Call to Order The meeting was called to order at 8:02 a.m., Thursday, July 25, The following Board members were present:,,,,,,, and. presided. welcomed members of the audience, explained the procedure for addressing the Board, and stated the mission of the Board. VI.B.10. Jose Alberto Sanchez RN Exam; LP043142; (Richter) CNA Attorney Robert Chelle was present and addressed the Board. Sanchez was present and available for questions. moved, seconded, and it was unanimously carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a substance abuse evaluation, at no expense to the Board, to be completed by a Board approved PhD level licensed psychologist, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, deny licensure and issue Notice of Charges for LP and CNA , and include the factual allegations and alleged violations of statute and rule for failure to comply with the Interim Order. VI.B.19. Jacob Alexander Mather CNA Exam (Richter) Attorney Robert Chelle was present and addressed the Board. Mather was present and available for questions. moved, seconded, and it was unanimously carried, based upon the findings of fact and statute/rule violations identified in the investigative report, upon meeting all certification requirements, and signing a Consent Agreement for a decree of censure, grant certification. If not signed within 30 days, deny certification. VI.D.11. Kimberly S Purdy RN (Greabell) Attorney Robert Chelle was present and addressed the Board. moved, seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts in the investigative report and material presented at this Board meeting, at no cost to the Board, issue an Interim Order for a Nurse Practice Evaluation to be completed by a Board approved evaluator to be completed within 60 days and then return to the Board. If the Interim Order is not completed, based 2

3 upon the findings of fact and statute/rule violations identified in the investigative report, issue Notice of Charges and include the factual allegations for failure to comply with the Interim Order. VI.D.13. Tracy Ann Strand LP (Greabell) Larry Herring was present and addressed the Board. Attorney Robert Chelle was present and addressed the Board. moved, seconded, and it was unanimously carried to dismiss the complaint. VI.J.4. Mitzi Surofchek RN (Hunter) recused herself to avoid the appearance of impropriety and left the meeting at 8:21 am. Attorney Robert Chelle was present and addressed the Board. Hunter addressed the Board with additional information.. moved, seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts alleged in the investigative report and material presented at this Board meeting, and at no cost to the Board, issue an Interim Order for: Substance use disorder and psychiatric evaluation to be completed by a Board approved psychiatric addictionologist, and any additional testing deemed necessary by the evaluator, to be completed within 45 days and Hair Follicle Testing for controlled substances (Health Professional Panel), to include Fentanyl, both to be completed with 14 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Notice of Charges and include the factual allegations and alleged violations for failure to comply with the Interim Order. Evan Kyle DiGiovanni RN Exam; (Monas) CNA Attorney Robert Chelle was present and available for questions. moved, seconded, and it was unanimously carried, upon a determination of reasonable cause, based on the facts alleged in the investigative report, and material presented at this Board meeting, issue an Interim Order for a substance abuse evaluation by a Board approved PhD level licensed psychologist, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue a Notice of Charges for CNA , and deny RN licensure, and include the factual allegations and alleged violations of statute and rule for failure to comply with the Interim Order. 3

Candice Lee Kaiser RN (Wagner) Attorney Robert Chelle was present and addressed the Board. moved, seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts alleged in the investigative report and material presented at this Board meeting, at no cost to the Board, issue an Interim Order for a substance abuse evaluation to be completed by a Board approved psychologist, who is at a minimum Ph.D. prepared, and to include any additional testing deemed necessary by the evaluator, to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Notice of Charges and include the factual allegations and alleged violations for failure to comply with the Interim Order. VI.A.13 Michael Rawlins RN Exam (Monas) Attorney Robert Chelle was present and addressed the Board. Rawlins was present and available for questions. moved, seconded, and it was unanimously carried to grant licensure upon meeting all requirements, and issue a Letter of Concern for Applicant s April 7, 1999, conviction in the City Court of Syracuse (NY), docket number , Driving Under the Influence of Alcohol, a misdemeanor, with a blood alcohol concentration of.13%, committed on January 10, 1999; his July 11, 2001, conviction the City Court of Sullivan (NY), docket number , of Driving While Impaired, committed on August 19, 1999; his December 2000, citation with drug possession resulting from his possession of ecstasy pills in his pockets, for which the charges were dismissed after completion of Drug Court; his June 9, 2000, citation for possession of drug paraphernalia, for which the charges were dismissed after completion of Drug Court. VI.Q.1. Michelle Elizabeth North RN093050; AP4304 (V Smith) Val Smith confirmed receipt of additional information. Attorney Jay Volquardsen was present and addressed the Board. Rebecca Lyn Green RN095478; AP2242 (V Smith) Attorney Kelly McDonald and Green were present and addressed the Board. moved, seconded, and it was unanimously carried, based upon the Findings of Fact and statute/rule violations identified in the investigative report, offer a Consent Agreement for a minimum of 36-month probation to include the attached stipulations, amended to include; practice administrator. Attorney Kelly McDonald was present and addressed the Board. moved, seconded, and it was unanimously carried to issue an Interim Order for a substance abuse evaluation to be completed by a Board approved evaluator who is at minimum PhD prepared, and to include any additional testing deemed necessary by the evaluator, to be scheduled within 30 days and completed within 60 days and then return to the Board. Kelly McDonald was present and addressed the Board. moved, seconded, and it was unanimously carried to issue a Letter of Concern for inaccurately disclosing on the Board's Investigative Questionnaire dated 03/01/2013, by answering "No" to whether you were terminated f rom Maravilla Care Center in Phoenix, AZ when you were terminated from the facility n 07/19/2010; inaccurately disclosing on an employment application to Hacienda Healthcare dated 01/19/2012 by answering that your reason for leaving Maravilla Care enter was to volunteer in Africa; and for self-administering an Ambien on or around 1/23/2013 and then driving a vehicle and resulting in an arrest in Scottsdale, Arizona; admitting that you either took an expired Ambien from an old prescription that belonged to you or you took one of your mother's Ambien. VI.P.4. Antranette Williamson LP (Chambers) (AKA: Isom) Kelly McDonald was present and addressed the Board. Williamson was present and available for Questions. moved, seconded, and it was unanimously carried to issue a Letter of Concern for providing inaccurate, misleading or false information in a written statement to the Board and on numerous employment applications, while seeking employment from or about 2011 and 2012 and for failure to notify the Board of her change of address within 30 days. VI.D.15. Iris Day Mears RN (Greabell) Greabell confirmed receipt of additional information. Attorney Kelly McDonald was present and addressed the Board. Mears was present and available for questions. moved, seconded, and it was unanimously carried to dismiss the complaint. Motion failed with five in favor and five opposed. After discussion, moved, seconded and it was unanimously carried to issue a Letter of Concern for disclosing to your then husband on or around November 2011 that you provided nursing to a high ranking employee while employed as a RN at Banner Good Samaritan Medical Center in Phoenix, AZ The motion carried with six in favor and four opposed. VI.D.2. Morgan K Cambern RN (Greabell) Attorney Michael Kielsky was present and addressed the Board. Cambern was present and available for questions. moved, seconded, and it was unanimously carried, on a determination of reasonable cause based on the facts in the investigative report and material presented at this Board 5

6 meeting, at NO cost to the Board, issue an Interim Order for a psychological evaluation with an emphasis on anger management to be completed by a Board approved evaluator to be completed within 45 days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Notice of Charges and include the factual allegations for failure to comply with the Interim Order. VI.D.3. Patricia Isabel Descalzi RN (Greabell) Greabell addressed the Board and confirmed receipt of additional information. Attorney Melanie Balastra was present telephonically and addressed the Board. Descalzi was present and addressed the Board. moved, seconded, and it was unanimously carried to issue a Letter of Concern for failing to document a verbal order in a patient s medical record which reschedules the patient s Insulin Glargine Pen 20 units from a morning administration time to an evening administration violation of the standard of care which requires that licensed nurses will maintain accurate patient medical records and on or around May 28, 2013 while Respondent was employed as a RN at Mountain Vista Medical Center in Mesa, AZ, Respondent failed to follow the facility s Heparin Protocol by sending a patient s blood for Prothrombin Time testing ( PT ) instead of for Partial Thromboplastin Time ( PTT ) during the 12-hour day shift that Respondent was working. VI.D.7. Jennifer Anne Lopshire RN (Greabell) (AKA: Miller, Kline) Greabell addressed the Board with additional information. Attorney Lisa Gervase was present telephonically, and addressed the Board. moved, seconded, and it was unanimously carried to go into Executive Session pursuant to A.R.S (A)(2) and (3), on Agenda Item VI.D.7. for the purpose of obtaining legal advice. Executive session convened at 10:00 am and adjourned at 10:10 am. moved, seconded, to lift the suspension ordered in the September 19, 2012 Consent Agreement Order No and on a determination of reasonable cause based on the facts alleged in the investigative report and material presented at this Board meeting, at no cost to the Board, issue an Interim Order for a psychological evaluation with an emphasis on boundaries, to be completed by a Board approved evaluator who is at minimum Ph.D. prepared, and to include any additional testing deemed necessary by the evaluator, to be completed within 20 business days and then return to the Board. If the Interim Order is not completed, based upon the findings of fact and statute/rule violations identified in the investigative report, issue Complaint/Notice of Hearing and include the factual allegations and alleged violations for failure to comply with the Interim Order. After discussion amended the motion to include: If Respondent has difficulty in scheduling and completing the Interim Order, and that difficulty is communicated to Board staff, Board staff may extend Respondent s time to comply with the Interim Order up to an additional 10 business days. concurred. Attorney Amanda Damianakos was present and addressed the Board. moved, seconded, based on the finding of fact and statute/rule violations identified in the investigative report, offer a Consent Agreement for a (12) month stayed suspension to be followed by a minimum (24) month probation, to include the attached stipulations, amended to delete AA/NA 3x per week option. If not signed within (30) days, issue Notice of Charges. After discussion, amended the motion to remove fact #1, rule #2, and statute #18 (h). concurred. The motion carried with eight in favor and one abstained. Deborah J Hanks RN051690; AP1421 (Dahn) Hanks was present and addressed the Board. moved, Johnosn seconded, and it was unanimously carried, based upon the findings of fact and statute/rule violations identified in the investigative report to issue a Letter of Concern for on or about February 17, 2011 and February 25, 2011, Respondent, who is a Family Nurse Practitioner (FNP), practiced outside the scope of a FNP when she diagnosed patient RB with Adult Attention Deficit (ADD) and provided him with a prescription for Adderall, a schedule 2 stimulant. Additionally, Respondent failed to obtain previous medical records supporting the patient claims of being diagnosed with ADD. 7

Virginia Sue Breslo RN156254; (Richter) (AKA: Leonard) CNA S moved, seconded, and it was unanimously carried to issue a Letter of Concern for your October 15, 2012 conviction in the Scottsdale City Court for Driving Under the Influence-Impaired to Slightest Degree, a misdemeanor. VI.B.9. Scott Richard Parone LPN Exam (Richter) Parone was present and addressed the Board. moved, seconded, and it was unanimously carried, upon meeting all licensure requirements, grant license, and issue a Letter of Concern for Applicant s misdemeanor arrests and/or citations for domestic violence and alcohol related incidents on October 19, 2006, April 3, 2007, and July 15, VI.B.12.
