LIMITED SOURCES JUSTIFICATION AND APPROVAL 1. Nature and/or description of the action being approved: Limited Sources Justification for renewal of PRISM software license and maintenance updates to the PRISM software. a. Acquisition purpose and objectives: The purpose of this acquisition is to establish a GSA Federal Supply Schedule (FSS) Blanket Purchase Agreement (BPA) for renewal of PRISM software licenses for NRC s instance of PRISM. PRISM is the commercial off-the-shelf (COTS) software solution that is being implemented for the NRC as part of NRC s Strategic Acquisition System (STAQS). STAQS is the toolset that, combined with business process improvements and acquisition policy streamlining, will facilitate execution of the Strategic Acquisition Program. b. Project background: The initial acquisition of PRISM software licenses for the first year (June 1, 2012 to May 31, 2013) of the STAQS implementation was performed on behalf of NRC by the U.S. Department of Transportation Enterprise Services Center (DOT/ESC) as part of Interagency Agreement number NRC-HQ-12- I-10-0008. NRC now requires renewal of the maintenance for those PRISM licenses, and NRC intends to do that through this GSA FSS BPA mechanism. 2. Description of the supplies or services required to meet the agency s needs (including the estimated value): NRC requires renewal of all PRISM software licenses is that DOT/ESC procured on NRC s behalf. This BPA will allow NRC to renew the PRISM software licenses and maintenance on an annual basis. WEB-09 CAC/PIV Card Module WEBM-09 CAC/PIV Card Module Maintenance C-02 FedConnect Portal Transactions (up to 2,000 transactions per month) The total estimated value of these license renewals is $7 million, over a period of 5 years. The ceiling amount of the resultant GSA FSS BPA will be $7 million to allow a reasonable amount of additional ceiling for uncertainty relating to the estimate. 3. Identification of the justification rationale [see FAR 8.405-6(a) and (b)] and, if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service: a. Acquisition authority. This acquisition is conducted under the authority of the Multiple Award Schedule Program. Consideration of schedule contractors will be restricted only to items peculiar to one manufacturer as provided in Federal Acquisition Regulation (FAR) 8.405-6(b). b. Demonstration of the proposed contractor(s) unique qualifications to provide the required supply or service: 1) Name and address of the proposed contractor(s): Compusearch Software Systems, Inc 21251 Ridgetop Circle, Suite 100 Dulles, Virginia 20166 2) Nature of the acquisition and proposed contractor(s) unique qualifications: Compusearch is the manufacturer of PRISM software and owns the intellectual property rights for PRISM software. NRC requires annual renewal of its PRISM software licenses, and Compusearch Software Systems, Inc. does not allow any other GSA FSS sources to sell PRISM software licenses or software maintenance. STAQS is implemented by configuring the listed PRISM software modules to specifically support the NRC s acquisition business process requirements and to establish an automated integration of STAQS with the NRC s financial management system (FAIMIS). No other COTS software product can be substituted to perform the same functions in the same timeframe and at the same cost as PRISM. Therefore, this GSA FSS BPA and related orders can only be awarded to Compusearch Software Systems, Inc.
4. Determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d): GSA has already determined the prices of the supplies and services under FSS contracts, including rates of services offered at fixed hourly rates, to be fair and reasonable. By placing an order against a schedule contract using the procedures in FAR 8.405, the ordering activity CO has concluded that the order represents the best value (see FAR 2.101) and results in the lowest overall cost alternative. However, NRC intends to request that Compusearch Software Systems, Inc. commit to a reasonable discount of its GSA FSS prices for all orders under this GSA FSS BPA in light of the $9 million maximum value of the resultant GSA FSS BPA. 5. Description of the market research conducted among schedule holders and the results, or a statement of the reasons market research was not conducted: Market research on GSA s website revealed that Compusearch Software Systems, Inc. is the only GSA FSS provider of PRISM software licenses and software maintenance. 6. Any other facts supporting the justification. None. 7. Statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made. NRC Division of Contracts will conduct market research each year before renewing the PRISM software licenses and maintenance to determine if the renewals can be competed among two or more GSA FSS contractors at that time and, if they can be competed, NRC will consider using a competitive procedure unless the pricing discounts from the GSA FSS BPA would result in a better GSA FSS price.
