the information in the investigative report, issue Notice of Charges. V.B.9. James Lamb RN093041; CNA983174103; AP2293 Greabell Lamb was present and addressed the Board. moved, seconded, and after discussion it was unanimously carried, based on the information in the investigative report, offer a Consent Agreement for a minimum 6 month stayed revocation/suspension with terms and conditions to be followed by a minimum 6 month stayed revocation/probation with terms and conditions to be signed within 30 days to be followed a minimum 6 month standard probation with terms and conditions. If not signed within 30 days, issue Notice of Charges. V.C.2. Update on Report to Legislature Regarding Long Term Funding Strategies for the Certified Nursing Assistant Program Harris/Orchard/Bontrager/Ridenour Late Mailing Gregg Harris addressed the Board regarding his work on the CNA funding issue relating to operating costs for the CNA program. Meetings have been held with some legislators and additional meetings are scheduled to be held with stakeholders interested in determining a comprehensive goal solution, with funding solutions that would work well for the stakeholders and for the Board. A report outlining CNA funding issues, federal restrictions to not charge CNA applicants, and Board recommendations to implement a fee structure to charge, is due to the legislature on November 1, 2014. VII.A.4. Update Potential 2015 Legislation Impacting Nursing Regulation-Harris Gregg Harris noted there was interest in sunrise applications which he will monitor.
