SPHEROS NORTH AMERICA, INC. LIMITED NON-TRANSFERABLE MANUFACTURER S WARRANTY SPHEROS NORTH AMERICA, INC (hereinafter referred to as Spheros) warrants their products against defects in material and factory workmanship as stated below from original date in service on the original vehicle. A/C S (Spheros supplied A/C unit with and without compressor) Shuttle /Transit Bus/ Coach - twenty four (24) months School Bus twenty four (24) month warranty. Thirty six (36) months or 75, 000 miles whichever comes first for Spheros approved application. If date in service is not registered, the warranty period shall not exceed twenty seven (27) months for shuttle, transit bus and coach, and thirty nine (39) months for school bus from the original date of sale by Spheros. This warranty period may be superseded by a contractual agreement. Compressors purchased separately through Spheros shall have a limited warranty of 12 months based on the compressor manufacturer limited warranty. Extended warranty of one (1) to two (2) years on any A/C unit is offered as a separate package. Replacement parts are covered for six (6) months or the remainder of the original warranty period, whichever is longer. Replacement of a Spheros Unit Assembly (complete condenser unit or evaporator unit or rooftop unit) is considered a Replacement Part. The intent of the Spheros warranty is to protect the original end-user of Spheros products from such defects and provide free repair and replacement of defective parts, after inspection, in the manner provided herein. During the warranty period the exclusive remedy will be for Spheros, at their discretion, to repair or replace those parts which are demonstrated to be defective in material or workmanship. Owner s Responsibilities: A/C system should be serviced at the beginning of each season. While such maintenance may be performed by a Spheros accredited service center, improper or incorrectly performed maintenance or repair voids this warranty. Warranty Limitations: This warranty shall not apply to: Normal wear of service parts: (filters, belts, filter dryer, lubricants, fuses) Owner s failure to provide regular maintenance such as tightening belts, fittings and mounting hardware, cleaning coils, replacement of filter dryer in accordance with standard refrigeration principles, improper voltage or loose electrical connectors, maintaining refrigerant and oil levels, and lubrication of auxiliary engine. Damage to product during transit. All claims must be filed with the carrier. Improper installation, repairs or modifications, which are not in accordance with manufacturer s instructions or approved OEM applications. Deterioration due to normal wear, corrosion, improper storage or operating conditions. Use of non-genuine parts or repair by unauthorized personnel or service center. Operation in any manner contrary to the Spheros operation and maintenance procedures. Defects caused by any repair facility during system repair or maintenance include system contamination, loose wiring or fittings, torn or crimped O-rings, etc. Any part or parts of products becoming defective as a result of negligence, accident or other casualty. Loss of refrigerant as a result of negligence or defects directly or indirectly caused by parts not covered under this warranty. Damage / loss of function to the unit or accessories due to contaminated refrigerant or incorrectly charged unit. Economic loss for expenses related to travel lodging, loss of revenues, vehicle disability including towing, cost of a replacement vehicle, personal injury or other incidental or consequential damages arising from any breach of this expressed warranty. Alteration/ removal of product label, serial no. or product name plate. Any provisions stated in the warranty manual. - Limitations stated in the compressor manufacturer limited warranty. This condition only applies if compressor is purchased separately. ANY APPLICABLE IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE HEREBY LIMITED IN DURATION TO THE WARRANTY PERIODS DESCRIBED ABOVE. IN NO EVENT SHALL SPHEROS BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES RESULTING FROM THE BREACH OF ANY IMPLIED OR EXPRESS WARRANTIES. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR EXCLUSION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. WARRANTY MANUAL Purpose of this Warranty Manual The purpose of this manual is to provide the customer with specific how to proceed instructions for product defects within the products limited warranty period. This manual provides the policies and procedures to follow for a product warranty claim and reimbursement. Items COVERED under this warranty Spheros covers the following items and procedures: Testing & Diagnosis as described in the flat rate labor time guide on Appendices A - C. Parts and accessories supplied by Spheros such as; Compressor, Electrical Harness, Thermostats, Relays and Relay Boards, Control Switches Coils, Tubes, TX-Valves, Blower, Fans, Sensors, Pressure Switches, Check Valves, Solenoid Valves, Electrical Harness, Relay Board, Housing, and Control Unit. Complete system purchased through SPHEROS NORTH AMERICA, INC Items NOT COVERED under this warranty Normal wear of service parts such as; filters, belts, filter dryer, and lubricants. Repair or replacement of any parts of the product or unit beyond the original warranty period. Damage to product in transit. All claims must be filed with carrier. Deterioration due to normal wear, corrosion, abuse, damage, accident, improper storage or operation. Modification of product by alteration, use of non-genuine parts or repaired by unauthorized personnel. Damage to electrical parts caused by incorrect voltage, reversed polarity or alteration. Owner s failure to provide regular maintenance such as tightening belts, fittings an mounting hardware, cleaning coils; replacement of filter dryer in accordance with standard refrigeration principles, improper voltage or loose electrical connectors, and maintaining refrigerant and oil levels. Improper installation, repairs or modifications, which are not in accordance with manufacturer s instructions or approved OEM applications. Operation in any manner contrary to the Spheros operation and maintenance procedures. Damage / loss of function to the unit or accessories due to contaminated refrigerant or incorrectly charged unit. Defects caused by any repair facility during system repair or maintenance include system contamination, loose wiring or fittings, torn or crimped O-rings, etc. Limitations defined in Spheros limited non-transferable manufacturer s warranty. Spheros does not warrant the workmanship of the installer and will not bear any cost due faulty or incorrect installation or shipping damage. Owner Responsibilities The intent of the Spheros warranty is to protect the original product owner from product defects and provide free repair and replacement of defective parts in the manner provided herein. During the warranty period the exclusive remedy will be provided by Spheros, at their discretion, to repair or replace those parts which are demonstrated to be defective in material or workmanship. The owner of the unit shall follow the following: 1. The unit or product that needs repair or adjustment shall be taken to a Spheros authorized service center or original installer. In such cases where the service center is too far away, the customer may find a qualified service center. Customer shall contact Spheros before doing any repair to the A/C system. Spheros will attempt to allow the service center to address the concern. A product serial number is required for all warranty claims for Unit Assembly and accessories. 2. Service A/C unit at the start of each season. While such maintenance shall be performed by a Spheros accredited or authorized service center, improper or incorrectly performed maintenance or repair shall not be the responsibility of Spheros and shall not be liable for any additional cost other than cost of initial repair. Warranty Registration Warranty is effective from original date in service on original vehicle and other provisions stated in Spheros limited nontransferable manufacturer s warranty. Owners are required to fill up the warranty registration card sent along with the unit and send to: Attention: Warranty Department SPHEROS NORTH AMERICA, INC 5536 Research Drive Canton, MI 48188 USA A downloadable version is available in the company website: www.spheros.us. (On-line registration option will be available by end of 2015) Performing Warranty Work While such maintenance may be performed by an accredited or any company authorized by Spheros, improper or incorrectly performed maintenance or repair shall not be the responsibility of Spheros and its affiliates. The facility must have an accreditation/license from government/accreditation agencies, and provide their technicians with all the necessary tools and training required to properly diagnose and repair mobile A/C units. Also, the technician performing the work shall be duly certified by an EPA-approved organization to perform repair work on mobile A/C units. Spheros shall credit accredited dealers and service centers for labor for replacement Technical publications such as technical manuals, parts manuals, and service bulletins are available via the company web site (http://www.spheros.us). Informational newsletters and important product update notifications are periodically sent to our network of Spheros customers to provide them with the latest information and changes required for quality servicing of Spheros products. For questions and further assistance, dial 1-734-218-7350 ext. 113, 111 or 107 or toll free at 1-888-960-4849 Once the product and installation has been examined, the cause of malfunction determined and the defective part replaced, a post-repair operational test must be performed to ensure proper functionality. Any part replaced under warranty must be returned to Spheros. A test maybe conducted to confirm that part or unit is defective and for purposes of ongoing product improvement. Return Material Authorization (RMA) A Return Material Authorization (RMA) is required prior to returning any product. Spheros will provide the customer with an RMA number and shipping instructions. Warranty claims without an RMA no. will not be processed. A re-stocking fee of 20% shall be applied on any returned new part/product with a valid reason. The part or product should bear the original packaging. Acceptance will depend on the condition of the part/product as received. The RMA number must be prominently displayed on the shipping container and referenced on all correspondence pertaining to the returned product. The original invoice number or, for a return of parts under a warranty claim, the serial number from the product for which the warranty claim pertains to. 2. The reason for return. IMPORTANT NOTICE: When any product is returned without an RMA, a 75.00 USD administration fee charge shall be charged to the customer account. Claim Reimbursement Labor Times - Recovery is based on the applicable labor time guide defined in appendices A-C. Labor Rate - Recovery is based on the standard customer rate, which is a published / verifiable rate. Parts - Recovery is based on component cost plus markup for shipping and handling. Flat Rate Labor Guide Maximum allowable labor is a combination of testing and diagnosis, and one of the following operations: 1. Exterior Component Repair. 2. Easily Accessible Component Repair. 3. Complete Dismantling Repair and Re-assemble Refer to Appendices A-C for the Flat Rate Labor details. Repair Procedure and Performance 1. A check of connectors, fuse, wiring, belt drive, battery integrity and amount of refrigerant shall be performed prior to conducting any diagnostic test procedure. 2. Using the appropriate service and repair manual, the technician should proceed to test and diagnose to isolate defective components on the A/C system in question. 3. Proceed with component removal and installation. 4. Perform post-repair operational testing. Replacement and removal of equipment, as a means of repair, is not covered. Submitting a Warranty Claim NOTE: While warranty is provided to the original end-user, it is to be administered and serviced in accordance with the Spheros warranty policy or contractual agreement between Spheros and a second party. A Warranty Claim form is available by request by calling 1-734-218-7350 ext. 113, 111 or 107, or can be downloaded at the Spheros website at www.spheros.us. Incomplete claims shall not be processed. Approved claims will be reimbursed by a Credit Memo to the associated customer account. Spheros will process approved claims within one (1) month upon receipt. Defective parts must be identified with the Spheros issued RMA number and returned to Spheros before a warranty claim can be approved for reimbursement. IMPORTANT NOTICE: Spheros must receive the warranty claim within 30 days of the service repair. Claims submitted more than 30 days will be refused. Refused Claims In the event that a claim is refused, the customer will be informed outlining the reason for adjustment or refusal.
